Complaint: My XXXX home was damaged on XXXX XXXX, XXXX by an out of control vehicle. Due to circumstances beyond my control, I was forced to be evacuated from my home for more than a year. I suffered inconvenience ; disadvantages ; discomforts ; and unnecessary difficulties, while a contractor who was hired and paid by your company was supposed to rebuild the XXXX floor of the house, which was almost totally destroyed ; was supposed to repair any and all damages to the XXXX floor ; and was supposed to repair any and all exterior damage, including damages to the very foundation of the structure .Your company, as well as your contractor and anyone else involved, were all made aware that when the vehicle flew through my house that it shifted the house off of its foundation. However, my insight was neither welcomed and/or addressed. But once I had re-occupied my home, by XX/XX/XXXX rainy season I had no choice but to contact your company in a letter dated XXXX/XXXX/XXXX, accompanied by photographs, addressing this unacceptable situation. ( Please See Attached ) Now it has been XXXX months since the vehicle accident and the basement situation has been exacerbated exponentially. As previously stated, the basement fills with mud and silt whenever it rains and/or when the snow melts. It began at a somewhat manageable rate, but as time goes on it was increased dramatically - it now covers your feet if it rains for XXXX days. Visual investigation reveals that the foundation has crumbled away even more now and has fallen in causing the adjacent driveway to crack and deteriorate with holes large enough to peer down through to see that dirt has been displaced. You can see that underneath the pavement of the driveway is hollow. Were it not for the rebar in the foundation of the driveway it would have caved in already. It should immediately be torn up, refilled with about XXXX inches of rocks and gravel, then re-paved. This active hazard is a situation that poses a threat to life, health, and property. There is eminent risk of harm to individuals and damage to property other than the house and land. I am afraid that either my vehicle is going to fall through the driveway pavement or someone walking through the driveway XXXX fall and be injured at any time. I am XXXX years old and have had to have my XXXX, thus I am XXXX. This Friday on XXXX/XXXX/XXXX I am scheduled for yet another XXXX. Because I XXXX, I am vulnerable to the inherent risk of parking my vehicle in this unsafe area. I am afraid that one day the pavement may give way and my vehicle may suddenly go crashing through the unsupported driveway, injuring me and damaging the vehicle.
The basement houses my washer, dryer, and XXXX ( XXXX ) freezers. Therefore, I and/or my care giver ( s ) must go into the basement often to wash, dry clothing and retrieve food. When it is wet outside the basement floor is extremely slippery and unsafe. Additionally, my appliances have been damaged by the constant barrage of mud, slush, and muck. During each rain the dirt beneath the driveway turns to mud and continues to wash away from underneath the driveway and flow into the basement taking with it silt and crumbled pieces of concrete from the foundation. I am an XXXX year old XXXX with several physical problems including a XXXX problem. I am sick and tired of trying to find someone and paying them to clear the mud from the basement, haul it up the steps, and scatter it back on the outside. To try to put the mud back under the driveway would make no sense whatsoever. As a XXXX on a fixed income I am doing all that I can to maintain YOUR property. However, I am unable to make the repairs necessary to upgrade the current situation from dire to tolerable. I am tired, XXXX, XXXX

Complaint: This complaint is being submitted due to derogatory information on our credit report for property located at XXXX XXXX XXXX, XXXX CA XXXX. XXXX XXXX XXXX, NA collateral was surrendered in a Chapter XXXX XX/XX/XXXX in Federal Bankruptcy Court and the presiding judge was XXXX XXXX. This secured claim was surrendered and satisfied in full through surrender of the collateral. XXXX XXXX XXXX then sold the loan to another mortgage company and they sold the loan which resulted with One West Bank having the loan now. They have the property in foreclosure on my credit report as if I still own the property. One west bank has been notified by my attorney that the property was surrendered XX/XX/XXXX and of the improper conduct of XXXX XXXX XXXX

Complaint: My bank has placed a foreclosure date on my home. I have placed my home on the market and we finally received an offer which was presented to the bank and denied due to the foreclosure date I also submitted my documentation requesting for a mediation which were submitted late due to lack of knowledge by the person helping us save our home, a date of XXXX XXXX, 2015 has been giving but my bank continues to proceed with the foreclosure process.

