Complaint: In XXXX XXXX, we filed XXXX XXXX bankruptcy. In XXXX XXXX, we completed our bankruptcy and according to our bankruptcy documents, we were to resume our original mortgage payment of {$480.00} in XXXX XXXX to our mortgage company Bayview Loan. This amount did n't include our current escrow, so we started paying {$650.00}. In XXXX XXXX, we found out they were cashing our checks but not applying our payments to our account. They claimed we owed {$11000.00} in back escrow. After NUMEROUS phone calls and faxes, we were sent a payment history from XXXX XXXX to present. We have been in bankruptcy since XXXX, where was the rest rest of our payment history? At first, we were told that was all that was available. Then we were told they were sending it but that there was an 8 month gap between their old system and new system that they can ' t provide. So far, we have received NOTHING! Also, we were requesting an escrow analysis because according to the payment statement we did receive, on XXXX XXXX, three months before we were to complete our bankruptcy they added close to {$11000.00} to our escrow account. Bayview has made numerous promises to get us documentation, provide us with a researcher, and help us determine if we owe this money and if we do, why it was added so late in the bankruptcy so it could not be paid off. They have done nothing. They have ruined our credit report we worked so hard to clean up and are now threatening foreclosure. Also, if we still owed arrears, why did they sign off on the bankruptcy completion papers saying all arrears had been paid?

Complaint: I was told that our house is in the process of Modification since we informed our Servicing Loan company that we would like to keep the house. Their latest communication to us was on XXXX XXXX, 2015 where they requested to submit list of documents and, as our response, we submitted the required documents last XXXX XXXX, 2015. The deadline for the submission is on XXXX XXXX, 2015. However, in the mail, we received a Notice of Sheriff 's Sale of Real Estate last XXXX XXXX, 2015 from XXXX and XXXX with a Sale date of XXXX XXXX, 2015. We got confused because the XXXX XXXX, 2015 communication we received, was a congratulatory letter that our Application for Modification is in the beginning of the workout process. We thought for a while that the XXXX Sale letter is just a miscommunication between their legal and mitigation departments. But just to in the safe side, we decided to submit this concern to your office because we do not want our house to be sold and our application for modification is still very active. What we would like to achieve at this moment is, that we would be given the opportunity to prove our capability to pay by subjecting us under the Trial Period Plan.

Complaint: I called bayview to ask why they were charging me late fees on my mortgage, when I send my payments two weeks ahead of time.I can send my payments on the first of the month and by the XXXX. off the month and they will tell me they have not recieve my payment and will charge me a late fee, I have until the XXXX of each month before my payments are late.When I called bayview loan servicing on XXXX XXXX, 2015 an ask when will they send my XXXX to file my taxes, they said that it will be mailing them out on a saturday XXXX. I waited until the end of XXXX and I still did not recieve a form. I called bayview back and they said oh we sent them out and if it do n't come go online an get a copy on their web site. I went on their web site an could not find it When I called them back and asked about my XXXX, they did'nt want to talk about the form an kept asking me why they have'nt recieve my payment. I called back in XXXX and asked them to send out a XXXX again, an all they wantrd to talk about was my payments being late. Complaint: Bayview loans keeps calling and harassing me about being behind on a payment. I 've called them numerous times to try and fix this problem but no one can help me in the so called customer service area. I have gone to my bank and receive copies of my proof of payment starting back from XXXX and ended it in XXXX, I have fax them numerous times showing them that I never miss a payment. Every time I ask them a question over the phone they say put it in writing and fax it to us. Not one person I 've talk to was able to answer a question. Its like its choreograph. I called one time and got a person here in XXXX XXXX, when I found that out and ask her if she had a branch in XXXX she just laugh and said no. She works out of her house and supposedly all my information is there on her computer. I 'm not liking this. These people are no better than XXXX and have no desire to help you what so ever.

