Complaint: I filed for bankruptcy in XXXX of 2014. My case was discharged by the courts in XXXX of 2014. My mortgage company Caliber Home Loans refuses to lift the hold on my account stating that they never received an " abandonment of property '' document. This is issued before the case is discharged by the trustee but once the case is discharged that paper means nothing.They will not send me statements or allow me any internet access to my account. I have never missed a payment. They charge me XXXX dollars to make a payment on the phone so I have been paying via bill pay at my bank. I dont know if my escrow is being paid or my insurance. The amount of my payments changed and I was never notified. There is mony in an account of unapplied funds that they wont apply it to my account. I feel like they are trying to make me default on my loan which they bought from my original mortgage company. Help please!!

Complaint: A family member passed away and in order to keep the house I assumed the mortgage from their spouse through a formal " mortgage assumption '' provided by Caliber Home Loans. After approval of the mortgage assumption, the closing process was completed XX/XX/XXXX. My family has since moved into the house. During the closing process the loan officer at Caliber went on vacation. One week after closing I began to reach out to Caliber every few days via email and phone to get a method of payment such as a statement or login and also to confirm the transfer of ownership was complete. Several weeks later I was told the former loan officer was no longer with the company and that the file is being reviewed. Caliber Home Loans has NOT contacted me with a timeline or any communication to resolve the situation. The mortgage is now over 30 days past due because they refuse to acknowledge and provide the transfer of ownership. As a result, my family is not associated with the account and they are not accepting payment. A VP at Caliber even contacted the ex-owner about having a negative balance. Caliber Home Loans wo n't refund the escrow or provide the lien release to the ex-owner despite the assumption process and closing taking place. This is causing an incredible amount of stress on everyone. If Caliber does n't resolve this now, it could negatively affect the credit of both the ex-owner and my family.

Complaint: I inherited the house upon my grandmother 's death in XXXX XXXX. At the time of my grandmother 's death I was only working a part time job with XXXX. Whereby, I did n't have the monthly income to keep the account current. Since I began handling the estate of my grandmother, I have had XXXX periods of unemployment which was from XXXX XXXX until XXXX XXXX and again from XXXX XXXX until XXXX XXXX. I now have sufficient employment. whereby, I can now afford the monthly mortgage payment. But, I do not have the money to pay {$9000.00} towards a total past due amount of {$12000.00} in order to start a repayment plan. The servicer is stating that the DTI ratio shows I have the ability to pay the mortgage. But, the servicer is n't taking into account how the mortgage got behind along with my ability to pay towards a large past due mortgage balance. The CFPB Rules state that a client inheriting a home should be able to have the loan modified into their name with reasonable terms which the present offer is n't reasonable.

Complaint: Today it was brought to my attention that a mortgage company has been reporting to all XXXX credit companies. I 've never had a relationship with the company called Caliber Home Loans, but they have been reporting as if I do for the last year. I did previously own a property with XXXX XXXX XXXX, but as of XXXX XXXX I was discharged and cleared in the United States bankruptcy court in XXXX NC. I was discharged from XXXX XXXX XXXX and all other debts. At the time of XXXX XXXX, I gave up all rights to the property and debt and had not lived in the property since XX/XX/XXXX. So it crazy to me how a Rep at Caliber Home Loans by the name of XXXX XXXX number XXXX, told me that they acquired the loan from XXXX XXXX XXXX as of XXXX XXXX, A whole year and a half later after my BK was discharged. XXXX XXXX stated that my BK did n't discharge me from the property, all it means that they ca n't collect the monies on the property that was owed before my BK, but that they can continue to report this loan to the credit companies, and that they can collect funds on the property since the discharge of BK, but If I want to go on a payment plan, modification she could help me cause If I called another department no one can speak to me because her department is the only one that can handle my calls. I told her, I did n't need her help because I gave up the property and that the property was discharged in BK. After I stated that XXXX XXXX, became disrespectful, rude, and used foul language to me and placed me on hold without asking and never came back to the phone. I just ca n't believe that this is possible.

