Bank account or service: Cashing a check without an account

Complaint: Hello : I 've been to Bank of America at XXXX New York XXXX three times in the past 6 months to cash a large check up to {$5000.00}. Each time, I was treated with extremely rude disrespect by that branch manager. He accused me of trying to cash a check that was n't real and treated me as if I were a criminal. Each check I submitted for remittance was indeed legitimate, but I had to go elsewhere and spend money to cash them. I truly hope that the manager of this particular branch gets a lesson on how to treat customers.

Application, originator, mortgage broker

Mortgage: Conventional fixed mortgage

Complaint: In early XXXX, I applied for a mortgage refinancing through Bank of America Home Loans. On XXXX XXXX, I paid {$680.00} for a home appraisal and immediately gave access to the appraiser. However, the appraisal was not completed within the 60-day rate lock period, despite repeated inquiries and attempts to move the process to completion. I e-mailed the loan originators, their supervisor, and Bank of America Quality Assurance, without any resolution, specifically writing on XXXX, XXXX, XXXX, XXXX, XXXX, and XXXX -- the last two after the rate lock had expired. On XXXX, I asked for a refund of the {$680.00} I 'd paid for services I did n't receive, but heard nothing ; I wrote again on XXXX to restate my request for a refund -- and again, Bank of America ignored my correspondence. In short, Bank of America scammed me by collecting fees for services they failed to provide inside their own timeline ; they failed the customer service test by ignoring my repeated requests for a refund.

Settlement process and costs

Mortgage: Home equity loan or line of credit

Complaint: I filed a complaint ( Case number : XXXX ) that explains : " We received a modification agreement for our Loan number XXXX with Notice date : XXXX XXXX, XXXX. Bank of America requested us to return the signed agreement by XXXX XXXX XXXX. On XXXX XXXX, XXXX XXXX, XXXX XXXX and XXXX XXXX, XXXX we requested via FAX to Bank of America to send us the Truth in Lending Disclosure Statement to be able to sign the new modification agreement and send it back. We also asked : " Can you please let us have more time to send sign it and send it back after we receive this information? ". We have not received this information and we still need to review it to be able to sign the agreement. All I asked for a fair resolution to the issue was : " Bank of America send immediately via email the Truth in Lending Disclosure Statement of the Home Equity Modification Agreement with Notice date : XXXX XXXX, XXXX to allow us to review it and sign it if we agree with the modification. '' During the past weeks I received a call from XXXX XXXX - Bank of America Resolution Specialist XXXX - who told me that Bank of America can not provide the Truth in Lending Disclosure Statement. I asked him to send me this response in writing and after that I would send them back the signed modification if we agreed. Meanwhile Bank of America continues withholding the payments that we have sent on time. I did not get the reply from XXXX XXXX XXXX about the Truth in Lending Disclosure Statement. The Next letter I received from Bank of America last week states : " Your home equity loan is not eligible for a Home Affordable Modification Program because we did not receive a Home Affordable Modification Program by the date specified in our letter to you ''. ( Attached ) This is not the first agreement that I receive. We got the first HELOC home equity modification agreement during the process of modifying the XXXX XXXX with XXXX XXXX XXXX XXXX. The 1st HELOC modification on XXXX XXXX, XXXX initially offered a monthly payment of {$94.00} ; after we paid the 3 months trial the amount increased to {$190.00} which is the amount that we are paying right now. On XXXX XXXX, XXXX and XXXX/XXXX/XXXX we got a modification package with a letter that stated " Your modification is not yet complete. Enclosed is a replacement copy of your loan modification agreement. '' and offered us {$250.00} and send someone to our home to " help us '' sign it. We figured out that the " Copy '' had a different amount the be paid on XXXX XXXX, XXXX of {$39000.00} instead of the initial {$3000.00} on XXXX XXXX, XXXX. On XXXX XXXX, XXXX we received this new modification, we requested more information, got all kind of replies but not the Truth in Lending Disclosure Statement we requested several times via FAX and now a denial. I believe that Bank of America has infringed the law and is trying to cover it. I ask the CFPB to please find out what they have done and are doing with our money. My son has XXXX and my husband had a XXXX years ago. I am really struggling financially and I am scared. I have been paying on time and the account is current. We do not deserve this. We really need help please. All documentation is attached.

