Written notification about debt

Debt collection: Other debt

Didn't receive notice of right to dispute
Complaint: My first notification of being in collections was from a company called XXXX. I called XXXX XXXX after applying for an apartment and getting denied. This is when I found out it was in collections. The collections company is National Credit Systems. The issue is I have nothing in writing prior to the XXXX. They acquired my account on XX/XX/XXXX and claims to have mailed a letter to me. I do not have one and never received one. I have paid the balance but it is not reflected on the account not have I received a receipt. My credit card reflects the payment but nothing from them. The rep XXXX who " assisted '' me got very personal. She is offended if you ask a question, if you are intelligent, if you don't like how she is yelling at you, etc. She kept putting me on hold and asking about the other person on my rental application. How is it they have my rental application with non pertinent collection info on it???? I'm concerned about my data. I think they are holding my payment because of her attitude towards me. The supervisor XXXX was not helpful in correcting the behavior. I paid them more than 24-48 hours ago as of this complaint and still no receipt. The online account does not show the payment either. Have I been scammed. XXXX is no help, unaccountable and fake collections people there.

Attempts to collect debt not owed

Debt collection: Other debt

Debt is not yours
Complaint: I was first contacted by phone in XX/XX/XXXX by Collection Representative XXXX XXXX who is employed by National Credit Systems , Inc regarding an alleged debt of {$110.00} incurred by me in XX/XX/XXXX. Ms. XXXX would not provide specific information regarding the debt and I stated that I was disputing the debt. In XX/XX/XXXX, my father, XXXX XXXX, was contacted by cellular telephone and notified that National Credit Systems was attempting to contact me to collect a debt. 15 U.S.C. 1692c ( " a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector. ). On XX/XX/XXXX, I received a letter from MsXXXX XXXX stating that " The above referenced account has been placed with this office for collection. National Credit Systems , Inc. has been authorized to recover this debt by way of credit bureau reporting ( following this initial 30 day validation period ) as well as other available remedies. '' I called Ms. XXXX and spoke with her on or about XX/XX/XXXX and informed her that I was disputing the debt. Ms. XXXX stated that I must do so in writing and that she would " remove the debt from my credit report. '' I informed her that the letter stated that the debt would not be reported to my credit until after the " initial 30 day validation period. '' She informed me that the letter ( sent by her ) was not correct and that the debt had already been reported negatively to my credit. 15 U.S.C. 1692e ( A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. ). I informed Ms. XXXX that I would send written notification of my dispute of validity and did so on XX/XX/XXXX. On or about XX/XX/XXXX I received a letter signed " House Collector '' from National Credit Systems acknowledging my dispute but stating that they have " yet to find sufficient evidence to validate your claim ( s ). '' I then contacted National Credit Systems and spoke to my account representative -- I believe this was XXXX XXXX, but I am not positive. I informed the representative that I was willing to provide sworn testimony from multiple witnesses to support my claim that I did not owe {$110.00}. The representative said that only " documents '' could be used to support a claim. This is obviously false and misleading. 15 U.S.C. 1692e ( A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. ). The account representative also informed me that my lease required me to conduct a " move out inspection. '' I reviewed the lease and it did not require me to conduct a " move out inspection. '' 15 U.S.C. 1692e ( A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. ). On or about XX/XX/XXXX, I attempted to apply for an automobile finance loan. My credit score had been affected negatively by National Credit Systems negative report and I was not able to receive a competitive interest rate as a result. Ms. XXXX had previously stated that the negative report would be removed from my credit report. On or about XX/XX/XXXX, I called National Credit Systems to receive clarification and attempt to settle the debt. I reached a woman who described herself as a switchboard operator named " XXXX. '' I asked " XXXX '' if she could provide me information regarding who I can discuss settling my debt with. " XXXX '' stated that my account was handled by " XXXX '' and " XXXX. '' I explained my difficulty in receiving honest communication from XXXX and asked to speak with XXXX. " XXXX '' informed me that " XXXX '' was not in. I asked " XXXX '' for last names for XXXX and XXXX. XXXX informed me that she was unwilling to provide last names. I then asked why and she was unwilling to provide a reason. I asked for XXXX 's last name and she stated she was unwilling. See 15 U.S. Code 1692e ( A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. ). I was eventually able to reach the voicemail of XXXX, who later became known to me as XXXX XXXX. Mr. XXXX was described to me by a receptionist as being " in the office '' but possibly on break. On Thursday XX/XX/XXXX I left a message with my name, account number, and phone number and asked him to contact me to resolve the debt. Neither Mr. XXXX, nor any representative of National Credit Systems returned my call. On Friday XX/XX/XXXX I left a message with my name, account number, and phone number and asked him to contact me to resolve the debt. Neither Mr. XXXX, nor any representative of National Credit Systems returned my call. On Monday, XX/XX/XXXX, I left a message with my name, account number, and phone number and asked him to contact me to resolve the debt. Neither Mr. XXXX, nor any representative of National Credit Systems returned my call. On Tuesday XX/XX/XXXX, I left a message with my name, account number, and phone number and asked him to contact me to resolve the debt. I also was able to acquire Mr. XXXX 's e-mail address from a switchboard operator. She also informed me that Mr. XXXX was at work that day. I then sent an email to Mr. XXXX at XXXX. I explained to Mr. XXXX the reasons for my difficulties so far with National Credit Systems and concluded by writing : " I have been and am willing to settle the debt, but have thus far been unable to reach anyone with that authority and I have been met only with stonewalling, deception, falsehoods, and misleading statements. Because of this, National Credit Systems is putting me in the position of proceeding with administrative enforcement options through the Federal Trade Commissions Consumer Financial Protection Bureau and/or civil suit U.S. District Court for the Southern District of Florida. Due to the time and expense, I am willing to settle this matter. Please respond to this message by the end of business today, XX/XX/XXXX. I release you, XXXX XXXX, from any prohibition on contacting me by telephone at XXXX or e-mail at XXXX in regard to the above-referenced account number. '' Neither Mr. XXXX, nor any representative of National Credit Systems returned my call or my email. On today 's date, XX/XX/XXXX, I again called and left a message on Mr. XXXX 's voicemail. I have not received any response. As I stated to Mr. XXXX, I have been and am willing to settle the debt, but have thus far been unable to reach anyone with that authority and I have been met only with stonewalling, deception, falsehoods, and misleading statements. The debt is for a relatively minute amount and I have spent well more than {$110.00} worth of time in an attempt to resolve this alleged debt. However I believe it is necessary for people who are wronged to assert their rights. I am hoping you can help me resolve this issue before I resort to judicial remedies.

