Complaint: Ditech is current servicer on a mortgage loan transferred to them from Green Tree. All correspondence from them relating to possible modifications or other remedies come in the form of a letter, but it is never signed by anyone. Seems to me that whoever is sending me a denial etc should sign the letters. I feel that ever since the transfer of the loan that one person should be my contact in loss mitigation/modification dept. so I have a name and phone number. Personal contact is needed, but seems to me they always are changing people and its almost like starting over when a new solution is possible. Poor communication with no one person really having the authority to solve the issues involved. Suggestion that I make for a possible remedy never are presented to XXXX XXXX on my behalf.No real flexibility in working out a solution to prevent a foreclosure.

Complaint: I reached out to Green Tree in hoping to get some answers on a home loan. I was contacted by XXXX XXXX in the XXXX, NJ office. I gave him my social security number, income, address and all necessary information to run my credit.
He replied back to me with my credit score and that he would get back to me with a financial plan.
I waited over 5 days to hear back from him, meanwhile the realtor is awaiting this information. I had to send him a follow-up email on the status.
He stated, " Good luck, you will need it. '' I then got upset because his customer service skills were horrible. I advised him I would never deal with him or Green Tree due to his poor communication skills.
At XXXX, he then sent me another email stating, " I truly apologize. I did n't like the tone of your email and gave you a nasty reply. It was childish and I was wrong. So I am sorry. I had a rough day, your email set me off, and I made a mistake.
I thought we did try to help you. If I recall, you said there were items on the report that were n't yours. We sent you a copy of the report so you could see what was on there. We could n't do anything based on the report and your resulting income to debt ratios. So I thought we tried helping you by letting you know what was on there, and apologize if you think we did not. There 's nothing I can do to remove those items. You will have to get in touch with the credit bureaus to see why they were showing up. That seemed to be the main issue and you will have that issue with any lender, as those items will continue showing up on your report.
Again, I apologize sincerely and hope you have a good night " I am writing you this email so you know what type of employee XXXX is.

Complaint: This company keeps sending statements and request for payment to an address that I have never lived at nor do I have an business with. They are doing this in spite of notification and a formal complaint in 2015. This causes embarrassment and makes my personal information available to any person that gets the mail at this address. Ditech has been notified and the consumer credit reporting agencies have been notified in writing that this address is a public building and has no association with me nor should my private information be sent to the address.

Complaint: I recently completed a Chapter XXXX Bankruptcy and paid my mortgage and arrears through my Chapter XXXX Plan. My Trustee filed a notice of mortgage cure and has given me payment records that indicate my principal balance should be significantly lower. My loan started with XXXX XXXX XXXX and was then transferred to Greentree and now is with Ditech. No one seems to be able to give me a complete account history so that I can have a XXXX audit my loan file from its inception which is XXXX of 2001.

Complaint: DITECH FINANCIAL LLC., and XXXX are attempting to sale my home on the courthouse steps XX/XX/XXXX with an assignment that was robo signed XX/XX/XXXX by XXXX an atty that was attempting to foreclosure a few year ago. the assignment was created after the cut off date of the of the XXXX. According to section 201 of the pooling and service agreement had to be conveyed prior to this cutt of date of XX/XX/XXXX. The assignment is fraudulent ATTY XXXX was not the vice president of XXXX. HE WAS THE FORECLOSING LAWYER. XXXX signed a verified affidavit XX/XX/XXXX, and it was filed in SUPERIOR COURT OF XXXX GA XX/XX/XXXX. This affidavit was also recorded in the deed book. I have asked that my concerns be address, and this foreclosure be stopped for XX/XX/XXXX The cut off date of the trust in section 201 clearly states that this assignment should have been obtain before XXXX, also it contain fraudulent infomation, and fraud can not be the basics of obtain a deed. my main goal is to keep my house with an affordable payment to the write party

Complaint: First, I would to express my thanks an appreciations to Ditech Financial, LLC, CFPB, the senator 's office, the court and law offices the lawyers that have work so hard and continue to work in my interest believing in the United States ' justice system because it works and it 's one of the best justice system in the world ( I can attest because even though I 'm denied a " QWR to H.A.R.P modification request, the judges that have looked at my case have a cursor on the broken statue relating to my QWR request, but yet find prudence to bring about closure around justice denied in my case ).
My complaint is thus : When my H.A.R.P modification decision be reach. If Ditech Financial will begin requesting the very same document/s submitted to as XXXX out of the range of what the law permits as in the XXXX XX/XX/XXXX case when XXXX ( XXXX ) represented me for a modification. This time during a recorded conversation on XX/XX/XXXX, Ditech reported that a " QCD/DD '' was the only data needed to be submitted to complete my file ( " Your file was rejected by underwriting pending the document '', the representative reported. Once received, the file is completed for underwriting result.
This concern is a proven fact that is conspicuous in my case-file ( a fact that the bank/s and its ' entity will request for a document, and when one follow-up, the finding will be that the data was not admit receipt ). The next instruction after a document/s follow-up -- is to resubmit same multiple time despite an admitted conformation of the document/s date, time and station receipt.
At this stage in the modification process, I 'm advice to undergrid the bank/s deceptive strategies in the banks ' written rules employ outside of the law that works. The act of an ongoing request for document/s and multiple resubmit requests to delay the time -line to process and reach an intervention within the Federal regulation parameter that works needs attention. Underwriting is the resisting department of moral laws vs rapacious/predatory knack to continue the delay schemes with an ultimate end being the very foreclosure that was to be remedy.

