Closing on a mortgage

Mortgage: VA mortgage

Complaint: We were denied a VA loan through Veterans United after making several payments well into the process. The reason given for the denial was the distance between my job and the house. I contend that it was known where I worked and also where I was looking for a home early enough by VU to advise me on a proper course. This is my first attempt at buying a house, and I think in the history of home loans I am not the first to move from one job to one closer to home. I was asked when I received the first pre approval letter, where the house was and stated XXXX WA. The loan Officer had all of my information, such as mailing address and the address of my job, but the question didn't come up until very late in the process. Payments for earnest money ( XXXX ), home inspection ( XXXX ), water quality inspection ( XXXX ) not to mention the cost of trips to the area that were in excess of XXXX. All through the process I shared what houses we were looking at and where they were located. Pictures and addresses were sent to the officers for their opinion. When I was finally asked about the distance, I informed them that it wouldn't be a problem for me, VU had me write a letter explaining how I planned to handle traveling to and from work, I did that and was told it wasn't good enough and that in the letter i stated i would be getting another job. It was confusing, on one hand I'm not supposed to change jobs and then I have to have a job closer. We got to within a VA appraisal of getting the house, almost like a child being born, only to have our Hopes and dreams dashed. Not only do we not have a house, but the owners of the house we wanted refuse to release the earnest money and the only way to get it back is to arbitrate or sue for contact breach. We would have moved closer and found employment if we knew this would be the outcome. I also contacted VU with my concerns and was informed the company is not responsible for the money we put out, but it would not have happened if we were told this from the beginning.

Struggling to pay mortgage

Mortgage: VA mortgage

Complaint: To whom it may concern : Please see a copy of our latest hardship letter, attached below, to the bank without our identifying information as your site indicates. Synopsis of our situation : Essentially after an acute medical crisis and related loss of employment in XX/XX/XXXX, I contacted the bank, Veterans United Home Loans ( VUHL ) and inquired about either a reinstatement, loss mitigation, and or a modification per their advice. They subsequently began directing us to submit information including medical documentation, financial / income information, and hardship letters. We complied with all requests and indicated we were able to begin paying the mortgage. We were repeatedly asked to submit additional and essentially duplicate pieces of information which has dragged out the process. We were denied a modification for their erroneously computing our income, stating that the hardship was no longer applicable as I was recovering, and that the terms of the loan could not be met with a modification. They have also failed to consider our reduced taxes following the awarding of Homestead exemptions amounting to a 50 % tax reduction as well as the possible effects of market interest rate reduction. VUHL later indicated we were not eligible for a modification because following hurricane Irma in XX/XX/XXXX which affected our area, we accepted an offer of a three-month modification from VUHL. VUHL indicated that thus precluded us from a new modification. If we had known that we would never have accepted that original offer. VUHL should have indicated that from the beginning and we would have paid the original reinstatement instead of waiting and hoping for a modification. Of note, VUHLs associated fees, including lawyer and late fees have also unnecessarily affected any reinstatement amount. We have been currently waiting for over a week for the latest reinstatement amount from VUHLs attorneys office as we are trying to accrue that amount. Also, of note, we recently offered to pay a good faith {$5000.00} payment pending a modification as well as offered to accelerate the monthly payments in order to bring the arrears up to date within about a year. We have also continued to pay our monthly homeowner association fees. We believe this issue has been delayed by their inefficient, overly bureaucratic, and incompetent system as evidenced by their repeated requests for duplicate information. We have been dealing with multiple individuals who have seemed not to readily have all the pertinent information at hand. We appreciate the importance of maintaining a contract but consider their handling of our efforts to solve the arrears as possibly approaching maleficence, discrimination against two senior citizens including a veteran, and a convoluted effort to simply attain the property for a quick resell profit. We can submit copies of all correspondence, email communications, and pertinent documents pending your request. We are also considering contacting our elected representatives for guidance. Please note we have a court hearing on XXXX here in Florida for a judgement. We look forward to any assistance or guidance your office may offer and thank you for your time and consideration of our situation. Sincerely, Mr. and Mrs. XXXX.

