Complaint: I began a loan refinance with Band of America Home Loans on XXXX XXXX, 2016. On XXXX XXXX after giving all information to Loan Officer my loan was denied without any full explanation of why or other alternatives. Furthermore, I was told by Loan Officer on XXXX XXXX that if Loan did not close I would be refunded the appraisal fee of {$690.00} and on XXXX XXXX when loan was denied I was told I am not entitled to a refund. I have left a message with Branch Manager XXXX XXXX which has not been returned and was told I would be called this evening by another manager and was not. I am disputing the charge with my credit card company and want Loan Officer XXXX XXXX to be investigated for verbally telling me before XXXX transaction for appraisal fee that this would be refunded if loan did not close. Complaint: In the past, I have requested the assignment of qualified, professional, and knowledgeable single point of contact ( SPOC ) be the Bank of America Customer Relationship Manager ( CRM ) assigned CRM/SPOC and that the individual SPOC, the SPOC 's unit, and the SPOC 's supervisor be bona fide Bank of America employees who actually are available for person-to-person telephone contact to communicate the current home loan mortgage account status, activity, decisions, documents and documentation during normal business hours and days. While there have been a multitude of SPOCs assigned to gather, organize, and disseminate account documents and information and be current on account activity and status, not a single one has been able to preform their duties as required per the National Mortgage Settlement ( XXXX ), RESPA enforced by Regulations Sand Z, and California Civil Codes XXXX and other applicable law, agreements and settlements that dictates how the single point of contact is to execute their duties and interact with the borrower. I know this because I have never been informed by any SPOC of the fact I was approved for a MHA HAMP and was directed to be placed in a MHA HAMP TPP as early as XXXX 2012 by the Bank of America Appeals Department upon completion of an appeal or other escalated case.

Complaint: On XX/XX/2009 I defaulted on a mortgage loan number XXXX. On XX/XX/2009 a fourclosure complaint was filed. The property than went to final judgement and the house was actioned off. The original servcer of the loan was XXXX Mortgage, Than the servicer was switched to Countrywide home loans and than to Bank of American N.A. I defaulted on this loan well over 7 years ago. Bank of America is still reporting this negative information on all XXXX of my credit reports. This are reporting complete different time dates and defaults on each credit report. Basiclly they have no idea when the default accured because the loan was transfered so many times. Attached is proof that tha default accured over 7 years ago. Complaint: A few years ago I opened FREE checking account in Bank Of America, in XXXX, Oregon. I had to follow few simply rules as not using teller services, only ATM, and I pad no fees. Few weeks ago I have noticed that while still following rules I agreed, I was being charged {$12.00} per month fee for having this account. I called, I visited in person and was told that type of free account I opened do not exist anymore. I closed my " free '' checking account immediately. Bank of America used " bait and switch '' tactics in order to trick a lot of consumers, I supposed, into paying monthly fees. I have no idea for how many months I was paying $ XXXX monthly fee without my knowledge, but I am quite sure I ma not the only one who was tricked by BofA ( in Oregon at least ). In my opinion switching free account into $ XXXX monthly fee account was purposely designed trick. More than receiving paid fees, I would to ask to investigate BofA banking practices and I offer to provide more information and comments if needed.

Complaint: I applied for a refinance loan with bank of America. I was paying all closing cost at closing I was just refinancing my property for a lower rate which would have in effect gave me a payment of {$300.00} less each month. The first time I applied that application for some reason was cancelled out without any notice to me after supplying a lot of financial documents. A new loan application was generated by bank of America and I had to provide numerous financial documents again that were lost or misplaced by Bank of America. After numerous inquiries by Bank of America on my credit report they denied the loan for excessive obligations in relation to income. Bank of America was provided corporate returns and personal returns. The corporate returns reflected the business paying ALL my financial obligations which are not many. i.e. Mortgage, all utilities, all credit expense accounts etc. The business returns even showed a profit after paying those items and has shown a profit for the past ( 9 ) years. I also take a {$12.00}, XXXX draw each year from my company which is 100 % unobligated money because all expenses are paid by my company. So not only are all my bills paid by the company I also get a XXXX draw every year. The previous mortgage I was trying to refinance is {$300.00} more than the refinancing I was attempting to obtain and was paid for 9 1/2 years by my company never late. Bank of America is discriminating against me as I excercised my rights under the Equal Credit Opportunity Act. One more thing, Bank of America had an appraisal of the property completed and it showed {$85000.00} in equity in the home. As we both know banks appraise the property very conservativly. Obviously for the past 9 1/2 years my company has paid all my bills including the current mortgage ( never late ) and made a profit every year after paying all expenses related to my debt and the business expenses ... ... not to mention the {$12000.00} I get for my pocket every year. Bank of America clearly discriminating against me and wrongfully denied the loan. I would like to mention I have been a bank customer of Bank of America with my business and personal accounts for over 10 years.

