Complaint: Ditech gave me written approval for a loan modification, then came back right before the third trial payment and stated VERBAL by way of a phone call that they modification should have not been approved ; stating that there was a glitch in the system why it got approved. I have submitted all of the trial payments on time, then they voided out the modification and it was apparently listed as cancelled in the system because it would not allow their customer service representatives to process my XXXX XXXX, 2017 payment. I called several times, leaving messages in the mailbox for the account representative assigned to my case, and also the the non-profit company that assisting me with the making home affordable program contacted their contact personnel by email on several occasions without any response. I called back on Tuesday XXXX XXXX, 2017 and demanded to speak to a supervisor. At that time I was informed that " the underwriter went in and placed some notes '' in my file. I was then able to make the XXXX XXXX, 2017 payment. Ditech has been very fishy with responding or giving information or clarifications when requested. In addition cancelling the modification twice with no concrete reasons, or justifications, then blocking the account so that payments can not be made? i have then all that is being requested of me ; as within my abilities to secure a modification.Then to make matters I was advised that they had a pending sale date of XXXX XXXX, 2017.

Complaint: I am writing this complaint in hopes someone can help me. Green tree bought my loan off of XXXX which is now Ditech. I was late by XXXX days they started XXXX my phone day and night ... constantly..I asked if i could do a modification because I was going threw a tough time they said oh sure, no problem..i got everything gathered up that I needed and faxed it, they said they never got it, next day same deal i fax and they started to ignore me, stating they never recieved it, this went on for XXXX weeks. as i was keeping the fax confirmation stating it went through, They ended up denying me for a modification, harassing me to get out and would ask me if i wanted to keep the property. I asked them what my options were since the modification did n't work out they said i could do a deed in lue ... asked them exactly what that was..they said a short sale. I needed to remove everything from the house, not even a coat hanger left in the closet and i would be approved for this for sure. So I did, moved everything out that weekend ... Called them monday to let them know and the phone calls stopped and could not get ahold of them. Kept trying and trying and nothing. Finally got ahold of someon who would talk to me, said i was denied a deed in lue! after i did what they said moved everything out ... they denied my modification and now this. I went back to the house only to find a lock on the doors and can not get in. They got what they wanted me out with denying me modifications or this deed in lue. Its been over a year and they keep sending me statement of how much i owe them and they have since put insurance on the property saying i owe that!!!! I delt with harassing phone calls day and night from these people ... .for months, did modifications that i was denied only after i faxed them XXXX times and told to move out and do a deed in lue, did that,,, ,denied ... .then they lock the doors and send me more papers to do a modifcation..someone plz help!

Complaint: My mortgage company erroneously reported that we were over XXXX days late on our XX/XX/XXXX mortgage payment. To date, we have NEVER been XXXX days late with any of our payments and this accounting error on their par has lowered mine and my husbands credit scores from XXXX down to XXXX because f Ditech 's error. We noticed this error on XX/XX/XXXX and contacted Ditech immediately to report, we called several times, each time getting a different story on how we were to obtain proof that they corrected, and I have emailed them requesting this as well and have yet to receive back up that they have corrected with credit bureau and will not send us a letter or anything stating they made this error and it was corrected with date of correction. My credit score is still XXXX or below due to this error and we are supposed to try to buy a new car since our car lease is up at the end of XX/XX/XXXX. They have also repeatedly charges us incorrect late charges and also XXXX allocated our check we sent for mortgage payment to another amount thus charging us late fees for their error. This time, it did us actual damage to or credit and will not respond with correction for us to use when we go to apply for lease for car. I have attached bank statements that show each payment totaling {$1100.00} per month ( our monthly payment amount ) highlighting the check memo that is printed with each payment that lists month, mortgage, and year on it.