Improper use of your report

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Reporting company used your report improperly
Complaint: Veteran 's United Home Loans based out of XXXX, MO pulled my credit report without my authorization. My husband had been working with them on a pre-qualification. I was not involved in any of their previous discussions. I did not authorize them to pull my credit report. When I called on XX/XX/XXXX to inquire as to why they did pull my credit several people were conveniently " unavailable '' to talk with me. On XX/XX/XXXX a person named " XXXX '' from the " Production Management Team '' returned a call to discuss inquiry from XX/XX/XXXX. When I was able to speak with XXXX he informed me that my husband had filled out the online application and had given them permission to work toward a pre-qualification. When I contested his authority and my husband 's authority to grant permission to accessing my financial information his response was, " Your husband is allowed to grant us permission because you are legally married and he has that authority. '' Last time I check, this was not XX/XX/XXXX and I have my own rights independent of my husband and I am the only person who can grant anyone else access to my personal, identifiable information such as social security, HIPPA, etc. This includes access to my credit report. Veteran 's United Home Loans infringed upon my personal rights by accessing my financial information without MY express consent. The fact that I am married has no relevance in them not seeking my permission. I was not in contact with them during any point of my husband 's attempt to pre-qualify for a loan.

Closing on a mortgage

Mortgage: VA mortgage

Complaint: Started the Streamline ( IRRRL ) VA Loan Refinance Process on XXXX with Veterans United Home Loans. Received an initial loan estimate and then we provided documents the company required. As time went on we kept getting new Loan Estimates which kept increasing the amount we would be financing. When we questioned why the costs of processing the loan kept increasing we were never given an honest answer and all the companies reps said " We are trying very hard to find the lowest cost for you ''. The initial loan estimate was for {$180000.00} and the most recent loan estimate we received was for {$180000.00}. {$180000.00} is {$10000.00} more than what we owe on our mortgage which is {$170000.00} and this would take at least 10 years to recoup which then makes no sense to refinance when one has to pay these extremely high closing costs. This {$10000.00} amount is more than we paid when we purchased the home which makes no sense. So when we talked to several other VA Authorized Mortgage lenders they all said we should only pay from {$4500.00} to {$5000.00} in total closing costs and no where near the {$10000.00} that Veterans United Home Loans wanted. So we pulled our application with Veterans Home Loans due to the apparent fraudulent behavior they begin exhibiting after more than 40 days of the closing process. We have submitted the Loan Estimate documents we received over this 40 day period of time from Veterans United Home Loans showing how each time the amount to be financed kept increasing for absolutely no reason. We also paid for a Full Appraisal out of our pocket and then found out only an Outside ( Drive by ) appraisal was done and we said we needed to be reimbursed the difference since an outside appraisal is less costly than a full appraisal and were told repeatedly they would look into it but we never got a reimbursement for the difference or explanation whatsoever. We will use another company to do the streamline refinance and hope our complaint helps other Vets so they are not Ripped Off by unscrupulous lenders.