Complaint: Over the course of three months, I discovered I had {$14000.00} worth of fraudulent charges on my debit card. I notified Bank of America and they refuse to cover it. I had been seeing a woman during this time and it turns out that she was the one who was running up my debit card. I have filed a police report, submitted time sheets that prove that I was at work when some of these charges were made, and I even submitted a transcript of text messages between her and I where she admits that she was the one who charged up my cards. Bank of America has covered {$3800.00}, but wont cover the other {$10000.00} ( not including international fees ) and wo n't explain to my why they covered part of it but not the rest. I have made multiple phone calls ( at least 25 or more ) into the bank, and requested on every single call that I speak to an 'investigator ' ( the decision makers when it comes to fraud ) and have never once gotten a call. But when I speak to the fraud department, I have been told everything from they wont cover it because the charges were made from my IP address ( i would let her stay at my house when I went to work, I keep all of my debit and credit cards as well as all my passwords in a drawer at my desk in my home office ) to one rep telling me that because I let her stay at my house without anyone there, I was technically giving her permission to use my card-I NEVER gave permission, to one rep telling my that yeah the bank should cover it but it was n't up to him or his department. These are multiple charges that happened over the course of three months to place like XXXX. I cant even read the merchants name. Yet BofA tells me that their security team called or someone called in to justify these charges. my neighbor tells me that this woman had visitors while I was at work. But Bank of America NEVER called me to ask about any of this. They just refused to fight on my behalf even though I have submitted paperwork proving I did not authorize these charges. What I do n't understand and what they refuse to explain to me is why they covered some of the charges and not the others? They were all fraudulently charged without my permission!

Complaint: Before about XX/XX/XXXX ( guessing ) I went to an attorney and filed for a legal separation and his is how I acquired the quit deed. Money was getting tight and we did n't have money for the property taxes. We went to BOA in about XX/XX/XXXX, cant remember the year and we 3-wayed a all and spoke to XXXX, he stated not to worry that the bank would pay it. In ecember I called XXXX County and the payment was not made. We went back to the bank and 3 wayed another call, XXXX said the check went out. He called the dept that sends the checks out and the lady said we do n't make payments like that, she hung up. I reminded XXXX, that on a recorded line he made that statement. They paid the taxes. Around XX/XX/XXXX, I lost my job, XXXX decided to quit his, got into a serious fight and I called the police and had removed from the property. He took a car that had my name on it also. He went to XXXX. I filed a restraint order. He did n't make any payments so I had the car repossessed. It took a few months to get to the point we could talk. I files for the XXXX Foreclosure Assistance thru XXXX in XXXX. I was able to make payments until about XX/XX/XXXX, then was awarded the loan. XXXX recognized me as the home owner since I had the deed. Between XX/XX/XXXX-XX/XX/XXXX I got a call from BOA, stating XXXX was dead, I knew he was n't because someone in the from the family would have called me. XXXX had to come to XXXX and prove he was alive. As the loan was coming to an end, I still did n't have a job, and I called BOA to see if I could get a XXXX loan. ( XXXX XXXX ) stated the loan was bought out by a company in XXXX and it would be useless to start the paper work, 2 months later after not getting any new paper work I called BOA back and the same lady XXXX Oh we decided to keep it. I told her that I had not received any paperwork for the transfer and nothing about keeping the loan. XX/XX/XXXX, they said we can get you a modified loan, bear in mind XXXX was out of the house. I started a job in XX/XX/XXXX. I was told I did n't have a XXXX house, and I knew I did. In the modification they pulled XXXX XX/XX/XXXX tax return, the year we bought the house. I stated this a modification loan, meaning to change. I was told I had to make XXXX dollar payments, in good faith showing I could make the payments. I paid 6 payments on time. On XX/XX/XXXX, XXXX. XXXX. I managed to pay XX/XX/XXXX and XX/XX/XXXX payments. Workers Comp said they had over paid me and cut XXXX out of my weekly check. It took 8 months to get back part of the money and I never got the other. WC only took responsibility for the chipped elbow.I approached XXXX again ( XXXX XXXX was my connection ) and we started the paperwork for a loan modification. They suggested to remove XXXX name from the loan and put mine on it, asked XXXX if that was legal she said no. Since XXXX, I have filed over XXXX complaints with the CFPB in XXXX, the treasury dept, Federal Reserve, Obama, XXXX governor which was a joke. I called XXXX XXXX, program that can assist in different legal problems. I talked to XXXX attorneys and no one would help me. XXXX XXXX of BOA was assisting on the loan application, everything she asked for was sent it. A utility bill with my name, a letter from XXXX stating he had not lived in the home since XXXX, proof he did n't have a checking account, his pay stubs, and a utility bill with his name on it. XXXX had moved to XXXX XXXX in with his girlfriend. XXXX XXXX kept telling me and XXXX everything was looking good. Then I got an email and letter stating that I would have to sale the home, no XXXX loan because XXXX didnt live in the house

