Complaint: XX/XX/2018 Consumer Financial Protection Bureau XXXX XXXX XXXX XXXX, IA XXXX Dear Sir or Madam : I am requesting you to investigate Mortgage Research Center LLC d/b/a XXXX XXXX XXXX XXXX. Too many unscrupulous lenders are in the business of defrauding home buyers in particular Veteran home buyers ; Men and Women that have fought and was wounded for this country of the " American Dream. '' I am one of those Veterans. XXXX XXXX XXXX XXXX know they are wrong about defrauding and mistreating and Veterans but they also know there is little accountability. XXXX XXXX XXXX XXXX knows it is much cheaper to continue to break the law than to obey the law. ( See XXXX XXXX XXXX ) The above fraud went on for a while and violated many Veterans, until the XXXX decided to do something about it. I am hoping that the CFPB do something about my case and so many other cases that I have read on your website where people have been violated by Mortgage Research Center LLC d/b/a VXXXX XXXX XXXX XXXX. I am a XXXX XXXX Veteran. I am well qualified with my credit worthiness to receive a mortgage loan and purchase a home. For home ownership is the " American Dream ''. I chose XXXX XXXX XXXX XXXX because of their advertisement on the internet claiming to be connected with the VA. I applied to XXXX XXXX XXXX XXXX for a Mortgage Loan on XX/XX/2018 and I was preapproved. I got a contract on a home on XX/XX/2018, unfortunately the contract fell due to a defective Roof. During the home purchasing process I was assigned XXXX XXXX, Loan Officer and I told her I was a XXXX Veteran with XXXX XXXX XXXX XXXX. She acknowleged my conditon. I made XXXX aware of what " XXXX '' my condition and when I am 'XXXX '' my thinking gets XXXX and I have XXXX XXXX, I become XXXX, and I become XXXX XXXX. The tXXXX happen when XXXX XXXX raised her voice at me yelling, when she talks over me, when she ignores my request to include me with my home buying process. Many times when XXXX XXXX did not include me in emails when she discussed my information with my real estate agent or the seller agent. When the Appraisal came back lower than the sale price I asked XXXX XXXX for a Reconsideration of Value. She said that I could not get a Reconsideration in Value because the house appraised lower than sale price. Also I thought it odd that the Seller Agent could give Comps to the VA Appraisal. ( Exhibit 2 ) The real estate agent, XXXX XXXX called me and said she was not suppose to get the appraisal because that is my business not hers. XXXX said she did not know why XXXX sent the appraisal to her and not me. The emails below verify communications between my agent, the seller agent and the loan office. The seller agent was given the appraisal and communicated with the VA Appraiser. The Seller agent provided COMPS to the VA Appraiser. This is a conflict of interest when the Seller agent communicates with VA Appraiser. My Loan Officer included correspondence to the Seller Agent, XXXX XXXX. This is a Conflict of Interest. So I used my cell phone and signed the forms but I could not read them on the small cell phone. I did not know what was in the contract since I was not included in putting it together. I did what my real estate agent demand I do or else. Of course this XXXX my XXXX symptoms. When I finally had the chance to view the contract ; I was shocked at what I read. I asked XXXX to change some things like add the home warranty for the seller to pay for it and I choose the home warranty company. XXXX refused and said, " Well you signed it! '' She could care less about me or what I wanted. XXXX was looking out for XXXX. No one cared about me the buyer. The agent certainly is not. She is being nasty and greedy and unprofessional. The seller went back and forth about the roof and it was confusing at times. She want to pay for the roof at closing, then give me a check for the roof, then put the roof in escrow, then replace the roof with a cheap roof and she picked the roof and color. I signed all the addendums and still did not get the house. I became ill after having a verbal disagreement with XXXX XXXX, XXXX XXXX Loan Officer, about going behind my back and discussing my business with my agent and others without includng me. XXXX XXXX told me, " The Goal here is to close on the home. '' I told her that is not my only goal but she said that is our goal. I felt so unincluded and demoralized with this home purchase situation. I want to be happy with my first home purchase. I want a home for my family. I want a part of the " American Dream ''. I want a move in ready home that I can enjoy with my family. Not just to close on something that is dangerous and unsafe to live in like the house at XXXX XXXX XXXX. I felt pressured by the loan officer, my agent and the seller agent to close on a house that was dangerous to live in. No insurance company would give me insurance on a home with a defective roof. XXXX XXXX knew I could not get home owner insurance with the roof condition. And the seller did not want to pay for a quality roof prior to closing. The seller agent, buyer agent, loan officer wanted the low grade roof with choice of roof and color decided by seller. They bullied me to go for that. I wanted to choose the type of roof and color. I got a second quote for the roof. XXXX XXXX gave me a quote for a 3 dimensional roof for {$7000.00} which was a {$90.00} difference than XXXX XXXX which had a lower grade 3 tab roof quote. The contract failed due to the roof. After this I continued to look for a home ; I drove around looking and looked via websites. I called XXXX XXXX XXXX XXXX customer service and requested a change in