On XX/XX/2019 I received an email from Faye Servicing HR representative, XXXX XXXX that said the following, " Hi XXXX, sorry for the delay I had to confirmed a couple of things. Unfortunately we will not be moving forward due to some of the results in your background check. You will be receiving an email from XXXX in regards to our decision, a copy of your report and some options available to you as well. As of today I still have not received the report or had an opportunity to review what was reported about me.

Complaint: My husband and I filed chapter XXXX in XXXX that included 3 mortgage payments. At that time, XXXX XXXX XXXX held our mortgage. All payments after filing were paid to them. They sold our mortgage to XXXX XXXX XXXX XX/XX/XXXX, which payments were then paid to them each month. XXXX XXXX XXXX sold our mortgage to XXXX XXXX XX/XX/XXXX. As we neared the discharge of our bankruptcy because everything was paid back, XXXX XXXX contacted our attorney and told them we were behind on our mortgage - 9 payments. I sent payment information of each payment to our attorney to prove they were paid. XXXX XXXX still argued there were payments missing. They sent us modification paperwork to fill out and we did to keep them from doing anything like trying to forclose on our house. Continually making payments that at one time were in excess of {$1100.00} per month when our payments were only supposed to be {$760.00} per month. We received a letter XX/XX/XXXX stating they had sold our mortgage to Fay Servicing who is still saying we are behind 4 payments. My husband and I have both contacted them being told we need to speak with our account manager XXXX XXXX - yet neither of us have been able to speak with him because he is always on another line. I have emailed him 63 pages of proof of payments and still we can not get through to talk to him. My husband asked to speak with his supervisor - named XXXX - and was told he was not available either. We are in the process of selling our house and do not want the {$3000.00} dollars we DONT owe them to be taken during the closing. We have also requested a payoff which we have yet to receive. We have left several messages for XXXX and XXXX and have not received any calls back. Please help!!!

Complaint: I had gotten behind on my payments & on the 4th month had to make a large payment or was threatened with foreclosure. I made the minimum payment and subsequently have been making an effort to catch up. On XX/XX/19 I called the online payment center & made 2 payments - my jobs do direct deposit to 2 different banks - so I made a {$120.00} payment from one & a {$1500.00} payment from the other. Each was received the same as usual & I was given confirmation # 's for each. A week into XX/XX/XXXX I received FOUR correspondence letters from Fay Servicing stating my mortgage was in default. Upon calling I was told I could not make 2 payments in one day and the larger payment was not accepted. Not only was I not notified upon submitted the payments but Fay accepted the very small payment over the large one that would have kept my account in good standing. The rep refused to reverse any late payments though she knew I actually made the payment before the end of the month. I was also notified that I had been reported to credit agencies for nonpayment. Fay has also raised my payment as much as {$100.00} a month over the original loan amount & I'm suspecting hidden fees. As a struggling consumer I feel I'm harassed as though Fay wants me to relinquish my home!