Applying for a mortgage or refinancing an existing mortgage

Mortgage: VA mortgage

Complaint: We are purchasing a home after a PCS move. We had used Veterans United ( VU ) with our previous home purchase and were pleased with our agent ( XXXX XXXX ). Our real estate agent advised us that with her referral, the appraisal would be complimentary. She referred us erroneously to the wrong XXXX @ VU ; that XXXX recommended we use the XXXX we were comfortable with and that as his repeat customers, we would also be given a complimentary appraisal, which I confirmed with XXXX XXXX ( XXXX ) and have in writing with no other stipulations as to offer restrictions. I spoke with XXXX on the phone to inquire as to whether or not our down payment would affect our interest rate or anything, and he said it would not. Our real estate agent put together the offer, which was accepted and we forwarded the agreement to XXXX to prepare the Loan Estimate ( LE ). XXXX meanwhile sent us 2 forms for signatures which had outdated information such as our previous residence addresses, income, and expenditures that was from our previous loan file 6 years previously. When I expressed concern over this, he replied that I shouldn't worry about it, just sign it, it wouldn't have an affect on our loan decision, etc. I also pointed out that the form indicated that he had collected the information from us via phone interview, which did not happen. He replied that he had instead just used the information from our previous file because he thought we were in a hurry - at the time, I had not started my new job and was available around the clock and my husband ( XXXX XXXX sponsor ) was easily reachable at work. He again assured me not to worry about it and just to sign and that moving forward, forms we received would be accurate. I received the LE and was shocked to see the funding fee was over $ XXXX along with a fee for the appraisal and an origination fee of $ XXXX. I emailed XXXX to ask about the funding fee significantly higher than I was expecting, but also did some research while I was awaiting his reply and found that the funding fee is 3.3 % for <5 % down payment, while 5 % drops the funding fee to 1.5 %. I was irritated that he did not disclose this when I asked how the down payment would affect our loan, as I had explained to him we have a flexible amount to put down. We had decided to put down a little more than the minimum, which was 25 % of the amount of the purchase price over the VA maximum, which we rounded up to $ XXXX. It turns out that was 4.4 % of the total amount of the loan and putting down just {$3400.00} more would save us about $ XXXX on the funding fee. XXXX replied to me confirming this the following day and also explained that the appraisal fee would be waived in the lender credit, but would look like a fee on the LE. We had received yet another document to sign that had incorrect information and discrepancies between the information XXXX and I shared, such as previous residence addresses and phone numbers, etc. I informed XXXX that his lack of attention to detail was a concern for us and that while it may not ultimately matter in the decision, the details did in fact matter to us and that I did not want to see or sign another form with inaccurate info and that I felt like he didn't have our backs by not disclosing the information about the fee savings with a very small additional amount applied to the down payment, especially considering I had asked about it on the phone and told him we were flexible and could actually put down the entire amount of overage, if it made a difference - I explained that I wasn't sure we wanted to continue with the loan with VU. So we put our application with VU on hold due to loss of confidence while we shopped for other lenders. We found a lender offering a better interest rate and APR with no points and no origination fee and asked XXXX if he could meet that offer. He asked for a copy of the LE from the other lender and said that he would ask his manager. He called back to tell my husband the same thing about the funding fee and ignored the other requests. My husband asked him again about matching the other lender 's rates and he said he'd follow up again. We were trying to keep things simple because we were already 10+ days into our closing period but were still reluctant in considering moving forward with VU. Our VU online account showed that the appraisal would occur once our home inspection was completed and that they would call us to request payment. Our home inspection was scheduled 1.5 weeks in advance with a date of XX/XX/19. Unbeknownst to us, XXXX had scheduled the appraisal to occur on XX/XX/19, before our inspection - we only found out about it having happened from our agent in the days following the appraisal and in fact asked her several times if she was certain because it still showed on our VU online account that it had not yet been performed. While we were still waiting to hear back from ZG, we received a notice from VU after 3 days that our application had been closed due to inactivity. We had found another lender with more competitive rates who said he would most likely be able to meet our original closing date and elected to move forward with that lender. The new lending agent asked us to contact VU to have them transfer the appraisal, to which they agreed if we would sign an Intent to Proceed ( ITP ) and pay for the appraisal. We agreed to pay for the appraisal, against what we had originally be told about it being no charge, in order that the transfer could be expedited. VU sent us the ITP and told XXXX on the phone that it was illegal for them to release the appraisal without us paying for it. XXXX again told them he would pay for it, but we would not retroactively sign the ITP because 2 of the statements that our signatures would certify as truthful were in fact false ( we did NOT verbally express intent to continue with the loan and we WERE charged a fee prior to signing the ITP : the fee for the appraisal they are currently trying to collect ) and the form specifically stated in capital letters that we should NOT sign the form unless we intend to proceed with the loan represented by the LE. I asked XXXX to provide me with a copy of the law that required payment prior to releasing the appraisal as well as a copy of our authorization to proceed with the appraisal, both of which we ignored. We went back and forth regarding this and a VU agent ( XXXX XXXX ) told me that they could NOT accept payment unless we signed the ITP and they 100 % would not transfer the appraisal without payment. XXXX sent our real estate agent and email threatening to send us to collections if we didn't sign the ITP and pay for the appraisal. I contacted the VA via phone and was told that VU were not following VA policies, that they were behaving poorly, and for us not to sign the ITP or pay for the appraisal, but instead to have our new lending agent forward the email from VU stating that they wouldn't release the appraisal without the ITP/payment. The next day, the appraisal had been transferred to our new lender, however XXXX from VU sent our real estate agent another email today which threatened to send us to collections TODAY if we didn't sign the ITP and pay. When my husband found out, he contacted XXXX via email and asked that he stop speaking with our real estate agent instead of contacting us and to send an invoice for us to make the payment, but also that the VA had instructed us not to pay. The next email from XXXX stated that it was now out of his hands because I had previously refused to sign the ITP. We did NOT consent to them providing the appraisal because we did NOT express intent to proceed with the loan, in fact exactly the opposite when I told XXXX we weren't sure we wanted to continue after receiving ( but not signing ) the LE. We were told the appraisal was complimentary. We did not sign anything authorizing VU to incur fees on our behalf or pass those fees on to us. VU has not provided us with any invoice for fees due to them, nor given us an opportunity to pay them without additional contingencies which force us to sign inaccurate forms. VU has not communicated to us that we may be sent to debt collectors ( they have instead sent these threats only to our agent, which she relayed to us ), it has only been 13 days since VU supposedly incurred this fee on our behalf. VU is aware we are 13 days away from closing on our loans and I believe making these threats to scare us into signing the ITP retroactively and forcing us to pay a fee for this 'complimentary service ' under duress. We have written email documentation of all conversations and claims with exception to those noted specifically as phone conversations - I would also like to note that the VU lending agents requested and made contact from their cell phones, I suspect to avoid audio recording and " paper '' trails.

