Complaint: This is my XXXX complaint with this debt collector that bought old debt 2011. I had a wage garnishment and due to the collector not serving me properly. I was given back every penny and the levy was then closed. This collector keeps trying to get the venue transferred to a court to re serve me. The court that the collector is submitting it to gets taken off calendar then gets denied. I am like how much longer can this go on. I am a single mom with a daughter in school, trying to put a roof over her head and with this open collection no one will lease me home, we are now homeless. I have tried to contact the credit card company to make arrangements to pay the debt and only get told Mam? this account has been charged off.

Complaint: After pulling a copy of my credit report I noticed that Cavalry Portfolio is reporting that I owed them {$1800.00}. I have never done any business with this company and have never owe anyone that amount of money. So on XXXX XXXX I mailed a certify letter to Cavalry Portfolio informing them that I am disputing the debt that they say that I owe, provide me with any papers that show that I agree to pay them. I also requested validation of the so called debt and ask them to delete and stop reporting false information to the XXXX major credit reporting agencies. On XXXX XXXX 2016, I received a letter from Cavalry Portfolio claiming that my letter is lacking in any specific information and therefore they can not investigate my claim and that I will hear from them within 90 days from the date of their letter. This is a clear FCRA violation, I should get this information within 30 days of my letter. I mailed a second request on XXXX XXXX, 2016 and its now XXXX XXXX, 2016. I have yet to receive any proof from Cavalry Portfolio that I owe any debt to them and the company is still reporting to the XXXX major credit bureaus that I owe them. This company is in violation of the Fair Credit Reporting Act and continues to defame my character by reporting this frivolous debt.

Complaint: Cavarly Portfolio Services sued me whereI did not live or sign for the debt after they bought it from a bad debt list the original creditor wrote the debt off and the first collection agency XXXX wrote it off in bankruptcy. I became aware of this when I served both the default judgement and the notice of hearing at the same time in XX/XX/XXXX. I made my last payment on the car in XX/XX/XXXX. I did n't know I could sue at this time and so I did nothing. Since they have had the default judgment they have violated my FDCPA an additional three times. They seized all of my mothers social security funds from her bank account around {$900.00} in order to get it back she had to pay around {$150.00} to get an attorney to fix it. Cavarly claimed because my name was listed as payable upon death that they thought the account was mine even though the XXXX XXXX XXXX advised them otherwise. Then later on I had a account at XXXX XXXX XXXX one day it was just negative {$50.00} because they had seized all of my direct deposit paycheck from the day before and the bank charged me for the transaction. Still unaware of my options without talking to an attorney I believed it was over with in XX/XX/XXXX when the scarlet letter I wore on my public records for my credit report listed with case number XXXX default civil judgement for {$7000.00} fell off my report. No they were not done I sent them a letter regarding my rights under FDCPA and that they had violated several times. The statue of limitations had come and gone XXXX times. I advised them not to contact me or I would be sueing them for all of the violations. I received a generic letter from a new attorney in XX/XX/XXXX letting me know that they were taking over the collection of my debt from Cavarly. I am in the process of selling my home and the title is clouded something I was never served papers on even though all of the legal filings thus far had been in XXXX County where I had resided once temporarily for six months. I lived in XXXX County for two years when they say I was sewer served about lawsuit in XXXX County. However they filed the lein on my home in XXXX County of course not even that could be done without adding and inflating the amount of the judgement by {$7500.00} in interest they are claiming on a {$7000.00} debt that they were never intitled to collect on in the first place.

Complaint: XXXX - XXXX, XXXX calls me incessantly about a debt they purchased from Cavalry SPV I , LLC. I know Cavalary as a pending class action law suit as a result of their unethical attempts to collect debts via repeated phone calls even after the consumer requested not to be contacted any longer. The debt is nearly TWICE the age of the statute of limitations age - seven years here in SC. I 've asked on four different occasions in one week for them to cease contact. When you call their XXXX number you 're usually put on hold until some rude customer service representative answers. I was told that if I simply paid the debt, then they would stop calling. I informed XXXX reps that I was going to report them. One person hung up on me and one rep informed me that due to the age of the debt and law limits, their client, Cavalary, SPV I, LLC, will not sue me for the debt and will not report it to any credit reporting agency, but offered to settle the account for a one-time payment of {$630.00} if I provided a credit card via phone. Why on earth would I " settle '' a thirteen year old debt that continues to be sold for pennies on the dollar, if according to law I am no longer responsible for the debt? Then, that rep hung up on me as well. I also have a letter dated XXXX XXXX 2016 from XXXX XXXX , XXXX stating their client will not report it to any credit reporting agency and I can not be sued for the debt because of its age, yet they l continue to call repeatedly to collect a debt which is thirteen years old. I 've since blocked their number, but they continue to call.

