Complaint: ENTITY INVOLVED : CALVARY PORTFOLIO SERVICES, LLC. For nearly a year now ( since XXXX ), I have been trying to get erroneous collection data addressed on my credit report with the three credit reporting agencies. The erroneous data resulted in a denial of 3 housing opportunities in XXXX. As a XXXX XXXX XXXX, I am beyond frustrated with the reporting entities ' failure to follow federal rules and regs. As of XX/XX/XXXX : XXXX finally realized that Calvary Portfolio Services was reporting erroneous data that could not be verified, in violation of Federal Regulation V. As of XX/XX/XXXX ( and going back several years ), Cavalry continues to report an alleged collection account with an open date of XX/XX/XXXX to XXXX and XXXX. Upon written request ( dispute ), Cavalry they could not verify the proper account balance ( different from what appears on credit report ), the date the alleged account was closed, date reported or the charge-off date - to the credit agencies. THIS ACCT WAS RE-AGED by Cavalry despite no legal event that would allow re-aging. Per XXXX data, the account is about to turn 7 years old. As of XXXX, Calvary reports to XXXX that the contact info. for this alleged collection account is in XXXX, NY. However, Calvary reports to XXXX that the contact info for this account is in XXXX, AZ. This is another clear compliance violation. Interestingly, in XX/XX/XXXX, another company " XXXX XXXX '' sent me an invoice out of the blue and - says their client is Calvary SPV I, LLC, owns the account. Payment is demanded. This account over the Statute of Limitations and this entity is located in South Dakota. So, we have NY, AZ & SD offices and two different entities demanding payment on this re-aged alleged debt. Thanks to violative conduct by Calvary and associated entities as well as non-compliance by XXXX XXXX and XXXX XXXX by failing to properly obtain verification, harm has been caused to this consumer.

Complaint: Cavalry and their law firm XXXX XXXX XXXX have been using false representations trying to collect a debt from me without any evidence that the debt is mine and that they own the debt. Among other wrongs, they have used a false credit card agreement to verify the debt and to file the lawsuit. The real credit card agreement for the alleged account, which can be obtained from the supposed original creditor XXXX or from the CFPB database, is markedly different from the credit agreement they have been attempting to collect with. This is in violation of the FDCPA. Again, they filed a lawsuit against me 3 days after the statute of limitations had expired, according to the last payment dates on the credit card statements they provided in debt validation and in court. And in order to trick the court into getting a judgement against me, they submitted a random computer printout where the date of last payment was changed to be the very last day of the statute of limitations so it looks like they filed the lawsuit just in time. They tried to use the court to collect a debt using evidence that had two different dates of last payments with no explanations for the inconsistencies. Again, the amount they claim is owed on the debt and reported to the credit bureaus is different from the amounts on the alleged credit card statements they provided as validation and in court. So yes theyre validating and trying to collect a debt using documents that show two different amounts owed with no explanation. Again, they are attempting to collect a debt using an affidavit which contains a notary signature that appears to be forged. The signature appears as a pixelated image, in stark contrast to the other signatures and marks on rest of the document. This is not an artifact of photocopying, and is consistent with digital forgery. When I pointed out to them that I do not owe the debt and showed up to trial ready to put an end to it, they non-suited without prejudice, so as to avoid getting a judgement against them, so that they can keep tarnishing my credit reports with the hopes that I will one day send them money. Theyve had nothing to say about all these violations and lack of evidence that the debt is mine and have refused to take this off my credit report. Cavalry and their attorneys have committed multiple violations of debt collection and common laws and have refused to stop collection and remove this debt from my credit reports.

This seems to be a common practice with today 's debt collectors where they buy a debt that has aged out and then re-report it on your credit as of the date they purchased it. The account in question has passed any/all time limitations. This Company should be investigated for their practices not only in my case but in all the consumers they have affected.

Complaint: I was noticing a few days before my direct deposit was supposed post I tried to open my account using my phone and on the computer and I couldn't open my account at all. XX/XX/XXXX ( Thursday ) I called the bank to find out why I couldn't open my account that is when I found out that there was a write of garnishment of property on checking account. I called Cavalry Portfolio Services and spoke to a women ( do not recall the name ) who answered the phone and taken my up dated information and I ask her why didn't they go thru HR with DoD which I've been employed for the past XXXX and not XXXX which was a part job which I have not work for in over a XXXX XXXX she said they couldn't locate me and that was very hard to believe. XX/XX/XXXX : I went to the court house in XXXX XXXX County I spoke with an appointed court attorney explain to them ( her ) that I didn't know a third party company could block my bank account from any debits from my bank account until the entire amount is paid, I have no money to pay any of my bills. I was asked to get copy of the case that was filed this affidavit was served on XX/XX/XXXX to the address of XXXX XXXX XXXX XXXX XXXX XXXX MD XXXX. My concern is this form is the exact form submitted on XX/XX/XXXX .... nine years ago and now submitted again without even trying to locate me or thru the HR department at XXXX XXXX XXXX XXXX where I've been the last XXXX know, I believe this was purposely done, not to collect the amount XXXX XXXX purchased it for but the interest for the past nine years included. Know the other problem I have with this Writ of Summons is .... I was living in XXXX Va. at XXXX XXXX XXXX XXXXXXXX XXXX during time they said I was served or summons ( I have attachments of w-2 form ) and I didn't find it in my last year credit report and I request another for this year. I also believe this account is not mines and I say that because XXXX I was living in XXXX Va.
