Complaint: I took out a home loan for $ XXXX in 2004 with XXXX XXXX. They file bankruptcy soon after. A company out of Texas called Caliber Home Loans continues to fail to document my payments and correct loan balance and does not own my loan nor do I owe them anything per the FDCPA, they are simply debt collectors acting on their own behalf and need clarification to all of thisXXXX XXXX XXXX XXXX XXXX claims to be the Trustee for XXXX XXXX XXXX XXXX out of Delaware, but I have not seen any documentation whereby they have paid any consideration nor bought my mortgage. I have a group of Attorney authorized on file and they have failed to send them the requested documentation. Right now I would like an update of my alleged loan balance and escrow account with this company, along with a copy of all documentation requested by my Attorneys.

Complaint: XXXX XXXX XXXX XXXX ( XXXX ) XXXX XXXX XXXX XXXX ( XXXX ) contacted us via mail, we responded, spoke w XXXX XXXX, and went through a qualification process. We were contacted next by the Senior Underwriter, XXXX XXXX on XX/XX/XXXX, who told us that he had spent several days on our file, had contacted our Mortgage company, Caliber Home Loans, and negotiated a restructure of our existing loan with the following terms : 2-3 percent, 30 yr fixed, and arrearages forgiven. He spoke with both my husband and me and told us this was done ( we had a complete modification pkg in at the time with Caliber and it was in underwriting ). I sent a letter of confirmation stating the terms quoted to XXXX. Next XXXX XXXX told us XXXX would sent a Cease and Desist letter to Caliber in our behalf, and a contract. She asked for three monthly payments for " performance trial payments '' for XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX totaling {$1200.00} per month. We made all of our payments. I have copies of all of the cashier s checks, as well as the tracking number information of receipt of same. She said we would receive an award letter at the end of three months, and the restructured loan document. The Senior Processor, XXXX XXXX spoke several times to us, said forward any correspondence from Caliber to him, until XX/XX/XXXX and cashier 's checks to XXXX, to XXXX XXXX.
Meanwhile, we received an approved modification agreement from Caliber on XXXX XXXX, XXXX, which was an interest only, 5 yr loan from XXXX XXXX, rather that Caliber. The agreement needed to be signed and returned by XX/XX/XXXX, and we did not received it until XX/XX/XXXX. I contacted XXXX, and they encouraged me that the negotiated loan was more in our interest.
XXXX XXXX told me to forward their agreement to him. Recently in XX/XX/XXXX, we received a verification of claim amount, and then a Notice of Power under Sale from XXXX XXXX of a sale date of XX/XX/XXXX. I forwarded these to XXXX XXXX at XXXX. i made several calls, daily, w no return calls. I emailed XXXX XXXX at XXXXXXXXXXXX He told me that he would " Look into it. '' I emailed him several times, and there has been no action : at one point, he sent a second email, stating " please forgive me, I will reach out to you in 48 hours. '' There has been no response via phone or email from XXXX.
i next contacted XXXX XXXX, XXXX @ XXXXXXXXXXXX who advised me to call Caliber that day, and find out if XXXX had forwarded our payments to Caliber.
CALIBER They had no record of our payments, nor of a negotiated restructure of our loan.
Caliber told us that our offered modification agreement from them expired XX/XX/XXXX, and to send a new application package in " tomorrow. '' I spent an entire day getting our application package ready, and uploaded the documents to Caliber.
I spoke several times with different representatives, XXXX, XXXX XXXX, and XXXX. Each time they informed me that there is " no sale date. '' Our application pkg was acknowledged, and a couple of documents were requested at approximately on or about XXXX XXXX on XX/XX/XXXX, which i gathered to upload within the hour. I knew that the regulation X law protected us from " dual tracking '' which was in play. I had also documented in a memo to Caliber, that I had been told there was " no sale date. '' by the Caliber representatives, previously mentioned with their ID no. s I tried to upload the requested documents, and was blocked, then I called Caliber and they told me that they " must have just place a sale date in their system ( after I noticed them in a memo ) ; and now they '' won t review my application. '' I believe this is deceit according the the fair debt practices act, and the federal regulations.
I believe that first XXXX deceived us, and has received our payments.
XXXX needs to instantur return all of our payments.
Secondly, CALIBER has told us " no sale date, '' while their law firm has told us the opposite. They are both debt collectors, and must be in communication. This is against the FDPA, and federal guide lines.
CALIBER needs to instantur rescind the Sale date ; XXXX XXXX needs to instantur rescind the Sale date..
With all of this deceit, I believe that we should be given that which was promised by XXXX- a 30 year fixed loan, at 2-3 per cent interest, with arrearages forgiven.
This complaint is documented in order that we retain our family home of 26 years, and hopefully no other family experiences this.