I believe I am due a substantial reduction of fees, interest, and principle as a result of the gross mishandling of my mortgage. The attached timelines chronicles the events that effected this situation, to date. I must stress it was based upon Bayview advised that I decline the original modification as the offered a principal reduction program of which my approval was " eminent ''. 1. XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX ( loan XXXX ). Shortly thereafter the loan servicing was assigned to Bayview Loan Servicing ( account XXXX ). 2. XXXX XXXX, XXXX. After 22 months qualified for Home Affordable Loan Modification - Representative 's XXXX XXXX XXXX XXXX XXXX XXXX XXXX -- XXXX XXXX. XXXX ). 3. XXXX XXXX, received notice that I qualified for a new modification based upon a national mortgage settlement reducing monthly payments " up to 39 % ''. From XXXX XXXX Bayview Loan XXXX XXXX. XXXX XXXX, XXXX - received notice of approval on XXXX XXXX XXXX XXXX 5. On XXXX XXXX, XXXX as instructed by XXXX XXXX ( per the advice of his supervisor ) to decline loan modification and apply for settlement program, which I did. 6. Over a period of a year, supplied documentation to XXXX. Each time he acknowledge and stated things were moving along well. 7. XXXX XXXX, XXXX receive notice of Default and Intent to Accelerate from Bayview. XXXX year after being advised to decline loan modification. 8. With the assistance of XXXX XXXX international ( client XXXX ), Representative XXXX XXXX XXXX Bayview re-opened modification program application. I was under the assumption it was the same program XXXX proposed, assigned to XXXX XXXX at Bayview ( who has been most helpful ) XXXX. 9. XXXX/XXXX/XXXX Approved for loan modific ation ( not from settlement ) program with a massive balloon payment of {$310000.00} but a lowered interest rate. Far from the 39 % reduction I was lead to believe. Representative XXXX XXXX XXXX x XXXX. 10. XXXX/XXXX/XXXX XXXX XXXX informed me they do not offer settlement reduction modifications. I said I had a copy of the proposal, which I forwarded to him ( attached ). Please note if I proceeded with the original modification, rather being instructed by Bayview to reject it, I would have been making payments over the past 23 months, there would not be an extreme past due balance.

Complaint: I have submitted XXXX written requests and made numerous phone calls to Bayview Loan Servicing to obtain a breakdown of the activity on my mortgage account. I am in chapter XXXX but I make the payments directly to Bayview each month. I have been told that it is not their policy to send monthly statements of account to CHXXXX clients. I do not understand this because before XXXX XXXX XXXX transferred my loan to Bayview, XXXX XXXX XXXX did send monthly statements. I have made XXXX of the 60 monthly payments required under my monthly plan. I am not in default. Bayview has also failed to send the XXXX mortgage interest statement required under IRS regulations. They offered to give me a figure over the phone but obviously this information must be reported in writing. As I am typing this, I just spoke with Bayview and they state that the XXXX will be faxed today or tomorrow. They also stated that because I have an attorney of record on my account. their policy is not to send me any information but to report it to my attorney instead. The problem is that my attorney states that Bayview has not sent them the requested information either. I have experienced problems with accounting errors on previous mortgage accounts and it is important that I know how my payments are being applied. I know that the law requires Bayview to provide me with a detail of how my payments are being applied as well as my escrow and principal balances. I believe that I am not the only client of Bayview who is not receiving information on their account. I am attaching a copy of the XXXX the letters mailed to Bayview in XX/XX/XXXX and XXXX XXXX the XXXX letter was also faxed. I would appreciate any assistance you can offer to facilite my receipt of the transaction activity and balances on my mortgage account. ThanksXXXX XXXX

Offer on my house made XX/XX/XXXX for over asking price and to this day, still have n't closed. XXXX asked for same info every XXXX days ; claimed the XXXX inspection was n't done but in fact the inspector said he was asked to say he " lost '' information, etc. I believe they are trying to force a foreclosure. I would have never moved out back last year if they did n't say closing would be in XXXX days. Complaint: This is either from a payday loan or a credit card debt that I failed to pay. On Thursday, XXXX XXXX, 2015 before XXXX XXXX Pacific time, the landline of the residence where I rent a room ( as I have a personal mobile phone and I was already off to work ), called on the landline and left a message looking for me and saying that a case was going to be filed against me in the XXXX XXXX XXXX Court since the city I reside at, XXXX, CA, is in XXXX XXXX. The caller also said for me to return their call at XXXX extension XXXX with a case number XXXX. In any case, I really feel that the caller should have said they were debt collectors which they did not and I really felt scared and intimidated by what they said they were going to do. I would really prefer the collection agency or the original creditor, whoever I owe to, to mail me a letter saying how much I owe. Right now, I have several debts, mostly to payday loans, XXXX made in person at payday loan places and the rest on line. As well as to credit card companies. Most of them have sent me letters, or the collection agencies acting on their behalf have, and since I can only pay so much, I do pay what I can on paydays and am not trying to dispute the amounts nor run away from my obligations. I for XXXX am trying to avoid bankruptcy and I really wish all those I owe money to will allow me to do partial payments till fully paid. As for this caller who left me that number to call, I really would like their attention called and I will pay what is due but only after their attention is called. I really would like them to just send me a letter and I also wish that when they send me anything in writing, nothing threatening like suing me in court. There is no need to even mention that. And yes they called before XXXX XXXX Pacific time though the jist of this complaint is their saying that a case will be filed against me in court. That is phone bullying.
