Complaint: This is not a complaint per-se. This new case is submitted merely out of our need to have this matter mediated / witnessed by a third party ; based on previous interactions with Ocwen. We see that the latest notification letter received, dated XXXX XXXX, 2016, attached to the current agreement for the short sale, gives 14 days from its date of drafting for homeowners to apply for the HAMP in lieu of finalizing settlement on the buyer 's purchase. We foresee being able to assume the HAMP loan in the very near future, after we are placed in the jobs we now seek, with the provision of the payments not being substantially more than what they were quoted to be in the XXXX XXXX, 2016 offer. Though our MD HOPE Program attorney, XXXX XXXX XXXX of XXXX, XXXX and XXXX XXXX, has been absent from work for a few days because of some pressing concerns of his own ; he is still very much in charge of our dealings. However, we are launching the request to cancel our short sale through this venue and the other corresponding method in the interest of time. He will resume administrating our affairs shortly, and again ; all correspondence from Ocwen and its associates must pass to us THROUGH XXXX XXXX. If we have signed something which binds us to the settlement we will call on the fact that we are still within the 14 allotted days for changing our course. The ultimate objective of this arrangement ( which is under the auspices of the HAMP / HARP program ) is to help the homeowner keep home ownership if at all possible. Complaint: I 'm a widow and my husband was the major income contributor in our family. I tried to get help form Ocwen before I could no longer make the payment. I filled out the Hardship paper work and sent it in. I was contacted by a representative and he told me he would be my point of contact. He said I was missing some paper work so I got it together and sent it in. Three weeks later I hadnt heard form them so I called, Long story short I had been assigned to a different person and they had not recieved the paper work. This happend for the next couple of months until they said the information was too old I needed to start all over again. I was behind on my mortgage for a few months but I got it caught up in XXXX 2016. Now they are calling me everyday about when I am going to pay XXXX payment and it is not late until the XXXX of the month.

Complaint: Ocwen Loan Servicing LLC has been misapplying our payments in order to fraudulently misrepresent that we owe one back payment ( approximately ; the figure varies randomly ). All the proof previously submitted to Ocwen and in our previous CFPB complaint proves that we have never been late or in default on a payment since our loan modification went into effect years ago. After our initial complaint to the CFPB you said we would receive an explanation from their ombudsman. We NEVER have received any explanation. On the contrary, the " ombudsman '' just attached the same documentation back to us that proves we made all our payments, with no acknowledgment of our very clear demands, no explanation of the reason for their misattribution, and no apology or compensation offered for the damage done to my credit score, my time and my health. They subject me to the constant stress of falsely threatening me with foreclosure. You at the CFPB must follow up and make sure that I receive compensation and full vindication of my financial records. You should review the case and do your own investigation, as they have failed after numerous letters and phone calls trying to get them to stop the false double billing every month. I tried to make a phone payment to them and have them apply it correctly to the XXXX bill but they said they would be applying it to the XXXX bill even though they acknowledged that the XXXX amount was paid on XXXX XXXX. By the way on the phone menu I requested the " relationship manager '' on the account. The person who answered, one XXXX, was clearly not a manager at all, even less a relationship manager, because she simply read boilerplate to me and provided no attempt to answer these questions ; on the contrary she said she had to apply the payment to XXXX as that was what showed, and said we could address any complaints to the Research Department ( this designation on the phone menu was so blatantly false that this also rises to the level of fraud ). Since there have been no results whatsoever from our bringing this to the attention of Ocwen 's " Research Department '' where they repeatedly refer us ( and who never answer ), and to their corporate administration, please review this matter and reply to us within two weeks, as this has gone on far too long ( for years ), and it is clear it will continue forever unless you take action against them.