loan officers. I was referred to XXXX XXXX of XXXX XXXX Advocate Team. I was told by XXXX XXXX that he was the point of contact. I emailed him and requested a different loan officer. On XX/XX/2018, received an email from XXXX XXXX saying this will be the last time I can change loan officers. THEY THEN TOLD ME TO USE THEIR REALTOS AND BEGIN LOOKING FOR CONDOS. THEY KNEW THAT IT WOULD NOT BE RIGHT AWAY THAT I WOULD FIND ONE. THIS IS THE MESSAGE I RECENTLY GOT IN THE EMAIL. THIS IS THE MESSAGE I RECEIVED AFTER 10 DAYS THEY COULD NOT LOCATE A VA APPROVED CONDO FOR ME AND THEY REQUIRED THAT I USE THEIR REALTORS. Complaint: After hurricane Irma I was given forbearance on my home loan for 90 days with XXXX XXXX XXXX XXXX At the end of the 90 days I was contacted by XXXX XXXX that I was expected to pay in full the past 90 days or the house would be foreclosed on. They have also sent to the credit bureau that I was in default and it is affecting my credit score. I have been paying my mortgage payment every month and I'm still being threatened with foreclosure. I was told by XXXX XXXX when I signed up for forbearance that the missed payments would be applied on the back end of the home loan and I would keep my same monthly payments.

Complaint: First I would like to mention that I filed a complaint just moments ago concerning XXXX. This complaint is against XXXX XXXX XXXX XXXX XXXX due to the fact that a XXXX manager stated to me that they were shorted by XXXX XXXX XXXX XXXX XXXX during the sale of my mortgage to XXXX. This complaint is filed so that any miscalculations or missing information can be submitted to XXXX so this issue can be resolved without me being involved. The following is the identical complaint filed against XXXX, and mentions XXXX XXXX XXXX XXXX XXXX as well. Before I begin I want to say that I spoke with XXXX in one of the CFPB offices yesterday and he gave me some suggestions on how to proceed with my complaints. Thank you XXXX. My complaint now begins. I purchased my home in XXXX and have made on-time payments automatically through my bank since that time. The home was financed by a lender who shortly after sold my note to XXXX Mortgage. XXXX haunted me for about nine years until I finally refinanced the home in late XXXX because XXXX would not refinance my house as they liked the fact I was paying well over 6.25 % interest. The house was refinanced with XX/XX/XXXX in XX/XX/XXXX. Shortly after I was notified that XXXX was taking over the loan. I was informed the payments would remain the same so I had no problems with the transfer. However after almost a year to the day I was called by a very rude, unprofessional and very unfriendly XXXX representative who told me to start making my payments with an additional {$170.00} or so a month due to my flood insurance premiums being increased. I told her I have no notices or information of that kind of increase and that I would not pay any addtional monies until someone from management called me and explained what was going on. This person then began a rant about how it was my responsibility and that I had better make the addtional payments. I told her again to have management contact me and we would discuss it. I then hung up the phone. I never heard from XXXX management, however I did check with my insurance company and my flood insurance went down over {$200.00}. This representative lied to me from the very beginning. My taxes have gone up slightly, however not very much. And definitely not enough to cause my mortgage payment to go up almost {$200.00} a month. I have continued to receive robot telephone calls from XXXX since this all began, and even the attempts I have made to contact XXXX had been unsuccessful as I was always put on long hold times. I work for a living and dont have time to wait around for almost an hour everytime I try to speak with someone about this situation. After so many failed attempts, over twenty since the very first call, I finally called XXXX on a Saturday back on XX/XX/XXXX. The representative was friendly and once I explained the situation, we had been on the phone for over an hour. He said he would contact management to have them call me, however that call never came. I waited for a month before I made the next attempt to speak with someone in XXXX management. I spoke with a manager for just short of three hours explaining the problems with the disrespectful representative, the on-going robot calls numerous times a day, and about the issues with the payment increase. After a lot of questioning and trying to get to the actual reason why they were trying to get an extra almost {$200.00} from me each month, he finally stated that it seemed the previous lender had shorted XXXX with the refinance and that they were making me pay the shortage. I told him that was not my problem. In fact before he made that statement I had told him I was willing to pay half of the increase, but not the entire amount because my insurance and taxes had not gone up as I was told. However when he stated the issue was likely caused by a shortage calculation or worse by the previous lender I told him I was not paying the increase. This was on a Wednesday. I told him I would get as much information about the previous lender, XXXX XXXX XXXX XXXX, and we could take it from there. He promised to call me back the following Monday afternoon, however that call never came either. Prior to the two calls to XXXX in XXXX and XX/XX/XXXX, I had sent emails, made numerous telephone calls, and even sent several messages via the XXXX website, however not a single response or reply from XXXX has been received. I have sent several