Complaint: I desperately wish to stay in my home. I do not have anywhere to move to with my kids. I now have the money to make regular mortgage payments.
I was in personal bankruptcy. The mortgage company, Caliber Home Loans, agreed to provide me with a loan modification on my home mortgage ( Loan number _________, Property : XXXX XXXX, MA XXXX_ ) so I voluntarily dismissed my personal bankruptcy case in early XXXX. I filed a loan modification application with Caliber on XXXX XXXX. Caliber agent XXXX ( ID No. XXXX ) advised me on XXXX XXXX that I only had two remaining documents to submit in order to complete my home loan modification. I submitted one document the lease agreement for my basement apartment -- on XXXX XXXX. The other document required verification of my wages -- could not be signed by a company officer from my company until XXXX XXXX because they were all on vacation. I have an email date stamp showing I submitted this final document on XXXX XXXX as I both faxed and emailed this document. Caliber Agent XXXX and Supervisor XXXX ( Agent ID XXXX ) just informed me it closed my loan modification application subsequent to XXXX XXXX. Caliber has a sale date of XX/XX/2017 to sell my home. Complaint: Hello Caliber home loan managers, I am writing to request your assistance in escalating, appealing, and review of a shortsale application that is before XXXX XXXX, representative, on the Res.Net. portal.
I have been working over six months to get to a point where there can be an amicable resolution, but I frankly believe that the offers and the willingness to resolve the matter are being acted upon in good faith.
The borrower is deceased and the executor to the property, XXXX XXXX, is attempting to complete the shortsale. The mortgage is in foreclosure at this time with motions and cross-motions pending before the court.
The original mortgage was about $ 305k, however, with the arrears, the total payoff is now $ XXXX. I have submitted a top offer of $ XXXX to the rep. who declined that offer today and demanded the XXXX payoff. That is NOT how shortsales work. The shortsale buyer is not an investor, but an end buyer who will reside in the property. Prior getting to this point, XXXX XXXX, not knowing what the payoff amount was and having no idea of the location of where the property was situated demanded $ XXXX after a BPO was done. I disputed that value and submitted repair comps. The investor then approved a demand for $ XXXX.
However, when I pointed out to XXXX that this demand is higher than the payoff, he then followed up with a request for the total payoff amount. I explained that the buyer is making an offer of over 70 % of the arrears and is an end buyer who can not qualify for more funding. The buyer is the Executor who wants to keep the property within the family so that she, her brother 's kids, and sister can live there.
At this point, I am frustrated with the responses and the process that I believe to be deceptive. XXXX has been very closed off in providing information and generally not explaining why the counter demands remain unreasonably high.
I urge you to step in and assist me in this process as soon as possible. Specifically, I would like XXXX XXXX XXXX to be taken off the review of the file. Another party needs to and should be assigned.

Complaint: This loan servicer has been unreliable and impossible to work with since closing on the loan.
In XX/XX/XXXX we were notified that our mortgage company did not pay our hazard insurance premium and they were going to cancel our policy. So we paid the premium out of pocket.
In XX/XX/XXXX we were noticed by our local city government that we had n't paid our property taxes and were facing a judgment. These also were to be paid by the mortgage servicer via Escrow.
In XX/XX/XXXX the mortgage servicer sent us a notice that our Escrow account projected balance was too low and we needed to send them {$440.00} to settle it, which we sent on XX/XX/XXXX.
In XX/XX/XXXX we requested that our Escrow account be removed and refunded so that we can just continue to pay our insurances and taxes out of pocket on our own since they continued to make errors and they denied our request.
In XX/XX/XXXX we received a notice from our flood insurance servicer that our flood policy had n't been paid and they were going to cancel our policy. Again this is supposed to be paid by our Escrow.
InXX/XX/XXXX we recieved a notice from the mortgage servicer that we did n't have a home owners insurance policy on our property so they were providing us one, we do in fact have one.
In XX/XX/XXXX we received yet another notice that our Escrow fund was low and they need a check for XXXX.
If they are n't paying our taxes, are n't paying our insurances how is the fund low? Further more I 'm a XXXX and my husband is a XXXX XXXX and we own 3 homes ; neither of us have ever seen anything like this in 15 years. Additionally, all of my clients that are serviced by this mortgage company have the same complaints. I want to open and investigation into the Escrow funds to see if they are servicing them appropriately and if there is any mishandling or commingling of the funds in some way to pay the companies debts or something, because this is just insane.

