Complaint: Entered into subprime mortgage with Countrywide. Had a motorcycle accident. Immediately contacted HUD/FHA for mortgage relief while injured ( could not go to work, financial hardship ). Contacted by BofA regarding my requests. Sent to numerous mortgage counseling programs and representatives of different departments within BofA, all to no avail. BofA disregarded my qualified written requests as of why they were dual-tracking my mortgage and were deficient in providing me with mortgage foreclosure relief at the same time. Complaint: In XX/XX/XXXX, my mother passed away, and her XXXX condominium became part of her trust. Though I live in XXXX, all of my family is in the XXXX area, so I expressed an interest in the condo. My sisters agreed to sell it to me below-market value, but asked me to get a loan to purchase it from the estate ; the estate 's lawyer said I could use my owner equity as XXXX of the heirs toward the loan 's down payment. On XX/XX/XXXX, I went to the Bank of America in XXXX California, to talk with the bank 's Mortgage Loan XXXX. Saying that I was n't sure if my financial profile would allow me to proceed with the purchase, I wanted to see what, if anything, might be possible. The loan XXXX asked for my employment and salary history, savings and investments, loans and credit card debt, and so forth. She also asked if I owned any property. I said I was joint tenant of a house in town with 50 % ownership and that I could verify as much using the property 's title and payment records. She entered my information into her system and, within moments, I gave me a letter of conditional approval for a {$96000.00} loan. On XX/XX/XXXX, the bank 's loan XXXX emailed that I had received " official Final Approval '' through the Bank 's " Buyer Ready '' program and that the " only outstanding items necessary to proceed would be sales contract, appraisal and preliminary title report. '' On XX/XX/XXXX, I submitted a copy of the signed real estate contract. On XX/XX/XXXX, while visiting family in Illinois, I met with the XXXX, only to get a *second* appraisal request on XX/XX/XXXX ( apparently because the Bank lost XXXX first XXXX ). As the bank worked to get another appraisal lined up, emails continued to report inaccurate information about the loan, even as the XX/XX/XXXX, XXXX of XXXX date approached. The loan XXXX emailed XXXX saying they were still trying to get an appraisal but that " Worst case estimated closing date XX/XX/XXXX ; due to miscommunication with appraisal department and supporting staff. '' The day before I was to close, I learned a new underwriter put a hold on the appraisal request because " liability guideline - liability obligation ca n't split mortgage obligation in half. '' My loan XXXX explained I had already received final approval through the " buyer ready '' program but, the next day, I got a notice that BofA denied my loan due to " Debt to Income Ratio : Excessive obligations in relation to income, Income insufficient for amount of credit requested. '' Cautiously, I agreed to work with the Bank on a new loan -- XXXX with a cosigner -- because my loan XXXX and her supervisor promised they could close in XXXX weeks on the grounds that " the Bank owed me. '' Yet despite another flurry of financial documents, updated sales contracts, alleged XXXX shortage, a *second* missed XXXX of XXXX date ( XX/XX/XXXX ), and a range of supervisors intervening at various stages of the process, I was declined once again due to my debt-to-income ratio. After I learned of my loan 's rejection, a mortgage broker in XXXX reviewed my financials and the bank 's loan forms and, within XXXX minutes, was able to say I would n't qualify for a loan ; the numbers just did n't add up. And yet Bank of America told me that I did qualify, TWICE -- first under its Buyer Ready Program, and then with a cosigner. If BofA had more competent personnel and/or systems that cold accurately flag debt-to-income discrepancies, I may not have been able to purchase the my mother 's condo, but my mother 's XXXX would have been able to make timely, alternate arrangements. Instead, it has spent thousands of dollars on additional payments for a mortgage, property taxes, insurance, HOAs, and legal services/documents on a property BofA said it could help me purchase but, ultimately, did not.