messages to different departments at XXXX via their website and still no response from XXXX. I continue to make my mortgage payments twice a month as I have for the past several years. I continue to receive automated robot calls from XXXX, however I will no longer attempt to call them because I am always put on-hold, and I will no longer call them on weekends. XXXX has ignored every attempt I have made to try and resolve this issue and they continue to ignore me. I have even mentioned in the various messages that I would be contacting various federal government entities about this issue if a manager does not contact me. They continue to ignore me so I am keeping my promise. I am filing a complaint against XXXX as well as XXXX XXXX XXXX XXXX. I feel that they may have made some incorrect calculations concerning my refinance with XXXX. However if that is not the case then XXXX needs to figure out what the problem is because I am not going to be held responsible for their mistakes. If however the cause is in fact due to increased taxes or insurance, then I will work that issue out with XXXX to resolve that issue. I want to thank the Consumer Financial Protection Bureau for assisting me with this issue. I hope that in doing so XXXX corporate management will finally make an effort to contact me. Complaint: False Advertising complaint against XXXX XXXX. They consistently advertise VA Mortgage Loans as {$0.00} Downpayment without providing details of who actually pays the lender closing costs and prepaid items ( insurance, tax escrows ). You must submit all of your information and then have the explanation provided by a Realtor that they refer the lead, who pays a portion of their commission to XXXX XXXX, which may be a separate issue regarding Lender Rebate programs. The VA Mortgage product is at best a 100 % financing option ( based on the Veterans Entitlement and loan amount chosen ) with Closing Costs typically paid by the Seller in negotiated concessions in the sales contract. Lenders may also build these costs into their rate but based on XXXX XXXX published terms that does not appear to be the case.

Complaint: While under contract with a builder the lender denied me a mortgage based on information that they knew was incorrect and then forwarded this information to the builder. The builder then demanded additional money for carrying costs on the house or would cancel the contract. Due to this erroneous information I lost my earnest money and appraisal money. Approx {$2500.00}. I was never delinquent with past or present creditors. This can not be proven be this lender because it never happened.

Complaint: After reviewing my credit report I noticed a few inquiries on there being reported by this credit bureau in which I have disputed them and put a fraud alert on my account as well with the creditors and the credit bureau is still reporting these not proven compliant inquiry deficient of true permissible purpose that requires immediate and permanent deletion, on my credit report. The last two letters I sent certified with tracking numbers in which the credit bureau responded back with if you believe this was unauthorized, please contact the creditor and still reporting these inquiries and ignoring my request of dispute. My complaint is towards these unauthorized and or possibly fraudulent, certainly unproven to be compliant with mandated proof of permissible purpose allegations of credit inquiries by Original Creditors on all three of my credit reports. Regarding the following inquiries < XXXX XXXX XXXX from XX/XX/ and XX/XX/ > I have disputed these unauthorized inquires for several months with no help from the XXXX XXXX XXXX. I was told, this is a third party service for a XXXX XXXX and I needed to contact this company. I have sent letters to both companies with no response. I am tired of being put off and given the run around. I am not a veteran, I did not apply for a home loan, and I did not authorize anyone to pull my credit for any reason from these companies. My credit report was pulled twice with this company and I would like these unauthorized inquiries deleted from my credit file with all three credit bureaus immediately! I have also filed complaints against XXXX XXXX XXXX. I need these fraudulent unauthorized inquiries off my credit report.

Complaint: In XXXX XXXX 2017 I applied for a modification of my mortgage with XXXX XXXX XXXX XXXX. I retained the services of an attorney to assist me. My attorney 's office attempted on several occasions to contact my mortgage servicer but was repeatedly told that there was no modification department and that they had to contact the original mortgage originator ( the person ). Ultimately, my attorney 's office sent a complete modification request package with a standard RMA, Income Verification, Bank Statements, and a Reason for my Hardship. This request package was faxed and emailed twice, only to be returned without explanation. My complaint centers around the fact that mortgage servicers, such as XXXX XXXX, are by law supposed to have accessible mortgage assistance programs and policies in place so that consumers may access them in times of hardship. A review of XXXX XXXX 's web-site shows that there is nothing available that can be found to direct consumers on how to go about applying for loss mitigation assistance. I am sure I am not the only mortgagor who has run into this road block and I believe that this type of stonewalling consumers to prevent them access to mortgage assistance programs that should be made available can only be resolved by seeking the assistance of the Consumer Financial Protection Bureau.

