Complaint: My husband passed in an accident in XX/XX/XXXX changing my whole world! I had a tight budget, I became single income person. House payment went up from XXXX to XXXX. The Bank of America started a remodification. After months of sending documents over and over again, talking with numerous people at the bank ( never the same person and just someone in customer relations reading the notes ) they gave me a modification, then immediately changed there mind before I got out the door saying they made a mistake, just that fast. Bank suggested refinance again sending documents over and over again, talking with customer service relations declined, no reason why I was more than qualified, I moved out, The bank contacted me by mail saying we could work something out. The only option at this time was a short sale because I did not live in the home. Started short sale process on XX/XX/XXXX. I filed Bankrupcty and surrendered the home. The judge granted me motion to proceed with the short sale. ( documents attached ) They rejected a qualified buyer that has since bought and closed on a new home. They rejected the short ( letter attached explaining why ). I in good faith spent money on repairs and home warranties to maintain the home. ( paperwork attached ). I cancelled the home warranty after they declined the short sale. I am disappointed that Bank of America does not have a authorized person of knowledge about the information sent to them to try and come to some resolution instead ; they have what they call customer relations answer the phones and read notes back to us. They appoint one customer relations person that you should be able to contact, if he or she does not accidentally answer you have to leave a message and wait 24 hours for her to call back, if you miss their call the process starts all over. This has been going on for many years. The short sale was declined on or around XX/XX/XXXX. I requested a pay off, I owed XXXX at the time of my hardship. Because of the dragging of Bank of America responding and or having us start the same process over and over again to try and get a resolution it has exculated to the loan amount of XXXX for me to get a loan and pay off the bank and or pay XXXX to reinstate. The Bank has been wrong to hold the home in my name this long after declining the short sale. In one letter the Bank said I needed to wait 1 year and try to get a loan and buy the house.Last letter I recieved from the bank was on XX/XX/XXXX saying I coud live in the home if I filled out the documents they sent me and qualified, from my past years experience with the Bank of America I have no hope of the Bank ever coming to a resolution. I feel like Ihave been playing a game for the last 6 years. Once again the Bank seems to want to work with me, but I need closure. Had my husband not passed I would not be in the situaton I have ended up in. I really in the beginning thought the Bank was going to work with me. I feel Bank of America has not treated me fairly and that it is wrong to have left the home in my name this long. Why are we not allowed to talk with the people at Bank of America that process the paperwork we send in? Why? It would only make since.

Complaint: I purchase my home in XXXX through XXXX and financed by Bank of America. At the time of purchase my home was valued {$180000.00} and the home was purchased for {$150000.00} I was then offered a equity line of credit through Bank of America for {$35000.00} for Home Improvement. Shortly after Home Improvement the home was reappraised by the bank and was value of {$210000.00} 6 months after home improvements the bank send me a letter requesting that I pay back the equity line of {$35000.00} infull payment, because my home is no longer of value and it 's only worth {$75000.00} I immediately contacted the bank and started Communications trying to restructure my mortgage being in shock not knowing what was happening to the real estate market. The bank in communication told me that they can not do anything to help me or restructure my mortgage payments because I have not missed a payment and they do n't care what my home is worth they just want their money back. I was then informed by a Bank of America customer service representative that the only way they can help me is for me to miss at least three payments so I stopped paying my mortgage in XXXX and by XXXX second XXXX the bank started filing for foreclosure. Shortly after that the Department of Justice ordered that the equity line of credit is to be charged off and I did not have to pay it back. Bank of America mediately report the & gt ; charged off as derogatory & lt ; to the credit bureau and sold the main mortgage to XXXX lending. Bank of America also reported a & gt ; foreclosure initiation & lt ; to the credit bureau. I sold the above mentioned home in XXXX on a short sale and XXXX receive the {$35000.00} of what the home was valued after depreciation at the time and was sold for. XXXX then reported the sale of the home and final payment & gt ; in full pay less than {$150000.00} what is owed & lt ; on my credit, and a report of. & gt ; balance charged off & lt ; it was send to the IRS, reported as income. The IRS charged off as a loss of mortgage. In less than one years after purchasing my home the depreciation started and had dropped in price from {$210000.00} to {$35000.00}. My credit is now ruined with no fault of my own and the banks were bailed out by the government and the consumer is left holding bad debt. This is not right! Someone need to do something. I am now unable to attain a normal interest rate and also unable to purchase another home because of these derogatory statements on the credit report showing either foreclosure, tax lien, legal action taken, or repossession. How could our government allow this to happen.

