Complaint: XXXX XXXX XXXX ( Cavalry SPV I , LLC ). After things at my work changed, I took full retirement when I could. My wife and I and daughter then moved to live in my wife 's GA home. The Warranty in Debt mailed to us was mailed only ( not signed for ) at our old still empty VA house address. It was mailed XXXX/XXXX/2016. After the mail was forwarded, we finally got the notice in early XXXX 2016. That 's about two months later. The original court date was for XX/XX/XXXX2016. After getting on-line, I fortunately saw the case was continued for XXXX/XXXX/2016. We called to settle the debt through their local XXXX XXXX XXXX. We paid and settled the debt on XXXX/XXXX/2016 through XXXX XXXX XXXX for Cavalry SPV I , LLC. They had bought the debt from XXXX XXXX. Although we paid {$1800.00} and settled the debt, the account information through the credit reporting agencies should say something like " Account paid for less than full balance. Paid collection '' or " Paid and Settled for less than full balance ''. The account should also be closed with no balance now. Instead, the account remains open and with {$470.00} balance remaining and is still be reported to the credit agencies that way.

Complaint: Calvery Portfolio purchased account # XXXX from XXXX XXXX XXXX XXXX XXXX FL XXXX, which was opened XXXX XXXX and first reported to the Credit Bureau oh XXXX XXXX. Calvery Portfolio changed my Date Opened to XXXX XXXX and First Report date to XXXX XXXX. I filed XXXX disputes with the Credit Bureau and they failed to properly investigate this matter, I called Cavalry spoke with XXXX XXXX employee # XXXX tried to explain to him they are reporting incorrect information to the credit bureau ( the date open is incorrect, last balance is incorrect ) and I would like to have this inaccurate account removed from my credit report, he said he had no way of removing the account and the only solution he offered was to reopen the account to collect more money from me. I would like a investigation done on my behalf because the credit bureau is not do their job in fully verifying the information is

Complaint: There is a collection account on my credit report from Cavalry Portfolio Services. It says they are reporting it every single month, which is just another means of harassment to get someone to pay. I have never even taken out a credit card with XXXX XXXX in the amount of {$440.00}. They are also reporting this as late, but I do n't even know how it 's possible to be late on a supposed collection account. I do n't have a contract with them. In fact, on their very own " validation '' it says previous arrangements are not applicable. There 's nothing to be late on. I 've never even been contacted by them. I 've never been contacted by XXXX XXXX about this account either. In fact, I just opened a new credit card account in XXXX with XXXX XXXX, but Cavalry just keeps reporting this collection item and on top of it report it as late every month. I called Cavalry again on XXXX/XXXX/16 at XXXX and requested validation of this debt. I was told that they do not own the debt and that they are not reporting, which again then should n't be on my credit report because it says being reported by Cavalry every single month for YEARS. Cavalry told me that XXXX XXXX owns this account and gave me their number. XXXX told me that they are owned by Cavalry and Cavalry is the one reporting this. I called Cavalry back again at XXXX and I again was told that there 's nothing that they can do and they are n't the ones reporting this although it 's on all three credit reports as such. I called XXXX XXXX back yet again and asked again about validation. I told them that if it is somehow indeed a valid debt that I would pay them, but they just told me that I should just know if a debt is mine or not and if they send me validation that it will just say that I owe {$440.00} and pressured me to just pay them over the phone and when I requested validation yet again they got gruff and hung up. A month and three days later ( today ) I called XXXX back to ask about my alleged account and spoke with XXXX XXXX at XXXX and she told me that after I asked for validation on XXXX, Cavalry recalled the debt the very next day. They are simply trying to hide that they never even owned this debt while they were reporting it, incorrectly reported and are shuffling this back and forth so that I ca n't do anything about it. Cavalry and their subsidiary ( if they even are a subsidiary! ) are just giving me the run around and it 's unethical and this needs to be deleted from my credit reports. Furthermore, each time a debt is assigned or sold to a new collection agency or law firm, that agency must advise me, very specifically, that I have a right to dispute the debt and request verification of the debt. I requested validation of my own volition numerous times and I have NEVER received a right to dispute.This notice is required pursuant to 15 U.S.C. 1692g of the Federal Fair Debt Collection Practices Act ( FDCPA ).

My credit reports show that both my XXXX accounts were closed by me and paid in full. The alleged charge-off would make this debt fall outside the statute of limitations in the state of TN. Complaint: Several accounts were opened using my information in the past as an act of fraud. This fraud was likely committed by an ex significant other who managed our finances - though I do not know who for certain. I believe an ex significant other treated my credit as an extension of theirs - managing the credit until the relationship ended. Once it ended, many cards were suddenly opened, immediately maxed and all of the existing accounts stopped receiving payments.
I have alerted several companies to this and many have updated their records. It appears XXXX accounts in this office are part of this. I do not know of the accounts in their office. XXXX only provided verification ( after XXXX requests in writing ) once a XXXX complaint was filed. As verification statement photocopies were provided to me but the activity on the account and statements I do not recognize.
These accounts were listed on a notarized Federal Trade Commission Identity Theft Complaint and Affidavit. Despite this, Cavalry continues to report inaccurate data on my credit report using it as leverage in a sick attempt to force payment.

