Struggling to repay your loan

Student loan: Federal student loan servicing

Can't get other flexible options for repaying your loan
Complaint: I've been working for the XXXX XXXX since XX/XX/2005. I just found out after years of paying my student loans that I had the wrong type of loan and am not eligible for forgiveness. I had FFEL loans, and I had no notification that it had to be a direct loan. A federal loan is a federal loan. So now I've almost made 120 payments and don't qualify. This has to stop.

Struggling to repay your loan

Student loan: Federal student loan servicing

Can't get other flexible options for repaying your loan
Complaint: I have several student loans all which are consolidated thru Navient and the Department of Education. I began my schooling career in XX/XX/XXXX and completed 2 XXXX degrees in XX/XX/XXXX, then a XXXX in XX/XX/XXXX. In XX/XX/XXXX i filed bankruptcy. After about 4 or 5 years i realize that i was not getting and keeping gainful employment and was relying solely on my XXXX check XX/XX/XXXX% of the time for my survival, i wrote the loan companies asking to be dismissed as because i was a person with a XX/XX/XXXXXXXX. The loan companies wrote me back and turned down my application without further ado. Now 12 years later i still have not had any gainful employment to speak of and the loaners are always ringing my phone. This is very disturbing for me emotionally, i spent nights crying about these debts i collected or was allowed to collect, equaling almost XXXX dollars. So i just read that there was a suit against these loaners because of other people with similar circumstances as me. So I am submitting a claim in hopes it will be reviewed and some sense can finally be made of this situation.

Received bad information about your loan
Complaint: I have been trying to get Navient to right their wrongs for years. Despite my trying to dispute the legitimacy of these loan for years, I decided to pay them off and fight it on the back end. Yet, Navient STILL continues to fraudulently report my loans to the credit bureau. On XX/XX/XXXX, I requested ( and was approved ) for a forbearance on loan " 3 ''. Then again on XX/XX/XXXX, I initially 2 payments to PAY OFF loans " 1 and 2 ''. On XX/XX/XXXX, I checked my credit report and it something to the effect of " between XX/XX/XXXX and XX/XX/XXXX, consumer missed 2 payment ( failed to pay off loan ) and is 120 days late '' and " Between XX/XX/XXXX and XX/XX/XXXX consumer filed dispute ''. BOTH statements are bold face lies and I paid OFF two loans and got a forbearance on the third, yet paid interest on this one ( during the forbearance period ). Navient continues this fraudulent practice of erroneously reporting negative statuses to credit agencies and nothing is being done.

They are hereby notified, under provisions of Public Law 95-109, Section 805-C, THE FAIR DEBT COLLECTION PRACTICES ACT to hereby CEASE AND DESIST in any and all attempts to collect the above debt. I sent a constructive notice that, absent the validation of their claim within 30 days, they must cease and desist any and all collection activity and are prohibited from contacting me, through the mail, by telephone, in person, at my home, or at my work. But they failed to uphold the law. Their failure to do so is suppose to be a result in charges being filed against you with the State and Federal regulatory agencies empowered with enforcement. Im looking for proper remedy in which case to have this removed from my personal credit report.

Dealing with your lender or servicer

Student loan: Private student loan

Trouble with how payments are being handled
Complaint: On Saturday, XX/XX/XXXX I got a notification from my bank that my account went into overdraft. I was charged fees on top of the overdraft. I checked my account to see what caused the overdraft. To my dismay, it was a auto debit check from my private loan from Navient charging me about {$440.00}. My normal payment on the XX/XX/XXXX is around {$270.00}. I was confused and angry but could not speak with the company because they were closed on the weekends. Monday morning around XXXX XXXX I called the company regarding the matter. I told them that I was not notified of a payment increase or a change in my rate reduction program. The person on the phone name was XXXX and she was very rude. She argued and told me I signed up for this and they are allowed to debit whatever amount. I was trying to explain to her that I was not notified, but she said well it was taken out of your account since last month. When she told me that I checked my account and saw that she was right. About {$440.00} was taken out automatically by check and then for some reason I paired them {$270.00} on top of it. Because she was SO rude I asked to speak with someone else. This person, XXXX, wasnt AS rude but she was not empathetic either. I asked her if I was notified that there would be a change in my payments. She said yes and told me to hold on and it took her almost 2 minutes to look. She stated she couldnt see when I was notified by it should be in my statement. I asked her how am I supposed to know when my rate reduction program ends without notification from the company? I also was confused because I did receive an email from Navient stating my program was ending XX/XX/ and my payments would be increased in XX/XX/. I submitted an updated financial statement and e-signed it. I never received a call back from Navient about that. I did not receive any notification notifying me of an increase starting in XX/XX/XXXX. She claims one of my loans ended in XX/XX/XXXX but couldnt explain to me when would one end and not the other when I signed up for the rate reduction program and the same time ( I think in XX/XX/XXXX ). I also asked her to take me off of auto debit because of this matter. She never notified me that I would be charged {$23.00} to end auto debit. This company is not professional at all and I wish I never signed up when starting college.