Complaint: On XX/XX/XXXX we had submitted the certificate of eligibility for the Sandy Forbearance program to Caliber home loans. After months of calling and asking for a response, they sent us a letter dated XX/XX/XXXX stating they require a Certificate of Occupancy prior to reviewing the loan for the program. On XX/XX/XXXX, when we received our CO, it was faxed to Caliber Home Loans. According to the letter requesting the CO, it states that upon receipt of the requested documentation, a Single Point of Contact representative will contact us to inform us that they have the information required. Subsequently, we will receive a follow-up phone call explaining the particulars of the forbearance. We have not received any phone calls, e-mails or US mail responding to the information sent. In addition, we had e-mailed a copy to XXXX XXXX, as he had requested that an e-mailed copy be sent to him. According to the law, we are eligible for a 12 month forbearance from the date we received our CO. We are facing foreclosure and have been patiently waiting for this offer of forbearance. I have been calling the Customer Service line at Caliber once a week since sending the CO and nobody is aware of any such forbearance. Time is not on our side. We desperately need this offer of forbearance, as we meet the criteria according to the law.

Complaint: XXXX XXXX, Vice President with Caliber Home Loans response to CFPB # XXXX is that Caliber Home Loans have not violated any servicing guidelines on my loan. Caliber also claims that Caliber has already provided me with supporting documentation and/or clarification relating to XXXX XXXX. When in fact all of the supporting documentation that I have received from Caliber to date supports that she was/is an employee of XXXX XXXX XXXX XXXX. aka Caliber Home Loans and/or XXXX XXXX XXXX. To date I have received no supporting documentation that XXXX XXXX had power to execute on behalf of XXXX XXXX XXXX., XXXX XXXX XXXX of North Carolina or XXXX. Furthermore I do n't have documentation that she had power from Caliber Home Loans either, because she is not listed on nether one on the Certificate Of Incumbency that I have on file for Caliber Home Loans. Complaint: I applied for a refinance through Caliber Home Loans, my existing Mortgage provider, in XXXX XXXX. This originated from a cold call from them to me and I only started this process because I had considered doing a refinance to complete some home improvement projects sooner than I had planned.
Caliber has since added additional requirements and at each stage, when I have provided everything asked for, or available, a new criteria has been added.
Now they are DEMANDING that I produce a relative who does not live in my home, and provide contact information for them. When I informed them that the only one I could think of was estranged, and repeated attempts to contact him failed, I provided the information for my child 's mother.
I was told that this was unacceptable and it was required to be a relative, and since I mentioned that I have a child, I am now required to provide " all pages of documents ''. I have asked what " all pages of documents '' means and advised that if they were implying some sort of court order, that one did not exist and I could not prove the " non existence '' of something.
The response was that if I did not comply with their policies, they will not process the loan. No response to my questions has been provided.
This is after a considerable monetary investment of time away from work and out of pocket expenses for appraisals and inspections.
This is discrimination based on family status and considering that this company had no problem accepting payments for the past XXXX years, they are actively denying a loan based on criteria that has nothing to do with the ability to repay a loan.