Complaint: Upon obtaining my credit file, Cavalry was a company on my file I disputed with the credit bureaus but it was not deleted it was updated with new information. Once the credit bureaus informed me of this status I sent Cavalry a complaint that they were reporting inaccurate credit information. I also asked that the information needed to be verified and deleted from my credit report as soon as possible. In response Cavalry sent me a letter stating in receipt of my dispute made pursuant to the FCRA. In acknowledgement they requested the CRA 's to report it as disputed. They have also reviewed the dispute and find the dispute lacking and specific facts or information which will allow them to investigate and because they have no information they ca n't investigate the dispute pursuant to the FCRA. They also state they are treating my letter as a request for validation under the FCDPA and they will write me again on 90 days. My original letter, was a validate and delete request letter from the beginning. But that 's not what they did at all. In response to them not validating and then saying they will contact me in 60 day when they know its 30 days I sent another letter stating : I received Cavalry letter but under the FCRA your company has 30 days to validate and verify this alleged account not 60 days, if I do n't get a response with the 30 days of my original letter this alleged account must be removed and I 'm forwarding your letter to the Financial Consumer Protection Bureau showing that your company is not following the FCRA which states that your company has only 30 days to validate and verify alleged account ( s ). If your company can not validate and verify this account I request a correspondence be sent to the credit bureaus ( as well as myself ) stating you request them to delete this account from my report. Please delete the above information as quickly as possible. Cavalry then replied, acknowledging receipt of my dispute and request for account validation, and to be advised that they have already ceased collection efforts for the time being in response to my communication. They also stated they will contact me again, either to provide validation, or an update on the status within 60 days from the date of the letter sent. No further collection efforts will be made unless and until validation is provided. Cavalry know under the FCRA their company has 30 days to validate and verify this alleged account not 60 days.

I checked my credit report through XXXX and the debt has been reported as an adverse account. [ Account # XXXX ( Please note : XXXX omitted account 's last XXXX digits for security reasons ]. Pursuant to the Fair Debt Collection Practices Act, Section 809 ( b ), I sent via certified mail [ Mailed XXXX/XXXX/2016 ; received XXXX/XXXX/2016 ] a request to Cavalry Portfolio Services to provide me with the following : 1. the amount of the debt ; 2. the name of the creditor to whom the debt is owed ; 3. proof that you are licensed to collect debts in Maine ; and 4. proof of the last payment made on the account. Complaint: The above listed descriptions of the behavior of the agency are not exactly descriptive of what they do, but I had to mark one option in order to be able to expand on the subject. Let me explain. The XX/XX/XXXX/XX/XX/XXXX meltdown had terrible financial repercussions on my family and I. When people around me were declaring Chapter XXXX bankruptcy, I stuck it out and fought back in order to pay back loans. My house went into foreclosure three times and three times I saved it from this fate by providing mountains of bank-requested documentation, many times the day before the house went to auction. The mortgage bank purposely lost the mountains of documents they requested and in the process protracted the home loan modification period to well over two years. Two years of suffering, not knowing whether the next month we would still be living in the same home. And this is after cooperating with the bank and yielding to their every whim. Regardless, I am so grateful of having achieved this and of my clawing back from a situation that forced others not as fortunate to fall. Tragically some of my debts went without recourse and I lamentably could not pay them back. This credit card debt is one of them. The reason I stated the best description of the issue as being communication tactics is as follows. I noticed that collection letters this company has sent to me appear to be from supposedly the same debt collection company. What I found is that each letter comes from a different entity that is at least outwardly, similarly labeled but importantly different in their content. If you are not careful, you could fall for XXXX of the XXXX statements and options they present to the you, the debtor. For example on one form, they state that because of the age of the debt, they wo n't sue me. On another letter, that is still under the same name overall but a different direct entity, they make no mention of not suing. In fact in this version of the letter they threaten to pursue a judgement. So which is it? Either they wo n't sue me or they will depending on the very vague statement that depends on which form you receive and at which point in the timeline? These are very disturbing tactics that quiet frankly took me an inordinately long time of analysis to catch. They do stress however that they will continue to report it to the credit reporting agency if I do n't pay the balance that I owe plus the interest accrued. I have enclosed images of what they send me routinely in the mail so the reader can compare both communications ; in my opinion very deceitful and dishonest. I can not help but wonder how many unsuspecting people have been the victim of this form of manipulation of the written media. This must be stopped!! These are legal firms with bar-authorized attorney carrying out this form of misrepresentation. Your group could do a great deal to correct this

Complaint: Please be advised on XXXX I mailed XXXX correspondence advising them that I do not have a contract with their company and if so I would need a copy along with any other information I signed with them! I received a letter from XXXX Attorney XXXX with information regarding a debt I had with XXXX and not XXXX! As I stated to XXXX they have not produced a contract I have with them! I stated to them in my letter if they are claiming they received all rights of interest because they purchased the debt then they are in breach of the contract because they will never fulfill the original obligations. Furthermore I as a consumer can not be forced into a Contract with anyone under my consumer rights. If XXXX can send me documentation that I signed a contract with them that would be what I would like to see! To top it off I received another letter from XXXX Attorney wanting to collect on the debt! So now they are violating the FCRA 2 companies with no Contract with me trying to collect a debt! Double jeopardy!