Complaint: My wife and I have been negatively impacted by the debt collection practices of Calvary Portfolio. I have seen her upset and have seen her negatively impacted for a contract employment opportunity because her reputation was negatively impacted due to a scrupulous Public Record entry which this company used as a means to collect a debt. This circumstance greatly affects my entire family unit, for which I tirelessly work hard for. This form of debt collection also forces innocent people whom are not known to my wife to be publicly associated with a debt they do not owe in a Public Record forum. If Calvary Portfolio is allowed to continue in this debt collection pattern, this means, any person 's name will eventually be included in a Public Record entry by virtue of living next to, living with, or knowing someone with a debt, but the debt is not belong to them.
Calvary Portfolio has purchased this debt from another debt collector. Upon Calvary Portfolio 's procurement of this old debt, this company engaged in aggressive debt collection tactics by filing several motions in different states as an attempt to collect prior to giving the alleged debtor a chance to be heard before litigation. This method is commonly seen as an act of intimidation, a means of a quick settle, and frankly, a scam.
Sometimes, they harass the wrong person and their lives are made difficult to clear their name in the Public Record Forum. This method of debt collection is now frowned upon with new legislation to protect the consumer since XX/XX/XXXX. I had no real proof this debt belonged to me from this debt collector, I simply paid the debt, all the while experiencing financial trauma in my own life. This company preyed on old debt and victims in the midst of the country 's credit crisis. They have " contract '' lawyers in many areas and one of their lawyer 's was absolutely abusive in her language and collection tactics. Please see the attached. I was not given a chance to be heard and I relocated frequently due to my husband 's contract XXXX job and my acceptance of an XXXX Position. Additionally, when I discovered this company filed motions in different states with accompanying negative comments, and names of private parties as notes for others to see on my Public Record report. Please see attached. I 've asked the company to remove this and all entries in Public Record ( which are worded inappropriately ), they have not responded. My wife also was treated very poorly and abusively by Calvary Portfolio 's lawyer. Debt collectors should not be free to ruin people 's reputations, include people 's names unrelated to the debt in my Public Record, and refuse to respond to my written request to fix the damaged they have caused. Without the forum and neutral assistance of the CFPB, this abuse and debt collection practices will continue to occur. This debt has been paid and I did so not really having hardcore proof specifically of this debt, the purchase of the debt, nor was I given an opportunity to be heard prior to the filing of several motions in several states by Calvary Portfolio ( or their representatives ). It has already been requested Calvary Portfolio remove their Public Record Entry for my name in all the states they filed motions just to collect a debt. Please see the attached for XXXX example. If there are filing fees, please advise, but the comments they have added to the public Record forum is absolutely inappropriate. It is noted that Calvary Portfolio essentially concedes that prior to legal action being taken against me, their offices did not attempt to contact me for a debt they 've procured and took legal action prior to me being heard both in XX/XX/XXXX and in XX/XX/XXXX. Even with knowledge of a known address, a time frame period was not provided to me informing me of a possible impending legal action.

Complaint: I am a resident of the XXXX and I wish to file a complaint for abuse of process and violation of the FCRA against XXXX XXXX and Cavalry LLC ( debt collectors ) who have filed suit against me in a mandatory mediation state knowing that the debt was non-collectable as the statute of limitations has been exceeded.
I believe that Calavry and XXXX purchased a non-collectable debt because their algorhythms showed I have several " paid current '' on my credit report, including my mortgage and my car. I believe that to data mine and file court summons for debt outside the statute and then use the mandatory mediation nature fo XXXX small claims court to compell a summons is an abuse of process and I wish to file a claim against them or have one filed in my behalf and those like me. Thhis concerns a XXXX credit card I closed myself 7 years ago XX/XX/XXXX when, at the peak of the financial crisis, XXXX sent me a letter stating that, eventhough I had not missed a payment they were demanding a full payoff of my {$5800.00} balance in 30 days or that I would agree to a new interest rate of 29 %. As I could not afford eitehr of those terms, I closed the card XX/XX/XXXX. I paid on the closed car faithfullly for three years until they raised my rate again despite no fault of my own and I was unabel to pay the new rate/ minimum payment.
On the date of my summons, the plaintiff, Cavalry LLC did not appear and I challenged this before the presiding Judge ( XXXX ). Judge XXXX said that XXXX could represent Cavalry against me as their Atty was present and was acknowledged as an officer of the court. The XXXX Atty assigned the case who met with me in mediation was XXXX XXXX, who seemed to be representing XXXX and Cavalry LLC on every case before the court that day.
In mediation I challenged the debt on grounds of absolute defense due to statute of limitations being expired ( no payment of cc closed XX/XX/XXXX since XX/XX/XXXX, court filing date by Cavalry was XXXX XXXX XXXX.
The Atty for XXXX could not produce proof of payment on the debt within the statute of limitations. I requested a continuance of one week as XXXX XXXX ( one week later was my vacation and I could come to court and request dismissal on that date for their failure to produce proof of collectability ). The Atty for XXXX stated, " one week is not enough time to get the proof " and protested my asking for it on " too short a notice ''.
Therefore, a continuance was granted until XXXX XXXX, which therefore requires me to give up some of my planned XXXX vacation to return to court or face a court issued judgement against me. It is my view that, given that Statute of limitations is expired and, alos given that Calvary filed suit against me and summoned me to court on XXXX XXXX, XXXX, they should have brought the proof of collectability with them on that court date ( they had 2 1/2 months to get it ). The case should be dismissed, but I also wish to pursue XXXX as it is my understanding that a court judgement in XXXX has been rendered against them for the same violation : bringing suit outside the statute of limitations and summoning people before the Court without standing to do so ( no proof of collectabilty ).
XXXX has confirmed that they are obligated to tell me under the FCRA that the debt had been written off in XXXX XXXX with last payment more than 120 days prior ( XXXX XXXX ), the case was filed XXXX XXXX ( outside the 3 year statute in XXXX. Further XXXX told me that XXXX and Calvary have placed the collection report on my credit report despite lack of standing ( attempt to re-age the debt ) I wish to file suit against them for damages related to their abuse of process and I want them to lose their right to act as a debt collector in the XXXX.