Complaint: This is a new complaint against Ditech Financial LLC, formerly Green Tree Servicing. Ditech is now harassing me by misappropriating funds and facilitating economic hardships. This complaint is about Ditech misappropriating an extorted payment under an illegal threat of foreclosure and asking for part of the same payment again once I paid it ; and Ditech reclassifying funds when only the borrower has that right to determine the classification of funds. 1. On XXXX XXXX, XXXX, Ditech billed my {$3900.00}. On XXXX XXXX, XXXX I paid the total amount due. The statement Ditech dated XXXX/XXXX/XXXX ( received XXXX/XXXX/XXXX ) shows Ditech posted the total amount due on XXXX/XXXX/XXXX. The XXXX/XXXX/XXXX dated invoice shows Ditech misappropriated {$540.00} to funds in suspense. Then, Ditech fraudulently misrepresented that I had an outstanding balance of {$540.00} and asked me for the same {$540.00} that it misappropriated to funds in suspense with no authority to do so. This also had the effect deceptively changing the terms of my mortgage payment from {$1100.00} to {$1600.00} per month. Ditech did not have authority to place the {$540.00} in funds in suspense. {$540.00} was for late fees that Ditech is claiming from XXXX before Ditech took over the note. My note/security instrument deed of trust does not allow late fees to be held in funds in suspense. Ditech can only put partial payments of mortgage principal and interest in funds in suspense. There was no partial payment carried forward from the XXXX/XXXX/XXXX statement, but for Ditech 's misappropriating funds and fraudulent misrepresentation on the XXXX/XXXX/XXXX dated statement. I paid the total balance to cure the alleged default. It was fraudulent for Ditech to bill me a total amount due and then misappropriate the money to funds in suspense and ask me for the same amount of money. Additionally, the note only gives the borrower the right to designate how funds are classified, not the lender. 2. Ditech also misappropriated {$72.00} from funds in suspense to the escrow account to harass me. Under my note/deed of trust, funds in suspense can only be use used for mortgage principal and interest, not the escrow account. My note allows Ditech to refund money. I have asked for Ditech to refund the {$72.00}. The statement dated XXXX/XXXX/XXXX shows Ditech applied the {$72.00} to the escrow account. The regular escrow payment is {$400.00} plus the {$72.00} equals {$470.00} escrow total. Ditech has since taking over the note provided interim statements. However, Ditech did not provide a statement for XXXX/XXXX/XXXX, which showed the escrow balance is a positive {$790.00}, and not ( {$460.00} ). Thus, returning the {$72.00} will not create an escrow shortfall.

Sometime later XXXX took over the loan, then XXXX switched to Ditech. my {$20000.00}, XXXX year loan was up last month. According to Ditech still oweing {$15000.00}. we have paid almost {$52000.00} in XXXX years, at XXXX % interest. In XX/XX/XXXX we had to claim bankruptcy, Ditech does n't even acknowledge it. It 's plain to see the math will never add up! We were also forced to use their insurance, and they also had a escrow account of {$470.00} that was disbursed but to who or what we do n't know. I know I 'm XXXX of many complaints you have received. What am I to do? This is a mobile home fixed loan

Complaint: I called XXXX Mortgage ( XXXX ) to obtain a XXXX mortgage interest statement. XXXX with I.D . # XXXX stated that my loan had been sold to Green Tree on XXXX XXXX, XXXX and gave me their phone number ( XXXX ). When I called Green Tree at the number XXXX provided, after providing my address and either partial or full social security number, heard a recording offering me a {$100.00} XXXX gift card and a {$50.00} restaurant gift card. I was to press a key to accept, which I did not. Then a representative who said his name was XXXX XXXX came on the line, updated my address, etc. and said the computers were moving slow and while waiting for them, he wanted to tell me about the XXXX XXXX restaurant card. I listened politely and when he asked, did I want to take advantage of these great offers, I declined. He persisted with why did n't I want to receive these free items for a small {$4.00} charge. When I declined a second time, he hung up on me. I XXXX the phone number and found out it was a number in XXXX with many more phone numbers with the same beginning XXXX and viewed complaints against the number. I got on line to research Green Tree Mortgage and remembered that they had merged with Ditech Financial. I was very concerned since I had provided the fake Green Tree representative with personal and sensitive information. I assumed since XXXX had provided me the phone number of XXXX, that is was a legitimate number and company. I then called the Federal Trade Commission who transferred me to the Consumer Financial Protection Bureau. The representative, XXXX was very kind and listened to what had happened, but said it was not her department to handle the incident and did not understand why the Federal Trade Commission had transferred me to her department. Since I could not get anything done through either of them, she suggested I file a complaint here. She transferred me to a department that could provide me with information to protect my identity, credit, etc. I called XXXX and placed a fraud alert on my credit report. I was told the other XXXX credit bureaus, XXXX XXXX and XXXX would also be notified to place a fraud alert. I called XXXX back so that they would not continue to give out the number since it is a scam coming out of XXXX. I spoke to XXXX with I.D . # XXXX, who said she needed to transfer me to an agent in the United States. I then spoke to XXXX with I.D . # XXXX, who listened to what happened and told me that that was the number they were using for Green Tree. She put me on hold while trying the phone number herself. She was put on hold and then the call hung up. XXXX thanked me for letting them know about the scam number and said she would be reporting it to her supervisor and upper management. I am filing this complaint for two reasons : 1 ) to file a complaint so it will not happen to others and 2 ) to document and protect my identity, credit, etc Thank you. XXXX XXXX

During the transition, there were late fees charged to our note -- directly due to the transition from XXXX loan servicer to another. Funds have been held in suspense since the transition that more than covered the late fee -- yet, Ditech will not honor repeated requests to net the funds in suspence with the late fee.