Trouble with how payments are being handled
Complaint: Hello, I regularly check my credit score has Im trying to fix my credit. Ive noticed that navient has popped up as a charge off on a student loan. I immediately disputed the derogatory mark has I didnt recognize the lender. Upon further investigation I saw that they use to be a part of sallie Mae. My mother paid off all of my student loans before she passed away in XX/XX/2014. According to the report payments stopped in XX/XX/2014. Navient made no attempts to reach out to me directly. Had I known there was a loan left out I would have picked up where my mother left off. Navient has stayed that they have tried reaching out to me with no response. Ive asked for the phone number and address they have on file which they say they can not provide. Im beyond disgusted with the lack of customer service in trying to get this debt resolved. I find some of what they are doing fraudulent. I have disputed this information to the credit bureaus numerous of times. I must have rights when it comes to this matter.

Dealing with your lender or servicer

Student loan: Private student loan

Trouble with how payments are being handled
Complaint: Have been paying on private student loans prior to completion of terminal degree ( XXXX ). Recently in XX/XX/XXXX, private loans went into default, while enrolled in payment program. Have been paying {$250.00} per month since XXXX at least and not clear as to how loans went into default. Was informed needed to put all loans in at different times due to how they were taken out. Then was informed they were in default due to payment amounts not being sufficient, when they ( Navient ) were the servicers who enrolled me in the program with the acceptable rate/charge. Now 3 out of 5 of my private student loans are in default and there is nothing I feel I can do, especially since I am still paying $ XXXX month, plus my co-borrower is also paying a fee and has been for the past year at least. I have sent in letters and statements ; spoke to supervisors and numerous representatives. I receive phone calls at least 1 time per hour between the times of XXXX and XXXX CST. I am unsure of what to do. I do not have much on my credit report besides student loans, a car loan and 1 credit card ( with low balance of XXXX ). Not sure what else to do or where to go for support.

Trouble with how payments are being handled
Complaint: On XX/XX/2018 I logged into Navient to check my account and it said I would have an automatic payment of {$270.00} on XX/XX/2018. I made an extra payment of {$210.00} directed at 1 single student loan on XX/XX/2018. On XX/XX/2018 I logged on to Navient 's website and saw my auto pay had been changed to {$39.00} for all 6 of my loans, but I had not been notified as to why it had been changed. This had happened before on XX/XX/2018 and XX/XX/2018, but for different amounts ( from {$380.00} to {$270.00} ). I am unsure why my my monthly auto payment has dropped by 90 % in the past 3 months, but my loans have not dropped by 90 %. I still have over {$21000.00} in loans and I am not in an income based repayment plan, so I should owe more than {$39.00}. It seems that Navient may be recalculating my payments in order to keep me paying them longer. I do not want my loans to be messed up because I am a XXXX and could be eligible for loan forgiveness. I am not eligible if I miss payments, even if it is the fault of the servicer.

