Complaint: I XXXX XXXX have made several requests for proof that a creditor once originated with a national financial institution that has FDIC insurance can sell off a debt that is part of a securitized trust. Then these same debt buyers that used to be known as collection agencies could re-assign the debt to a fourth party for collection enforcement. This process of stating that debts are being purchased by a third party and then enforced by a fourth party is the larges scam in America. The U. S. Supreme Court decision in XX/XX/2017 known as XXXX v. XXXX XXXX XXXX XXXX is responsible for this scam. This decision basically states that since a third party purchases the debt, that my rights under the Fair Debt Collection Practices Act is VOID. The problem is that almost all unsecured debts are sold off to XXXX XXXX in various traunces in securitized trusts. There simply is no resolution where the debt can be purchased, only that the debt can be assigned for collection purposes. Each financial institution must file a 10Q filing quarterly with the Securities and Exchange Commission. The rules on debts being charged off is with the Federal Deposit Insurance Corporation through the FDIC Act, XXXXode 5000. A debt can be classified either standard or sub-standard. Debts over 180 days late must go into the sub-standard category and written off on a quarterly 10Q SEC filing. These charge 0ffs usually are submitted in the tens of millions of dollars. So its virtually for these debts to be sold..period. Accordingly, I request full validation proving the debt purchase. Secondly, I will entertain a very low settlement agreement to put my dispute to rest. All of the settlements can be submitted through the CFPB portal email address submitted. I am still within my rights under the FDCPA since proof of a purchase to a third party has never been established.

Complaint: XXXX XXXX XXXX Credit Card - I closed the account due to charges that were not mine. Issue was not resolved. The account was charged off in XXXX. XXXX XXXX XXXX - I received threatening notices and calls in XXXX. The amount had gone up to {$9000.00}. Cavalry Portfolio Services SPV- I Received threatening calls of garnishment and would be taken to court if I did not pay. XXXX XXXX XXXX Attorney for Cavalry Portfolio Services SPV - Sued me and went to trial on XX/XX/XXXX. Sheriffs Dept.- Received a Levy Notice shortly after trial, completed the Exempt form and mailed to Sheriff Dept. the amount went up to {$13000.00} and still adding on more interest. I retired in XX/XX/XXXXand living on a Pension. Had I known I was exempt from garnishment I would have told the judge. Even though I answered the Levy, I am still getting these Levy notices, I wrote to XXXX XXXX XXXX to stop. I have been getting the Levy notices since XXXX, and they don't stop coming.

Complaint: Cavalry Portfolio Services LLC as assignee of Cavalry SPV I , LLC ; is attempting to collect a false debt and also falsely suing me for debt that is not mine ; that I never had ; as I have never owned or had a XXXX XXXX account that Calvary states they purchased from XXXX XXXX in XX/XX/XXXX in the amount of {$3700.00}. Calvary Portfolio Services claims I owe this debt and has attempted to collect the debt through bank levy. Court files show they have been pursuing me since XX/XX/XXXX and filed suit in XX/XX/XXXX without my knowledge and without ever contacting me. Cavalry and it's associates makes claims to proof of service by substituted service in XX/XX/XXXX at an address I no longer lived at. Cavalry has been attempting to collect and sue/take me to court ; all without my knowledge using an old address to pretend to contact me until XX/XX/XXXX in which I received notice from the county recorder of an involuntary lien recorded. On XX/XX/XXXX I called Cavalrys ' Collections Attorney ; XXXX XXXX XXXX to receive information and dispute debt. They stated I now owe {$7200.00} ; which is a misrepresentation and not what is stated in the lawsuit. I sent a dispute letter and request for validation of debt by certified mail to both Cavalry and XXXX on XX/XX/XXXX in which they both received. XXXX XXXX XXXX sent me their first correspondence ever stating they were attempting to collect a debt. The amount stated over the phone and on paper are different. The information provided in their correspondence to me does not belong to me ; nor are there any documentation of proof showing that I had such account or that there is a debt owed by me. The file sent to me was incomplete, unverifiable, and inaccurate and the dates do not match up nor are there any signatures or valid information to link me to this false account. Calvary filed in XX/XX/XXXX an abstract of judgment against me which should be stopped immediately. I only know of this recent file by way of the county recorder. Calvary has been attempting to collect a false debt since XX/XX/XXXX. Cavalry obtained a default judgment in which I never knew about in XX/XX/XXXX by using a previous address so that I could not dispute or fight for my rights. A debt collector must serve you with notice of a lawsuit if it sues you. And if it gets a default judgment against you because it failed to serve you with notice of the lawsuit, it is prohibited from trying to collect on that judgment. Collectors are not able to collect phantom debts ; this is violating the Fair Debt Collection Practices Act. Saying I owe a nonexistent debt is in violation.