Mortgage: FHA mortgage

Complaint: XXXX XXXX XXXX, HUD Housing Specialist, tel # XXXX, ticket # XXXX informed us this morning that this Borrower does not qualify for the FHA Preforeclosure Sales Program due to the delinquency of over 43 months. She stated that this was a Bank of America error. She stated that it was up to the lender whether or not they would accept or reject a pending offer. No one from Bank of America has ever advised or disclosed this information to us or the Borrower. In fact, the information that was given us was that it was HUD that would not allow the postponement of the scheduled Trustee Sale scheduled on XXXX XXXX. No one from Bank of America has offered any " other '' Short Sale programs that the Borrower may qualify for. Compounding the problem is that we have 2 appraisals with a significant difference in value. Due to this oversight, we request that the sale be postponed. We are submitting a new all cash offer for {$250000.00} today. We request that this offer be considered for a HAFA short sale or any other alternative short sale. But, we need time to properly prepare the Closing Documents based on whatever program the Borrower qualifies for. Any consideration less than this would not be in good faith due to the discovery of this oversight. Please escalate this to the highest level. Thank you!

Closing/Cancelling account

Credit card:

Complaint: Bank of America closed my credit card account with notice, immediately after I paid off the balance on the card with the intention of using the card for new purchases. A credit card holder should be able to reasonably rely upon access to their line of credit. If the bank can just close the account without notice, the card holder could be put at risk, e.g. if the cardholder is traveling or if there is an emergency. A bank should give reasonable notice to the cardholder before closing an account, in view of the fact that closing an account can create a serious hardship for a cardholder, even placing the cardholder in physical jeopardy, e.g. if the cardholder is traveling without access to other funds. Moreover, my account was closed shortly after I paid off the balance on the account, because I wanted to free up the available credit for new purchases. The timing of the account closure is suspicious and suggests that Bank of America waited for me to pay off the account before closing the account. In other words, the timing suggests that the account was flagged for closure because the balance had been paid off. Obviously, this kind of closure tactic maximizes the risk of financial hardship, because people often pay off credit cards with the intention of then using the freed up credit. Finally, this account closure tactic has an additional harm beyond placing the cardholder at risk of hardship -- it also harms the cardholder 's credit score. If banks close accounts because credit scores are low, this has a snowball effect, because the closures worsen the credit scores, perhaps leading to further account closures, and further worsening of credit scores. This enhances the need for reasonable notice and process before account closure.

Complaint: My tenant paid us the rent ( {$2400.00} ) at the counter of a branch of Bank of America on XXXX/XXXX/2016 and she withdrew {$1300.00} at the same time. Instead of withdrawing from her own account, the bank withdrew money from my account. Is it ridiculous? I texted her and she said it 's bank 's mistake. The bank will correct the mistake. However, Bank of America did not take any actions. It turned out my tenant 's husband went to another branch to deposit back {$1300.00} on XXXX/XXXX/2016. The bank never notified or apologized to us any alert for this unauthorized transaction. We found out by checking our account activities by ourselves. I went to the branch on XXXX/XXXX/2016 near my home to bring up the issue. They called that branch and the branch manager said she was busy and will do the research and get back to me. But she never responded. I am very upset that people can withdraw money from my account without my consent. In addition, BOA had very horrible attitude. They NEVER followed up on this serious mistake. It 's an unauthorized transaction.

