Complaint: I am in the process of selling my home and purchasing a new home. My current home is financed through OCWEN and the sale is scheduled to close on XXXX XXXX. I missed the XXXX 2016 payment and paid it, along with the XX/XX/XXXX payment and the late fee, on XXXX XXXX. OCWEN reported this as a late payment in XX/XX/XXXX, with the account being 30 days delinquent. The lender for my new loan denied my mortgage because of the late payment reporting by OCWEN. Because this was the only time in my near nine-year history of this mortgage that the account was in delinquency status, I requested that XXXX waive the late reporting and was informed that this is impossible because it was not legal to do so. My attorney then contacted OCWEN and requested that they provide a goodwill adjustment, which is a legal withdrawal of a late reporting. They again refused to do so. Their refusal to help a customer who has only had one late payment in almost 9 years caused me to be denied by the lender for my new home purchase. Due to the terms of the sale of my first home, I must vacate that property by XXXX XXXX. I attempted to see if OCWEN would approve me for a new home loan since I can not get approved for a loan elsewhere, and I was referred to their new loan division, Homeward. Homeward informed me that they are currently not writing loans for new home purchases. This leaves me with no home, as I can not purchase a new one, so my boyfriend, XXXX children, and I have nowhere to go. I recognize that I am the one who failed to pay the XX/XX/XXXX mortgage payment, but as I have now paid it and paid the late fee, I feel that I have done my part to make it right. Additionally, the entire mortgage will be paid off in full in six days. I feel that one late payment is not cause for a punishment of a poor credit reporting that results in my denial of a home loan and not being able to buy a new home.

Complaint: Re : Disputing Value : Loan Modification for Loan Number : XXXX I was approved for a loan modification in XXXX 2016. After careful review of the documents I noticed the value of the home that Ocwen was using was not the true value of the home. I disputed the value and I received a revised value that did not make a difference in the loan modification payment. I resubmitted the appraisal that shows the details of what work needs to be completed however Ocwen is refusing to take into consideration the appraisal which shows a $ XXXX difference. Below is a letter I recently sent and I have attached the original letter that shows the appraisal. The goal is to get a loan modification that reflects the try value of the home while offering a monthly affordable payment.
On XXXX XXXX I provided Ocwen a appraisal that shows the current value of my home at $ XXXX. This appraisal included XXXX comparable homes that have no damage at : {$770.00}, {$770.00} and $ XXXX. Per our conversation today I was advised that the value Ocwen is offering is only {$720.00}. This appraisal I submitted provided detailed notes on the cost of repairs to bring the value up to fair market value. I am still disputing the value of the home Ocwen is offering based on the appraisal I submitted of $ XXXX.
I would like the evaluation team to review the appraisal again and consider the amount of work that would get this property value up to where Ocwen states it should be. Again my appraisal is $ XXXX and I would like to have a loan modification based on that evaluation. This would allow my family to stay in our home with an affordable monthly payment.
My last modification was approved by a Chapter XXXX judge and we used an appraisal similar to the one I provided and the judge approved. I am just trying to get a better deal on the loan modification and/or through a Principal Reduction based on the appraisal.
We would like to have a new proposed solution that reflects the new appraisal of $ XXXX. The previous loan modification which shows that Ocwen was giving us a IN-HOUSE loan modification with a true Principal Reduction. Please see previous correspondence.

Complaint: My husband was a XXXX as a result of XXXX. I had a lot of bills to pay after he passed and failed to cash XXXX checks and found them last year as I was cleaning up my home. I contacted OCWEN and was told by OCWEN to submit the checks to be reissued which I did on XXXX XXXX, XXXX ( attached ). Over a year went by and I got no response. I contacted them again earlier this year and finally received a response from them dated XXXX XXXX, XXXX ( attached ). In my view their response is purposely very confusing and they claim my ( by then ) dead husband had confirmed receipt in XX/XX/XXXX and as such they are refusing to reissue my checks and refusing to send me the money which is rightfully mine. We are talking over {$12000.00}. I just sent them another letter today asking them to reissue the checks and pointing out my husband was dead when they claim he confirmed receipt. Regardless of whether the checks had been received none were ever cashed and they have my money to this day.

