Complaint: I have been trying to get this resolved since I noticed it on my report once I opened escrow. This debt was a result of a furniture store delivering the wrong and broken Item to me, I did not allow them to leave the item and they are still charging me for the item. The furniture store also claimed the full {$1500.00} I was approved for but I only ordered a {$700.00} item that of the {$1500.00} and once it got to me it was damaged thats why I never took possession of the item. Now Duvera has derogatory charges to my report in the amount of {$3500.00} being reported negatively since XX/XX/2018 to current.

Complaint: PLEASE NOTE THAT THIS IS A SECOND CFPB COMPLATINT AND IS NOT THE SAME AS MY PREVIUS COMPLAINT. DO NOT LABEL AS DUPLICATE. I filed a complaint against Duvera Billing Services since they prevent me to make payments on my account and later sent to collections. I couldn't make payments or even pay off due to their phone and web sites are not available. They responded to my previous CFPB complaint with a copy of " Summary of Terms '' and a " Retail Installment Contract '' as proof of the debt, but these are unsigned copies. I would like to receive a clear copy of the signed Retail Installment Contract as validation of the debt.

Complaint: I got a loan from DuveraXXXX XXXX, I paid for some months an later I was unable to continue making payments on my account because the payment service or website was not working, after 30 days they sent the account to collections even when was not fault that their payment processing service was down and can't accept payments. I still being calling this company thru different numbers but all those phone numbers XXXX, XXXX, XXXX, XXXX, but any of those phone numbers works. Since they sent to collections my account by mistake, this hurt my credit score, and just because this company does not take phone calls I can't pay them of negotiate them. Also I being looking their website like https : //duvera.com/index.htm and XXXX XXXX XXXX I disputed the account thru the credit bureau agencies because I never had the opportunity to pay this account, also this account was charge off just after 30 days late payment and I was because they do not allow me to make payments. For some reason the credit bureau investigation resulted as " verified '' How they verified if nobody answers the phone??

Complaint: I took out a loan with XX/XX/XXXX. They are not letting me pay within the interest free period of 90 days. First they said my card was returned. I dont have a card on file. I told them to take directly out of my account they have my routing and account number. They said they would take the payment out of bank account I have it in writing and they still have not taken the payment. I believe this is a stall tactic so I miss the payoff date and am forced to pay interest. They also told me a bank transfer takes 10days to process? Hello its 2019. These people must be stopped and reported 58 % finance charges??? Please help! XXXX XXXX

Complaint: Signed for a loan through a pet store to replace my wifes deceased dog. Original amount was XXXX. In 8 months I have paid about XXXX dollars on the principal balance. Interest is XXXX percent. If I paid within three months of signing I would have paid the principal plus XXXX dollars and would be charged no interest. Some things happened that didnt allow me to do that so the interest started and so far Ive paid XXXX dollars and sill owe XXXX. Every payment has been made on time.

Complaint: I borrowed money to complete an expensive purchase of a pet for my daughter! They took application at the pet store. They let me have {$1800.00} loan They said I could pay loan in 90 days without penalty or interest. I tried to pay the loan and they said that I missed 2 payments so the loan went into default and that I owed almost twice the amount of original loan in fees and interest! I contacted them and they insisted that I owed the money ; and that I could do nothing! Now they have another entity trying to collect the debt and in less than 14 months the debt has been reported to 2 of the credit agencies as over {$5000.00} They reported several times with variations to account number and totally different dollar amounts so the agency has lowered credit scores over 100points because of multiple violations or debts. The agency reporting the debt has not verified the debt and its been over 65 days since we requested proof or verification of debt. The companies name is DUVERA FINANCIAL.

Complaint: I took a loan with XXXX XXXX on XX/XX/XXXX when I need necessary car repairs and had no other options. I signed an agreement and tried my best to make bi-weekly payments of {$71.00}. On XX/XX/XXXX I sent an email to the customer service dept. explaining I was having difficulty making the payments and could they please lower the interest rate or work with me to make smaller payments so I could pay back the money faster. They refused and I have been bombarded with text messages, and calls ever since. A recent text message offered me the chance to get my account back on track if I paid {$10.00} and then set up a once a month payment. I paid {$10.00} on XX/XX/XXXX and then had set up a payment of {$100.00} on XX/XX/XXXX and thought from what the email indicated they would be taking a {$100.00} payment per month going forward. However, they took {$71.00} on XX/XX/XXXX and tried to take the additional {$100.00} on top of that. I have contacted my bank to stop any further EFT withdrawals from this company as they seem to do what they want and I can not afford to have unexpected withdrawals from my account. I feel like this company is taking advantage of people who have no other means of getting assistance to pay for unexpected expenses and are just setting people up to fail with charging almost 100 % interest rate!!!