Identity theft / Fraud / Embezzlement

Credit card:

Complaint: I have contacted Bank of America NUMEROUS times about identity theft I was experiencing. Bank of America still refuses to cooperate and remove the fraudulent account from their systems and my credit report. I have submitted police reports, my identifying information, and proof of military service to them repeatedly. They keep claiming I am responsible for the credit card even after proving I was not even in the country. I was XXXX at the time the credit card was opened. Despite my diligent efforts, Bank of America refuses to remove the debt and ask the credit bureaus to remove the fraudulent account. Currently there is a balance owed of over XXXX on the card. I have spoken with managers and representatives with no resolution. My next step will be legal action through the necessary courts for a lawsuit.

Complaint: I have doubled my income in the last 2 months and submitted the documentation to the BofA as a change of circumstance. At the same time a sale date XX/XX/XXXX ( 2 days from now ) on my home was issued. Here in California " dual tracking '' is illegal, but the BofA continues to practice it. Here is how they get around the law. My contact person says the underwriter requires more documents, and once I submitted them, the underwriter asks for more while the countdown continues. This is where I find myself today, with the underwriter continuing to review my submissions one day before the sale date. The underwriter has asked me for the same information, so as long as the " review is not complete '' the BofA does not remove or postpone the sale date. My contact person sets up a day and time to check in. I call at that time and get only voice mail. The contact may call later that day or another day. When I see who has called I call back. The contact person does not answer the phone, only voice mail. This has gone on for some time and the result is I will receive a computer generated letter saying the bank has made several attempts to contact me, which puts me in a bad light. The appointed day and time for this conversation has yet to occur. All of this is to say that this even more delays being able to complete the necessary submissions for a modification. My sale date is 2 days from now ( XX/XX/XXXX ) and the contact person said she would schedule a phone appointment on XX/XX/XXXX to discuss my modification progress with the underwriter. XX/XX/XXXX is one day after the auction. My strong sense of this is that the bank is letting the clock run out by stalling me with these tactics. I have had postponements before, mostly due to complaints filed with CFPB XX/XX/XXXX XX/XX/XXXX. This has come at great relief because I was able to continue to restore the family home which results in more room rentals ( I live on the property ) and continue to develop my skill sets for employment. I have demonstrated a slow but stead increase of income and with this latest doubling of my income I would have expected a modification. It is clear to me in the one day remaining they have no intention in completing it. In addition, I asked BofA to reveal my investor. They named the XXXX. I called and emailed them and they said they were not the investor but a trustee on behalf of XXXX XXXX XXXX is Countrywide and is owned by BofA . I earlier complaint to CFPB was not answered by BofA in that they repeated XXXX as the investor. As a homeowner who has been restoring this historic XXXX home that my parents bought for 16 years, I feel I and others have the right to communicate with the entity who holds the note. This issue was covered in my previous complaint. This same non disclosure pattern occurs also when asking who decides the sale date. BofA says the investor or the BofA law firm XXXX XXXX XXXX ( XXXX XXXX ) sets the date. XXXX says they follow the BofA instructions.

Complaint: Dear Sir or Ma'am : Please know that I am the executor of my mother 's will. Both my parents passed away within one and half years of each other. The house that my parents owned for almost 50 years was sold XX/XX/XXXX. Or so we thought. During the sale of the house, we were notified of a lien on the property that was never released. The lien is recorded in the XXXX County Registry of Deeds website under guarantee of XXXX XXXX XXXX XXXX. The release of the lean was never recorded. The lien is from XXXX XXXX XXXX XXXX, listed under XXXX XXXX XXXX, Document # XXXX, Book XXXX recorded on XXXX/XXXX/XXXX in XXXX County Registry of Deeds in Massachusetts. The lien is for XXXX XXXX XXXX in XXXX, Massachusetts. According to the information obtained on the Registry of Deeds, the lien is as a result of a home equity line of credit established in XX/XX/XXXX. A Home equity line of credit usually extends for a particular period of time until it expires. Please also note that there is no request for funds owed on a Mortgage of any kind for either my father or my mother. Please see page attached page from the XXXX County of Deeds website. Subsequently, XXXX XXXX was acquired by Bank of America. Bank of America was notified by our attorney XX/XX/XXXX, XXXX number XXXX of the non-release of the lien. As of today, XXXX/XXXX/XXXX Bank of America has not resolved the lien issue which is causing the buyer and myself unnecessary attorney fees. I would like to see a quick resolution to the inquiry. The lien should be released and recorded in order for the sale of the house. If the resolution continues then I would even like to see any expenses incurred for this delay refunded to the buyer and seller of the house due to the non-action of Bank of America. If you would like additional information you can telephone me at XXXX. Sincerely, XXXX XXXX, XXXX, XXXX XXXX XXXX XXXX
