Complaint: XXXX of last year, I became suspicion that my loan with then XXXX XXXX inXX/XX/XXXX may not have aboveboard. In XX/XX/XXXX, my loan was processed primarily via certified mail and phone calls. At the time, the mortgage broker contacted me to refinance my mortgage was in a financial rut and credit was very poor. I realized that should not have been approved for a loan of {$75000.00} given checkered credit history. So, I decided to review how my loan was processed to allay my suspicion that my was not kosher. I requested a facsimile of the documents generated during the process of my. Caliber Home Loans, the mortgage holder, informed me in writing that the documents I requested were proprietary as such would not be made to me, mortgagee. For several months, Caliber Home Loans employed duplicitous tactics to thwart my efforts to obtain access to the documents that I requested. In XXXX of this year, Caliber Home Loans ' Attorney, XXXX XXXX, made the documents available to me. After a thorough perusal of these documents, I uncovered conflict and discrepancy between the settlement statement with respect to the actual amount that then XXXX XXXX paid to my first mortgage holder, XXXX XX/XX/XXXX. I found a distinct difference between what was recorded on the settlement statement vis a vis the document that was sent to XXXX XX/XX/XXXXto settle my principal balance. Also, the settlement statement suggests that I received a payout for {$1400.00}. I saw no other document that shows that I was given a payout during the process. Also, as I have argued ad nauseam during the past eleven months that I do not recall that I received such a payout. Again, the process of my loan was done in such an unconventional manner virtually by certified mail and phone calls, I suspect that a lot of errors was made given how my loan was initially processed. Given the discrepancy and the aforementioned conflict, in an email dated XX/XX/XXXX, I requested a facsimile off the checks that then XXXX XXXX issued to me and two creditors, XXXX XX/XX/XXXX and XXXX, both defunct. Shortly thereafter, I was informed by Caliber Home Loans ' Attorney that the documents that I requested were not in its possession. It's highly inconceivable that Caliber Home Loans does not have in its possession any documents that would corroborate whether I received a payout for {$1400.00} as recorded on the settlement statement. Also, it's not possible for Caliber Home Loans to not have any documents in its possession that would confirm how much then XXXX XXXX paid to XXXX XX/XX/XXXX to settle my principal balance besides the settlement statement & loan agreement.

Complaint: XX/XX/XXXX I inquired to caliber home loan about email they sent saying they can drop my mortgage insurance and lower payment on my current mortgage.On the phone loan consulatant XXXX said there is no costs but {$190.00}. I pulled over as he said he must wait on the line while I initial documents online and he can change anything going forward such as term amount etc. I asked about closing costs and was told there were no costs other than {$190.00} as they already have mortgage on house and are simply refinancing. After reviewing it they were tacking on an extra {$10000.00} to my loan for closing costs and XXXX said they would be waved or reversed. So in addition to {$10000.00} closing costs my interest rate would be even HIGHER if I refinanced. So within 30 minutes after I told him I wanted to cancel via phone and numerous emails. The Following day XXXX continued to process loan even after I told him I didn't want to go forth especially with paying higher interest and putting an extra {$10000.00} on refinance loan. I contacted his boss XXXX who then after I told him why I didn't want to proceed asked me why not and continues not to stop this.

Complaint: On or about XX/XX/XXXX i filed bankruptcy and included in the filing, a home i once owned t was therefore relinquished and forfeited. Caliber home loans left the loan open and is still open today even though the bankruptcy was closed in XXXX, and they continue to this day to report the activity on my credit report, included with these comments are actual letters from Caliber admitting they made mistakes and other illegal activity such as keeping the loan open in my name and letting other people service the loan. Caliber home loans has now sold the loan to another company, XXXX XXXX XXXX and failed to disclose any of the information about the bankruptcy proceedings, and they 9XXXX XXXX XXXX ) are now also reporting to my credit as a new foreclosure.

Complaint: I have 3 mortgages with Caliber Home Loans, XXXX XXXX XXXX XXXX, OK XXXX. The website and telephone system is unfriendly to me as a consumer, and difficult to navigate. I've tried several times to set up my payments as biweekly ACH autopay, and have been unable to do this because their system requires that I am ahead 2 months in my payments, AND that the next payment is due. So there is a narrow window of a few days in which to accomplish this, ( both after I've paid and after I wait until the next payment is due. ) This can only happen if I pay online, with an extra charge for online payment, and its still difficult times correctly. Whether an account is on ACH autopay is not reflected anywhere on my printed statements, or in any of the account details on the account website. ( Autopay accounts I have with other companies will say on the statement " Do Not Pay - Auto Pay. ) The only way I can check this is to telephone a representative and ask. There is always a very long wait through many prompts before I can speak to a representative, and the Caliber phone system is only available Mon-Fri XXXX to XXXX XXXX, Central time, inconvenient for me, as I live on the west coast. When I finally get to a representative, they are always helpful and professional, but the Caliber Company has not invested in a user friendly website, which would probably actually save them money in fewer calls to their reps.