Complaint: I have made several attempts for Cavalry Portfolio Services LLC to remove incorrect debt posted to the credit reporting agencies. They have failed to acknowledge correspondence and continue to submit debt validity and not show proof that debt was paid directly to original creditor when I refinanced my home. XXXX lost/never cashed check. I tried to request that they waive penalty fees and they refused. XXXX XXXX XXXX sent a settlement letter which was again paid by escrow company. Check was cashed by XXXX XXXX and I shouldn't be punished for their error. This issue has been going on for two years and is causing me financial harm.

Complaint: I sent Cavalry a Validation / verifying letter to Validate a debt they say I owe. I ask Cavalry questions about this debt. Cavalry received this letter on XX/XX/19 via USPS Priority Mail. I sent this letter under section 809 of the Fair Debt Collection Practice Act on validating / verifying debt. Cavalry under section 809 of the FDCPA should cease collection activity for 30 days or until they have sent me information validating this debt. Cavalry fail to do so by sending me a letter dated XX/XX/19 without any information verifying this debt is mine. In addition, continued to attempt to collect on this debt. That is clearly violation of my consumer rights under the FDCPA. They have place this debt on my credit report without Permissible purpose under 604 under the FCRA. I have not given Cavalry permission to invade my credit report and use my credit report as a tool to collect on a debt they can not prove that I owe. Cavalry XXXX XXXX XXXX XXXX, NY XXXX. Complaint: Calvery Portfolio has reported inaccurate information to the credit bureaus, the original debt occurred in XXXX, Calvery Portfolio purchased ( {$610.00} ) it from original creditor ( XXXX ) and said that the account was opened in XX/XX/XXXX which is an out right lie! I contacted Calvary portfolio in XX/XX/XXXX and was told that they had verification of the original debt that was supposed to be mailed to me, they never mailed documentation and they continue to report inaccurate information to credit bureaus, they have a recorded conversation from a past phone call. I had a XXXX XXXX XXXX credit card that was not closed properly and remained open over 10 years ago. There is no evidence on my credit report showing the history of debt. I have contacted the original creditor in which they do not have any information of me on file. I have contacted Calvary Portfolio who is reporting with XXXX XXXX XXXX XXXX XXXX XXXX XXXX, None of these companies have any information of the debt. None of them can tell me or explain the balance history. None of these companies are validating the history of the account. All I know is there was a balance of {$19000.00} which is now an alarming {$38000.00}. No one can tell my why I owe this balance?! Please help me investigate this. I am trying to refinance my home and I have great credit but this account came up and stopped me from doing what I need to do. I tried to dispute this with Cavalry, but they refuse to investigate or send me proof why they decided to lien my property for someone else 's debt ... Instead now they are harassing me for the payment..Now they started calling my work, even my ex and threatened to arrest me if I didn't pay the amount right away ... This letter is being sent to you in response to notices sent to me from your company and more importantly, due to your erroneous reporting to the Credit Bureau { s }, the highly negative impact on my personal credit report. Please be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 { b } that your claim is disputed and validation is requested. This is NOT a request for verification or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you. Please provide me with the following : What the money you say I owe is for : Explain and show me how you calculated what you say I owe : Provide me with copies of any papers that show I agreed to pay what you say I owe : Provide a verification or copy of any judgment if applicable : Identify the original creditor : Prove the Statute of Limitations has not expired on this account : Show me that you are licensed to collect in my state : Provide me with your license numbers and Registered Agent or Agent of Service : At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureaus { XXXX, XXXX or XXXX } this action might constitute fraud under both Federal and State Laws. Complaint: I submitted Calvary Portfolio Services a fraud packet regard a debt they purchased by XXXX XXXX-this account was an account that was taken over by a hacker and I had charges that I didn't authorized on the account that happened over 6 years ago. I submitted the fraud paperwork to XXXX XXXX but some how this account when to Calvary. They reported to my credit report. I did a fraud packet and submitted everything to them-they refuse to remove it off my equifax credit report. I have submitted two disputes and they keep sending back that the account is valid. I have attempted to call them and all I get is told that I need to pay the bill. So, I have no choice but to hang up.
