Complaint: We took out a second mortgage for XXXX for a 15 year loan in 2006 with XXXX XXXX XXXX who sold it to XXXX who sold it to Franklin Credit managment. The initial interest rate was 13.9 %. I made payments for 3 years the Principal stayed at XXXX. I had no contact from this company for 6 years. After 6 years they contacted me 6 months ago saying I had to pay XXXX in back payments or they would foreclose. They then hired The XXXX who put a Notice of Foreclosure on my house. This is a predatory loan. The loan amount never went down. The loan was for 15 years. We will pay them a total so far of the XXXX + the XXXX which will = XXXX.

Complaint: My name is XXXX XXXX ; i am a widow ; semi-retired from XXXX. The FCM bought out my XXXX mortgage a few years ago and placed a lien on my property. I have been trying to settle this since then. It is almost upsetting how they kept on asking me to counter offer against their offer of {$31000.00}, but never mentioned about the expiration date -- XXXX. Had I known that there was an expiration date on their offer, I would have made far better decision. I did not have a regular income, so I was trying to see if I could lower the final amount to borrow lower than {$31000.00}. I felt very angry at their deceit -- not ethical at all. Now I have to appeal this to see if I can settle this once for all, which has been my heart desire ; they just sent me 'Notice of Default and Intent to Accelerate ' to me last week. I had filed chapter XXXX in XX/XX/XXXX, I need clarification on page XXXX where they said, ''To the extent your obligation has been discharged or is subject to the automatic stay in a bankruptcy case, this notice is for informational purposes only and does not constitute a demand for payment or an attempt to collect a debt as your personal obligation. ' I am totally confused ; they said this debt was excused ; then, they would like to accelerate?. If you can help me settle this with their initial amount for me since they were deceitful, I would greatly appreciate it. I have XXXX different licenses -- XXXX ; each ethics class I had taken for these, they emphasized how important it was to inform your customers with all important facts to help them make a better financial decision. Their hiding this fact until after the fact seems to me pretty unethical almost like a criminal act ; consequently, I am appealing this to you to see if you can help. XXXX XXXX and a XXXX! Complaint: I have a loan modification loan for the past 2 or 3 years and i was told that it has taken care of the second on the loan also. i have not seen any negative statements on my credit file concerning this matter. Now i have been sent a letter o notice of default and intent to accelerate against me on my home. it says total payments due for 87 months XX/XX/2008. the principle is XXXX and interest is XXXXlate charges XXXX. I have no idea about any of this claim. all i know is that i had a loan modification and only XXXX bill to pay because it was taken care of by the loan modification.

Complaint: A letter was sent via certified mail to Franklin Credit Management Corporation regarding an amount owed. This debt represents fraud, unjust enrichment, breach of contract, violations of Civil Code Sections 2924, the Business and Professions Code Sections 17200 and Fair Debt Collections Practices Act, by failing to serve proper notice of default, claiming excessive amounts due are owed, and failing to provide supporting documents. as requested XXXX XXXX, 2015. A XXXX Certified Letter was sent on XXXX XXXX, specifically despite previous letters sent on XXXX XXXX. The XXXX representing Franklin Credit Management Corporation, failed to respond to said dispute letter and continues to illegally engage in harassment, fraud, unjust enrichment, breach of contract, violations of Civil Code Sections 2924. et seq,, the Business and Professions Code Sections 17200, et seq., and the Fair Debt Collections Practices Act, by failing to serve proper notice of default, claiming excessive amounts are owed, and failing to provide documents. NO assistance was offered and not effort was made in compliance with California Civil Code Section 2923.5 ( e ) to contact the borrower to discuss the borrower 's financial situation and to explore options for the borrower to avoid foreclosure.

Complaint: COMPLAINT # XXXXAfter request for help from XXXX CFPB sent XXXX notice of complaint as per CFPB letter dated XX/XX/XXXX. I have been working with XXXX to settle with Franklin Credit Management XXXX XXXX Lien Holder ) so that a Deed-In-Lieu can be accepted on my property at XXXX XXXX XXXX XXXX, NC XXXX. XX/XX/XXXX - XXXX informs me that on XX/XX/XXXX they sent a fax to Franklin Credit an offer to settle. Today I called XXXX credit to verify that they had received the offer and they claim that no offer has been received. Fax number sent was XXXX. I requested that XXXX send another fax with the offer to Fax # XXXX XXXX - XXXX ( Franklin Credit XXXX. Foreclosure hearing is on the XX/XX/XXXX. This will be the 4th Court Hearing! Both, XXXX and Franklin Credit call me almost daily, even today. I have given them all the information they requested to do a Deed-In-Lieu. Unfortunately, Franklin Credit does not seem to cooperate with XXXX and resolve the settlement so that there will be a clear title. This new complaint is directed in reference to Franklin Credit Management. The record should show XXXX recorded conversations ) well over 100 conversations concerning my account and no resolution in site. I ask that CFPB send a letter to Franklin Credit to work out a settlement so that a Deed-In-Lieu can proceed. Information on the account with Franklin Credit Management is as follows : Account XXXXFranklin Credit Management CorporationXXXX XXXX NJ XXXX XXXX have been trying to settle with Franklin since XX/XX/XXXX. The customer service is absolutely unacceptable. Last 3 way conversation with Franklin Credit, XXXX, and I this month, should have cleared any obstacles yet it has not! Someone is not telling the truth and I am to the point where I have no choice but to walk away. My personal finances are in a critical status and I do not know what to do.