Complaint: Good Morning CFPB- The BofA has continued to post sale dates while I am in a modification. The sale dates just get put back a few weeks or months as my income continues to increase. I have a pending complaint but the BofA response to your communication continues to be the same standard answer. The bank position is they are satisfied with their reply regarding their pattern of " dual tracking '', illegal for the last 3 years in California. To this I would like to add new information. I once again have been declined for a modification, even though my income has doubled and I am able to pay the monthly statement I receive in the mail. The bank will NOT allow me to pay that amount. I spoke with a bank representative on behalf of my single point of contact. I asked him how much money do I have to earn to satisfy the bank 's demand. His response is that he does not have that information and that the investor sets the income amount. This brings up the 2nd complaint I filed regarding locating the investor. In brief, BofA names XXXX XXXX as investor. When I XXXX their response is that they are not the investor but the trustee for a consortium of ( unnamed ) investors under the umbrella of XXXX. XXXX is Countrywide, and BofA owns Countrywide. This is a deliberate tactic to make sure the homeowner has no access to any entity who claims to be the investor and no one who claims authorship over who sets sale dates, required income amount, etc. When I confront the BofA with this information they say my only avenue is to contact XXXX even after I just told the representative what I have just told you. I then told the BofA representative that I am actively interviewing for full time employment and that until I have a firm figure from the BofA regarding my monthly income requirement I can not determine a dollar amount for salary when asked by a potential employer. The BofA rep then told me in his opinion " no amount of money would be enough. '' And with my sale date being XXXX XXXX, XXXX, the only option is a short sale. I much appreciate having this CFPB avenue to describe the position ( s ) BofA has put me and others in, and hope this Bureau will not be shut down due to the recent political election. Can you continue to work on behalf of my particular situation and others facing the same treatment? Once again I would like to mention that this is my family 's home since XXXX, I lost XXXX work due to the downturn of XXXX. I have been working when I can, using the money to restore this classic XXXX XXXX home here in the XXXX, XXXX XXXX. I started with an unlivable home generating no rental income, I am now able to remain on the property and generate {$XXXX} annual. And am working on the XXXX which will generate another {$XXXX}. With a full time job I could be generating a total of {$XXXX} annual. The current annual mortgage obligation is around {$54000.00}. Thank you for your continued support. Any cancellation or postponement of a sale date has allowed me to use the time constructively to increase my income, reestablish myself in my field and train in related fields, and continue to restore my home for optimum generation. Complaint: After Filling report with the Consumer finance about my over all experiences with Bank of America. The Banking Company sent me letter & banking statements in the mail. The letter stated They respectful decline my request for reimbursement. with this in mind, by reading the letter that was send from XXXX on the companies behalf, she did n't really do any research on the account. letter that was sent be to me by XXXX stated as follow, brief summery : ( There was no overdraft fee on the account. or Error/s ). I called in on the date after the funds where taken out of my business account. The agent that i spoke to was very helpful and under standing. The agent lifted the overdraft fee and and place on my account an Cr in the amount of {$150.00}. told me thats all she was allowed to do at that time. I am not sure if she made and case on my behalf for the remaining amount of {$280.00} that I am seeking an Cr for. When XXXX called in, she did n't ask me anything when calling just asked me how i would like to be contacted. I just think morally unjust and wrong the process that was taken after i was told the amount of XXXX was now permanent. They lied to me the consumer. someone that in trusted there money in your home for safe keeping. No matter how small the amount. As I am writing this i cant help but to feel distraught. Feeling unheard as an consumer. The fund where debited from my account with out any notice or letter date when the funds would debited from my account. an this is morally wrong with out and doubt. I would like to say that I am grateful there are banks that allow consumers to use their banking home system for our money safe keeping.