Complaint: To Whom It May Concern : We recently sold a house. Our settlement was supposed to have been XX/XX/XXXX but due to the gross negligence of the mortgage lender for the buyer of our house, our settlement ended up being pushed to XX/XX/XXXX. We did not become aware of the need to push the settlement one day until the afternoon of XX/XX/XXXX. Because of this last minute change, we incurred substantial out of pocket expenses totaling {$840.00} ( boarding charges for pets, storage of items on moving trucks, lost wages, and costs for temporary internet coverage to support home based business ). It came to our attention that the mortgage lender had the wrong settlement date in the file which caused this delay. I reached out to the mortgage lender on XX/XX/XXXX asking for reimbursement of these expenses but he is denying responsibility. Our real estate agents were assured Tuesday XX/XX/XXXX afternoon everything was on track and that they were only missing a couple pieces of information. It was not until noon on XX/XX/XXXX that my real estate agents finally called XXXX after not hearing from him and he informed them that settlement was being pushed a day. The mortgage lender that worked on this file was XXXX XXXX.

Complaint: On XX/XX/XXXX I applied for a mortgage with XXXX XXXX XXXX XXXX. Initially on XXXX I told XXXX XXXX Loan Officer with XXXX XXXX XXXX XXXX that I was having a dispute with my current landlord XXXX XXXX XXXX XXXX and that they were trying to evict me because I would not use their third-party utility service provider and pay extra fees. He ran my credit and said that I would need a credit score of XXXX at, at least two of the bureaus and XXXX XXXX would give me a loan. One thing for certain I do not owe XXXX XXXX XXXX XXXX any money, that was clear on the order that the money matter was dismissed. If they want the money they must go before a judge and provide proof that I had violated the terms of the lease as of XX/XX/XXXX when they said they were going to proceed with the eviction notice per the expiration of the 10-day notice. When looking at my credit report XXXX XXXX said that I needed to pay off two accounts, XXXX XXXX which turned into XXXX XXXX, XXXX and get a secured credit. That would boost my score quickly. Fortunately, by taking care of a few small issues I was able to boost my credit score to over XXXX. On XX/XX/XXXX I sent XXXX XXXX with XXXX XXXX XXXX a text to let her know that my scores had gone up. She wanted to know if I wanted her to run a hard check with all three bureaus and I told her yes. She did so and on XX/XX/XXXX she sent me an email stating the following : Hi XXXX, I am excited to inform you that your Loan Officer, XXXX XXXX, or another member of our team will review your updated file and credit scores and will be in contact soon. It is likely that I will no longer be your primary point of contact after today, but youre always welcome to reach out if you have a question or need anything in the future. Additionally, if you know anyone else who could use my services, please dont hesitate to pass along my name and number. Best of luck and its been a pleasure working with you! Thank you very much, On XX/XX/XXXX XXXX XXXX XXXX XXXX received information on my credit via a credit report detailing all my outstanding debts. I am certain that all looked good enough for them to proceed because on XX/XX/XXXX I received an email from XXXX XXXX asking me to create an account and he provided me with the links to go onto their portal to do so. He also requested verification of my rent on XX/XX/XXXX making them aware that XXXX XXXX XXXX XXXX was claiming that I owed them this back rent or that the rent was late however, they continued to process my loan anyway. Later that same day I received another email from XXXX asking me to provide information via a loan to do list. Later still that day I received another email from XXXX stating lets get you preapproved. I was preapproved and went about the business of locating a house. I subsequently went through several preapprovals until I finally found the right property for me and my family. When speaking with XXXX XXXX on XX/XX/XXXX about providing him with my gold portfolio he mentioned that I needed to provide a steady payment history. He asked me if I had any utility bills in my name and I stated to him that I did not because XXXX XXXX XXXX XXXX threatened to evict me if I did. I told him that I didnt have a rental History in the past 12 months because I had been living with my daughter in XXXX because of my XXXX. I then told him that I had been paying a monthly membership fee to XXXX XXXX XXXX for several years and he did not respond to that at all. I also provided XXXX with a rental history from XXXX XXXX XXXX XXXX Il XXXX. Even though it was not the latest rental history, it was a rental history that showed I pay my rent-on time each month. In any event it was a solid and sound payment history. However, they refused to use that information and relied solely on information provided by XXXX XXXX XXXX XXXX to deny me my loan. In VA Pamphlet 26-7, Revised Chapter 4 : VA guidelines for credit underwriting ; 4-40 paragraph c. how to analyze credit it states as follows : The applicants