Complaint: I received a Loan Modification approval letter from XXXX dated XX/XX/XXXX. The information included in this letter showed a new principal balance of XXXX at 3 % interest and payments of XXXX. ( There was also a clause in Summary under Borrower Incentive that stated that If you make your monthly mortgage payments on time, you will earn a one-time principal reduction in the amount of {$5000.00} payable on the 6th anniversary of the month in which the trial period plan is executed. ) I was making timely mortgage payments and thought all was going well.
Then, on XX/XX/XXXX, I received a Notice of Servicing Transfer from Carrington Mortgage Services , LLC in XXXX, IN. This letter was dated XX/XX/XXXX but I didnt receive it until XX/XX/XXXX!! There was no postmark on the envelope. This letter indicated that I should make my payments due on or after XX/XX/XXXX to them at a XXXX, AZ PO Box address.
I was diagnosed with XXXX XXXX on XX/XX/XXXX. From XXXX, XXXX through XXXX, XXXX, I had multiple XXXX and was treated with XXXX to treat my XXXX. While I was undergoing treatment, I was unable to work full time and my income was drastically reduced. I made several payments to Carrington Mortgage that were at least {$100.00} more than the minimum amount because I was unable to make a payment every month.
I contacted Carrington Mortgage by phone several times from XXXX, XXXX through XXXX, XXXX requesting access to their website or a mailed statement to determine the status of my account. I was given a number of reasons why I wasnt able to access my account on their website, including that their records showed that I was in bankruptcy and they couldnt provide the requested information. My husband and I did file bankruptcy several years ago but it was discharged in XXXX, XXXX. I was promised that I would receive a mailed statement but have yet to receive one as of this date.
The last payment I sent to Carrington was dated XX/XX/XXXX for {$700.00}. HOWEVER, this payment was returned to my bank on XX/XX/XXXX.
I contacted Carrington by phone several times to try to make arrangements for some kind of assistance. I was told that I could go to their website and download the necessary paper work and they would refer my case to the proper department. When I visited their website, I was unable to get the information I needed.
I received a Notice of Intent to Foreclose dated XX/XX/XXXX. I immediately called but was unable to reach them as their business hours did not include any that were convenient for me. When I finally reached someone, I was told where on their website to download the necessary forms to apply for mortgage assistance.
I emailed the Request for Mortgage Assistance and the required documentation on XX/XX/XXXX.
I received a notice dated XX/XX/XXXX that my application was incomplete, asking for additional documentation. I promptly emailed the requested documentation. I received a notice dated XX/XX/XXXX stating Your Application is Complete.
Then, I received an Additional Documentation Required notice dated XX/XX/XXXX! I emailed this documentation on XX/XX/XXXX.
I received a Loss Mitigation Evaluation Notice dated XX/XX/XXXX that stated that I was ineligible for anything except Home Liquidation. I sent an appeal to Carrington on XX/XX/XXXX because they misstated my income in their evaluation notice.
I then received a Formal Appeal Notification dated XX/XX/XXXX that my request has been denied. When I called to determine the reason why, I was transferred to 3 different people. The only thing I determined was that I needed to come up with {$5400.00} to bring the account current and that a repayment schedule was not acceptable.
In todays mail is a Notice of Intent to Foreclose dated XX/XX/XXXX.
At this point, I dont know what to do!! I have applied and was denied mortgage assistance, modification, forbearance or ANY type of repayment plan.
I do NOT want to lose my home. AND, I would like to work out some kind of repayment plan with Carrington Mortgage in order to continue to live in my home.

Complaint: XXXX XXXX is currently in mediation with XXXX XXXX. The homeowner received the LM copy on XX/XX/2018, and once I received this, I sent to all mediation parties.
The homeowner was the one that gave me a copy for everyone. Since I reviewed the first page, I noticed the XX/XX/2018 deadline. I asked XXXX XXXX for an extension since the deadline is only 1-2 business days from when we received it!
The Attorney from XXXX XXXX said they couldn't give her an extension on deadline to send final mod back. The Attorney responded " This is not a servicer requirement but HUD/FHA. I will pass your request along, but I recommend not relying on extension. This needs to be priority. '' ( So the deadline to get a Notary, review all terms in this final mod and make sure it looked okay, talk to her Housing Counselor ( me ), get any questions answered, and send back XXXX was XX/XX/2018. This also required her to make the XX/XX/2018 Modified payment by then. There was no discussion of a grace period date after I asked them.