Debt is not yours
Complaint: After living at XXXX at XXXX XXXX XXXX for over two years I suddenly started feeling sick and felt a weird sensation coming from the upstairs neighbor 's apartment. I often heard a rolling sound following me as I moved. I went upstairs and told my neighbor that something was making me feel sick in my bedroom and asked if she noticed it too. She said she wasn't sure of what it was. I also saw several maintenance men in her apartment, pest control, and they even replaced the carpet. During that time I started to having someone attempts to break into my apartment at night. My front door had two locks. One that is accessible from the outside and the other that can only be accessed inside. One night, while getting a drink in the kitchen, I noticed someone unlocking the bottom lock using a key. Thankfully the top lock was bolted and they could not gain access. I reported it to the apartment manager and requested that the locks be changed. The locks were changed, but the same thing happened twice again. All these incidences were reported to the XXXX County Sheriff Office. Shortly after the man downstairs, got sick I found myself in and out of the ER and the doctor 's office. The final event that frightened me so much, I knew I could not stay there any longer. On XX/XX/2018, at XXXX XXXX I was at work and I got a notice on my phone my personal camera detected motion. When I looked at the footage I say a maintenance man entering my apartment to replace an already clean AC filter. The apartment policy is that filters are replaced by the residents. After he walked into my apartment, he moved my camera out the way so I could not see what he was doing. Once I got home that day I started searching for a new place. Once I found a place I asked the apartment manager if she would let me out my lease citing the maintenance staff incident. She agreed and we both signed a document that ended the lease on One XX/XX/2018. I already paid the month of XX/XX/XXXX and left 17 paid days on the lease. The manager soon leases the property to a new tenant and I know this because I had to visit the property to retrieve a misdelivered package which was never found. There were moving boxes outside the apartment indicating that someone moved in. In XX/XX/XXXX, over a month later, I received a bill from the XXXX at XXXX XXXX for {$930.00} the remaining balance in XX/XX/XXXX ; knowing that it was being lived in by someone else. The account has since been placed in collections and my credit ruined because I refuse to pay for someone one else to live in that apartment. Enclosed I have a list of police reports provided by the XXXX County Sheriff Office and a photo of the maintenance man entering my apartment. I can also provide the video if needed.