Complaint: Hello I applied for XXXX due to being let go from work. I was granted XXXX they begin to issue payments according them to bank of America but I have not received them.. Bank of America is giving my money to someone else, and claiming that I did a bank transfer years ago they claim money is going to some account I have no idea what they are talking about or referring too. I have not given any permission to transfer anything anywhere. My rent and car note is due I need to pay my bills. I am asking that Consumer Financial Protection Bureau help me to get the funds owed to me from Bank of America. I am also asking your help to prosecute those that are using my money and the bank of America representative that is putting the money into the wrong account. Bank of America is giving me the run around. I am owed quite a few payments per XXXX around XXXX or XXXX. I am not getting anywhere with bank of America and XXXX seems not to be able to help as well. Complaint: I 'm addressing the fraudulent vandalism by BOA employees, to my house during the loan modification. My civil rites as a property owner, were violated by BofA employed agents to try to get me to vacate my property, when I was only one month in the rear in payments, and owned my house for more than 40 years and had XXXX BOA loans for more than 80 years. My XXXX XXXX XXXX stated that BOA was responsible for the damage, and cancelled my homeowner 's insurance policy. I took this up to the Department of Insurance, and they told me that you were working with litigation with Bank of America, also recommended I contact the BOA/ CEO president, he said that he could not speak with me because he was working with the state of California on litigation. We are XXXX and have limited income and are XXXX. We have a home which we have owned for more then 4 decades and was vandalized by BOA during their loan modifcations.

Complaint: Back in XX/XX/XXXX, when we were on an XXXX, we were offered a home by XXXX XXXX on XX/XX/XXXX, and we bought the house paying a {$6000.00} deposit ( House was valued at {$160000.00} ). The loan was then taken over by Countrywide Loans ( CL ) and finally Bank of America ( BOA ), bought out Countrywide Loans, which went under. XX/XX/XXXX, I suffered a XXXX, caused due to a rear ending of my car by an errant driver, who had no Insurance. The illness caused the company ( XXXX XXXX , XXXX ) that I worked for, for almost 12 years, to lay me off on XX/XX/XXXX. Although unemployed with no means of income from the government ( due to my XXXX status then ), either in the form of XXXX or Unemployment, I continued payments on the house and in XX/XX/XXXX, I requested Bank of America to help me with a Loan Modification. The trial period of three months was also fulfilled but without a job I could n't afford it further and requested Bank of America to reconsider lowering the rate further for me to afford it. In the meantime a company called XXXX from XXXX, California, offered to help and ripped me of for {$1800.00}. Since then I have sent in XXXX XXXX prepaid envelopes of documents that the bank requested. Finally when I got a job on XX/XX/XXXX with XXXX , XXXX, I reached out to Bank of America, who once again dragged their feet on the issue making false accusation of incompleteness of documents, These documents were completed and sent to them with the help of their branch in XXXX. To make good my Loan with them, I saved and put down {$11000.00}, against the loan 's principal in XX/XX/XXXX Both of the previously mentioned companies took advantage of my status and did not pay me the prescribed wages for which they had filed for my employment. I have reported the matter of XXXX, in XX/XX/XXXX to the Department of Labor ( DOL ) and am still to get my back dues. Now that we are Permanent Residents, I have directly referred the XXXX XXXX having short paid me directly to the Texas Labor Commission. Bank of America kept dilly dallying the issue by claiming to be working on my loan modification and then coming up with fictitious claims that my application was incomplete. Now that the price of my home has improved, they are wanting to possess it by foreclosing on my property. I first applied for modification in XXXX. Nothing happen. The temp service placed me in a job paying a little more I was able to catch up. So that job ended in XX/XX/XXXX. The next job paid a lot less so I struggled again. So in XXXX I applied again for Modification talk with rep went over paper work filled out package did n't hear anything called in XXXX had to reapply again same paperwork. So I called XXXX and did the same paperwork again. Now it 's theXXXX and I have n't receive paperwork to fill out. I 'm a 4 or 5 months behind on my payments. I did receive a coupon to pay XXXX for XXXX payment when I was paying XXXX I asked my self how do I pay more when I 'm trying to get it lowered. My name is XXXX like I stated I have a new job that 's paying me 3 dollars more