Complaint: OCWEN was my loan provider in XXXX and XXXX ( loan number XXXX ). In XXXX I purchased new hazard insurance for my house. When I sent OCWEN the documents for this XXXX insurance ( price {$1200.00} ), an OCWEN representative called me to tell me that the insurance had to cover 80 % of the remaining loan amount. Thus, I adjusted the insurance with XXXX to meet OCWEN 's demand ( price {$1400.00} ). My loan was sold to XXXX in XXXX and recently my monthly premium was raised by XXXX. Thus, I went back over my loan information to determine why my rate had increased. What I found out was that OCWEN had taken XXXX the {$1200.00} payment and the {$1400.00} payment from my escrow, which were claimed to be sent in the form of Insurance Disbursement checks to XXXX ( XXXX XXXX XXXX VIRGINIA or XXXX XXXX XXXX XXXX. Interestingly, however, XXXX never received the payment from OCWEN for the {$1200.00}. Therefore, OCWEN took {$1200.00} from my escrow that was not used for insurance and never returned to me or my escrow account. What concerns me is that I believe OCWEN representatives may be doing this to many loan customers, double charging for insurance from the borrowers escrow account and only paying the insurance company once. It would be easy for you to look at some OCWEN customer loans from XXXX and determine if there are a lot of double insurance charges in this year. If there were then I believe this may be a fraudulent activity that OCWEN is involved in.

Complaint: I was approved for a XXXX Trial Payment Plan in XXXX 2016 by Ocwen Loan Servicing , LLC . First payment was due on XXXX/XXXX/2016. I called my relationship manager, XXXX XXXX, last Thursday on XXXX/XXXX/2016 asking if my payment could be made by phone or electronically. I did not receive a return call from XXXX XXXX. When I call Ocwen 's customer service, I get the voicemail of XXXX XXXX. I looked at my account online and Ocwen does not show my payment has been received. XXXX XXXX is out of the office due to weather issues in the XXXX XXXX XXXX area. I have sent email communication today, XXXX/XXXX/2016, to XXXX XXXX to find out if my payment has been received. According to the documents received by Ocwen, " Trial Period '' payments must be received on or prior tot he XXXX day following the due date provided on each coupon. I would like to make sure my payment has been received. I mailed my payment on XXXX between XXXX XXXX and XXXX XXXX at the post office. I went to Ocwen 's website to provide the details of my payment earlier this week. Payment was mailed to the following address : Ocwen Loan Servicing , LLC, Box # XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, TX XXXX Check # is XXXX in the amount of {$3200.00}. I am not sure how often this mailbox is checked for payments and how long it takes to process these payments. I have been unable to reach anyone from Ocwen to discuss my concerns on the receipt of my payment. My prayer is that payments are processed in a timely manner so that we qualify for a permanent modification and that Ocwen does not delay the processing of our payment.

Complaint: US Bank acquired my mortgage from Concorde XXXX. I originally had a mortgage for {$96000.00} with Concorde but US Bank has added so many erroneous fees that now US Bank says I owe {$100000.00}. I have been assessed fees for force placed insurance, property inspection fees, legal fees, late fees, etc ... The mortgage servicing company is XXXX XXXX XXXX. I have been working with XXXX to come to a resolution about my mortgage. According to the FDCA, Foreclosure proceedings should have been haulted while XXXX and I were in negotiations. I am constantly being harassed with correspondence from XXXX XXXX, US Bank 's attorneys. I feel this company is abusing its power by just adding these fees to my loan and trying to foreclose on my home even though I am working out a resolution with XXXX. I have been denied employment and affordable housing because of US Bank. The loan was predatory from the beginning and has become completely un-manageable for me to bring the account current. I am asking that all collection and foreclosure activities stop.