Attempted to collect wrong amount
Complaint: Two months ago i learned that a past Apartment complex I lived in sold or hired a collection agency for debts incurred in XXXX for an eviction. I found out by learning that it was on my credit report when i tried to apply recently for housing and was turned down because they said i had a collection on my account in the amount of XXXX. Once I looked into it I called the collection agency listed on my report and spoke with a gentleman name XXXX XXXX from NCS. I said I just found out about the debt and id like to settle it however I need itemized charges because the amount I'm seeing has to be incorrect. He informed me that he had both my lease and itemized charges and that he would email me these items and then send a settlement offer that I should receive any day. Fast forward to today XX/XX/XXXX I called this guy back last night because I never received the email and left a long detailed message about how I contacted original creditor and got a copy of the charges and that I was disputing the charges but to call me today and if I hadn't heard from him Id call. I called around XXXX XXXX pacific XXXX. I explained to him that I never received the email with the charges or lease and that as a result I went to original creditors XXXX XXXX and they printed out a list of charges. I also spoke to a manager who stated that NCS had everything and that they couldn't get involved further because NCS now owns the account. XXXX interjected that in fact they didn't own the account and they were collecting on behalf. I found this interesting because twice I was told by a staff member at XXXX that there was nothing they could do because they dont own the account anymore. I was told once on the phone a month prior and last week when I went to the office in person. At any rate the charges which i will attach to this are for charges for normal wear and tear which i can not be charged for. You can not charge for painting, carpet cleaning, apartment cleaning. The XXXX deposit was for carpet cleaning. Also If you evict a tenant in nevada you can not then turn around and ask for the money for the month you are evicting them for. Its either evict for nonpayment or take payment and no eviction, you cant kick the person out and then ask for the amount that you kicked them out for. I also was never notified of how my security deposit was used within the 30 days that they are supposed to notify you that way I would have known that this huge amount they were charging me for had been following me around on my credit report. they were in possession of both my email address and forwarding address in which i never received any notification about charges. I also explained that i see that they tried to claim damages when there was no such damage ... he then said they did not charge for damages that i was responsible for all of the fees. he then stated that because i didn't do a walk through as stated in my lease as a requirement that they basically can charge whatever they want. I stated that my lease said no such thing and that I was told when i gave the keys in that they could not do a walk through that day by the leasing agent XXXX XXXX. I also informed him that a previous company is who i had the lease with and only a month prior to the eviction unbeknownst to all of us at the complex that the complex had been sold. I agree that something is owed and I really wanted to work something out but the charges are overcharged by over 2,000. The conversation didn't end well because the guy starts getting snappy and was like most people who call here call because they want to work it out but obviously thats not what you are doing here. Interesting because the settlement i received from him recently which happened to expire was close to the actual amount i should have been charged. So now false information continues to sit on my credit report because of lies and false reports of what i owe and the two companies XXXX XXXX and NCS aren't helping because XXXX is outright denying that they still own the account and now ncs is saying they don't own the account. In the mean time i cant rent any apartments because landlords here wont rent to someone with a high collection account from an apartment