Complaint: SUMMARY : Caliber Home Loans erroneously posted a XXXX late-payment notice on my credit report and I want it removed. A Caliber Home Loans customer service representative told me that my XXXX payment did not go through due to an error with their third party payment processor. I have the confirmation number of that XXXX payment by their third party processor, Caliber Home Loan 's own internal system shows this exact XXXX payment confirmation number, and my mortgage payment statement reflects that I made my XXXX payment. Still, my payment was reported as late. I feel this is a misrepresentation of the facts by Caliber and it is erroneously being reported on my credit report.
TIMELINE : I submitted my mortgage payment for the month of XXXX. I used my usual payment method and submitted the payment to debit my bank account. The confirmation number for that transaction was XXXX. The XXXX payment appeared on my mortgage statement.
In early XXXX, when I went to submit my XXXX payment, I noticed my XXXX payment was rejected. I promptly paid both XXXX and XXXX payments at the same time but Caliber Home Loans already reported a 30-day late payment to the credit bureaus.
At this point, I double-checked my bank account and my bank statement showed I had more than enough funds to cover the XXXX transaction multiple times.
I called Caliber Home Loans three times on XXXX XXXX 2017 and spoke to three representatives : 1. XXXX told me that there is nothing that can be done. That opening a dispute to try and rectify the situation would result in an illegal violation of FCRA on their end. XXXX is not licensed to make such a statement.
2. Called again and another representative immediately opened a dispute and told me that I would get a written response within 10 days. He also told me the error code that their system generated when their third party payment processor processed the payment -- " Unable to locate account ''. I confirmed that I paid the same way I always pay, through their third party system. He later noted that I should have a favorable response since on their system the payment was attempted in XXXX but that the error on their end kicked it back.
XXXX. Called again and spoke to XXXX to submit my bank statement as proof that there were funds in the account. XXXX stated that there was no way to submit said bank statement to the dispute process but that he would make note of it on his log. He further explained that the error message was not from a lack of funds and that the dispute investigation will take note of that. When I asked for a manager, I was ignored.
I was alarmed that on the same day ( XXXX XXXX 2017 ), I got different responses on how to proceed with my issue. It makes me question whether my concerns were being properly handled. I was professional with all three customer service representatives. Having agents not have any standard response or knowledge management resource and telling customers whatever they want is always alarming. Especially when they start claiming legal violations of FCRA. That is not standard for contact agents to claim what is legal or not unless they are licensed to do so.
All efforts to further escalate the matter to upper management have been met with resistance.
On XXXX XXXX, 2017 I received a letter from Caliber Home Loans stating that they maintain their current stance and that the late - reporting would stay and that as a reminder, they must receive the payment within the month to avoid a late payment. I find this finding ridiculous as I did attempt to make a payment but it was rejected on their end.
CONCLUDING : I feel as I am being unjustly reprimanded through the submittal of 30-day late payment on my credit report. I have confirmation that I made the payment in XXXX by their third party processor, Caliber Home Loan 's own internal system, and my mortgage payment statement. Still, my payment was reported as late. It is not my fault that a computer error on Caliber/Payment processor 's end returned my XXXX payment ruined my credit score. I feel this is a misrepresentation of the facts by Caliber Home Loans.
ATTACHMENTS : 1. Caliber 's XXXX XXXX after I called to start an inquiry. Notice that the letter does not mention that I made any attempt to pay the mortgage nor does it address Caliber 's error code on their end.

Complaint: I tried for seven years to obtain a home modification. Since I was not receiving any help and after submitting multitudes of home modification packages, as well as thousands of dollars to catch up, I went to court and enjoined the mortgage and FINALLY received a modification. After the modification, I received a statement from Nationstar, indicating I am released from paying PMI, and therefor my payment was changed. I tried contacting XXXX, to no avail. Then I received a notice from Caliber Home Loans LLC stating they had purchased my note but XXXX was still my servicer and I was to continue to send full or partial payments to XXXX, which I did and the payment was returned. On or about XXXX XXXX, i received notice of foreclosure on XXXX XXXX, clearly disregarding laws of foreclosure notice. I contacted Caliber, and they refused to speak to me. Although they claimed I am not the mortgage holder, they said a " cease and desist '' communications was in my file? How is that possible since they never communicated to me? I sent a letter in writing as instructed and received a letter back saying they were investigating my claim of " errors '' made. I then signed in to my XXXX ACCOUNT prior to the foreclosure and received a statement " your loan has been paid in full, if you are on automatic payments, you will be withdrawn and owe nothing further.
On XXXX/XXXX/XXXX, I received notice, without any outcome of Caliber 's alleged investigation, ignoring my requests for production of NOTE or production of document with my signature on " cease and desist communications, that my home was foreclosed. My self and my XXXX young sons are now being threated to be locked out of our home via Sheriff. The notice was from the sheriff was addressed to my teenage son, my mother, who does not reside here, and myself whom Caliber has claimed all along that I have no mortgage with them. The is the most heinous, egregious example of an unlawful foreclosure, using UNITED STATES POSTAL SERVICE TO SEND FRAUDULENT AND MIS LEADING DOCUMENTS regarding the same.