Complaint: I was wrongfully foreclosed on by Carrington mortgage services and XXXX, XXXX XXXX XXXX XXXX and suffered physical and emotional damage as I was being evicted from my home in 3 days by the purchaser of my home at the county auction in XX/XX/2018. I did not pursue legal action and I was forced to reapply for a loan modification. I sent my mortgage application in but was denied on XX/XX/2018 due to not having a complete package in because of a hardship causing me to be delaying in submitting additional documents. So I in turn sent in a complete package which they acknowledged when I spoke to them on XX/XX/18 to XXXX. I spoke them on XX/XX/18, XX/XX/18, XX/XX/18, XX/XX/18, XX/XX/18, XX/XX/18, XX/XX/18 several times. It wasnt until XX/XX/18 that anyone stated Carrington had to have deemed the package complete by XX/XX/18 or they would close my review. I have confirmed on XX/XX/18 that they had the additional documents meeting the deadline of the missing documents letter. Each representative assured me as soon as the package is complete the foreclosure sale date of XX/XX/18 would be postponed. The notice Carrington gave me on XX/XX/18 stating the sale date was XX/XX/18 is in error and even up to XX/XX/18 I was told by Carrington the sale is XX/XX/18 thereby stating I was within 7 days of the sale date which in fact I was not. The sale date on the legal notices is the first Tuesday of XX/XX/2018 which is XX/XX/18. On XX/XX/18, XX/XX/18, XX/XX/18, XX/XX/18 none of these representatives indicated one time that I was near a deadline but rather encouraged me that once my package was complete they would postpone the sale. I demand the foreclosure sale of XX/XX/18 be set aside to address these discrepancies in the mortgage loan servicing of my FHA back loan.

Complaint: We originally purchased our home with a local bank in XXXX. We have been in this home since that time, 26 years. We thought we had run across a wonderful deal when we heard of XXXX XXXX XXXX in XXXX & in XXXX we changed our mortgager to XXXX XXXX. This was trouble from day one. I have been trying to get a loan modification since XXXX. I was a customer of XXXX XXXX XXXX then transferred to XXXX XXXXXXXX XXXX, then to XXXX XXXX XXXX servicing. These were 3 servicers that transferred my loan or bought our mortgage. We were notified until after these transfers were finished but we had no knowledge till after this was done. In XXXX, My husband was facing a XXXX with a long recovery tperiod and I was trying to plan ahead if we should have trouble making our payments due to his recovery time. I talk to XXXX XXXX XXXXXXXX previous to the XXXX to prepare for the worst if it should happen. XXXX XXXXXXXX XXXX gave me instructions on how to get through this rough time and urged us to modify our loan agreement then I followed instructions given by XXXX XXXX XXXX. The instructions did not help me plan for the situation but it led us down a path to being put in foreclosure in XX/XX/XXXX.
We fought this foreclosure but then we were again transferred to yet another servicer, XXXX XXXX XXXX. We again faced foreclosure and in XX/XX/XXXX, We got included in a Mass Tort Litigation with XXXX XXXX XXXX XXXX, XXXX after paying {$5000.00} for their service, which we thought would solve all our problems. We received a modification from XXXX XXXX shortly after and made over a year of modification payments starting on XXXX. We called several times to XXXX XXXX in regards to finalize the loan and were told that they could only speak to our attorney We tried contacting the attorney with no news. We received nothing in regards to our loan in the mail in XXXX XXXX. Everything was sent to this attorney that we could not seem to reach by phone. We finally found out that the Law Firm was closed and this attorney was disbarred in XX/XX/XXXX.
In XX/XX/XXXX, we then got another notice of a sale date and foreclosure XXXX. We realized at this point our loan had been sold yet again to XXXX. We then sought help from XXXX XXXX, a real estate attorney. We could not negotiate with XXXX and had to file bankruptcy on XXXX to save our home. We then were able to get a Modification from XXXX in XX/XX/XXXX and our bankruptcy was discontinued. We made consistent monthly trial payments for the next year each month never late as we were waiting for permanent loan.
In XX/XX/XXXX we figured out that XXXX sold our mortgage to Carrington Mortgage after we received a loan modification agreement from Carrington Mortgage Services. but we were shocked by the numbers of the amounts we owed so we wanted to do more inquiry before signing the document. Our loan did not show credit for any payments made since XXXX and we had 4 years of undocumented payments with no credit to us or acknowledgement that we had made them. They were pushing us to sign the document and we did not agree with the balances shown. We just wanted to negotiate and understand the terms of the loan and come to some agreement so that we could receive some credit for our many payments. Carrington would not negotiate with us or listen to us and just said they were going ahead with foreclosure. We then got a letter dated XXXX that they were foreclosing and a sheriffs sale was set for XXXX. We did not understand as we were not delinquent at this time and our loan was in good standing with XXXX. Carrington told us XXXX no longer exists and they now own our mortgage. So in desperation, We again filed for bankruptcy on XXXX to save our home. We filed for another modification in XX/XX/XXXX. When I asked again if I could negotiate or have someone answer questions regarding payments that were not applied to the loan, Carrington suggested we submit a Customer Service Research Request, I did that on XX/XX/XXXX. In the meantime we started another modification as they told us we had an XXXX sale date. I was so confused at this time, I was not sure what to do but continued on to submit the Customer service claim and also the Modification AGAIN. Then we were told our modification was denied. I am still not sure what they decided on investigation although they sent a letter I do not understand. We now have a sale date of XX/XX/XXXX.
We have completed several loan modifications, multiple sale dates, which we have been fighting al this time. We had an independent review and after contacting HUD at one point, our home was sold but HUD made them undo the sale after it was sold. I just want a loan with a fair payment and We have been obstructed from doing so by so many companies. We have had so many foreclosures with sale dates that our legal fees are almost as much as the principal owed. We have more fees owed for interest and late payments that we owe more in fees than the principal owed on the home. We just want to work out a fair deal. This is not a case of us not making payments but to many servicers not communicating or acknowledging payments or blocking us from making them. These fees are unfair and very unclear. I have boxes of documents to prove all of these facts and also checks documented from our local bank proving the checks were cashed and payments were made.
Please help us, We have been in this home almost 30 years. Our business is here on the property. We have done everything servicers have asked and there must be a way to make this right. Complaint: Carrington was notified by XX/XX/XXXX that I lost my job with XXXX XXXX where was an XXXX, They offered a modification supported by the government to reduce the monthly payments.
Since their payments offered were still high ( about 640.00 per month ) I continuedin communication with them to reduce the monthly payments, They rejected this during all the month of XX/XX/XXXX until I had only three days before the due date ( XX/XX/XXXX ).
On XX/XX/XXXX I sent a check for the amount they wanted via certified mail.
The Post Office misplaced the envelope and it took for them to deliver on XX/XX/XXXX.
Carrington notified that I was left out of the program for non compliance.
I argued that it was the postal service and had the green receipt to prove it.
They said that they had to receive the check by that date and they didn't After that I submitted at least 18 Request For Mortgage Assitance packages every single one was rejected.
They put my house for sale with a date XX/XX/XXXX I do not have the {$33000.00} whi they say I own them including legal fees I have reason to believe that they have done this with the intention to get my house.

