Complaint: My brother, XXXX XXXX and mother, XXXX XXXX took out a loan with XXXX XXXX in XXXX, TN on or about XXXX. They both were not XXXX capable of understanding the financial documents. XXXX sold the loan to Greentree. XXXX XXXX, XXXX my brother died and XXXX XXXX, XXXX my mother died. I am the heir to the property. The house has been recently appraised for {$45000.00} The principal of the loan is approximately XXXX. I hired XXXX attorneys on XXXX separate occasions, neither could get any help from Greentree. We requested a short sale and offered a settlement. They faked a foreclosure. I had never experienced anything like that before, but I am wanting to keep this house, it was my childhood home, so I buckled and wired transferred XXXX only to get XXXX applied to the principal. Once they sent me papers so I could make an offer, but they would not process them because they wanted financial information from my brother and mother. THEY ARE DEAD so they have no income. On several occasions they will call and continue sending mail for my dead family members to contact them. They have all the legal documents required to show I, as well as my daughter XXXX XXXX has legal rights to talk to them. They have the death certificates. I have been trying for 2 1/2 years trying to reach a settlement offer. They are now called Ditech. Ditech has not changed anything, including the employees we talk to. Her name is XXXX. She is rude, condescending and makes hurtful remarks regarding the death of my family members. I have sent several certified letters to their higher management, in which they signed for. Still no one will contact us regarding this loan. I recently learned of the XXXX XXXX dollar lawsuit of all the illegal and unethical tactics Greentree was found guilty of. It is obvious Greentree changed their name to Ditech, but are still operating under the same principles.

Complaint: My mortgage loan with Ditech was paid off on XX/XX/2016. At that time, Ditech was notified by the lender that I refinanced with that we had paid our annual property taxes and the loan was paid in full per the loan balance payoff statement provided by Ditech. I had paid the property taxes in full XX/XX/XXXX. I receive a short pay notice from Ditech for {$2600.00} dated XX/XX/2016. The short pay resulted because Ditech had also paid the property taxes. The letter from Ditech indicated that I would need to pay them an unreasonable interest rate of XXXX per day on {$2600.00} shortage. I IMMEDIATELY paid the {$2600.00} via wire transfer by my Title Insurance Company, to keep them from charging me such a corrupt, and criminal interest rate. Since my loan balance was paid, and the {$2600.00} was paid immediately, and Ditech received a refund on the property tax that they overpaid, they have owed me {$6000.00} since XX/XX/2016. Each time I call, the length of time it will take to receive my money gets longer and longer and longer. My local Sheriff 's office confirmed that they returned the overpayment to Ditech on XX/XX/2016. It is now nearly three months later and I have not received the {$6000.00} that Ditech owes me. The loan is closed, and paid in full. Ditech is holding my money, after paying a property tax bill that they were told not to pay. From the beginning, they have managed my escrow account in a very suspicious manner. Over collecting in the beginning, then sending a huge refund ( Approximately that same amount that I complained had been over collected ... nearly {$5000.00} ) after holding the overage for more than 6 months, then showing a shortage and increasing the monthly payment substantially. The individual is demanded to pay interest of nearly {$48.00} dollars a day on a {$2600.00} amount that resulted from their error, while the lender can keep {$6000.00} of my money for three months and do nothing to assist me with a more prompt and reasonable return of my money.

Complaint: I had a Mortgage with Greentree mortgage and then it became Ditec LLC They have raised my escrow for no good reason since my taxes have gone down. It also do n't make sense because two months before they raised my payments they sent me money because there was too much money in my escrow. This lender has a bad track record of being honest.

Complaint: Our home was sold to the mortgage company Ditech. Right from the start we had problem with them, trying to set up automatic payments or even making a payment at all, but the real problems started when we sold our home. We were told when we closed on our home to expect a escrow refund check within 20 days of closing. Several days past the 20 day mark we still did not have a check. We called in and they told us to wait till next week. We finally got our check and put it in the bank. Our bank later called to let us know that Ditech cancelled the check and they had to charge us a fee. We called Ditech who told us that they would re-issue a check and to expect it by XXXX XXXX. XXXX XXXX came and still no check. We called in again and the person we talked to stated there was never a check re issued. We were told we needed to prove that the check was cancelled and to send them a copy of our bank statement showing the cancelled check. She said that once we sent that in they would be able to direct deposit the money back in and we would hear within 24 hrs on the status of our refund. 3 days went by and we still had not heard anything. We called in again, this time the representative informed us that they do not do direct deposits and that they would have to re issue the check and send it in the mail but that they would need to get back to us and they should know something within 24 hrs. We still did not hear from them. We called in again and Each and every time we call in we have to speak to a new person and try and explain the situation, and each and every time we are told conflicting information which always gets us no where and ends with " we will get back to you in 24 hrs '' to which of course we never hear anything. We have spoken to probably 7 different people all promising to get back to us and have never received a phone call or any information back. This is over {$3000.00} of our money that was supposed to be given to us 2 months ago. This is beyond frustrating and we are not sure what else to do to get our money that we need to put down on our next home. It has now been 3 months since closing.