Complaint: In the past 30 days, there have been numerous instances that have resulted in our institution fraudulently and without cause having money taken from our account, by Bank of America. The first instance was on XXXX/XXXX/2016. A deposit was taken to the XXXX XXXX BOA, counted, and we were given a deposit slip. Later on, we noticed {$3100.00} has been deducted without our knowledge. We were later sent a piece of paper a deposit totaling {$6200.00} was missing {$3100.00}. There is no way their correspondence was even close to accurate. We went down to XXXX XXXX, where the young teller who counted the money admitted that the whole amount was in the deposit bags when he counted it. He was given stern looks, and then employees began searching through the trash ( hopefully they were n't looking for the deposit! But the timing was obviously suspect ). After speaking to XXXX XXXX, a representative at the branch, they eventually decided to credit us back the money ; however, they put it into the wrong bank account, and we had to have it transferred over. This was the first instance of Bank of America taking money from our account, saying we never deposited it even with a valid deposit slip. Next, on XXXX/XXXX/2016, Bank of America decided to deposit the same deposit into our account twice in the amount of {$1300.00}. Upon being alerted to their error, they they proceeded to deduct {$1300.00} out of our account, which is obviously {$20.00} more than their original error. Again, we had to call XXXX XXXX. Although we received no follow up call, the issue was eventually resolved, and the bank account does not even reflect their initial error, which is odd. Finally, on XXXX/XXXX/2016, we received another notice from Bank of America. This notice says that a deposit of {$5900.00} had been missing {$1000.00}, and they deducted that amount from our account. Again, the money was counted at the XXXX XXXX XXXX, and we were given a deposit slip. Even with this evidence, they took the money from our account. After trying to call XXXX XXXX again to see where our money went this time, we were stone walled, and not given any further information and would not let us speak to XXXX XXXX about their discrepancy. At this moment, they still have the {$1000.00} they took from us, with no sign of them even investigating where our money went. This is the XXXX time in 30 days that this branch has lost our money. We have had to fight them to get the money back XXXX, and are now out {$1000.00}, with no reasonable reason. We have valid deposit slips, and we have the notices from company. And we are getting no response from the XXXX XXXX XXXX any longer.

