Complaint: This is fraudulent collection opened by someone who stole my identity. Pursuant to the Fair Debt Collection Practices Act, Section 809 ( b ), Validating Debts : If the consumer notifies the debt collector in writing within the thirty-day period described in subsection ( a ) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. ( Emphasis added ) Therefore I am disputing this debt because I do not owe it. Because I am disputing this debt, you should not report it to the credit reporting agencies. If you have already reported it, please contact the credit reporting agencies, inform them that the debt is disputed, and ask them to delete it from my credit report. Reporting information that you know to be inaccurate, or failing to report information correctly, violates the Fair Credit Reporting Act. If you do not comply with this request, I will immediately file a complaint with the Federal Trade Commission and Attorney Generals office. Civil and criminal claims will be pursued. I respectfully request that you provide me with the following : 1. The amount of the debt ; 3. Verification or copy of any judgment ; 4. Proof that you are licensed to collect debts in Maryland ; 5. Proof that the original creditor attempted or contacted me regarding this debt ( certified mail, letter, etc ... ) I am asserting my rights under the federal and state Fair Debt Collection Practices Acts and the Fair Credit Reporting Act, including these rights : Because I have disputed this debt in writing within 30 days of receipt of your initial notice, you must obtain verification of the debt or a copy of the judgment against me and mail these items to me at your expense. You can not add interest or fees except those allowed by the original contract or state law. Any attempt to collect this debt without validating it violates the FDCPA. Couple years ago, I have lost my ID along with all my information which had all 3 bureaus place a credit fraud alert on my credit as a result of identity theft. As a result, on XX/XX/XXXX, I have disputed with the CFPB and have all the disputed items removed from my credit report. Now, enclosed is a copy of the FTC Notice to Furnishers of Information, which details your responsibilities as an information furnisher to credit reporting agencies ( CRAs ). As a furnisher, upon receipt of a consumers written request that claimed an Identity Theft, you are required to cease furnishing the information resulting from identity theft to any CRA. The Notice also specifies your responsibilities when you receive notice from a CRA, under section 605B of the Fair Credit Reporting Act, that information you provided to the CRA may be the result of identity theft. Those responsibilities include ceasing to provide the inaccurate information to any CRAs and ensuring that you do not attempt to sell or transfer the fraudulent debts to another party for collection. Finally, if you do not own this debt, I demand that you immediately send a copy of this dispute letter to the original creditor so they are also aware that I dispute the debt. As a matter of fact, this debt has already been successfully disputed through the CFPB on XX/XX/XXXX with complaint number : XXXX and has also been successfully removed from my credit report. Complaint: I called Calvary Portfolio SE and disputed alleged debt. I also sent a letter which was written in XXXX and ask them to verify assumed debt. When I spoke with them and provided varied discrepancies, they kept on pushing. It was just too much, so much so that I told them to refrain from calling me. The calls were too much. After writing said letter, I am still waiting on the above named credit agency to verify assumed debt. I have received no correspondence from them as it relates to verifying assumed debt.

CAVALRY PORTFOLIO IS AGGRESSIVELY ATTEMPTING TO COLLECT ON THE DEBT THAT IS 9 YEARS OLD.. I contacted citi bank the original creditor on this account who stated 1099c was issued 4 years ago, and confirmed that first date of default/last date of activity on this account was back in XXXX thus this account is too old to report on my credit and has passed a statutory allowed amount of 7 years. I supplied this info to Cavalry on numerous occasions who ignored and still refuses to remove this erroneous collection. Every time we call they just collect and update information on me and now they called my work and parents house, AND changed the " on record until '' date on XXXX report from XXXX year to XXXX how is it even legal ... why can't we stop them from harassment and violation of federal laws on collection FDCPA???

Complaint: Today, XX/XX/XXXX, an individual from the XXXX XXXX Sheriffs Department delivered a writ of garnishment to my employer. The writ was endorsed by the Superior Court of the State of California, XXXX XXXX County. The attorney of record on the writ is XXXX XXXX XXXX ( XXXX ) and the plaintiff/petitioner on the writ is Cavalry SPV I , LLC ( Cavalry ) as an assignee of XXXX XXXX. ( XXXX ). The writ of garnishment contains a mistaken identity. While it is addressed to my employer, the defendant ( who has the same first and last name as me ), has a different middle name, address, and social security number. I do not currently live in the same state as the defendant. I believe the mistaken identity originates from the fact that the defendants address is in the same zip code as my employers headquarters, despite the fact that I work in a separate office, in a separate state. I immediately contacted the sheriffs department and an individual there represented that he had no ability to change the writ, the sheriffs department merely serves the writ. I then contacted XXXX. The first operator I spoke with forwarded me to an unattended phone line. The second operator I spoke with forwarded me to one of the firms attorneys XXXX XXXX. Mr. XXXX asked for my address and the last four digits of my social security number. He confirmed that the defendant does not appear to be me and said he would draft a release letter to send to the sheriffs department. I requested a copy of the release letter as well. He requested my email address and said he would send me a copy of the release letter in the next 15 minutes. I did not receive any emails from Mr. XXXX today. I tried four additional times to reach Mr. XXXX and left two messages. My haste in filing a complaint is an attempt to force XXXX or Cavalry to submit a release of claims within the 10 day window in which my employer is required to respond. I believe XXXX misidentification, identifying me as the defendant, is a material violation of my rights and privacy. Further, XXXX caused significant embarrassment to me by matter of a sheriff appearing at my employers headquarters and making the false identification public to my coworkers. My complaint will be satisfied when XXXX ( and/or Cavalry ) : 1 ) prepares a release of claims letter that is sent to me, my employer, the XXXX XXXX County Superior Court and the XXXX XXXX County Sheriffs office ; 2 ) each entity confirms receipt of the release letter, 3 ) XXXX submits to me an apology letter, and 4 ) XXXX posts a new policy on its public-facing website stating the appropriate procedure an individual may follow when it believes it is subject to misidentification and, in that policy, XXXX commits to addressing every complaint alleging misidentification. I am lucky that I was able to catch the misidentified writ of garnishment before my employer deducted wages. Other individuals may not be so lucky.