Complaint: I was previously with XXXX and I started doing a loan modification with them and in the middle of the loan mod they sold my loan to another lender XXXX and this lender send me to another lender XXXX and so on... In the meantime I did not receive any information of this until after I received a trustee sale date and when I called Quality loan Trustee I asked them who is the loan with they said Caliber Home Loans I asked them what was the loan number and they hung up on me. I called around XXXX times to them and they kept hanging up on me. After XXXXcouple days of this I finally got a hold of someone who helped and provided me with a loan no. I called Caliber home loans gave them my social, the loan no. provided by quality loan and they kept hanging up on me as well. When I call caliber home loans and they ask me to enter the loan number which I did but the phone kept hanging up on me after I put in the loan number. I also went online and printed a loan modification packet, I filled it out and put together a full packet by the RMA instructions and I faxed in to Caliber home loans. The next day I called them asking them if they received my fax they said they did not and I told them I have confirmation but they hung up. I called them couple days later and asked them about the fax and the loan, they kept asking me for the loan number which I only received from Quality loan but they say that's not it and hung up. I even gave them my social date of birth which by that information they should locate my loan but they cannot and hung up again. I don't know what to do anymore and how to work with this company. I have a sale date scheduled XX/XX/2015 and am very worried that they are doing this to just say oh you did not send us any docs for a loan mod and then they will just sell the home. How can I get a hold of them so I can work with them? Please help me as this is getting out of hand and getting very close to the sale date.

Complaint: My loan company, Caliber Home Loans, sent me a certified letter stating that I 'm XXXX XXXX XXXX XXXX behind. This is false, and I can prove it! They also have reported me as being XXXX payments late. Also, FALSE! XXXX XXXX XXXX XXXX to XXXX XXXX XXXX XXXX years ago we had to retain an attorney because our mortgage company, Vericrest Financial, also accused us of non-payment and paying late. After a process that took XXXX XXXX years, the attorney got them to settle out of court and they were supposed to fix the negative reporting from all XXXX XXXX XXXX XXXX credit reporting agencies. They failed to do this and I was not able to get them to comply. I had to write to the individual companies and only XXXX XXXX XXXX XXXX were fixed. Also, I applied for a loan modification to Vericrest, which the attorney was able to get them to accept when, previously, Vericrest had denied it. Now Caliber Home Loan is doing the same thing. They are reporting us as paying late, non-payment and I resubmitted a loan modification, since it was due again, and Caliber loans says I never filed XXXX. At this time, I 'm unable to retain an attorney because XXXX financially, I ca n't afford an attorney right now. But I can prove, that even though I have been sick, I have still been paying on time!!!!! After the problems with Vericrest, the attorney suggested that we only pay our mortgage with a certified check, every month, and then send it by priority mail and keep the tracking numbers and receipts. This is what we have done every month, for the last XXXX years, so we have ample proof that they are falsely accusing us!!! I will be submitting the letter that was sent from Caliber, along with our two ( XXXX ) months of the certified checks and the receipts from the post office with the tracking numbers. I sincerely hope that you will investigate and that they will be punished so that no other family will have to go through this!!!! Complaint: In XX/XX/XXXX Caliber Home Loans sent a loan modification offer to an unknown address in a different state than I live. Please provide documentation showing who requested the documents to be sent to a different address? The offer was not sent to my address, my representing attorney or to the mediator named in Foreclosure Mediation Notice sent to XXXX / Caliber on XX/XX/XXXX by the State of Washington XXXX. I was n't made aware of the offer until mediation on XX/XX/XXXX after the offer was expired. At mediation Caliber stated they would re-instate the offer once they received a Quit Claim Deed and another completed loss mitigation application. I complied with their requests on XX/XX/XXXX, they were sent several completed applications and the counties recorded Quit Claim Deed on XX/XX/XXXX and multiple times since then per their request. They sent me XXXX denials for modification. Why was I eligible for a loan modification in XX/XX/XXXX but am not now? What criteria was used in the determination in XX/XX/XXXX that is different from the criteria used in XXXX & XXXX? Please provide written documentation of the criteria used in the determination in XX/XX/XXXX and again on XX/XX/XXXX. At the XXXX mediation XX/XX/XXXX I was told the investor guidelines wo n't allow Caliber to offer a loan modification because I have too much equity in my home and I can afford the payment. Which is true now that my lengthy ( 1 1/2 years ) divorce is over and I have been awarded my home, I can make the payment given the opportunity to do so, but Caliber & their Investor wo n't allow it. Why ca n't they put the delinquent amounts on the end of the loan and allow me to pay an additional $ XXXX {$300.00} a month on top of my regular payment to help pay the past due amounts? Any question I ask Caliber regarding the modification or denial is always " the investor guidelines do n't allow it ''. What does the investor guidelines allow? It is apparent the investor and/or Caliber has no interest in working with clients, they are not acting in good faith and they do not offer a fair review process as required by law.