Complaint: Due to a bounced deposit check, Bank of America closed XXXX checking accounts of mine and reported the accounts to XXXX as " possibly fraudulent ''. This was without contacting me in any way, shape or form to discuss the check. I tried contacting BofA through the phone but get pushed around between departments without any department being able to correct the issue for me with XXXX. Because of the closing of the account, my wife and I are unable to obtain any bank account with any bank and are on the verge of being evicted because checks are the only form of payment our landlord accepts. I have taken multiple steps to get in touch with BofA 's risk management team to correct the issue with no avail. I have even mailed formal letters of intent to sue with no response. Unfortunately, BofA 's headquarters are outside of my state and the process of suing them over this is far more expensive than I can afford. All I want is the information to be corrected and updated with XXXX. I appreciate your assistance in the matter.

Complaint: Bank of America mishandled my second request for mortgage assistance ( RMA ) of XXXX XXXX in violation of existing Making Homes Affordable ( MHA ) Home Affordable Modification Program ( HAMP ) guidelines and timelines, Real Estate Settlement and Procedures Act ( RESPA ) enforced by Regulations X and Z, a group of laws commonly referred to as the California Homeowners Bill of Rights ( HBOR ), and other rules and doctrines that govern banks, servicers, and their representatives throughout workout processes including modification and loss mitigation, in the ordinary course of business including, but not limited to, the preforeclosure and foreclosure processes.. All Bank of America statements and representations listed below alre false and known to be false when made known to the borrower throughout the modification process beginning in XXXX XXXX on receipt confirmation of a complete RMA from me by Bank of America . XXXX XXXX, Bank of America representatives claimed and continue to claim I 'm ineligible for MHA HAMP, other MHA programs, Hardest Hit Fund Programs ( HHFP ), and other modification assistance designed to keep the borrower in their home. XXXX XXXX, Bank of America claimed and continue to claim I 'd received multiple MHA HAMPs on this home loan mortgage account thereby making me ineligible for HAMP. XXXX XXXX, Bank of America claimed and continue to claim I 'd been denied MHA HAMP and a MHA HAMP TPP on appeal and other related escalated cases. XXXX XXXX, Bank of America claimed and continue to claim I accepted the XXXX XXXX settlement offer amending the XXXX MHA HAMP and represented this settlement offer as a separate and new MHA HAMP modification based on a new and separate borrower submitted RMA application package. XXXX XXXX, Bank of America stopped modification assistance consideration and began the borrower property separation loss mitigation process, meaning borrower is no longer considered for modification assistance designed to keep the borrower in the home. XXXX XXXX, Bank of America began first level preforeclosure processes including, but not limited to, tagging and coding home loan mortgage account indicating borrower is not eligible for modification assistance and considered only for loss mitigation assistance designed to separate borrower from the home, such as a deed-in-lieu of foreclosure or short sale. XXXX XXXX, Bank of America began second level preforeclosure processes including, but not limited to sending representatives out to my home, unsolicited mailings, single point of contact and other representative comments, omissions, and statements designed to promote a deed-in-lieu of foreclosure or short sale. XXXX XXXX, Bank of America had full knowledge of the errors made related to the incorrect MHA HAMP decnials and other false representations that began a year before as made known and apparent by the Bank of America Appeals Department. XXXX XXXX, Bank of America began third level preforeclosure process without any loss mitigation assistance. XXXX XXXX, Bank of America removed the Cease and Desist tag and coding from the home loan mortgage account clearing the way for foreclosure. XXXX XXXX, Bank of America contradicts their representations and claims of HHFP ineligible in their efforts to foreclose with workout assistance, specifically, the HHFP Transition Assistance Program. XXXX XXXX, Bank of America claimed and continue to claim I 'd rejected a modification offered in XXXX XXXX based on a borrower submitted RMA application package. XXXX XXXX, Bank of America began fourth level preforeclosure process. XXXX XXXX, Bank of America began fifth level preforeclosure process. This is where we 're at and how Bank of America brought me, my home, and my home loan mortgage account to this point and predicament. None of the foregoing is true and correct on Bank of America 's part.

Complaint: Bank of America has caused to be recorded with the XXXX XXXX County Recorders Office a defective Notice of Default with form entitled California Declaration in violation of California Civil Code of Procedure Statute 2015.5 and California Civil Code Section 2923 - 2944.10. Bank of America knows or should know the laws of the state of California where they do business. I believe this is an intentional act meant to coerce, harass and cause me extreme disstress in on-going attempts by Bank of America to separate me from my home.