Complaint: At closing of my loan with Caliber Home Loans, Inc on XXXX XXXX, XXXX, for the amount of {$490000.00} - I was presented with a Compliance Agreement. I have no problems with compliance agreements to provide missing documentations but under this agreement, I as a borrower only have 7 days to comply with any request.
XXXX I have with this agreement is the small window I have to comply with this request. What happens, if I get a letter in middle of a vacation or business trip and I cant respond within 7 days? Under this agreement, my failure " shall constitute a default under this loan. '' This seems like a easy way for bankers take advantage of borrowers for noncompliance.
If I had known about this requirement with sufficient time to close, I would have never have gone through with this loan. Unfortunately, I had no time left to look for alternative funding options without my real estate deal falling through. Therefore, I was forced to sign this agreement to ensure I did not loss my {$10000.00} deposit as part of my sales agreement. I feel like the bank had me over a barrel and I had no choice but to sign this agreement. This agreement is 100 % in favor of the bank and offers zero protection to hard working consumers. I really appreciate you looking into this matter.

Complaint: when I found out that the loan for my mortgage was in the wrong name, I contacted the XXXX, the mortgage company at that time. They did nothing. I sought legal advice to have it removed. I was told that I had to refinance my house, if I wanted it out of that persons name. XXXX told me they did n't do refinancing or modification. I contacted other companies for modification but unfortunately I was XXXX mailed by the person whose name was in the loan. He requested money to sign the paperwork. After I paid him the money, he left town. This caused my house to foreclose. XXXX then transferred my loan ( with the same fraudulent paperwork XXXX to XXXX home loan. I spoke to XXXX today, XXXX/XXXX/XXXX, for the XXXX time, about the fraudulent name and documents. According to XXXX, there is no paperwork with my name on it. Now that my house is in foreclosure, and I 'm not able to do any transaction or ask any question, unless I give them the info for that criminal that they have all over my paperwork, I have no choice but to report this fraudulent act to the government. I had to declare bankrupt, just to save my house, as I 'm the rightful owner.
I 'm trying to settle this matter without filing a civil suit, as I 've exhausted all my financial resources. The owner of the loan is XXXX Master Participation XXXX. They are predators, who preyed on innocent people like myself. They falsified the paperwork when I did my refinancing in XXXX, removed me as owner of my house, while they collected money from me for the mortgage. I was not able to enquire about my property, without giving them the info of the criminal that they used to XXXX side me. I brought this man to the settlement at the time of closing in XXXX XXXX, based on what they told me. I never knew that they would put my house in his name. This was a scam and fraud, but I never knew it then. It was n't until XXXX, when I refinanced the house, that I realized that I was scammed! I had no choice but to include the scammer in the refinance process. That 's how XXXX, had it set up. XXXX, kept transferring me from XXXX servicer to another. Finally they sent my paperwork to XXXX, whose plan is to take away my house.

Debt was result of identity theft
Complaint: On or about XXXX XXXX I received notification from my employer 's health plan that their database was compromised. They then offered me an ID theft protection plan. I checked all my records at that time and found nothing was affected.. When I went to file my taxes, I come to find out that my SS # was compromised and they took my tax refund. This was cleared up by the IRS for that year. Then in the midst of doing my taxes for the following year and secondarily at the request of the IRS an audit was requested. I come to find out that my SS # was used to get a vehicle loan in the state of CT. This was reported to the IRS and now they are requiring me to pay a tax penalty on this loan that I DID NOT report. In conjunction with my CPA and the theft ID program I/we have been attempting to get a letter from XXXX XXXX XXXX indicating that this is a fraudulent loan and that a letter is needed from them saying that so that I can turn it over to the XXXX XXXX of XXXX I have sent several letters and along with several phone calls have tried to get this resolved. They keep sending the information to the wrong address or they keep giving me the run around as to who to call, they never give a name of a person to speak with.