Complaint: In response to Fay Servicing XXXX, please accept this additional complaint. 1- Process to attempt to modify : Clearly, your response validates that your process is broken, as it shows that I had to submit several applications, plus engage legal counsel in order to process a loan modification. Your response failed to mention that my case was reassigned numerous times to different representative and the overall process has taken over a year. In response to Fay Servicings comments on the mitigation loss process : XX/XX/XXXX Fay Servicing closed the home loan modification application abruptly. Fay servicing was not responsive. Their delayed response caused the application to expire. The account manager assigned was XXXX XXXX. XX/XX/XXXX We experience no difference during the second application for a loan modification. I can certify that all documentation was submitted in time, but Fay servicing lack of response causes the 2nd application to expire. Ive tried to reach fay servicing multiple times during both applications and was not able to get a clear answer to why my documents were not accepted. The new account manager assigned was XXXX XXXX. After the 2 failed attempts to get a loan modification, we decided to seek help with an attorney. On XX/XX/XXXX, the 3rd attempt to apply for a loan modification and reinstate the load was also not successful. The legal consul, who is experienced in dealing with loan modification, also experiences my pain from the 2 previous attempts. The application was closed due to missing documentation, which I started to believe is a tactic to delay the process. ( Based on the previous responses ) On XX/XX/XXXX, our 4th attempt to apply for a loan modification also had issues with incomplete documentation. As with the previous applications, we submitted all the paperwork. Fay servicing finally accepted the application on XX/XX/XXXX, only to suggest a Deed in Lieu foreclosure, which is not a reinstate of the loan, and therefore not the desired outcome. The new account manager assigned was XXXX XXXX A new application was submitted on XX/XX/XXXX, hoping for a better outcome. Again, the same issues with incomplete documentation were received. Once Fay servicing accepted the application, they asked that we go into a trial period of with an unreasonable interest rate. The new account manager assigned is XXXX XXXX To conclude, all documentation requested was submitted in time during all applications for a loan modification. I've attached pieces of evidence to this complaint in support of my statement. As an example, XXXX XXXX confirmed during an application, that all paperwork was received, but he did not understand why the application was closed. The process is clearly flawed. The delay could have impacted the eligibility for protection programs that could have help re-instate the loan. 2- Rate of 6 % over the market rate : Your response indicates that 6 % is the lowest your investor will allow. The loan currently has an approved interest rate of 4.5 %. I feel that Fay Servicing is taking advantage of the situation and forcing me into a higher interest rate. We are simply asking Fay Servicing to honor the current rate of 4.5 %, which is a fair request in view that we are trying to continue to pay our obligation. We are not asking for favors or unreliable concession. 3-Timing under the plan : Thank you for clarifying the timing and please provide an updated plan in view that we are requesting the rate to match our current interest rate. Attached is our loan statement to validate the rate of our note. Complaint: I receved a letter on XX/XX/2019 that my mortgage was sold and not to send payment to old serviceing company.I had paid for XX/XX/XXXX due date on XX/XX/XXXX and my due dateis not till the XX/XX/XXXX son i oaid three weeks ahead then waiting for new Fay servicing i paid them on XX/XX/2019 for a due date of XX/XX/XXXX.Fay servicing says my mortgage is a DSI Mortgage that i never heard of and because there is 5 weeks between payment i must now pay an extra fee odd {$240.00} and i was never late but because there is mor than 31 days or somthing i must pay.In my 13 years i have been late and never had this charge this is all new to me.they say my interest rate is 10.61 somehow someone did not tell me truth.

Complaint: I live in a townhouse and my XXXX has XXXX XXXX and also XXXX XXXX. I have been calling my Mortgage Provider Fay Servicing, based to XXXX, to cancel both insurances over the course of a year. I have sent them proof of printed faxes I have sent to them. I have recently found out that they paid out on XXXX XXXX XXXX on my property in 2018. Everything time they complain they tell me to send a letter to them. I can not speak to anyone in their insurance department direct. When I received one response they mention that they credited me {$14.00} on a Lender place Insurance ( as I had another insurance ) and ignoring the fact that I do not need House insurance. Who can I get to get these guys to listen to me?

Complaint: XXXX XXXX XXXX XXXX XXXX XXXXKY XXXX Fay Servicing XXXX. XXXX XXXX XXXX Texas XXXX Account number XXXX I have been trying unsuccessfully to acquire a mortgage statement from Fay Servicing for activity on my account. On XX/XX/XXXX I was told by customer service that the statement generator was turned off on my account on XX/XX/XXXX, and that statements do not exist. This is a direct violation of the Periodic Statement Rule set forth by the U.S. government protecting consumers. I was also told on the same date, unbeknownst to me that I have an APR ( balloon ) payment that came due on XX/XX/XXXX. I have been making the payment every month for over a year, as if there were no problems with my account, and I was never notified of any balloon payment, its due date, or action needed. It is clear the intentions of Fay Servicing in this matter. They intentionally turned off the statement generator 2 months before the maturity of the balloon payment as to not allow me to know of any action needed. Without knowledge of the balloon payment due, it would look like I didnt pay the mortgage and allow Fay Servicing to Foreclose on my property without any knowledge on my part. Without knowledge I can not foresee where the more than one years of payments have been assigned. This is clearly deceitful and underhanded. As I have made my payments regular, the action of Fay servicing can be clearly perceived as theft by deception.

Complaint: On XXXX I received a certified letter from XXXX XXXX XXXX XXXX saying that my loan had been purchased back in XXXX of this year unknowing to me by Fay Servicing LLC. My mortgage was set up on Auto pay from my bank so I was thinking my loan was being paid. I had no idea that this company bought my loan because I have not received and letters or notices from them to start paying them. So now they are threatening to foreclose if I dont pay {$4800.00}. There is only {$3200.00} owed which I have no Problem paying. The rest is extra interest and late fees they are adding that I dont feel that I should pay because I was never notified until I received this certified letter on XXXX