Complaint: I started off with XXXX XXXX, then they sold my loan to Indymac, then they sold my loan to Ocwen, and ever since ocwen took over every year I have to pay them more money as they are always short on my escrow. So I pay the shortage, this year I received a check for escrow overage and then no more of me cashing the check I get a nitice that they are short on escrow again and I have to pay it back, also I have been out on work comp. for almost the last 5 yrs. so the last 2 years I have applied for a loan modification and been turned down, I am at a 7.125 % interest rate so they just keep telling me to put my house up for quick sale. So what can I do??

Complaint: My mother and I were co-borrowers on a home loan that was opened XXXX XXXX through Litton Loan. The loan was later taken over by Ocwen Loan Servicing in XXXX XXXX. During the time that the loan was with Litton we had several issue of payments not being posted correctly or being put in a suspense account. The payments included principal, interest, and property taxes. My mother was contacted by a local business man in XXXX who essentially told her that he owned her house now and that she should start paying him or he would put her out. We found out that Litton had not been paying her property taxes and that he had purchased the home in a tax sale. He wrote a letter to Litton Loan explaining such and drew up a contract with my mother. Litton then sold the loan to Ocwen. My mother file CH XXXX bankruptcy and pursuit of the debt seem to stop. I found out that it was reporting on my credit file and disputed it based on the history and mishandling of the account all along. They started reporting the account as " association terminated '' in XXXX of XXXX and deleted all account history. As of XXXX XXXX I get an update that state that I am XXXX delinquent on the account owing over {$15000.00}. I just gained access to the website and have found that there is no up to date information, statements, nothing. How can I be 180 days late on an account that has no history. The credit reporting alone is a violation. The loan should have never been sold to anyone when the original servicer was mishandling payments and not paying property taxes resulting in a loss of ownership and equity. My mother is now making payments to a person she never borrowed money from.

Complaint: This is my 4th complaint about OCWEN mortgage. I figure on the 3rd compliant with your company this would finally resolved the issues. They have decided to raise my escrow account again when my property taxes is less than XXXX a year but want to charge me XXXX a month in escrow for taxes. They was over charging me for years and sent me a refund check for over XXXX in XXXX for their mistakes and now they are starting it over again. My mortgage per the paperwork they sent me was to be XXXX a month but I been paying XXXX. Well last month they raise my mortgage to XXXX which is incorrect and I paid my regular amount of XXXX and now they are showing me late.
I am at my wits end with this company. I barely understand the representative when I called in due to they are based in another country. They do n't want to assist you just want to make you pay the wrong amount. My bankruptcy is about to be over this month and I feel again they are trying to make me lose my house. I do n't know what to do anymore with this company. Please help!!!

Complaint: Ocwen Loan Servicing refuses to acknowledge Litton is now a " subsidiary '' of Ocwen, arguing it has no responsibility for Litton mis-reporting to credit reporting agencies ( CRAs ) because Litton is not an " affiliate '' of Ocwen ( see XXXX XXXX, XXXX letter ). Ocwen/Litton refuses to identify the alleged 12-month arrearage at the time Ocwen assumed servicing rights in XXXX XXXX. Ocwen and Equifax refuse to provide the electronic exchanges relative to " investigation '' disputes. Ocwen admits to mis-reporting information to CRAs including, but not limited to illegal multiple charge-offs. Despite the admission, Ocwen refuses to grant relief for both the Litton mis-reporting and the Ocwen mis-reporting after XXXX XXXX at which time it assumed servicing rights. Ocwen continues to refuse to provide monthly statements, in direct violation of the Fair Credit Reporting Act. Due to admitted systems deficiency, Ocwen under-reported the amount of tax year XX/XX/XXXX interest by several thousand dollars. Despite widely known systems inadequacies, Ocwen refuses to verify or validate/verify payment information transferred in XXXX XXXX. Its position is that the onus is on borrowers to do so ; an unfair and undo burden. Not to mention the fact it refuses to provide the internal documents ostensibly authorizing debit from my checking account. I challenged its arbitrary use of checking debit deductions on numerous occasions.

