Complaint: Fay Servicing took over my XXXX XXXX mortgage account in XX/XX/XXXX. I filled out loan modification paperwork through XXXX XXXX and faxed it in before the deadline. However ; there was a transfer and XXXX XXXX transferred my loan modification paperwork to Fay Servicing. Now that my account is with Fay Servicing ... Fay Servicing lied throughout the whole process ; from stating they never received my paperwork [ during the initial stage - a Fay Servicing Rep confirmed receiving my paperwork ], as well as stating that the Fay Servicing account manager assigned to my account - has not had the time to look over my paperwork [ I spoke with her once and mistakenly gave her a good rating via the survey-but she actually lied too ; and stated she never had my loan modification paperwork, and that a new servicer will be taking over soon ; and that she does not see a foreclosure sale date, while also informing me to contact the Sheriffs office to look further into ] ; To [ Fay Servicing reps ] also constantly denying a foreclosure sale date when it was very much recorded on the Sheriffs foreclosure sale date list ; while additionally ; the Sheriffs office confirming that there is such a sale date. There had also been dual tracking, also the supervisor not willing to resolve, and making comments such as ; its a long time [ implying the need to foreclose ], you shouldnt point fingers [ at Fay Servicing ]. When they were no longer handling the acct ; XX/XX/19 ; Fay Servicing then mentioned that the company now sees a foreclosure sale date. How convenient - when they are no longer handing my account. What transpired also on Friday XX/XX/19 ; they wanted me to fill out their company loan modification paperwork. Fay Servicing stated on XX/XX/19 ; that my loan modification paperwork had been found ; that there had been missing info on the 4506T. Ok-nonetheless ; I could have rectified that issue by simply faxing it back to them. But no-they did not want the XXXX XXXX loan modification paperwork. They wanted their very own loan modification form to be completed. Speaking of their forms ; on the form it was noted to schedule an in-house inspection. I never heard of that. Usually ; from what I gathered ; the exterior is looked at. Moreover ; Fay Servicings modification form could only be filled out if there had not been a sale date within/before 37 days. There was definitely a foreclosure sale date within/before the 37 days ; [ that Fay Servicing vehemently denied until XX/XX/19 ]. On XX/XX/19 ; XXXX XXXX XXXX took over. So far-XXXX XXXX XXXX ... just as bad ... .On XX/XX/19 ; they did not see a foreclosure sale date ; transferring me to their lender [ how many lenders are there ] that verbally stated - he could not help me ; due to my circumstances. Therefore prompting me to fill out an adjournment at the Sheriffs office ; while going through the process of seeking an Attorney.