Loan modification,collection,foreclosure

Mortgage: Conventional fixed mortgage

Complaint: I contacted Bank of America numerous times when I was having difficulties making a mortgage payment. The property had been damaged by a tenant. I could not afford to make both the payments and the repairs with no the rent coming in. BofA rejected my application for a loan modification at least twice. I did not qualify for any type of assistance since the property was not owner occupied and none of the payments had been missed. I stopped making the payments in order to make the repairs. Bank of America proceeded to foreclose on the property. I contacted them serval times letting them know that I was rehabbing the property and I would like to work out a payment plan. They sent out a property manager that changed the locks, damaged the property, shut off the utilities and stole my tools and material. I filed a complaint with the servicer provider and never heard back. I finished the repairs and got the property rented. I contacted Bank of America again and asked for assistance. It was declined again and they would only accept full payment. I borrowed the funds from my 401k and sent them certified funds by XXXX as they instructed. They never credited my account and I never heard back from them. The funds were not returned to me. They contacted my tenant to let him know that I no longer owned the property and offered the tenant {$12000.00} in assistance to move out. Now my tenant stopped paying me rent because he felt like I did n't own it. I reached out to Bank of America dozens of times and could not get a straight answer on what happened to my money and why they proceeded with a foreclosure if they knew I was overnighting them a payment. Every time I called I got a different story by a different person and I continually asked for a manger to call me back. Nobody ever did. Some calls I would be on the phone for over an hour sitting on hold or being transferred from department to department. BofA finally admitted that they did receive the funds and never applied them to my account. They took at least 5 months to reverse the foreclosure since they actually had received the full amount of back payments by the day they specified. They never once contacted me with any type of update. I would have to call only to again be told different stories about what was going on and how long it would take. The whole time both my property and the life savings I had sent to save the property were unaccounted for. Once the loan was reinstated they immediately sent me notices that the loan was several months delinquent and and in the foreclosure process. I was not even able to make payments on the loan because they had frozen the account and foreclosed. All this time BofA charged late fees, inspection fees, and charged interest on an account that they would not even apply or accept payment on. Once I received the reactivated account statement showing several months of payments I sent them a check. I was sent back to me with a letter stating it was rejected for not being certified funds. Next I sent them a certified check. It was sent back with a letter also stating it had been rejected. I called to find out why. BofA stated I had not called to get a reinstatement figure. I was using the amount off of the notices they were sending me and even added a little more. I was told that the reinstatement figure would take 3 days to calculate. Which seems very odd for a lender not to be able to inform a borrower what is owed. As instructed I called back on day 3. The amount was not available. I called back the next day after that and was now told that the information can not be provided over the phone and I would need to wait for a letter. It has now been over a week and I ca n't even get BofA to tell me what the amount is that will reinstate my loan. I really hope you can help get BofA to act properly on the file.

I traced my steps and checked all my pockets. As soon as I noticed I could not find my card anywhere, I noticed bank of america customer service. When I called the customer service rep told me that I just withdrew XXXX dollars out my account via bank teller. This was a transaction that I never did. I filed a claim and contacted the bank that I just left. A bank teller stated that he thinks I was shoulder watched and that someone pick pocketed me at the atm. Complaint: I have tried to fix a loan that I have with Bank of America for the last year, in that process they at no time did they give me the opportunity to refinance or to work with me on converting a balloon mortgage to a conventional loan until it was to full term and then they would not let me make payments due to the term was due in full. After the fact that it was late they would not let me refinance with them due to it being one payment late. So they have pushed me around for the last year to get the XXXX form sent in. I have sent 8 forms in and every time it has been something else was not filled out right or it was due to the fax being as they say unreadable. When I have faxed it from their branch and also sent in myself. I have had nothing but problems with them and they have successfully ruined my credit in the process. I am having to put the house in my wife 's name so we can refinance it and so we can get a loan from another bank because I would n't trust or finance another thing from Bank of America. At no time can you go to a branch and have someone help you because it has to go to Colorado for evaluation and they do not call you back in a timely manner, so you have make a scheduled appointment with them to get a answer. I have sent 8 forms in and no success but I can call the IRS and with in one hour I had the transcript that they needed and they will not accept it because they did n't get it from the IRS. I want to file a complaint.