Complaint: My husband and I applied for a HELOC in 2006 from GMAC/XXXX. XXXX XXXX was the officer we worked with during the application process. His contact information is GMAC XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, CA XXXX, XXXX XXXX XXXX and XXXX XXXX XXXX. From the documentation I kept in my files, this is what I have pieced together. My husband and I were quoted a fixed rate of 8.25 % XXXX mo term. We received the loan documents to review on XXXX/XXXX/06. Everything looked good per the TIL and Good Faith. We then received a second copy which I kept. Then we received a third copy which turns out, was not the same set of documents. It is dated one day later on XXXX/XXXX/06 and did not include any specifics about the loan, no TIL and no Good Faith were included. I also have a copy of the closing instructions dated XXXX/XXXX/06. with no TIL or GF listed in the document section of the closing instructions. My loan was since sold to OCWEN. I recently received a letter from the current HELOC financer stating that I will be making the final loan payments at full principal as per the terms of my interest only loan. The problem is that my husband and I never applied for an interest only HeLOC. We feel that we closed on a different loan than what was initially disclosed to us and defrauded of 10 years of principal payments.

Complaint: my first loan was Indy/mac XXXX. Then it went to XXXX XXXX which was a loan modification company. Then it was transferred to XXXX another loan modification company. I was paying XXXX dollars a month. In XXXX XXXX I had XXXX XXXX XXXX and had to stop work for nine months but I was making my XXXX dollar payments to nationwide. In XX/XX/XXXX IndyMac /XXXX sent a letter stating I was to pay XXXX in three payments for taxes on the property which I paid and then gave them another XXXX check toward the past-due loan which came my father 's estate upon his death. Then in XXXX I had XXXX from XXXX and was out of work. I then retired XX/XX/XXXX. I was still paying the loan modification company. During this time my wife left and now I 'm divorced. I am also dealing with the VA over the XXXX XXXX that prompted the XXXX XXXX. Next thing I knew I was dealing with OCWEN which is the bank that IndyMac/XXXX transferred my original loan to OCWEN had sent me loan modification papers that required filled out over and over again .One major thing they messed up on was the property address which was different from mailing address. There are XXXX XXXX XXXX XXXX. XXXX is XXXX XXXX and XXXX XXXX which was in the low income area. They continually used the XXXX XXXX as the property address. They had pictures of the wrong house. This went on for months. It seemed like they were stalling toward resolution. When they finally came to a resolution, they wanted me to pay {$280000.00} the loan # XXXX. The amount left on loan before all this started was {$180000.00}. I have been trying to settle this and it has dragged out 24 months. Complaint: My problem is with Ocwen Loan servicing ...
We are attempting to pay off our loan. The loan will come to maturity on XXXX/XXXX/XXXX. We received a BALLOON LETTER in XX/XX/XXXX from Ocwen stating our loan will mature XX/XX/XXXX and Ocwen would not accept payments after that time. I requested a payoff quote, the quote came back stating we owed {$44000.00}. The information we continue to receive verbally and in written form is incorrect. Ocwen is claiming after paying 30 years on a 9.5 % FIXED rate FHA loan, original principle balance {$60000.00}, after 30 yrs we still owe $ XXXX. Details : We purchased our home in XXXX XXXX from XXXX XXXX co loan amount {$60000.00} thru XXXX XXXX. This was a 30 yr FHA loan 9.5 % fixed rate. After about 7yrs with XXXX XXXX ( {$500.00} monthly mortgage payment ), husband lost his job we got behind, HUD stepped in. For 4yrs we made payments to U.S Department of HUD Loan MGMT ( {$630.00} a month x 4yrs ). On XXXX/XXXX/XXXX the loan was bought or given to Ocwen. Ocwen took over the loan XXXX/XXXX/XXXX. They showed my beginning balance as {$60000.00} which was incorrect. We had been making payment between XXXX XXXX and HUD for 10 yrs. There were no record of