Complaint: To Whom It May Concern, I am filing this complaint against my servicer because they have failed to comply with my Qualified Written Requests. With all the recent news and fines imposed upon various lenders and banks, I am certain that we are victims of a faulty " mortgage-backed securities loan ''. My servicer has not complied with Federal or State law, specifically California Homeowner 's Bill of Rights ( HBOR ). Under this newly enacted law, it prohibits beneficiaries or servicers from recording robosigned documents on all mortgage-related notices of default, notices of sale, assignments of deed of trust, and substitutions of trustee, recorded in connection with a nonjudicial foreclosure, as well as declarations filed in court with respect to any foreclosure proceeding. The law further states that documents must be accurate, complete and supported by competent and relevant evidence. My servicer has failed to demonstrate that the foreclosure documents recorded against our property supports their ability and/or authority to proceed with a foreclosure. We are certain that the recorded documents recorded against our property are not accurate and are robosigned. This is in direct violation of the law. HBOR mandates that before recording or filing any mortgage-related document that it must be competent and reliable to substantiate the borrower 's default and the right to foreclose, including the borrower 's loan status and loan information. Unfortunately for us, our loan has been transferred in the last year. We are certain that our current servicer is in violation of Civil Codes 2924.17 and 2924 ( a ) ( 6 ). We have no idea who the present beneficiary is of our debt obligation is. Who my servicer tells me is the beneficiary does not coincide the data we have gathered through an audit of our debt obligation. It is our belief that the Assignments of Deed of Trust recorded against our property are a complete fabrication of the truth. Despite a recent ruling that stated homeowners could challenge assignments recorded against their properties, the California courts repeatedly rule that we do n't and choose to rely on other case law. Since when does case law take priority State law? The notion that homeowners can not challenge assignments of deed of trust recorded against their property is just unconscious. We as homeowners and tax payers and not getting our due justice. It is a well-known fact that these banks have been fined millions, even billions of dollars for faulty mortgage-backed securities. If these lenders and servicers are having to pay fines for their wrong doings, how is that we as homeowners are getting slammed and rejected in court? It just makes no sense and it is a complete injustice. There have been new laws put in place to further protect homeowners against wrongful foreclosure, and yet the courts choose to ignore them and us. I felt it necessary to file this complaint to exercise our rights to find out who truly is the beneficiary of our debt obligation. We are seeking the assistance of the Consumer Financial Bureau because the courts are favoring the lenders and banks and the recorded documents against our property are in direct conflict with the audit we obtained on our property. We need your assistance in informing our servicer to cease and desist with any further action against our property, including with proceeding with a foreclosure on my home scheduled for XX/XX/XXXX, until these matters are resolved. The Assignment recorded in XXXX of this year recorded against our property is not consistent with what our audit has revealed. It does n't even coincide with the Assignment that was recorded back in XX/XX/XXXX which was executed by MERS. The Assignment recorded in XXXX was executed by Caliber. This demonstrates a complete fabrication of the truth.