Complaint: My property was foreclosed XX/XX/XXXX ( judgement entered ). I contact my loan servicer, Ditech Financial LLC, on several occassions asking loan modification application after I was pre-screened on the phone if I qualify for a program. XX/XX/XXXX, I received a notice that a Sheriff Sale has been scheduled for XX/XX/XXXX. I contacted the loan servicer, Ditech Financial LLC, on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and again on XX/XX/XXXX to receive a loan modification application as the sheriff sale on my property was quickly approaching. I finally received the loan modification application on XX/XX/XXXX and a full packet of XXXX-page document was returned to Ditech on XX/XX/XXXX via Fax. Since then I did not hear anything from the loan servicer again. I called on XX/XX/XXXX ( 4 times and left messages to my assigned representative ), and on XX/XX/XXXX ( 7 times, leaving XXXX messages ). I finally got through to customer service at approximately XXXX. and I was informed that they will not review my loan modification application since it is so close to the sheriff sale of my property.
I have called countless number of times since XX/XX/XXXX, I filled out online " contact us '' forms, '' and called at least 15 times in the last two months leaving voice mails asking that Ditech calls me and provides me with a loan modification application. They failed to do so, until the very last minute so that they would not " have to '' review the documentation and take away my home. Why???

Complaint: I submitted a complete loan modification package and was foreclosed on well being reviewed Ditech claims I never submitted all paperwork yet I never received any notice and also a month after the sell of my home I received a letter saying I was reviewed for modification but was not approved due to no longer owning the home!! This is dual tracking! I also had a large payment misapplied and forced insurance to my loan when I was already paying for insurance!

Complaint: I have been out of work due to illness, however I was able to meet my monthly expenses, even though it was difficult, with help from family and finding little work here and there. I heard about the XXXX program and decided to apply last year XXXX through my mortgage company. I was asked to submit certain documents and I did so in a timely fashion, fearing that by the end of the year this program was not going to be available any more Initially I received calls from a service representative requesting additional information. That was submitted immediately. When I stop hearing from my mortgage company I called for updates. Every time I called, I was told that the case was at underwriting and that someone will return my call. This never happen, However I kept calling every week for an update, of which I got the same response. At XXXX of the calls I was told that there was an missing document. The representative checked the uploaded file and found that the documents were already there. they proceed to put a note on the file to inform underwriting that all documents were in. On XXXX XXXX, 2017 I received a call from the mortgage company looking for the payment. So I asked for an update. I was told that the case is closed because they did not received the information on time. I believe I was ignored. That my mortgage did not make an effort to help in my situation.

Complaint: RE : DiTech Financial LLC Acct # XXXX To Whom It Concern, I am filing this complaint in regards to the DiTech Financial account ( # XXXX ) that is reporting on my credit report with a past due status. I do not understand why DiTech is reporting this note as active. They have failed to demonstrate any ownership of the note or be able to provide proof if they are the servicer or note holder of this alleged debt. Please note the missing original pages noted with the contract copy.
This loan was originated XX/XX/XXXX by XXXX XXXX XXXX, XXXX. The loan was for a XXXX XXXX manufactured home that was purchased XX/XX/XXXX.
Please see the attached Title from the State of Michigan dated XX/XX/XXXX reflecting " no secured interest on record ''. There is no standing for any active loan to be collected on.
I am respectfully requesting a complete removal of the DiTech listing on my report. It appears they may have acquired this loan by error. Please reference all attached documentation and dispute response from DiTech Mortgage. Thank you.

Complaint: I keep getting letters about a mortgage I filled for but never got. They keep changing debt collectors to try and collect on this. I have never gotten any money what so ever from XXXX XXXX. The latest is a place called Ditech Financial, LLC. They want me to give them all of my personal information before they will even talk to me which to me seems like identity theft. I do n't see how these people think anyone will give them their personal information just out of the blue without some sort of proof about what they are talking about.

Complaint: XXXX XXXX, 2017 Re : Mortgage account # XXXX Property XXXX XXXX XXXX, XXXX IN XXXX Dear Sirs : This is direct request that Ditech terminate the escrow account and monthly charges on the above mortgaged property. Ditech is using escrow account on listed property to gain interest free self-serving loan from customer. The Consumer Financial Protection Bureau is suing Minnesota-based XXXX XXXX Bank XXXX for allegedly " tricking consumers into costly overdraft services ''. Ditech is doing the same 'trick ' with escrow account attack to defraud home owners for 20 % increase in costs with no factual basis or need.
On property : XXXX XXXX XXXX, XXXX, Indiana, the current escrow is $ XXXX. New escrow is $ XXXX. This change is an increase Total= $ XXXX, which results in $ XXXX increase. This is XXXX % rise in escrow cost, which adds total {$6000.00} escrow each year to cover {$5300.00} actual cost, [ Tax : XXXXHomeInsurance : {$1700.00} ]. This is an annual {$710.00} " profiteering '' interest free loan to ditech, in addition to the {$2300.00} carry forward balance before any escrow disbursement occurs.
House insurance on this property has not changed in 10 years, and current, active policy enclosed. Mortgage property value assessment has been substantially reduced on appeal [ Enclosed ]. This will result in property tax reduction. There is no evidence of tax or hazard insurance rise or increase.
When discussed with ditech staff on XXXX/XXXX/2017, the employee claimed : " this is your saving account. '' This is a bald face sales pitch lie, as no bank saving account pays 0.00 % interest.
Ditech escrow manual states : " If the surplus is more than {$50.00}, we will send you a check for the surplus funds. '' This statement is in direct conflict with the claim for an unsubstantiated, meritless increase of {$92.00} per month, and the additional demand for immediate payment of & gt ; {$700.00} excess escrow monies.
The ditech {$1400.00} escrow funds and collection attempts on mortgage account # XXXX must be terminated immediately. The {$1400.00} surplus currently in the escrow account must be paid, re-numerated, returned, to home owner.