Complaint: I was shocked when I reviewed my credit report and found late payment on the dates below : XXXX days past due as of XX/XX/2016, XX/XX/2016 I am not sure how this happened, I believe that I had made my payments to you when I received my statements. My only thought is that my monthly statement did not get to me. I am a XXXX and not sure how this happened. I am in the process of selling my home and getting ready to use my XXXX loan and this is really affecting my credit. Complaint: Ditech sold my loan # XXXX, to XXXX Mortgage, and did not give me notice of the Sale. They deposited my monthly payments and did not forward them to XXXX Mortgage. They have {$5300.00} of my Money, and my credit score has been ruined. Ditech sent me a check for {$1700.00}, one months payment, but no response on the balance of my money. XXXX Mortgage never contacted me and gave notice that they purchased the Loan, prior to sending a negative credit report to the Credit Agencies. XXXX has subsequently sent a letter to the Credit Agencies, but Ditech has failed to accept any responsibility, and sent a letter notifying me of the Sale and my {$1700.00}. I can not keep my Loan current if they do not release the balance of my money which they have misappropriated, which could further ruin my credit and cause me to lose my home. They gave me a supervisors name whom i have left XXXX messages with, and she has not returned my call.

Complaint: I filed a chapter XXXX bankruptcy but the court did figure my mortgage in the bankruptcy. I have paid it all along. XXXX sold my mortgage to a collection agency. There are errors on my escrow analysis and the way they are reporting to the credit bureau. Ditech refuses to talk to me because of the bankruptcy and will not let my attorney tell them they can talk to me. So how do we correct the errors?! They also waited a year to inform me of documents they had drawn up. It appears to me that they think they have no accountability.

Complaint: RE : XXXX XXXX XXXX Consumer Financial Protection Bureau ( CFPB ) Case No : XXXX Ditech Financial LLC Account No : XXXX I was illegally foreclosed on while I was in Bankruptcy and before it was discharged. The mortgage company, Ditech, continued to accept and cash my mortgage payments ( three months worth ) while I was in foreclosure and my home was subsequently sold at auction. The following is additional information re my original complaint : This letter serves to provide additional information related to the complaint I filed with your office and the CFPB regarding action taken by Ditech Financial in the foreclosure sale of my home, including Ditech 's response to my original complaint in a letter to you dated, XXXX XXXX, 2016. In the XXXX XXXX, 2016 letter, Ditech attempted to explain the chronology of events, however, this account is wholly inaccurate. I received a notice of foreclosure on XXXX XXXX, 2016, prior to the discharge of my bankruptcy on XXXX XXXX, 2016. Again, as stated in my previous complaint, I then began trying to contact XXXX XXXX at XXXX. I received a call back from XXXX XXXX on XXXX XXXX, 2016, which was adequate time to delay the foreclosure because I had been not discharged from bankruptcy at that time. Nevertheless, the property was sold on XXXX XXXX, 2016. Further, Ditech admits in this letter that they continued to improperly accept my monthly loan payments for XXXX, XXXX and XXXX 2016. However, Ditech explained that in XXXX, they returned {$1400.00} which they claimed was the amount in a suspense account and one of the monthly payments of {$950.00} that they fraudulently accepted. Again, this is a misrepresentation by Ditech. The {$1400.00} noted in the response letter was from the Greentree suspense account, and was not related to the payments they took in error, such as they describe. Ditech then went on to write, that they were " in the process of issuing a check for {$1900.00} to return to me, the two remaining payments of {$950.00}. '' As of today, such payment was never received. Furthermore, the " gesture of goodwill '' Ditech claimed they would make by " reaching out directly to discuss other ways to provide assistance, '' also never occurred. So, while Ditech claimed to you that they were " working diligently to do the right thing, '' they did nothing of the sort. In fact, it was four months ago that they vowed to you that they would make things right. I can only assume, this was simply said so you would close out my complaint against them. It would appear that Ditech never intended " to make things right. '' So, I have been left alone to continue to fight on my own against the current owner to try and stay as long as I can, in what was my home for XXXX years. If you 'll recall, Ditech claimed they asked to rescind the sale because of their gross errors and fraudulent behavior, but the new owner refused. I am an elderly, XXXX woman and have been left with no choice but to seek counsel to take legal action against Ditech, which honestly, I do not have the means to do ( see attached letter from my XXXX ). But perhaps, this is exactly what Ditech relied upon all along. Currently, I am also trying to obtain additional time to move out so the current owner can finally take possession of the property. I have no means to do this either, but yet again, I am left no other options before I will be forcibly removed by the Sheriff 's Department. Any assistance that can provide would be greatly appreciated because nothing about what Ditech has done is right here! Ditech should be forced to do the right thing, if they will not do so willingly. Complaint: My public record is showing a bankruptcy on my credit that does n't belong to me, it was my ex-wife 's. It was disputed by XXXX and I sent a letter to XXXX disputing it as well and was removed almost 2 months ago. About 2-3 weeks later, it showed back up on all XXXX credit bureaus again after I had received confirmation that i had been deleted. Ditech Financial, the bankruptcy company, had it put back on, and They are n't even the ones who the bankruptcy was with initially with my ex wife.
