Complaint: Cavalry Portfolio Services, LLC. on XXXX/XXXX/XXXX Levied and seized by car. I had tried to negotiate with them on an old debt the bought from XXXX XXXX XXXX that was charged off. They put a judgement on me on XXXX/XXXX/XXXX after the debt was charged of from XXXX. I am XXXX year old widow. They told me they were going to auction my car and then attach my pay if I did n't pay them {$13000.00}. The debt was only around {$10000.00} orginaly. I offered to settle for {$7000.00} or pay {$1000.00} a month. They wanted both which I could n't do. I had to rent a car to go to work which I am in sales and have to travel to clients homes. I had to take the money out of my retirement 401K. This has really hurt me financially and I think this is unfair. I do n't think they should put a Judgment on me to begin with. XXXX had written this loan off. It shows on my credit report it was written off. With my husband dyeing supply I was left without his income and struggle to make ends meet.

Complaint: Calvary Portfolio has purchased this debt from another debt collector. Upon Calvary Portfolio 's procurement of this old debt, this company engaged in aggressive debt collection tactics by filing several motions in different states as an attempt to collect prior to giving the alleged debtor a chance to be heard before litigation. This method is commonly seen as an act of intimidation, a means of a quick settle, and frankly, a scam. Sometimes, they harass the wrong person and their lives are made difficult to clear their name in the Public Record Forum. This method of debt collection is now frowned upon with new legislation to protect the consumer since 2009. I had no real proof this debt belonged to me from this debt collector, I simply paid the debt, all the while experiencing financial trauma in my own life. This company preyed on old debt and victims in the midst of the country 's credit crisis. They have " contract '' lawyers in many areas and one of their lawyer 's was absolutely abusive in her language and collection tactics. Please see the attached. I was not given a chance to be heard and I relocated frequently due to my husband 's contract engineering job. Additionally, when I discovered this company filed motions in different states with accompanying negative comments, and names of private parties as notes for others to see on my Public Record report. Please see attached. I 've asked the company to remove this and all entries in Public Record ( which are worded inappropriately ), they have not responded. Debt collectors should not be free to ruin people 's reputations, include people 's names unrelated to the debt in my Public Record, and refuse to respond to my written request to fix the damaged they have caused. Without the forum and neutral assistance of the CFPB, this abuse and debt collection practices will continue to occur.

Complaint: I was a co-signer on an auto loan purchased XX/XX/XXXX and financed through XXXX XXXX XXXX. Shortly afterwards XX/XX/XXXX Tropical Storm XXXX came through XXXX and flooded the vehicle. The owner was paying the car note but failed to maintain full coverage insurance on the vehicle because it was not being driven and he was going through a temporary hardship, however the car note never failed to be paid. Unfortunately the vehicle was flood during this catastrophic flooding that affected the entire XXXX area and with no insurance the vehicle was picked up by XXXX XXXX XXXX and sold. Years past and that vehicle sat on my credit report for 7 years. XX/XX/XXXX I had a hardship and I filed for Chapter XXXX Bankruptcy when I started my bankruptcy this was not listed on my original credit report pulled by my attorney, therefore it was not listed under my secured payments to be made, however I have just found out that after 10 years this collection company Cavalry Portfolio Services LLC purchased the debt from XXXX XXXX XXXX submitted a claim against my bankruptcy and has been receiving payments. From my understanding as a Co-Signer on the original loan they should not be attempting to collect in my bankruptcy Chapter XXXX. Also this non government collection is over 15 years old. I have called the collection agency and no one will speak to me or assist me in answering my questions. I get attitudes from management and they talk to me as if I ca n't do anything about this and then they hang the phone up in my face. I have heard chuckles in the background when I call as if I am a joke and who cares. I need help please. I wholeheartedly believe based on all the rules and laws I have read about my bankruptcy this company has broken the law. They have missed the statue of limitation for suit, why is it that they can claim against my bankruptcy after so many years and still remain on my credit report. Even the attachment I have included stated that they will not report to credit agencies however they are reporting to Credit Bureaus ... ... .Please, Please Help Me.

Complaint: The disputed account has been given ample time to validate their position of maintaining a collection account on my personal credit profiles. It is now time that I request a division of the Federal Trade Commission known as the Consumer Financial Protection Bureau to demand accountability. I have never paid on any account to this organization. This company obtained my personal information from a debt pooling service. There was never a legal assignment or transfer of ownership. FTC v. XXXX XXXX XXXX ( 2009 ) stipulates XXXX criteria f a legal collection process : 1 ) The debt must be within the resident jurisdiction of legal collectability 2 ) the ownership transfer must be in hard copy documentation, backed up upon request and 3 ) the individual must be given ample notice or 30-days that the legal collection could be posted on a person 's credit report is not rectified within said 30-day notification. In this matter, the collection company failed on all three criteria. The CFPB needs to monitor and sanction Cavalry Portfolio Services, and a " Cease & Desist '' must once again be administered against this company for such illegal collection practices.