Complaint: I am filing a Complaint against Fay Servicing. My complaint is for Illegally trying to put my home into foreclosure by not responding to my emails to Fay Servicing dated XX/XX/XXXX thru today XX/XX/XXXX. I have had a Loan Modification with Fay Servicing since I applied for a Loan Modification with Fay Servicing was sold my Mortgage previously with XXXX XXXX on XX/XX/XXXX. I have Notice of Service Transfer date being XX/XX/XXXX. My package from Fay Servicing advising me of Fay Servicing LLC dated XX/XX/XXXX. I was approved for Loan Modification with Fay Servicing LLC. I have NEVER missed a payment until XXXX & XXXX of XXXX due to the death of my precious XXXX son XXXX XXXX XXXX XXXX years young passed day after Mother 's Day on XX/XX/XXXX after in a XXXX for 7 days in the hospital. He had unfortunately lost his job and life insurance and medical insurance 2 weeks prior to his passing! XXXX had zero life insurance and me and my husband and family and friends made sure he was buried since he did NOT want to be cremated per him telling his friends. I was able to pay XXXX and XXXX but got behind in XXXX and XXXX. I had to miss a month of worth with no pay. I knew I had to get the XXXX Payment to prevent going into foreclosure! I called numerous times and to hold for so long my anxiety couldn't handle it. I figured out how to send emails on Fay Servicing wensite so the first email was dated XX/XX/XXXX advising Fay Servicing why I had gotten behind 2 months but could pay my normal monthly mortgage payment on my due date XX/XX/XXXX. I sent two more emails giving my routing and checking account number for XXXX XXXX XXXX XXXX Ive had 42 years since I retired with XXXX XXXX XXXX on XX/XX/XXXX with 30 years! I have been at XXXX XXXX XXXX 9 years on XX/XX/XXXX collecting apartment rental debt. I have NEVER had a Lawsuit filed against me at XXXX XXXX XXXX Fay Servicing NEVER emailed me back after several emails and left a message. After work the evening of XX/XX/XXXX I called about XXXX EST and a woman answered and I explained Ihow thankful I was to be able to talk to someone so I could make my payment for XXXX. She kept saying she could NOT take my payment my loan was already in preforeclosure and she would send a Modification pkg telling my options. I remember yelling at her to let me speak to my Account Manager XXXX XXXX finally she transferred me to XXXX XXXX and he told me the same thing that I would have to pay XXXX above and beyond my normal payment to stop the foreclosure! I was hysterically crying saying I couldn't afford more than my payment and then I told I wanted a Supervisor! After on hold he transfers me to a XXXX male who kept telling me he had to have over XXXX to stop the foreclosure! I finally just flipped out from EXTREME ANXIETY from trying to tell them my XXXX died and NOT 1 employee the XXXX woman XXXX XXXX or the XXXX Supervisor cared! Then I told them to take the the house I didn't because I would XXXX XXXX! The XXXX Supervisor said something like wait a minute hold on and FINALLY came back to the phone and took my normal Mortgage Payment! I vaguely remember telling him you saved my life for taking the payment! I sent NUMEROUS emails with NO response from Fay Servicing. I will gladly forward everyone of them even though Fay Servicing should have them and that HYSTERICAL phone call! On Friday afternoon I was visiting XXXX XXXX where my XXXX is buried and receive a call from my husband upset because a XXXX Police Officer came to the house because a Realtor had called 911 to report me XXXX and this was XX/XX/XXXX! I spoke with the XXXX Police Officer and advised I was fine. I emailed Fay Servicing again regarding the 911 call on XX/XX/XXXX! I finally received an email from XXXX XXXX showing him as AVP Fay Servicing telling me he would like to speak with me when it was convenient! This was on Saturday XX/XX/XXXX. I relied back advising he could email me any questions he may have. One of my numerous emails last week advised Fay Servicing I wanted my Account coded CEASE & DECIST! Mr XXXX never sent me anymore emails. I did Contact XXXX Police Department on Monday XX/XX/XXXX asking what I needed to do to report a FALSE 911 that was called in at XXXX on Friday XXXX XXXX. The woman advised me I needed to come in and file Police Report. I filed Police Report yesterday XX/XX/XXXX with XXXX Police Department. I should pick up Police Reports on Friday XX/XX/XXXX. Can you please request EVERY PHONE CALL especially one from XX/XX/XXXX, ALL NOTATIONS on my Account since XX/XX/XXXX! I am also going to pursue a Lawsuit against Fay Servicing for the following : Unlawful Mortgage Practices, Discrimination, Harassment, Racism, and STRESS for myself and my XXXX year old husband! I will be filing soon after I call XXXX County Courthouse in XXXX Georgia. PLEASE make Fay Servicing PROVIDE ALL EMAILS and RECORDED call since XX/XX/XXXX! You will be SHOCKED about how UNSCRUPULOUS Fay Servicing is with a soon to be XXXX on XX/XX/XXXX Southern Speaking XXXX Woman From Georgia! I forgot to mention I received a letter dated XX/XX/XXXX date stamped from Post Office XX/XX/XXXX which was a Modification Package! Today I received a letter dated XX/XX/XXXX telling me how much I have to pay by XX/XX/XXXX which amount is totally incorrect! Please get everything from Fay Servicing because I Don't Lie! Complaint: Fay Servicing is charging me forced place homeowners insurance even though I have provided proof of insurance. They refuse to credit my account and now I have to pay over {$4000.00}. I am not able to make these payments. Can you please help me? The mortgage company did not have my correct mailing address on file and this was confirmed by the customer service rep I have been in contact with. I never received any letters requesting proof of insurance since they were mailing to the wrong address.