those payments. Ten years of paid principal and interest unaccounted for. It seems Ocwen is only giving us credit for the 20 yrs they held the loan instead of the 30 years we have paid. Owen figures are not taking into consideration 10 yrs of prior payments. On XXXX/XXXX/XXXX Ocwen sent us an amortization report showing a breakdown of principle and interest and the projected application of both. Ocwen is not in line with their own report. On XXXX/XXXX/XXXX Ocwen sent a report with a breakdown of payment received and how applied. This report only reflected payments since they took the loan XXXX/XXXX/XXXX. If their beginning balance was incorrect, payment applied toward the principle and interest since Ocwen obtained the loan is incorrect. I was told 4 or 5 ys ago by Ocwen that we were current with our mortgage payment and we no longer needed to be on the forbearance plan. Our payment was reduced from {$730.00} month, to {$700.00} a month. I inquired if the new adjusted payment would be enough to pay off the loan at maturity I was told it would w/the exception an arrearage balance of aprox {$9000.00}. A couple of years ago, I called Ocwen to check the balance still owed ( not receiving monthly statements for yrs ). I was told by Ocwen our aprox bal. due was $ XXXX. On several occasions I disputed that amount. And now about 1 1/2 months before the maturity date, we owe $ XXXX. On XXXX/XXXX/XXXX. I " SCHEDULED '' phone call with my relationship manages, we got nowhere. I had requested the research department to research and give an account of the 10 yrs of missing payment. I did not receive what I had requested. When speaking to the research department I was first told the amount turned over to them was $ XXXX. I reminded the person that I had the Deed of Trust in my hand, later said he made a mistake the balance received was XXXX. He also said per the records they received from HUD it showed we had not made a payment since XX/XX/XXXX. There is no way we could live in our home for 3 yrs and not have paid anything. Ocwen 's records are incomplete and incorrect. We are asking that you look into our dispute/complaint and have Ocwen acknowledge and include the addition 10 yrs of credit not accounted for and to make sure payments were correctly applied to Principle/escrow and interest correctly. I requested payment reconciliation from the origination of the loan in XX/XX/XXXX until now. I feel the majority our money went toward interest ( that we did not owe ) and not disbursed according to the amortization guide they provide in XX/XX/XXXX. We need a correct pay off quote.. Complaint: OVERVIEW : Ocwen Loan Servicing LLC failed to fully refund an over-payment on my home. The refund check was short by {$460.00}.
FACTS : 1. Ocwen had serviced my home mortgage until I closed on the sale of my home on XXXX XXXX, 2016.
2. An extra auto-payment of {$2600.00} was made on XXXX XXXX, 2016. The payoff amount declared by Ocwen was fully paid at closing on XXXX XXXX, 2016, so the auto-payment of {$2600.00} was an over-payment.
3. I called Ocwen 's Customer Care number ( XXXX ) on XXXX XXXX, 2016 to inquire about a refund of the over-payment. I was told that a full refund check was mailed on XXXX XXXX, 2016.
4. The refund check arrived on XXXX XXXX, 2016. The postmark shows it was mailed XXXX XXXX, not XXXX XXXX. The postmark is coincidentally the date of my inquiry. Furthermore, the check was backdated to XXXX XXXX, 2016. Finally, the check was only {$2200.00}, not {$2600.00}. Consequently, it was short by {$460.00}.
5. I called Customer Care again on XXXX XXXX, 2016. I was told by Customer Care representative " XXXX '' that my complaint would be submitted to the " Refund Department '' and I would need to wait for up to ten business days to get a response.
CONCLUSIONS : 1. Ocwen failed to promptly refund the over-payment.
2. On XXXX XXXX, 2016, Ocwen made a fraudulent material misrepresentation that they had already mailed the full refund check on XXXX XXXX.
3. On XXXX XXXX, 2016, Ocwen made a fraudulent material misrepresentation that the check was a full refund of the over-payment of {$2600.00} that I had submitted via auto-payment on XXXX XXXX, 2016.