Complaint: I am LIVID with Ocwen Loan Servicing. My father died XXXX leaving no Estate. My mother passed XXXX. Since there was a house and no will, I had to go through Probate which was completed about XX/XX/2015. I sent Ocwen the personal responsibility form notarized by the XXXX XXXX XXXX Probate Court naming me as the ONLY party to the Estate. I 've been trying to get Ocwen to change the mortgage to my name as deceased people can not own real property. They refuse. Any contact with them has to open with giving my ( deceased ) mother 's ssn. This is ridiculous and stirs up emotions I just do n't need. Now for the ultimate insult. I got a fat envelope from Ocwen last week ( their date XXXX ) stating I 'm in default ( 2 months when letter was created, now XXXX. It also threatens foreclosure! I know foreclosure proceedings can not begin until 4 months in arrears. I tried calling and got the typical XXXX accent which I can barely understand. After explaining everything, he said that he could n't help as he 's not my 'personal ' mortgage assistant. I could n't understand his name or employee number at the beginning of the call. It 's time Ocwen actually showed some customer service! My brother is helping with mortgage due to a financial crisis. I 'm sure we can make 1 or 2 payments before XXXX ( four months behind ).

Complaint: XXXX/XXXX/16 Received a call from XXXX XXXX stating that he was a representative of OCWEN Loan Servicing, and that we qualified for a fixed 2 % loan modification thru the HAMP program. He emailed me an Acceptance & Acknowledgement of Acceptance of XXXX Trial Agreement. On XXXX, my wife and I signed it and faxed it back to him at XXXX. He then said in order to lock in on the loan modification, we needed to send the first of XXXX payments {$610.00} by XXXX ( person to person to XXXX XXXX ). We did and he emailed me a receipt. He then called the next day ( XXXX/XXXX/16 ) to say in order to lock in on the 2 % for the life of the loan we had to send the other XXXX payments of {$610.00} each ( sent {$1200.00}. We did, XXXX person to person to XXXX XXXX. The next day he emailed another receipt. ( his email address : XXXXXXXXXXXX ). On Friday XXXX/XXXX/16, XXXX XXXX called and said everything was good, however : they could not guarantee the 2 % fixed rate for the life of the loan unless I send them an additional {$860.00} for processing fee. That 's when I became very suspicious.

Complaint: Ocwen Loan Servicing, LLC- took over GMAC Loan Servicing the prior servicer of my Mortgage. Ocwen sent a Loan Modification form to me to be completed as of XX/XX/2013. However, Ocwen does not live to the promise of the modified document. 1. Ocwen increased our principal or the balance owned from {$58000.00} to {$84000.00}. 2. Ocwen does not waive the past late fees, past balance and all the attorney fees as promised during the modification. 3. Even we made 39 payments after the modification documents, ocwen have already file for foreclosure on us. The Interest rate is higher than the current rate. 4. I called Ocwen Ombudsman office I spoke with XXXX XXXX and I have explained to him that " Ocwen did not sign the Modified document and did not respect their promises so ; we need a new modification with accurate amount. Complaint: I contacted my Mortgage Servicing Company when I became XXXX behind and the lender recommended that I try Loan Modification and I stated that I was in a loan mod a year and a half before this date the lender said try and apply. So I apply on XXXX XXXX, 2016 and its a Saturday and submit all required docs by fax, email, to lenders contact. On Monday Morning XXXX XXXX, 2016 before XXXX XXXX XXXX XXXX XXXX I get a phone call from lender stating that I was Denied. I ask how they could even preview my docs that fast and decide to deny me? The relationship manager then informed me that I did not send in all required docs and that my lender suggested a re-payment plan. If I did not want plan my house would be foreclosed on. I received a notice of default when I was just XXXX behind and before I was denied loan mod. My home is under water and I owe a balance of {$230000.00} Our property is valued at the present time to be {$140000.00} My payment is {$1000.00} a month with tax and insurance My rate is 2.119 % which I have no problem with and its a 30 year fixed conventional Repayment Plan offer by lender After 2 months of run a round by lender on agreement on plan by then I was 3 months behind. So the lender offers me a re-payment plan that consist of Total payments behind 3 months at {$1000.00} x XXXX = {$3000.00} Required a down payment of {$1.00}, XXXX to be paid as agreed on XXXX XXXX, 2016 by XXXX XXXX which was paid as agreed to lender reference enclosed. Lender requested XXXX payments for months of XXXX, XXXX, XXXX, XXXX, XXXX of {$1600.00} Totals {$1600.00} x XXXX = {$8000.00} dollars plus the {$1300.00} down payment which would total {$9300.00} minus my past due of {$3000.00} = {$6200.00} Why are they charging me this amount for what? I made the down payment like I mentioned before as agreed and my next first payment of {$1600.00} is due XXXX XXXX, 2016. I can make my regular payment and a little more on top of regular payment but like I explained to the Relationship Manager it would be very difficult to make this payment. I 'm XXXX XXXX XXXX and my wife and I ca n't retire due to all the stress on our mortgage issues with lender. My lender never once told us about programs that were available to loans under water, We get collection calls all hours of days and weekend to. My lender did work with me on repayment plan to a certain point then I got contacted by different relationship Managers regarding plan half could not even speak very good XXXX hard to understand. We have been promised, lied to, mislead, had to sign incomplete documents, Our last loan modification was a backed up in the corner kind of signing we had no choice at the time. And on top of all this the stress it has caused my family and myself. And I recently was contacted by a company who said they work with my lender and offered me a Mortgage Restructuring & Streamline Program that was fully approved by my lenders Negotiator name is included to and the making home affordable program which I had to sign within 24 hours would drop my payment to {$860.00} and 2 % rate for XXXX payments of {$1200.00} total {$3800.00} which my lender is requesting. Now I know this is a scam and I have contacted my lender with no response at all. I have had to file chapter XXXX and XXXX bankruptcy 2 times over the years in order to keep my home. Been charged all sorts of fees and late charges, down payments by my lender I think they are scamming me again with all the charges listed above for the repayment plan where does it stop!