an hour. Were I was only making XXXX an hour. I would like to save my home. I just stared my new job so I will get a full pay check but I had to not take taxes out in order to pay my mortgage payment which will be late because I ca n't pay until the XXXX when I get paid. Complaint: I XXXX XXXX make a claim with the Consumer Financial Protection Bureau ( CFPB ) that the following attached attempt to collect a debt is highly fraudulent. My personal information is being floated in what is known in the debt collection business as a " debt Pool '', whereas collection information is outdated and not even enforceable. The attached collection from XXXX XXXX, XXXX does not state that the debt is no longer enforceable, a stipulation by the Federal Trade Commission. The method of an illegal posting of a collection on my personal credit report, or an illegal collection against my rights of the Fair Debt Collection Practices Act can not be tolerated. In Federal Trade Commission v. XXXX XXXX XXXX, XXXX ( 2009 ) the federal district court decided in favor of the Federal Trade Commission that a collection agency must operate within strict guidelines in the collection of a debt. The criteria are as follows : 1 ) The debt must still be enforceable within the state of procurement or where the original obligator resides, or a combination of both. 2 ) The debt collector must be licensed and bonded if applicable within the state in which it is trying to collect, if the debt is collectable. 3 ) The validation of debt ownership must be proved, without exception. There is no statement on the attached collection that the debt is no longer enforceable. The collection agency stipulates that Bank of America obtained a judgment against me. By legal mandate, the docket number of the judgment must be listed as well as what county clerk 's office the judgment is filed with. In this case, there is no judgment. The statement saying " This judgment may be forwarded to an attorney for execution '' is a complete falsehood. There can not be a lawsuit as the legal time limit to enforce a summary judgment action has passed. Even though the collection letter states that illegal, abusive, deceptive and unfair debt collections are illegal, this collection in its entirety is just that, a deceptive illegal attempt to collect a debt that is no longer enforceable. I demand that all my information be purged immediately by XXXX XXXX, XXXX and Bank of America, and that the Consumer Financial Protection Bureau ( CFPB ) take the necessary steps to sanction both companies for using such abusive collection tactics.

Since the first call, BofA did not provide proper guidance for international disputes ( per XXXX ), been unresponsive to my follow-ups ( XXXX calls ), and, during my last phone call with the Credit Claims Department on XX/XX/2016, the BofA representatives asked me to forge a letter from a XXXX retailer to say the product was not of quality ; this was witnessed by myself and the BofA Branch Manager. Complaint: We feel terribly violated and defrauded by Bank of America , N.A . on my parents REVERSE MORTGAGE whom have past away, I am the Executor to their Estate and the Promises made to my parents upon obtaining a Reverse Mortgage was Sadly Misleading, and Now I have family members with XXXX School age Minor Children with Fear of being Evicted despite doing everything according to the, REVERSE MORTGAGE SOLUTIONS and XXXX XXXX XXXX, Hired by Bank of America have shown to be Bullies and using intimidating language, Refusing to Allow us to Sell my Parents home by refusing, Offers of Purchase and Stalling the process by Numerous Motions, and Unfortunate Probate Delays, despite repeating attempts to accept Real-estate Offers, I have kept in close contact with Bank of America 's Attorney, XXXX XXXX XXXX and XXXX XXXX XXXX, XXXX, XXXX XXXX County Court House, I have email threads providing a timeline of these failures, despite speaking out. I 'm XXXX and was unable to hire an Attorney doing everything myself, I was Offered a " Cash for Keys '' agreement by XXXX XXXX XXXX, XXXX that was then resended by THEM with no further explanation, with NO RELOCATION ASSISTENANCE for the family members left in the house. I find this REVERSE MORTGAGE of our aging parents, Nothing more than a SCAM, that once discovered, there is nothing you can do the victims are deceased, and the family is left with the burden. In my case my parents were longtime Bank of America customers and they TRUSTED them, BUT we could of never imagined this would be the outcome my parents expected and as the Executor of the Estate we were informed Bank of America has Mortgage Insurance Premiums, covering the mortgage upon there death, that I 'm sure they long collected. My pleas is to Bank of America , N.A . to do the right thing and Offer RELOCATION ASSISTANCE, of {$3500.00} to my family or ALLOW us to SELL the property we were entitled to do according to there agreement with my parents.
