Complaint: On XXXX XXXX, 2017 Midwest Recovery Systems placed a opened collection on my credit report for a Debt owed to XXXX XXXX XXXX XXXX. I have not been contacted by Midwest Recovery Systems regarding the collection. To my best knowledge the company they claim I owe the debt too is no longer in business per the BBB website and was a non licensed payday loan company. I have never taken out a payday loan with this or any company. My credit report shows that owe them {$860.00}. I have tried to find contact information for XXXX XXXX and have not been able to locate it. My main concern is why did Midwest Recovery Systems place this on my credit report in the first place? From a company, that in all my research, seems to be a unlicensed closed business?

I am unaware of this creditor and have not received anything that pertains to this debt. This account is unverified and immediately needs to be deleted from my all credit files : XXXX XXXX and XXXX.

Complaint: On XXXX/17 I received an alert that a new collection was placed on my account. I called Midwest Recovery Systems. I informed them I never applied for a payday loan and I never received written notification of this debt from them. The customer service representative was rude and informed me that they did not have to give me written notification of anything. I have never done business with Midwest Recovery Systems. I do not have a signed contract with Midwest Recovery Systems. I have a right to demand that Midwest Recovery Systems furnish the signed contract between them and myself. This business did not give me written notice of the debt before placing it on my credit report with all three bureaus. Also this company is not licensed in the state of Tennessee. I would like this unfounded and unvalidated debt removed form my credit report. Per Tennessee Code TFDCPA 62-20-101 ( short title ) and 105 thru 127, Tenn Law emphatically states that " a collection service can not commence or conduct the business of collecting debts in Tenn without being so licensed and bonded as well as maintaining a " location manager '' who in turn is required to be licensed and bonded. in the State of Tennessee. Complaint: I disputed this collection account with all XXXX credit bureaus multiple times the latest date being XXXXXX/XX/XXXX. I have a collection account for the amount of {$770.00} showing on both my XXXX as well as my XXXX credit reports. XXXX removed the collection because this account violated FDCPA Section 807 ( 8 ) ( this law is for collection agencies ) 807. False or misleading representations [ 15 USC 1692e ] ( 8 ) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed. This debt is also in violation of Section 392.101 of Texas XXXX XXXX which prohibits a third-party debt collector from engaging in debt collection in Texas unless the third-party debt collector has obtained a XXXX bond and filed a copy of the bond with the XXXX XXXX XXXX XXXX of State. Furthermore, Sec. XXXX92.301 ( a ) ( 4 ) of Texas Finance Code Prohibits threatening to sell or assign to another the obligation of the consumer and falsely representing that the result of the sale or assignment would be that the consumer would lose a defense to the Consumer debt or would be subject to illegal collection attempts.as well as the Deceptive Trade Practices-Consumer Protection Act. I have filed a complaint, see attached, with the Texas XXXX XXXX XXXX XXXX XXXX as well and I request the immediate removal of this trade line from all XXXX credit bureaus as you and the original creditor have violated the aforementioned laws.
This debt has been removed and reinserted multiple times on my reports.
Please also be aware that any negative mark found on my credit reports ( including XXXX, XXXX and XXXX ) from your company or any company that you represent, for a debt that I dont owe, is a violation of the FCRA & FDCPA ; therefore if you can not validate the debt, you must request that all credit reporting agencies delete the entry. Pending the outcome of my investigation of any evidence that you submit, you are instructed to take no action that could be detrimental to any of my credit reports. Failure to respond to this complaint may result in small claims legal action against your company at my local venue.

Complaint: On XX/XX/XXXX, I sent certified documentation to Midwest Recovery Systems proving that I did not owe three collection amounts that they sent and repeatedly update to the credit reporting agencies. These medical bills were covered under charity care and I sent MRS letters from the hospital. I also sent this to the junk debt company before MRS -- XXXX -- and they deleted the information immediately. Although my letters were received by MRS , they choose to blatantly ignore me and FCRA laws and continue to harm my credit profile with impunity. They 've also re-aged ( dates are from XX/XX/XXXX, not XX/XX/XXXX ) and re-inserted illegally. The amounts in question are : {$37.00}, {$65.00}, and {$1000.00} ( originally only two accounts that they broke up into three to their benefit ) from XXXX XXXX XXXX which is associated with XXXX XXXX XXXX XXXX as indicated on the letters. Before I 'm forced to go to small claims court, I 'd like CFPB to step in. Thank you.

Complaint: I am not understanding why this collection is still on my XXXX report! Midwest has said three times they sent a request to remove yet it is still on my report. See their below responnse : We have followed our dispute policy and have n't had any further communication with the consumer. No future follow up is planned. Our dispute policy is once we have received a dispute we immediately stop all collection efforts and send a record of dispute to all three credit reporting agencies. Then we request validation of the debt from our client and once that is received we forward that on to the consumer for review. If validation is unobtainable then we immediately send a record for deletion to all three credit reporting agencies and then close and return the account to our client. Additionally, in this instance a record for deletion has been sent to all three credit reporting agencies.
I want this fraud trade removed from XXXX ASAP or I will seek damages as allowed under the FCRA.

Complaint: On XX/XX/XXXX, I got a notification from XXXX XXXX that there were three derogatory marks on my credit file. All three were from XXXX XXXX XXXX, one for {$1200.00} and two for {$270.00}. The company said XXXX. I have never heard of this company. I called the number and stated I did not owe this money and requested they send me a validation of debt. I never received anything. The {$1200.00} report says I have paid -25 % ( overpaid? ) of the debt ( {$1000.00} ) and the two {$270.00} reports say I have paid 73 % of the debt ( {$1000.00} ). I submitted a dispute with XXXX and XXXX. XXXX deleted all three collections from my report. XXXX also deleted them, but all three were back onXX/XX/XXXX. I would like these marks deleted from all of my credit files as I do not own them, I never received a validation of debt, nor did I get any notification prior to them showing up on my report.
