Complaint: I just recently found out there was a lien on my home from a line of credit that was and should have been cleared after my refinancing of my home. I refinanced my home with XXXX XXXX XXXX around XXXX to XX/XX/XXXX. I received a line of credit from XXXX XXXX for {$25000.00} soon afterwards. My property now shows the same lien filed in XX/XX/XXXX by XXXX.
XXXX XXXX filed for bankruptcy in XXXX and was bought out by XXXX XXXX in XXXX. I did a refinance with Countrywide Mortgage around XXXX or XX/XX/XXXX. Countrywide of course was purchased before this date by Bank of America. ( enclosed copy of doc. going to Countrywide from XXXX XXXX ) This is strange because XXXX XXXX was out of business in XXXX. I have not been able to find the refinance documents. Bank of America has denied that I was ever with Countrywide or XXXX XXXX. BOA shows a loan modification XXXX XXXX and a refi on the date. If a lien existed at the time of closing it should have been cleared. Now BOA has sold the loan to XXXX XXXX XXXX. The new companies title company claims there is no liens on property which is not true. The lien has been cleared but it still shows and the title companies at each closing claims it is clear. It seems BOA wants to claim it owned the mortgage before any of the liens were applied XXXX to get around their responsibility of making sure the liens were cleared at closings. I have requested documents from BOA without any success.

Complaint: On XX/XX/XXXX, I received an email alert from Bank of America stating that my checking account was no longer eligible for bill pay. I called not understanding why ( they had switched the bill pay to my HELOC ) - after being transferred twice, I was told that there was an AML freeze on my account and I would need to speak with them. She transferred me to them, but they were closed.
I called first thing on XX/XX/XXXX and spoke with the AML department. After verifying me, he stated that the issue was with information for my wife, XXXX. I got her on the phone, and he verified her identity. He then stated that they had asked her to go into a banking center to verify this a month ago, and that's why they froze the account.
I reminded him that we signed all the paperwork for a HELOC in XXXX of this year. She is also in a banking center on a regular basis to make cash withdrawals. He said the HELOC signing wasn't sufficient. They wanted to confirm 1 ) does XXXX have a dual citizenship, and 2 ) what is her occupation.
I asked to file a compliant, but he did not take one down from what i can tell. I then asked to confirm that during this period of having the account frozen, did they return any debits ( checks, ACH ). He said he had no idea and would transfer me to customer service.
I spoke with customer service, and after much back and forth, I was told that nothing was presented and rejected during the period of the account being frozen.
The idea that they would freeze the checking account ( but not the HELOC! ) of a 15+ year client without a letter or phone call, over the suddenly urgent question of dual citizenship and employment, is beyond absurd. I specifically asked to file a complaint with Bank of America and was not given that opportunity. I know they will respond to CFPB complaints. Please forward this on to ensure it is reviewed by their AML officer and head of retail banking.

Credit card company isn't resolving a dispute about a purchase on your statement
Complaint: On XX/XX/XXXX Bankamerica withdrew {$2000.00} from my business checking account without my authorization & without any advisement that they were going to debit my account. They applied this money to my business credit card ending in XXXX which THEY cancelled over one year ago.
This theft on their part caused {$280.00} in overdraft fees and bounced checks but my real concern is when I called they said they can do what they want because I was behind in my payments. Additionally they said they will debit my account for additional money to satisfy the remaining balance due at their discretion. I argued this was theft and they said I signed an agreement back in XX/XX/XXXX that would allow them to do this. I asked for a copy of this document and have not received it.
I have been trying to make weekly payments on this credit card but most of the payments do not go through because of insufficient funds.
I am suffering a hardship at this time and explained this to Bankamerica many times. I asked if they would consider a settlement offer to reduce the entire outstanding amount over a period of time and they said they do not offer settlement reductions on business credit cards. My home is in intent for foreclose, I am behind on my NJ sales and use tax and my rent on my business is delinquent as well.
Also, as of close of busiess XX/XX/XXXX they have charged me a total of {$29000.00} in overdraft fees. I received a refund of {$980.00} when I prove that they allow certain checks to be cashed BEFORE I scheduled those checks to be paid. Ive ask them to refund some of these exorbitant fees and they say my account does not qualify. Why? Is it because they know I am a XXXX year old woman? Or a single mother? Or do they feel believe I have no voice because I have fallen on terrible financial set backs and they can gouge me out of dollar after dollar whenever they can.
Please help me. Their new ad campaign now states : What would you like THE POWER to do? They refer to themselves as THE POWER now, is this what they mean? POWER to extort and wring money from your account-POWER to charge tens of thousands of dollars in overdraft fees? POWER to bleed an extra {$35.00} just because you were overdrawn more than 5x in a row?
They have to be stopped.