Complaint: My XXXX XXXX spouse and I were married XXXX XXXX, XXXX and purchased our home jointly in XXXX. In XXXX we were interviewed telephonically prior to obtaining a reverse mortgage in XXXX. We were told that if I quit claimed my half of our property over to my husband we would be able to withdraw an adequate lump sum to pay a low cost loan from the County of XXXX used to upgrade and resolve much needed repairs to our aged home. In XXXX my husband renewed the reverse mortgage for additional upgrading and to purchase a used vehicle for me.
I was married to my husband throughout the term of the HECM, and there are no invalidating claims against the mortgage except my husband 's death. I have maintained the required insurance and taxes in good faith that I will be permitted to remain in my home of XXXX years.
I have been able to follow the various federal court cases in XXXX, addressing reverse mortgages as they apply to non-borrowing surviving spouses.
HUD was admonished by the court in XXXX for not providing relief for Non-borrowing Surviving Spouses. In XXXX HUD addressed and resolved some HECM issues for non-borrowers residing in the borrowers home at the time of the HECM. However there remained no relief for Non-borrowing Spouses if the XXXX was obtained prior to XXXX XXXX.
In XXXX XXXX, HUD set forth a list of requirements so that individuals such as myself could remain in our homes until death. In XXXX XXXX, a Class Action was filed against HUD, in part, for financially discriminating against Non-borrowing Surviving Spouses in that the financial requirement listed was cost prohibitive. Within a few days, HUD rescinded all requirements and permitted all lenders/mortgagees to offer a XXXX day extension on foreclosure proceedings being XXXX XXXX, XXXX. At that time our lender, XXXX XXXX Bank postponed the Trustee sale of our home to XXXX XXXX, XXXX.
If our home is sold at auction, I will become homeless and since I am on XXXX only, the irony is that I will have to apply to HUD for help to find a place to live.
I am hoping to get HUD to offer Financial Freedom the opportunity to either extend my husband 's HECM until a final court decision is rendered or for HUD to except the HECM from Financial Freedom, since the only default is that the borrower died.
Thank you so much for any assistance you can offer me, I can not afford counsel and have been handling all communications myself since my husband 's passing on XXXX XXXX, XXXX and the first posted Trustee sale date in XXXX XXXX.

Complaint: My husband ( BORROWER ) of a XXXX loan now deceased. I, the Non-Borrowing Spouse while in the mist of complying with ML XXXX learned TODAY XXXX/XXXX/2015 that the program as been rescinded. Ironically, today XXXX/XXXX/2015 was my deadline given to submit monies to comply with HUD 's Principal Limit Test. I called in this morning to get how to submit instructions and/or extension request. I was told that the program had be scraped by HUD and the server was not going to honor or offer the program to me. Devastating news to me for I stood ready to fulfill the outstanding requirements. So XXXX now I feel victimized of my rights as a XXXX, let alone the devastation of losing my husband I have to add these additional disappointments and agony. ML XXXX was rescinded with XXXX. This complaint goes out to HUD for their indecisiveness and wearing XXXX faces. HUD created the problem I am now faced with ( foreclosure ) while insisting that the lender proceed in foreclosing and creating my displacement all to satisfy the conditions for paying insurance claims. These foreclosures are illegal under federal law and I PROTEST. HUD need to be held accountable because I was removed from title to my home at the onset of the XXXX now I 'm being punished. I am being VICTIMIZED!!! Please advise!!!!.

Complaint: For XXXX months I have been trying to access my OneWest on-line account to make a payment. I was locked out of the account and OneWest will not assist with helping to re-set the passwords! I 've called, and made requests in writing, to no avail. I 'm now sending payments based on my recollection of what past payments have been, and am unable to view the account to see if those payments are over or under the amount due. My last payment of {$800.00} was sent on XXXX XXXX, which should have been more than enough to cover what was due. On XXXX XXXX I see a XXXX days past due ' come up on my credit report!! Unacceptable and to my detriment because of their poor customer service. What is my recourse and how do I get this OFF my credit report??

Complaint: I 'm stating this because I find it absurd that the limitation for debt forgiveness is under {$750000.00}. I 'm a widow whose late husband refinanced against my wishes and now I 'm responsible for debt over {$900000.00}. In negotiations with OneWest/IndyMac for a mortage restructuring, they received a desktop evaluation that my house is worth less than {$500000.00}. For that reason, I refused the terms of their modification contract. In said contract, they asked me to sign the statement " If, at any time, I can not afford to repay the entire amount of the loan, I agree OneWest/IndyMac can put a lien on any and all of my other assets. '' I refused to agree to that, and also can not accept a modification that 's equivalent to a sub-prime where the interest rate starts out low but increases every few years. I am now facing foreclosure so I would like to see if I can get an extension to the foreclosure date, which is now less than XXXX months, to give me time to find a place to live.