Complaint: I had to get some work done on my car roughly around XX/XX/XXXX. At the time I could not afford the total amount of {$600.00}. The gentleman at the register at XXXX XXXX XXXX XXXX suggested I finance the amount of the repairs, which I agreed to and signed. A couple of days later I receive a call from XXXX XXXX saying that they had purchased the contract from the XXXX XXXX XXXX XXXX and they would be collecting the payments. XXXX XXXX and I discussed the terms of the agreement, which we agreed to. We proceeded to set up EFTs through my XXXX XXXX account which I suggested. A few day later I received a welcome letter from XXXX XXXX, reiterating what we had discussed a few days earlier. ( See Welcome Letter Attached. ) The problem happened after they attempted to continue withdrawing funds from my account via EFTs from my XXXX Bank Account. I call on XX/XX/XXXX and spoke with XXXX asking why they were attempting to withdraw money from my account after the agreement was fulfilled? ( See EFTs withdrawn from XXXX XXXX Attached ) According to XXXX that was not the contractual agreement and I owed roughly another {$600.00} plus, on top of what we agreed to verbally, and in writing referencing the terms via the Welcome Letter. XXXX XXXXXXXX has reported this on my credit report as a collection account. Even as per the agreement I fulfilled my financial obligation for services rendered. Also, they have consistently called and ask me to make some kind of payment arraignment for the remaining balance. Which I have painstakingly told them the obligation has been fulfilled and I have the letter, and withdrawals to confirm I owe nothing.

Complaint: On XX/XX/XXXX I entered into a financing contract with a company by the name of XXXX XXXX XXXX ( which is owned and operated by the parent company XXXX XXXX XXXX ). I had a 90 days no interest agreement which states if my balance is paid in full in 90 days or less that the only amount due is the amount which is financed. I financed {$500.00}. I paid a total of {$700.00}, with {$200.00} being due back to me since I paid the balance in full prior to the promotional periods end date. On XX/XX/XXXX I contacted the company regarding this issue and was advised that they are not going to refund me the {$200.00} owed to me, because a payment was not paid on the XXXX of the month and rather the XXXX. I informed them that was of no fault of mine, and that the contract I signed states very clearly that all payments will come out on the XXXX of the month by auto draft. I argued this case and was advised that I had allegedly logged in on XX/XX/XXXX and removed the auto pay option, which there is no history on my account nor any confirmation communication of this alleged event. I advised that by law they are required to alert me when changes are made to the contract or billing arrangement, and since I know I didn't go into the account to change anything until XXXX ( when I noticed their error and paid it myself in good faith ), and they can't provide any verification of me doing such ( and neglected to provide said verification at the time of the alleged change ), I feel it is well within my rights as a consumer to be refunded the total amount of {$200.00} due to me for interest charged during the 90 promotional period in which I successfully paid back the entirety of the {$500.00} financed amount. In my contract it states I need to reach out to their Legal Team with a written notification of dispute, however as I've called multiple times and worked directly with XXXX XXXX ( Operations Support ) over email, they have refused my request for the address to send their Legal Team a certified letter of such dispute. Since my requests for good faith remediation of this issue have been denied multiple times, I am reaching out to the Consumer Finance office for assistance getting back the over payment amount in full ( including any fee 's they feel they should charge for said financing service since I've been through this issue ) of {$200.00}. Complaint: The company name is XXXX with the website XXXX appears in my credit report as Duvera. The interest rate is 151.97 %. From the {$1000.00} dollars I owed when I bought the dog in XX/XX/2018, I owe approximately {$980.00} though I have paid always on time with an autoplay plan every two weeks all this time for {$65.00} each payment. This means that a total of XXXX has been paid until today. But I still owe about the same. I went to buy a dog at XXXX XXXX. A mixed breed dog. I saw this place which offered financing and went in. My family was waiting for me and they made me wait at the store for almost 2 hours stating others where filling the paperwork for financing. When I finally got to do the financing, I was just hurrying to leave. My family needed to eat and I was 30 minutes away from home. I signed out the paperwork in a rush and did not realized how high the interest was. I was just in a hurry to get out of there and trusted no one would commit usury in our state since it is unlawful. When I got to the time where there's no more no interest charges, I realized my debt had gone back to the beginning balance and I think even higher. then I call and ask the interest fees at which point I find out it was 50 %. My credit is not as bad as to deserve this ridiculous amount of monthly interest. I called and asked to talk to someone who could lower my interest and advised them this is unlawful. The person said there's nothing they can do since I signed for that. There where two different loans offered by the seller and she pushed this one. She filled out something in front of me where I could see she was getting a gift card. It seems like they pushed this loan in order to gain the gift card. That was fishy and I asked about the gist card. She said it was some competition they had related to the loans and sales. I do not deserve this usury high interest. It is against the law in out state. Florida Usury Laws Under Florida statutes, usury is defined as the charging ( whether paid or not ) of interest that exceeds 18 percent on loans, lines of credit, advances of money or any obligation of amounts up to {$500000.00}, and that exceeds 25 percent for transactions involving amounts totaling more than {$500000.00}. Loans with an interest rate between 25.01 percent and 45 percent are criminally usurious misdemeanors, while a rate above 45 percent is punishable as a third-degree felony. The challenge with avoiding a potentially usurious transaction lies in the intricacies found in the agreement, the characterization of the various fees reflected in the agreement, and, in some instances, the determination of whether the agreement is intended as the acquisition of an equity interest in the venture or the issuance of a debt obligation.This company thinks that a persons signature protects them when braking the law. I did not resigned my lawful right to be treated equally and to charged according to our state 's laws.

Complaint: The company we applied for a loan for a car repair says that they havent received a payment for 45 days, at least, when we have made multiple payments. Its not being reported to my credit account and the payments are going through without fail. We have contacted XXXX XXXX XXXX ( which is owned by Duvera ) and told them this but in the past we were put on hold for up to three hours without being connected to someone and we hung up out of pure frustration. When last contacted we were told that the account is past due even when they had charged us the day they contacted us and days prior.