Communication tactics

Debt collection: Other debt

Used obscene, profane, or other abusive language
Complaint: On XX/XX/, 2019 I received the first phone call from National Credit Systems Inc. XXXX XXXX was the employee who spoke to me. He used aggressive and loud language and while attempting to understand if the debt was added XXXX my credit report, he hung up on me. I called back and reached him where he told me if I didnt listen to what he had to say he would hang up on me again. I asked to speak to the manager, and he hung up on me. On XX/XX/XXXX he called me back and I told him I would make a complaint if he spoke aggressively toward me one more time. I was able to tell him that I am not disputing all of the charges owed, but my previous lease did not require me to pay for some of it. He stated that he filed the dispute. On XX/XX/, 2019 XXXX XXXX called me back and stated that the lease he had did not contain literature about pet damage. Once I realized the apartment complex provided the wrong lease, I provided the updated lease that included the pet addendum. I told her what paragraph to find the literature and we disconnected neutrally. On XX/XX/XXXX XXXX XXXX called me and spoke to me. He explained that the apartment complex would not remove the disputed amount of money. He told me that he never asked me for an updated lease and that he did not know what I was talking about. I reminded him that I in fact sent the email to his XXXX, XXXX XXXX with he email he provided me. XXXX asked me why it was a big deal to dispute the small amount that was owed instead of paying it. I told him my lease stated I was only responsible for a replacement and not a repair, as the literature stated. XXXX XXXX interrupted me and disconnected the phone call. National Credit Systems is refusing to mediate the amount owed and refusing to understand the literature of the lease in question. National Credit Systems is using harassing tactics to prevent me from paying only the money I owe. I have stated many times I am not disputing the majority of the debt and I am willing to make payments. I am unwilling to pay for what I am not responsible. National Credit Systems is attempting to stall on the issue to allow for enough time for the debt to go into collections for purposes of profiting. I attempted to speak to the XXXX XXXX XXXX XXXX on XX/XX/XXXX but was only allowed to leave a voice mail and was told he would not accept my call.

Debt collection: Credit card debt

Debt was result of identity theft
Complaint: I have attached a Complaint letter. This complaint is regarding the credit unions namely XXXX, XXXX and XXXX. My identity was compromised in the year 2016 which I was not aware of then. I received my social security number around that time and not being originally from the United States of America, I was not aware of the term identity theft and how it can affect your life. Unfortunately, being a victim of identity theft myself it has not been easy life since the year of 2016. It has been over 2 years since I am constantly requesting and disputing accounts in my credit report which was not opened by me. The credit bureau has not been very cooperative, I have sent several letters stating to send me proof of verification or else delete the accounts. XXXX deleted all unverified accounts but failed to remove all non-account holding inquiries. XXXX and XXXX did not delete any unverified account, nor did they send any verification of the accounts. I request Consumer Financial Protection Bureau to help me with this issue and protect my rights as this issue has affected me emotionally as I can not purchase a vehicle or house for myself or my family. This inconvenience caused to me for all these years and I would want to be compensated for my time and struggle.

Attempted to collect wrong amount
Complaint: On XX/XX/XXXX I moved from an apartment complex by the name of XXXX XXXX XXXX. The housing complex absorbed my deposit which was around {$1400.00} and the debt was written off by the original creditor. I was contacted countless times by National Credit Systems Inc.the collection agency that I have to block them. I was surprised for them to still be able to call me just using another line of sorts. I was informed I could write a letter to have them cease communication with me in regards to the collection. I disputed the collection which in the amount of {$3000.00} with both the collection agency and the credit bureaus ( debt was opened listed XX/XX/XXXX ). I've written multiple dispute letters and none of the agencies can provide validation letters of the debt proving them amount owed or if it's even my debt. The collection agency forwarded me only a copy of a lease with what I assume are supposed to be my initials, but there isn't a clear signature. I keep asking for this debt to be closed and removed off all credit bureaus or renting database so that I can acquire housing, but they refuse stating the debt is valid even though they can not prove the debt and amount is even mine.