Complaint: It has come to my attention that the company servicing my mortgage loan, Ocwen, has made a serious error and cancelled/liquidated my outstanding debt, incorrectly citing the loan status as delinquent. I have had this mortgage for over 10 years, and have made each and every monthly payment. When I called their customer care line, I was informed that the loan had been " charged off ''. When I inquired as to why, I was told they would have to " research it ''. I received a reply a few days later indicating it was charged off due to the " delinquent status of the loan ''. This reply, sent to me by XXXXXXXXXXXX, indicates to me that they never did any research, as the loan was not even close to being delinquent. The matter originally came to my attention on XXXX XXXX, 2016, when I logged on to make the only payment that was due, which was the monthly payment due XXXX XXXX, 2016. Furthermore, if there were additional terms buried in my contract that required I do more than just make the monthly payment on time each month to ensure my loan was not considered delinquent, Ocwen never contacted me to inform me of them. Prior to Ocwen charging off this loan, they made no attempt to even contact me to let me know they considered the loan to be delinquent. I made each monthly payment in accordance with the terms of my loan, and verified both the amount and due date on Ocwen 's website each time I made a payment. But again, for reasons unknown to me Ocwen suddenly considered it delinquent and cancelled/liquidated the outstanding debt without ever contacting me. Upon receiving the reply from Ocwen 's research department, I then contacted customer care to ensure they would not falsely report to the credit bureau 's that my loan was charged off " due to delinquent status '', and reaffirmed that the loan was not delinquent. I was told that they will report " whatever their records indicate ''. When I informed them that reporting false information is a violation of the FCRA, I was told there was nothing they could do. I should also note that the last payment they applied was on XXXX XXXX, 2016. This was the monthly payment that was due on XXXX XXXX, 2016. So as of XXXX XXXX 2016, my loan was fully up to date. The loan was subsequently declared delinquent and charged off before XXXX XXXX, 2016 ... less than 2 months later. I have attempted to follow up with XXXX ( email address referenced above ), but she has not responded. I fear that if this error is not corrected ASAP, they will report false information to the credit bureau 's that will severely impact my credit score in a negative way.