Complaint: I submitted a request to the original mortgage servicer, XXXX XXXX, for loss mitigation. During the process, my loan was sold to a third party without notification from XXXX XXXX, but the third party. The third party, XXXX XXXX XXXX XXXX XXXX, notified me on XX/XX/2019. When I contacted XXXX XXXX, they did not confirm or deny. Weeks later, I finally received a letter from XXXX XXXX indicating that my loan was being sold to Fay Servicing. Fay servicing mailed out statements, etc ... When I called them to determine the status of the loss mitigation, I was told that all of the paperwork would be on file from XXXX XXXX and that my account manager would follow up. Each time I call I can not get an answer. My most recent phone call interaction was information telling me that the loan has been sold to yet another servicer as of XX/XX/2019 and I should have received correspondence. I have not. I am fearful that these companies are playing the shell game with my mortgage in an effort to avoid processing my loss mitigation request and move to foreclosure of the subject property. How can my loan be sold in less than 30 days?

Complaint: I am in Chapter XXXX Bankruptcy protection and called to make a payment on XX/XX/2019 at approximately XXXX XXXX Pacific time. Calling XXXX Fay Servicing LLC. The problem is that the representative named XXXX XXXX or XXXX stated that she could take my payment but that she could not provide me with a confirmation number. She stated that it was their policy to not provide confirmation numbers to persons in Bankruptcy protection that do not have authorization from their attorney to discuss mortgages. The Only Thing that was asked was for a confirmation of my payment so that I could have something proving the payment was made on time. If for some reason the payment is not made I am in fear that Fay Servicing could request relief from automatic stay. It makes no sense that they not provide any data when the only way they can take the payment is from me providing my social, address, full name and loan number. I do want to emphasize that the only thing that I requested from them was a confirmation of my payment as shown on my mortgage statement. I asked for a Supervisor or another person and she put me on a brief hold. She stated everyone was busy and I explained that the CFPB had fined her company in the past for unfair practices and I asked her to notate that I would be contacting CFPB. Her reply was that they were not the only ones that had been in trouble! Hopefully you can ask for a recording of the conversation.

Complaint: I am writing this letter to explain my unfortunate set of circumstances that have caused us to become delinquent on our mortgage payment. In late XXXX, our daughter fell upon financial struggles with her living expenses and returned back home with our XXXX grandchildren. Our living expenses have increased slightly ; since theyve moved in as I now currently have to care for not only my daughter, but also my grand-children. In the beginning of the year ( XXXX ) we fell upon 3 major auto repairs between our two personal vehicles and business vehicle, in which we are currently still paying on ( listed in financial worksheet ). In-between the additional expenses and unexpected auto repairs, my company had a decrease in income/volume from XX/XX/XXXX to XX/XX/XXXX. We had a few clients whom did not renew or return for my business services resulting in a decrease in income. Although we attempted stretch funds amongst all our personal and business expenses, we slowly and surely depleted our funds. As of XX/XX/XXXX, my business has since recovered from the lost income and weve been able to sign on additional clients increasing work volume. As we began to recover from the hardship, we attempted to resume payments, however to my surprise I was advised I was unable to make a payment, unless I was able to reinstate the full past due balance amount. We are requesting a loan modification or possible repayment plan, as we are now in a better financial situation and we are able to afford our mortgage payment again. At this time, we are requesting assistance on the outstanding/past due delinquency balance in order to help allow us to retain our home and move forward with your financial institution in good faith.

Complaint: I have asked my mortgage company to cancel my HO Flood and Insurance for 18 months. I have written letters, emailed and nothing. I complained via the CFPB. They responded ( incorrectly to part of my complaint ) and ignored the remainder. Then closed it erroneously. My previous Mortgage company had forced me to have HO Flood and HO Insurance on threat of Lender placed insurance. FAY have basically totally ignored my requests to sort out the insurance.