Didn't receive notice of right to dispute
Complaint: Recently became aware of a derogatory item that has been reporting inaccurately on my credit report since XXXX. On XX/XX/XXXX of XXXX I moved out of XXXX XXXX apartments after satisfying the requirements of my lease. I had signed a 12 month renewal that began on XX/XX/XXXX and expired XX/XX/XXXX. I lived there from XXXX until moving out in XXXX. Prior to leaving, I provided written notice as requested in the lease agreement, and also made sure that the apartment was left in a better condition than when I moved in. After cleaning the place top to bottom and taking pictures of each room, I left for good. It was only recently that I found out that National Credit Systems has a collections account for almost {$2600.00} that I was never made aware of under my rights of the FDCPA. I contacted them directly to dispute the debt and they sent me a copy of my lease along with an itemized claim of inaccurate damages. First and foremost, for over 4 years now they have inaccurately reported the creditor as " cross lakes apartments ''. On top of that, the claim is for 2 months of unpaid rent and late fees for the months of XXXX and XXXX of XXXX. My lease expired in XXXX! Why am I being harassed for 2 months of rent payments that I was no longer liable for? Third, all of the miscellaneous cleaning fees claiming damages outside of normal wear and tear are just a joke. I have photos to this day that show a complete different story. The bedrooms, bathroom, living room and kitchen were all immaculate when I left and photographed them. Furthermore, I lived there for 5 years, and I know that the carpet is replaced after a tenancy of that long. Charging {$150.00} " carpet cleaning fee '' is absolutely ridiculous after I had paid a cleaner to come do it prior to leaving. On top of all of this, they had the audacity to add on a {$730.00} " collections fee ''. I asked why I was never provided written notification of the debt as required by federal law, or allowed the opportunity to dispute it before now. I was told by the representative that they " called and left messages ''. I asked what phone number they were calling and she gave me phone numbers that belonged to my relatives. She told me that they didn't have my address to send me written notice. I advised her that by law they are required by law to provide WRITTEN notification, as well as ensure the accuracy and validity of the debt being claimed in order to legally report to the credit bureaus. I reminded her again that they didn't even have the name of the original creditor correct that they have been reporting for nearly 5 years now, as well as attempting to collect debt that is not legally owed due to being outside the dates of my contract. I requested immediate deletion of this due to being in blatant violation of the FDCPA and being inaccurate and unverified, but the representative refused to comply. I have reported to the XXXX as well, and am preparing to exercise my legal rights to recover any damages to which I may be entitled.

Complaint: This matter is regarding US residential management company XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, TX XXXX they used to manage Park on XXXX XXXX, TX XXXX. When I moved out they said I owed for a washer and dryer, I had them move out their washer n dryer because I had my own. For one they had never contacted me until like a year later about ANY damages I provided them with a move out contact number and address. Only heard about it when had actually went to collections and than they would not provide with sufficient documentation said charges besides a sheet of paper that said " cleaning '' and " damages '' with no description. I finally get the ledger and there's a XXXX dollar charge for a washer and dryer. I had my own I have receipts for that washer and dryer too that I can provide but they should have a work order stating that I wanted them to move out the washer and dryer.

Attempts to collect debt not owed

Debt collection: Other debt

Debt was paid
Complaint: I rented a room in XXXX XXXX, now XXXX on XXXX XXXX, from XX/XX/XXXX to XX/XX/XXXX. When signing the lease, the apartment management did not require a security deposit. On XX/XX/XXXX, three months after I had moved out, my mother received an email from the management with an invoice for the following charges : {$73.00} for a coffee table, {$50.00} for a bedroom door, {$160.00} for a mattress, {$45.00} for bedroom/bathroom cleaning, and {$5.00} for an electrical overage, totaling {$340.00}. They claimed that they had notified me about these charges on XX/XX/XXXX via email and uncertified mail, neither of which I received. On XX/XX/XXXX we sent a letter via certified mail disputing the charges, and including check # XXXX for the electrical overage. The coffee table had been paid for by my roommate who had caused the damages. The bedroom door had already been paid for on XX/XX/XXXX by check # XXXX which they deposited on XX/XX/XXXX. I did not do any damage to the mattress or room other than normal wear and tear. I believe this error may be because I switched rooms with permission of the management, so they may be charging me for damage done to the old room by whoever moved in after me. On XX/XX/XXXX, the manager acknowledged via email that we paid the overage. This collections claim was added to my credit reports in XX/XX/XXXX for {$340.00}. On XX/XX/XXXX I started receiving collections letters from National Credit Systems for {$330.00}. After getting in contact with them, we sent documentation to show that these were illegitimate and unwarranted charges. The most recent letter on XX/XX/XXXX says that they adjusted the balance and reset it to {$340.00}.