Complaint: I recently submitted a loan modification application to Caliber Home Loans that was denied the week of XX/XX/XXXX. As a result, I submitted an appeal. The basis for my complaint is that every Caliber Home Loan representative that I had spoken with BEFORE and during this process neglected to tell me that I would not qualify for a modification because I had one in XXXX, finalized in XXXX. In fact, one representative told me WHEN to apply and that I needed to wait ONE year which meant that I could apply as of XX/XX/XXXX. No one told me that I would NOT qualify based on those facts which would have been extremely helpful. More importantly, it was my right to know and be properly informed. This is not the first time that I have been given the wrong information from a Caliber representative. I have experienced this before and as a result, a manager by the name XXXX, had to personally review my file because I had been misinformed and my file had been improperly handled. At that time, I was initially denied a modification and after XXXX handled the case, I received a modification, and completed the trial payments seamlessly. All of this is a manner of record ( recorded and verifiable ). This time, once I received the denial letter, I contacted the company, requested to speak with a manager because I was tired of the runaround and misinformation. Nevertheless, they did not allow me to do so. I do not believe Caliber exhausted all the hardship options available and for this reason, I think it is unfair and unprofessional that I'm continuously given incorrect information especially regarding such a serious matter. As a homeowner experiencing a hardship, I deserve to have all my options explored which I don't believe they have been. Additionally, I deserve to receive accurate information so I can be fully aware of the process and where I stand.

Complaint: I have a FHA mortgage that is beening serviced by Caliber Home Loans and the lender has not afforded any of the mortgage rights that accompany a FHA Loan. I have not been afforded an opportunity to have a face to face with my lender. Moreover the lender has told me that there investor does not allow a short sale. This is not true as this loan is an FHA loan. I have several offers on this property and the property was listed with a realtor.

Complaint: I was offered a trial modification by Caliber Home Loans and have made my trial payments within the month, as I am suppose to. However, my May payment was never posted, and I immediately contacted Caliber and requested my Payment to be processed. They agreed and my payment was processed. In XXXX I sent my Payment in, as instructed, and it has not been processed. I attempted to make the payment through the automated payment, but it would give me an error message and I was unable to successfully process my payment.

Complaint: I have filed a suit against XXXX XXXX concerning my home. The note and mortgage was cancelled in XXXX of XXXX. XXXX XXXX seven years later tried to claim the note. I have filed complaints against them several times with your agency ( CFPB ). Since then I found out between the months of XXXX and XXXX of XXXX. They filed foreclosure against me and in return I filed a suit that is pending. Around XXXX of XXXX, XXXX XXXX claim they sold the note to XXXX XXXX XXXX. I also filed a complaint with your agency ( CFPB ) against them also. During my suit I requested Temporary Restraining Order ( TRO ) until we could solve our disputes. They then removed my case from District Court to Federal Court around XX/XX/XXXX. I requested a TRO with the Federal Court but It was less than a week before the foreclosure and I had to file Chapter XXXX Bankruptcy. My case is still pending, but while the issues of this suit is still active XXXX XXXX XXXXXXXX sold the note to Caliber Home loans. I have filed around five Qualified Written Request to put them on notice that I do not have a contract with them and my note and mortgage is cancelled. I now believe all of the Servicers of this ghost loan is defrauding me. XXXX XXXX XXXX XXXX, XXXX, XXXX XXXX XXXX and Caliber Home Loans. I am now filing this complaint against Caliber Home Loans, because of Mortgage XXXX and Fraudulent conveyances. I have no contract with them and owe them nothing. They continue to harass me and violate the RESPA rules.

Complaint: I was affected by the recent Federal Government Shutdown that lasted 35 days. I had no income coming in at all, all my expenses have became delinquent. I recently requested mortgage assistance with my mortgage servicer Caliber Home Loans several times for several months to bring my mortgage current and keep my home. I have remitted mortgage payments by XXXX XXXX and my payments were rejected by Caliber Home Mortgage and returned to me. As of XX/XX/2019 I have resubmitted my request for mortgage modification with financials.Received correspondence from foreclosure attorney dated XX/XX/2019 XXXX XXXX XXXX foreclosure attorney stating my property is set for property foreclosure sale XX/XX/2019. The deliver notice for the certified letter XXXX XXXX XXXX was delivered by mail XX/XX/2019 was available for pick up post office XX/XX/2019 I wasn't given a 30 business days notice excluding weekends and holidays as required by Tennessee State Law.