XXXX - I called and disputed all over charges totaling - {$110.00} XXXX - Made a payment - {$28.00} XXXX - Received 7th Statement - Was charged {$6.00} for Personal Account Protection and {$8.00} Finance Charge XXXX - Called to Dispute all charged totaling - {$130.00} - Balance should be {$710.00} XXXX - Made my 2nd purchase on Credit Card - {$450.00} for a XXXX gaming system and {$78.00} for replacement plan for it, which balance should have been {$1200.00}. XXXX - Made {$20.00} payment. On this statement they show on XXXX They charged me a {$39.00} Late Fee for my Payment I made on XXXX - I made a payment of {$49.00} XXXX - Charged me {$12.00} for Personal Account Protection Plan and {$13.00} Finance Charge. XXXX - Called and Disputed my Entire Credit Card ( dropping my credit Limit, the late Fee, and all the Protection Plan and ID Charges totaling - {$240.00}. I told the representative that I will not be making another payment until all these charges are credited, and my account reflected my actual amount owed. She told me she would look into the matter. XXXX - I was livid. I called and complained for the last time. I wanted what was now {$420.00} in bogus charges removed. The representative told me again that the issue would be dealt with. XXXX - I made my last payment to XXXX in the amount of {$56.00}. I called the payment in, and told the representative that this would be my final payment unless my next statement was corrected. XXXX - I received 13th Statement, and not only did they charge me {$39.00} on XX/XX/XXXX for Overlimit Fee, {$14.00} Personal Account Protection, {$19.00} Finance Charge, but {$15.00} Check By Phone Fee AGAIN! XXXX - I called for the Last Time. If my account was not credited {$500.00} for all the disputed and what I felt, unlawful fees that had charged over the past year, I was DONE! XXXX - I received the 14th Statement, and had been charged {$39.00} pm XXXX for Overlimit Fee, {$14.00} Personal Account Protection, and {$22.00} Finance Charge. XXXX - I received the 15th Statement, and had been charge {$15.00} Personal Account Protection and {$19.00} Finance Charge. No late fees or overlimit fees. XXXX - I received 16th Statement, and was only charge {$20.00} Finance Charge. XXXX - I received 17th Statement, and was charge {$23.00} Finance Charge. XXXX - I received 18th Statement, and was charge {$20.00} Finance Charge. XXXX - I received the 19th and Last Statement from XXXX, and was charge {$21.00} Finance Charge. All Disputed charges totaling {$700.00} XXXX - I received a Request and Writ for Garnishment for XXXX Bank from their attorney, XXXX XXXX, in the amount of {$1900.00}. I wrote to the court and disputed all actions taken by Cavalry SPV/ Assignee of XXXX Bank Nevada . I was never served with a summons, and I felt the judgement unfair. Didn't matter. And I have had this judgement hanging over my head for years. I have been XXXX since XXXX, and the years I receive the same Request and Writ for Garnishment ( Income Tax Refund/Credit ), they are unable to collect. XXXX - A man named XXXX XXXX, showed up at my door, showed me a badge, said he was the XXXX XXXX XXXXherrif 's department, and handed me a Report of Collection Activity under Order to Seize Property. He said that if I didn't pay {$600.00}, he would have a wrecker come and pick up my XXXX XXXX XXXX. He ended up accepting {$400.00} cash, and had me sign the form, giving me a copy. At the bottom of the page, in his writing, it says : I agree to pay XXXX XXXX / Cavalry SPVL XXXX {$100.00} monthly starting XX/XX/XXXX and by the XXXX of each month thereafter until the debt has been paid in full. I have no idea what the full amount is, and I called his number XXXX to ask on XXXX, XXXX, and XXXX. I received no phone call back. Today, XXXX, I called his number again. He answered. Didn't give me the full amount, but gave me the address on where to send the {$100.00} payments. I don't know what to do. I have been disputing everything that has to do with XXXX for over 11 years now, and I just want it to be over. I don't know if I should just start paying something I don't owe, but now have a judgement against me for, and I am scared to call the XXXX XXXX / Cavalry SPVL XXXX number XXXX because I feel that any amount I pay will all be for nothing, and I will end up owing these people for the rest of my life. If you can, please help me.

IT HAS BEEN AN ON-GOING BATTLE WITH THESE COMPANIES. THE LAW IS VERY CLEAR TO ME AS FAR AS MY RIGHTS. THEY HAVE FAILED TO COMPLY WITH THE FCRA LAWS AND THEY HAVE NOT BLOCKED OR REMOVED THESE FRAUDULENT ACCOUNTS WHICH WERE OPEN BY THE THEFT AND NOT ME.