Complaint: When I purchased my home I was told that I would need to pay flood insurance. I was told that typically conventional loans are less likely given for homes in flood zones unless they have a large down payment. I was also told that I would have no problem getting the home loan because it was backed by the VA. The structural integrity of the property is poor. I 've found that this property was just filled in wetland. Now that the seawall/bulk head has quickly gave way I have learned the repair/reconstruction cost of what is now known as the properties foundation will be more than {$30000.00}. It would not be covered in any homeowners policy. The home was remodeled directly before the purchase. You can see that the home is settling quickly deeper into the earth. I learned last year when a home across the road which is also in a flood zone that it was too purchased by a veteran. The previous owner was leaving because he said it was just floating. I paid {$290000.00} for a small lake cottage in Indiana and will need to put no less than {$50000.00} more into the property which was not disclosed to me. I was told there was nothing to worry about when I questioned a slight break in the bulkhead which has now fallen into the lake with a second 50 foot section breaking way quickly. I question whether veterans are targeted to purchase flood zone properties because the backed VA is most accessible for these locations.

Complaint: My Husband and I applied for a mortgage thru XXXX XXXX XXXX XXXX. from the first discussion, we explained our plan to move closer to our children, and my husband plans to retire. We are both currently employed, my husband is a XXXX XXXX veteran, and our combined income at the time was XXXX annually. We discussed our plans to purchase a home, my husband would retire, and at that time I would seek comparable employment in the area of the home purchase. The new purchase is 200 miles from our current residence. Our plan was to purchase the home, sell our existing home, direct all proceeds toward the principle of the mortgage and in the interim, I had family members near our current residence to provide housing allowing me to continue with my current employer. I have been with this employer for 37 years, have built a professional career and reputation, and planned to travel to the new home on days off. We were immediately prequalified for a mortgage of XXXX. We found a home, negotiated a contract, and began to complete the mortgage process. we had no contact with XXXX XXXX for three weeks expecting all was proceeding well. Our FICO score is excellent, debt to income ratio is below 30 %, and all other necessary requirements easily met. Over the past two week, we have been in daily communication with our loan officer to provided requested documents immediately. we have been asked to write letters explaining our reason to move, our plans to sell our current home, travel plans for myself, property information for my families home, and many other documents. All were provided within 24 hours of the request. At no time were we informed of ANY possibility of the loan being denied. two weeks ago, my husband was asked to provide documentation of a date of his retirement. He had previously planned to retire at the end of XXXX, but moved the date forward to XXXX XXXX to satisfy the request from XXXX XXXX. Last week, we were notified of contingent approval from underwriters pending a letter from me again explaining my employment plans, a copy of my Power of Attorney for my family property, tax and insurance information for that property. Again at no time were we informed of any possibility of denial of this loan. Four days prior to closing, we were contacted telephonically by XXXX XXXX of denial of our loan by the underwriter based on criteria that is unacceptable. The reason stated was unable to approve the loan based on my husbands social security/veterans income solely. My income ( XXXX annually ) was could not be included in the loan as I had not proven local employment, and my current employment was " uncertain. '' I reminded them of our impending expectation to close the loan, utilities already under deposit, and asked for our recourse. The reply was there is no recourse, the denial was final. At no time during this process over the past six weeks has there ever been a discussion of the possibility of denial based on local employment, and there was NEVER information provided as a mandatory expectation of VA loans to validate local employment. Initially, I asked to use my husbands current salary of social security/VA benefits/and salary of XXXX annually to qualify, but was instructed to remove his employer salary as he had planned to retire. he has now given a notice of retirement to his employer, so we will now be without his salary as well. The loan would have been approved had we included his salary in its entirety, but now have no recourse to resurrect this loan. My employment is far from uncertain, and at no time did we mislead anyone at XXXX XXXX. I was asked to write numerous letters explaining my plan as a " trailing spouse '' and compiled letters exactly as I was directed by the loan officer. Again, we have never been informed of the requirement of VA loans to provide evidence of local employment. Currently we will lose our earnest money, cost of VA appraisal, cost of inspections, cost of utilities deposits, cost of home insurance, my husbands salary, and the cost to apply for a loan with another lender without VA mortgages. Our total potential loss is greater than XXXX if cash outlay, and have no recourse. We also could lose the home to another buyer if no alternate mortgage is available to us in a timely manner. XXXX XXXX XXXX XXXX is a very large company with what seems positive reviews from buyers. Our experience has been completely different. I am pursuing options to file an official grievance, attempt to recover financial losses, and actively locate a lender who is interested in working with us.