Complaint: Carrington is in violation of CA HBOR and dual tracking. Carrington is acting with gross negligence and incompetence.
At issue is a modificaiton request that was submitted on XX/XX/18. After the modification request was submitted Carrington violated RESPA guidelines and RESPA guidelines by filing a notice of sale. Additionally Carrington continues to ask for documents that were already submitted to them. They already received contributor information they already received most recent pay stubs but they continue to pretend that they haven't so that they can illegally foreclose on property.

Complaint: This is the second complaint we have filed as when we called in the XXXX kept saying the DOB does get involved in Short Sale approvals. It's evident no one at the division of banking even READ THIS COMPLAINT as the information mailed to me in response was regarding CARRINGTON MORTGAGE and this complaint is NOT AGAINST CARRINGTON. This complaint is not regarding a short sale.
This is regarding XXXX ( 2nd loan servicer ) sending a discharge of mortgage debt ( 1099C ) to homeowners in XXXX and then when they went to sell in XXXX they couldn't because the mortgage discharge was never recorded. When we attempted to contact XXXX they scrambled and said the entire debt was still due - however each homeowner is in possession of the 1099C which was dated XX/XX/XXXX.
Per Massachusetts law Mass. G.L. c.184, 17B the mortgage servicer has 45 days to record a discharge once the mortgage debt is discharged. Mortgages must be discharged within 45 days of receipt of full loan payoff by recording and furnishing a copy of the discharge with corresponding recording information or providing a proper discharge to the person paying off the loan. If the DEBT is discharged in it's entirety there is no mortgage anymore. XXXX XXXX and XXXX XXXX XXXX mortgage debt was discharged in it's entirety. A discharge should have been recorded by XX/XX/XXXX.
From XXXX : I have listed my house for sale. When title was pulled it showed TWO mortgages, however in XXXX my mortgage was forgiven by XXXX. XXXX was originally XXXX XXXX which was sued for giving out bad loans. My the debt was forgiven by XXXX with a 1099C in XXXX, but they never took the mortgage associated with this off of my title. Now I'm being told that even though they sent me a 1099C stating the debt was forgiven that that was a mistake and I owe the entire amount. This makes no sense. If the debt was forgiven via a 1099C then the mortgage should have come off my title at that time, but it was never done. On top of that how is it I now owe the debt that XXXX forgave?