Incorrect information on your report

Student loan: Federal student loan servicing

Account status incorrect
Complaint: I have dealt with the office of advocacy for navient for several months now whereby they have puts misleading and errant remarks on my credit bureau that never should be there. I have been assured that these remark would be taken off only to be alerted later via XXXX that the remarks have been added back on. I just had remarks put on my credit bureau that state that payment was deferred when in the fact that is incorrect and fraudulent information due to the fact that I am on an income-based repayment plan of {$0.00} a month until XX/XX/XXXX or XX/XX/XXXX next year when I will be consolidating all of my loans over to XXXX. It's bad enough that a 90-day remark from XX/XX/2012 has haunted me for the past 6 years 7 months and navient will not do anything about it and continuously says that the remarks are accurate when in fact they did not own that the loan back in XX/XX/2012 as it was owned by Sallie Mae. I have been continuously denied for credit due to a serious delinquency remark because all 18 loans were marked 90 days late and made XX/XX/2012 and I have asked this organization for months if they would be willing to remove the negative remark a couple months early ( it's been on there for 79 months ) and I have been met with nothing but unprofessional rude discourteous service.

Received bad information about your loan
Complaint: I had private loans with SallieMae when I graduated college in XXXX. I started payments soon after. The Public Service Loan Forgiveness program started in XXXX and I thought I was the perfect candidate. I worked for XXXXXXXX XXXX XXXX for at least five years while paying off my loans, then moved to XXXX XXXX and started working for a XXXXXXXX XXXX XXXX XXXX. I thought I was well on my way to having my loans forgiven. I called SallieMae to find out what I needed to do. They told me that I needed to get onto one of their income based repayment plans and I would be doing everything necessary for the Public Loan Forgiveness plan. The thing they didn't tell me was that your loans had to be Federal loans to take advantage of this program at all. At the time, in XXXX, there wasn't any information online for me to read that would let me figure this out myself. What incentive did SallieMae have to let me leave their company? It took until much more recently, I don't remember exactly when it was, but I removed my loans from SallieMae and re-consolidated them ( took on more interest ) with XXXX. I now have something like 20-30 payments toward public loan forgiveness. I should have been done with this program by now. I've been paying Income Based repayments since XXXX, that's almost 12 years worth of payments, and I barely have a few years worth from XXXX XXXX.

Struggling to repay your loan

Student loan: Federal student loan servicing

Problem lowering your monthly payments
Complaint: My student loan was bought by Navient along with the majority of student loans sometime in XX/XX/2013 I believe. I was contacted by them to start making payments. I couldnt afford it at the time having a job that barely paid my bills as is. They requested I go for Student Loan Forgiveness. Which I did and made several payments following which is what they requested. I didnt hear from them for 2 more years. One day I decided to look into it and as it turns out they had been sending me letters and emailing me about having to make payments. However, they had the incorrect address of where I lived ( house number was off by 2 digits, very strange almost like they changed it so I wouldnt see it ). My email address they had on file was also incorrect. Low and behold, my loans had defaulted and gained copious amounts of interest. After dealing with 20 minutes of machines I finally reached a representative. They had no idea why that happened and they requested I take a break from payments with financial hardship. I signed up for that not knowing that my loan would continue to accrue interest and raise it even higher. I did this twice before I realized that was happening. I called and expressed my concern and they explained to me how to enroll in the Income Driven Repayment plan. After a week of dealing with mailing my information, talking to reps, and figuring everything out, I was finally able to apply. I made modest payments for awhile and then was notified I would have to reapply every year I wanted to do that program. They made it EXTREMELY difficult to reapply and gave poor customer service as to how I could continue to use the program. The representatives were rude and I was transferred several times to figure out what I needed to do. After 2 weeks I finally just sent them the information they requested and am waiting on acceptance. The normal payments are half of what my rent costs every month and I dont understand how anyone in my situation is expected to pay that much every month. So now Im paying through income driven repayment and it barely covers my interest rate. Im dissatisfied with the customer service and overall handling of my loans with this company. I wish I was with someone else that could actually help me get my loans under control. Although, thats not likely to improve with anyone else. In a nutshell, my only option is this : You cant afford the outrageous payment every month? Ok we will cut it in half but youll be paying your loans quadruple what you pulled out in the first place something needs to be done about the student loan problem millions of Americans my age in this country face.

Complaint: On the day of XX/XX/XXXX, I mailed off a letter to Navient/Department of education. in that letter was a statement saying that the company agreed to delete/waive a late notice that was marked on my credit report XX/XX/XXXX when they decided to cash a check I also included in the envelope.