Complaint: To whom it may concern : A company identifying itself as the legal department of " XXXX XXXX '' called my estranged ex-wife ( divorced for nearly 10 years, but on good terms ) attempting to contact me. The caller told her they " are on their third attempt at trying to serve me papers, '' and that she is my contact.I immediately called them at XXXX and identified myself using a 6 digit reference number they provided my ex. They answered the phone as " legal department ''. The representative named XXXX asked for my name and last four digits of my social security number. He then repeated my social security number to me ( weird and unnerving ). He knew my address here in XXXX XXXX as well. XXXX said his company was in the process of filing a civil lawsuit against me to collect on a debt for Bank of America. There is some legitimacy to this. Fifteen years ago ( as a XXXX year old ) I opened a joint bank account with a girlfriend in XXXX XXXX, Missouri. After we broke up, I think she ran up a few hundred dollars in overdrafts. I'm unsure of the details or the veracity of that, but do remember that a Bank of America collection showed up on my credit reports years ago. XXXX said that the suit hasn't been filed yet, even though I was allegedly served " 45 days ago '' at my address. I still had a chance to settle for ~ {$1600.00} on an original debt of ~ {$590.00}. However, if I did not respond, they'd file suit, we'd go to court, and I'd owe > {$4000.00} including court costs etc. I stated that I had not given consent for his company to access my financial information and asked how he had obtained it. He stated that I signed over permission when I first opened the alleged Bank of America account. I asked XXXX for more information about the original debt. He responded that it was my responsibility to keep those records. I then stated that I'd need to gather more information and would call back.This phone call was extremely upsetting. My heart was beating like crazy. I read a few articles about debt collection to develop a strategy. They include : XXXX - Sued for Debt? I called again and was connected to XXXX again. Just as an aside, they also had my name connected to my phone number in their computer system at this time. What's funny about that is my name is XXXX XXXX XXXX, but I solely go by XXXX. They didn't have my middle name and so on several occasions said that I was not the account holder. Anyway, I asked XXXX a series of questions : 1. Is the debt time-barred?
XXXX would not answer this questions. He stated that his company was not a debt collection company. In regards to time-barred debt, XXXX responded, " I don't know what that is. '' He added, " I am not trying to collect a debt. '' It appears he was only attempting to serve me with a civil lawsuit as a threat to extract payment for a debt I never generated, but had a strong semblance to something that could be real, supported by how much they knew about my personal information!
2. When was the date of last payment?
" There has been no payment, but the account has been default since XX/XX/XXXX. '' 3. Will you send me a debt validation letter?
XXXX said they would not send any debt validation and did not seem to know what this was.
I called back one last time to ask for the name of the company and their physical address. The representative identified the company as the legal department of XXXX XXXX. He would not provide an address for the company and accused me of being unwilling to identify myself. When I identified myself as XXXX, he responded, " No you're not. '' Long story short, the representative refused to provide XXXX XXXX XXXX address. Looking up the number XXXX pinpoints the call to XXXX, California. This is somewhat corroborated by XXXX mentioning that his company is based in California during my first phone call.
Further research indicates that the Missouri statute of limitation on debt collections maxes out at 10 years. Trusting XXXX XXXX default date, this alleged debt is over 13 years old.
This experience consumed my entire morning. In fact, it's XXXX XXXX and I'm still actively thinking about it as I write this e-mail. I consider this to be a highly sophisticated scam that could easily entrap someone into paying for something they don't owe to a company that doesn't deserve payment from anyone. Their knowledge of my personal information and willingness to call my ex-wife is very disturbing as well.
You'll see that the details of my experience are spot on compared to comments left on the XXXX comment thread. A few examples of these details include owing > {$4000.00}, attempts at serving a civil lawsuit 45 days prior, identification as XXXX XXXX, and unwillingness to provide a physical address or details on the account. Lastly and perhaps most bothersome to me, " XXXX XXXX '' called employers, family, and friends of some of the commenters stating they were attempting to serve a civil suit on a debt in default. Wow! If that's not illegal, it certainly should be.
That's all I can think of at the moment. I hope this will be worth publishing in some regard as this is a sophisticated and dangerous scam that is predatory and questionably legal. Please, let me know if I can provide any further details for you. I want to do whatever I can to ensure that no one is attacked by these people ever again.

Complaint: Earlier this year I suffered a terrible XXXX injury preventing me from keeping up with my finances as usual. Around XXXX, I noticed a tremendous amount of fraudelent charges on my checking account. Unable to sit on hold for hours, I was unable to make it in to a local bank of america branch until XXXX. During this 3 month period, amongst all of my accounts, I was charged in excess of {$3000.00} in miscelanous fees. This would be acceptable, however I did manage to make it into a branch and sit down with a personal banker for over 3 hours while he went over a spreadsheet of fraudelent charges with customer service. I enjoy Bank of America 's services and would like to return, however these fees are out of hand. I deposited into Bank of America that same day at Bank of America ATM .... I discovered MondayXX/XX/XXXX that there was a 10-day hold on this cashier 's check .... looking at the receipt it stated that the reason for the hole on the cashier 's check is because of a possible return. I call XXXX XXXX and they said it was an excessive amount of days to put a cashier 's check on hold because it's guaranteed and the money was definitely in my account when I got the cashier 's check drawn .... as a matter of fact they would have given me the cashier 's check had the funds not been available in my account. XXXX XXXX told me to tell Bank of America if they need to call and verify the funds do so and they would verify ... XXXX Bank of America would not call XXXX XXXX .... as a matter of fact I spoke with a supervisor by the name of XXXX who continuously told me that there was nothing Bank of America could do about holding this cashier 's check for 10 days I also spoke with a customer service rep by the name of XXXX who said the same, nothing they could do.
I called one last time to Bank of America yesterday XX/XX/XXXX to confirm that they still would not take the whole off this cashier 's check because I have gotten behind in my bills I had very important Financial obligations I needed to take care of I lost out on a very good deal of an automobile I needed and they would not answer the phone ..so I called back again and I left my option in the automated system to get a call back in 30 minutes ... when they call back I press 1 to accept the call and the system hung up the phone ... I never got to speak anyone on the second attempt of confirming they were going to hold this cashier 's check another 3 days.
I said to the supervisor why don't you put a disclosure note at the ATM machine about cashier 's check if you're going to hold them for 10 days ... .a cashier 's check is guaranteed.. in other words I truly believe discrimination here ...