past repayment practices on obligations are the best indicator of his or her willingness to repay future obligations. Emphasis should be on the applicants overall payment patterns rather that isolated occurrences of unsatisfactory repayment. Determine whether the applicant ( and spouse, if applicable ) is a satisfactory credit risk based on a careful analysis of the credit report and other credit data. XXXX XXXX XXXX XXXX was a landlord tenant dispute and does not show that I do not pay my rent it shows that there is a dispute. In a denial letter sent to me dated XX/XX/XXXX it states that XXXX XXXX XXXX decision to deny me credit was based on delinquent past or present obligations with others. It also stated in the letter that they used information to obtain a credit score from XXXX on XX/XX/XXXX and I had a credit score of XXXX which was above the XXXX I needed to qualify for a VA loan. They also added that I had derogatory public records or collections on file, lack of recent revolving account information, lack of recent bank/national revolving information and length of time since derogatory public record or collection is too short. All the information on my credit file representatives at XXXX XXXX XXXX XXXX knew before they started the loan process, yet they continued to lead me to believe that I was getting the loan. For the last five years I have been paying on a membership financed through XXXX XXXX XXXX for {$110.00} a month. That membership is financed by XXXX and interest is paid in accordance. Although they dont report it to a credit bureau, I believe that would qualify as a recent revolving account. I have also been paying a membership fee of {$160.00} to XXXX XXXX XXXX XXXX for four months and my car insurance of {$130.00} for five months, both of which would be a revolving account. Also, even though XXXX XXXX XXXX XXXX is saying that I owe them back rent you representatives at XXXX XXXX XXXX XXXX was aware that there was a court order that says the money matter was dismissed so I dont owe XXXX XXXX XXXX XXXX any money. They are also aware that I had been paying my rent to XXXX XXXX XXXX XXXX on time. The problem came when I was sent an eviction notice saying they were going to proceed with eviction procedures per the expiration of the 10-day notice for failure to pay utilities in accordance with the lease. That is considered retaliation in a court of law especially when the lease gave me the right to use my own utility company. I sent XXXX a copy of the lease, so he is aware of my rights under the lease. I also sent him a copy of the email where XXXX XXXX Senior property manager for XXXX XXXX XXXX XXXX stated that they were going to proceed with the eviction procedure per expiration of the 10-day notice. Not at any point and time did XXXX XXXX XXXX XXXX ever send me an eviction notice for failure to pay rent. I dont think that the fact that I didnt have a credit card should have caused me any issues since I would not want a high debt to income ratio. As an economist doing research, evidence from studies of mortgage loans suggest that borrowers with a higher debt-to-income ratio are more likely to run into trouble making monthly payments. So why would I want to keep adding accounts, so I can fail? As far as outstanding debts I was told by XXXX XXXX to pay off XXXX and XXXX XXXX which I did on XX/XX/XXXX. I acquired a secured credit card at the request of XXXX XXXX XXXX XXXX officers. However, the plan was to get one anyway not because I wanted to boost my credit but because it makes it easier to rent cars. On XX/XX/XXXX XXXX XXXX XXXX XXXX sent me an email stating they were ordering an appraisal on the property at XXXX XXXX XXXX XXXX XXXX, Il XXXX even though they already knew all the issues with my credit and XXXX XXXX XXXX XXXX they proceeded on leading me to believe that I would get my home financed. If those issues were that serious the time for them to stop the loan process was on XX/XX/XXXX when they first found out about XXXX XXXX XXXX XXXX claiming that I was late on my rent. However, there was no issue until I sent in my identification and they realized I was a XXXX year old XXXX XXXX Male. On XX/XX/XXXX three weeks after XXXX knew that I was having an issue with my landlord he finally called and left me a message asking me about the late rent. When I called him on the XXXX of XXXX I told him that I would call him on Tuesday the XXXX of XXXX and explain to him about the late rent because I was unaware at the time that XXXX XXXX XXXX XXXX was reporting my rent as being late. When I called XXXX on the XXXX I was with XXXX XXXX with the Department of Veterans Affairs, and I attempted to explain to him what happened. XXXX said he just needed to try to explain it to the underwriter to try to help me get the loan approved but that is was the underwriter that had the last word. In any event XXXX XXXX XXXX XXXX allowed the appraisal to go through even though they already knew they were denying me the loan. They also kept leading me to believe that I was going to get the loan. As it stands right now XXXX XXXX XXXX XXXX Has caused severe injury and emotion trauma to me and may cause me to lose my house because of their discriminative practices.
