Complaint: In XX/XX/XXXX we worked with XXXX XXXX XXXX home modification, we were approved in writing and getting ready to make our modified payment and the next week we received a notice saying we were denied, we worked with our loan coordinator to find out why. Our loan coordinator told us to resubmit the modification, in the process of resubmitting our modification we received a notice that our loan was being sold to Carrington home Mortgages as of XX/XX/XXXX and our home is in foreclosure. I called XXXX XXXX XXXX again this time the loan coordinator we were working with was no longer with the company and we now had a new one, in speaking with her she said " well your loan was sold and we no longer have any information on your loan, you will need to call Carrington home mortgages ''. I called Carrington on XX/XX/XXXX they told me that it is a new loan and they would n't have any information on the loan for up to 60 days. I told them I did n't have 60 day because my house was being foreclosed with a sale date of XX/XX/XXXX, they told me not to worry that, that Carrington owned the loan and that XXXX XXXX XXXX can not sell your home because we now own the loan, she said call back next week and see if we have your information loaded. I called back on XX/XX/XXXX, they still did n't have the loan information loaded they again told me not to worry that there would be a 60 day grace period and no sale should happen. They told me to try again next week to see if the loan information was loaded, I called again on XX/XX/XXXX this time they sent me to the collections department at Carrington, they told me that it was partially loaded but we were in foreclosure and there was nothing we could do or they could do to stop the sale, I said we were told to submit a modification, she told me that it was to late and nothing we could do our house was going to sell at foreclosure. I was told by 4 attorneys that this is how XXXX XXXX XXXX gets by with foreclosing on people they sell the loan right before the sale date when they know that it takes a while for information to be transferred to the new company therefore there is no time left and people are left without a home. All we want to do is pay our mortgage and keep our home we have lived in our home for 11 years, we have a XXXX XXXX child, and this is very traumatic and stressful on all of us. We are looking for any help to save our home before XX/XX/XXXX which is our sale date.

Complaint: I have previously filed a complaint against the lender ( XXXX ). The lender took 2 months time to respond. My wife 's chapter XXXX bankruptcy petition has been approved as of XXXX of this month. Nevertheless, Carrington Mortgage ForeClosure Prevention Office in XXXX, TX is sending mails to us and threatening of foreclosure. The property currently have an automatic stay order and an exempt property under Federal Bankruptcy Law ( Chapter XXXX Bankruptcy Case # XXXX ) The lender has not moved the foreclosure auction sale notice from the XXXX District Clerk 's office either, which is causing harassment by number of buyers around the home everyday. Please help us against this illegal foreclosure procedure. Complaint: WE WERE APPROVED FOR A MODIFICATION WITH CARRINGTON. WE MADE ALL THREE TRIAL PAYMENTS AND WE MADE OUR FIRST REGULAR PAYMENT. CARRINGTON CALLED TO SAY THEY WERE CLOSING OUR CASE BECAUSE THEY NEVER RECEIVED SIGNED DOCUMENTS. WE NEVER RECEIVED ANY DOCUMENTS UNTIL THEY FINALLY EMAILED US A COPY ON XX/XX/XXXX THE DATE ON THE DOCUMENT WAS XX/XX/XXXX AND THE DUE DATE WAS XX/XX/XXXX BOTH OF WHICH ARE PRIOR TO THE DATE THE DOCUMENTS WERE RECEIVED ON XX/XX/XXXX. THE SIGNED DOCS WERE XXXX AND CONFIRMED RECEIVED ON XX/XX/XXXX. I HAVE MADE ALL TRIAL PAYMENTS AND MY XX/XX/XXXX PAYMENT AND SENT THE DOCUMENTS WHICH H AD NO REAL DATE. CARRINGTON IS TAKING ADVANTAGE AND TRYING TO STEAL OUR HOME! WE CALLED CARRINGTON AND SPOKE TO THE TEAM LEAD IN HOME RETENTION XXXX EMPLOYEE # XXXX WHO BASICALLY SAID IT WAS OUR FAULT THAT WE DIDNT GET THE DOCUMENTS ON TIME AND SAID THE DENIAL STANDS. HE REFUSED TO TRANSFER US TO A MANAGER AND WHEN HE FINALLY AGREED HE DID TRANSFER US TO XXXX XXXX # XXXX. XXXX STATES HE IS GOING TO HELP US GET THE MOD REINSTATED.

Complaint: I applied for a modification, my mortgage balance was aroun d 130K at the time, by the time the mortgage was approved, the arreerages were around another 20K, I did the 3 trial payments which were around 100 dollars more than the payment of my house before the modification. They denied it after the third payment because they said I had put my daughter on the title and I did that to had that house in her name when I died, and they said that she had a lien on her house at a different address and that because she had a lien on a different address for XXXX dollars that they can not approve the modification on my house and that they are proceeding to foreclosure when I called them today, they never sent me a letter or nothing since the month of XXXX . I called today and they faxed me something. Iam attaching it. I asked them to give me time to pay this and to modify my house and they told me that no they are proceding to foreclosure, how can that be????? They need to give me time to pay the debt of my daughter who is NOT no longer on title on my house, she was in 2016 and at the request of carrington, I took her off my house title she owns her own house in another place and the lien she owes to the department of workforce solutions is for unemployment pay back which is also a mistake she has to clear out as she does not owe that. she is working on clearing this out. The company should send me a modification package tome right away to honor my request for modification since they are waiting to XX/XX/XXXX so that they do not have to modify us according to thehope or harp or whatever the situation is for the tarp funds the banks received and force me out of the house I worked for. I am a XXXX year old XXXX , and I worked for my house and I bought it for a lot more than it is worth and paid a lot of years for it. I also bought a substandard house built with bad materials and I paid thousands of dollars to make it livable.

Complaint: I received no notification from Carrington Mortgage Services notifying me of the XXXX XXXX, 2017 foreclosure sale date. The first notification I received was a letter from the attorney on XXXX XXXX, 2017 stating there was a scheduled sale on XXXX XXXX, 2017. This did not allow me to submit my modification package prior to the 37 days before scheduled sale date deadline. I spoke to a supervisor " XXXX '' ( ext XXXX ) who claimed that Carrington Mortgage Service did not have to mail any notifications or letters to me because they attempted to call me. I informed him that is not correct and everything is done by written correspondence as I do not know if they were calling the wrong number. As far as I knew I was still in review for a loan modification and was never made aware or saw anything in the mail from Carrington. " XXXX '' ( ext XXXX ) reiterated again they did n't have to mail letters and phone calls were enough and that most borrowers want to be called and not have letters. This is a violation of XXXX XXXX servicing guidelines and against the CFPB servicing guidelines for loan modifications.

Complaint: Do to unforeseen circumstances we had to file bankruptcy in XX/XX/XXXX. The only month we were ever late on our mortgage was in XX/XX/XXXX when Carrington Mortgage stopped our automatic payments without notice. It took us 10 days to realize the payment was not pulled and we immediately made the payment by phone. We chose to reaffirm the loan after bankruptcy and on our XX/XX/XXXXstatement there was a {$120.00} charge but since we were not receiving statements do the bankruptcy they were unable to tell us over the phone what the fee was for. We were told by XXXX ID # XXXX that we could just pay the monthly amount and would not be charged any penalties or late fees on the {$120.00} and to fax a request in writing to find out what the fee was for. We faxed in the request and at the same time faxed in a request to start receiving statements again. Our XX/XX/XXXX statement came in and showed the {$120.00} was a fee for reaffirming our loan, is that legal? They also charged us a {$5.00} late fee for not paying the fee in XX/XX/XXXXalthough we were told there would be no late fees or penalties.
