Complaint: I have a loan with ALLY FINCL. I have always made my payments on time. For some reason I realized that there was a late payment on my credit report. As you can see, I have always had a stellar payment record with this company. I tried contacting both XXXX, XXXX, XXXX and ALLY FINCL with no successful resolution. XXXX, XXXX and XXXX were reporting me late. There was definitely an error on their part. I was never 30 days late XX/XX/2017.

Complaint: In XXXX of 2016 we were in a no-fault traffic accident in our vehicle which was declared a total loss. My insurance company paid off the majority of the loan ( approx $ XXXX XXXX and it took a couple more weeks for the gap insurance to pay the remaining balance. Once the gap insurance paid the remaining balance, there was approx {$1100.00} left over. We were 60 days late paying this and requested assistance from their XXXX department but was blown off and made it too difficult to contact back. We paid off every penny within a couple months of the accident but this was reported as being written off as a repossession. I disputed this with XXXX ( # XXXX XXXX but now it still shows that $ 600+ was written off and thats how they reported it. We sent this payment then found out after the fact themat they wrote it off. I dont know if they reported the entire amount to the XXXX as a credit but this is wrong. I am unable to purchase a vehicle because the banks look at this as a repo. I have called and asked them for a payment history but I have still not received it.

You told them to stop contacting you, but they keep trying
Complaint: I have received telephone calls from an " unknown number '' to my cell phone every day for the past two weeks, at varying times of the day. When I answer the phone and ask who is calling, I am told that it is XXXX from Ally bank, looking for [ my sister 's name ]. The individual states that my sister and her boyfriend are clients and they are not answering their phones ; the bank is trying to reach them. They stated that they found my cell phone number via a " public database ''. I have asked for my telephone number to be removed from their list, and stated that this number is not associated with my sister, yet they continue to call.

Funds not handled or disbursed as instructed
Complaint: As of XXXX XX/XX/XXXX, the state of Connecticut mandated Payers ( Banks ) who had business in the state to withhold Ct state tax from Pensions, Annuities or Retirement account distributions of maximal 6.99 %.
Connecticut residents could tell the Payers ( Banks ) the correct amount of Connecticut income tax to withhold by filling in " Form XXXX '' and sending this to the Payers ( Banks ).
When I send to my bank what is ALLY BANK the forms for my Required Minimum Distribution ( RMD ) I included also the " Form XXXX '' with my instruction to withhold {$0.00} for state tax withholding. My income is low and the last 2 years I had only to pay a minimum amount of CT state tax.
Ally bank did totaly ignore to what I had filled in on my " Form XXXX '' and took out 6.99 % from the amount of my RMD.
It seems very strange that while the state of Connecticut let ALLY Bank thru my " Form XXXX '' not withhold CT state tax, ALLY Bank insist in doing this against my wishes, and in a way ALLY Bank forces me on XX/XX/XXXX, to give the state of Connecticut a loan that I can get back in XX/XX/XXXX after I have filled in my CT State income tax.
Attached is a file with 3 forms that I send to ALLY Bank to request my RMD from my IRA.

Complaint: XXXX XXXX XXXX Sales Associate ran credit report with other lenders after I explicitly advised staff that I all already had a pre-qualification later and was pre-approved for auto loan financing through XXXX XXXX XXXX. I told the associate explicitly that I did not wish to have any hard inquiries on my report and that I only was seeking financing with XXXX XXXX and that I only authorized my credit to be examined through XXXX XXXX. I already had credit monitoring and an active credit card account with XXXX XXXX. XXXX XXXX XXXX appears to have ran my credit with the folllowing lenders, which are Ally Financial, XXXX, XXXX XXXX and XXXX XXXX all on XX/XX/XXXX. All of these hard inquiries will remain on my credit report until XX/XX/XXXX. I did not authorize for any of these companies to run my credit profile. I only wanted to determine an approval for auto financing ONLY through XXXX XXXX XXXX.

Complaint: We applied for a mortgage with Ally Bank and were approved to close on XX/XX/2018.
A problem came up last minute where the city refused permission to repair the existing septic and required a city sewer hookup instead. The city was not able to provide dates where this could take place.
1 ) Ally refused to close without the work being complete. Other lenders will proceed with a hold back of funds for the work.
2 ) Ally refused to allow a new rate when the lock expired, instead instituted a {$340.00} fee every 5 days rate extension fee until the work was done. This is the equivalent of a blank check, which is not workable.
3 ) Ally refused to release our appraisal which WE paid for up front so that we could use it for a mortgage company that was willing to close with a funding hold back.
Ally gave us no options except an open ended and rapidly escalating fee. I feel our appraisal is being withheld out of spite as other financial institutions will transfer appraisals. The situation was not our doing, yet Ally gave us no option but to pay them thousands of dollars in extra fees.

Old information reappears or never goes away
Complaint: In XX/XX/2018 my girlfriend and I moved across the country from XXXX to XXXX, XXXX so she could pursue her career with a new company that offered her a significant promotion. After this move my finances were drained from all the expenses involved. I had to use my stipend from the federal student loans I had acquired from the previous semester to cover these costs. This stipend had been budgeted for the cost of my car loan. Having no other option I had to use that money to cover those costs. While in my new city it took until late XX/XX/XXXX to find a decent paying job. During this excruciating process I then fell way behind on my car payments that I had diligently stayed on top of for over two years. The car was repossessed and had been taken THREE HOURS away to XXXX, CA. ( to make matters worse ). After about 45 days I was able to save enough money to reclaim my vehicle. This wound up costing me {$2000.00} that I had to scramble to save. Since this time I have been on time with all payments ( 5 months ) and I believe my positive track record of paying on time for over two years prior to the repossession should speak for itself. These 3 late payments are weighing very heavily on my credit report and hinders me from getting more favorable loan agreements.

Attempted to collect wrong amount
Complaint: On or about XX/XX/XXXX I purchased a vehicle from XXXX XXXX XXXX for {$10000.00}, financed through Ally Financial. A XXXX XXXX XXXX, XXXX : XXXX. The vehicle was repossessed on or about XX/XX/XXXX.
A dispute letter has been mailed to Ally and XXXX XXXX disputing the full amount of {$10000.00} for vehicle that Ally is requesting me to pay. Because the vehicle has been sold, I should not owe the full amount. Allys account number XXXX.
In addition, after the vehicle was repossessed, I did not receive any notices, and after the vehicle was sold I did not receive anything showing what the vehicle sold for : below is what I should have received from the financer, but I did not receive anything.
1 ) Notices should have states that they have the car in their possession and that the car will be sold to recover the amount owed ( this is called the Notice of Sale, which I did not receive. ) This notice should have been sent to me within ten days of their possession of the vehicle. Since they did not provide me with this information they can be barred from collecting on a deficiency judgment.
2 ) After the vehicle was sold the lender then is required to send me a second notice, stating the amount that they credited me from the resale, as well as a cancellation notice of the original sales contract.
Additionally, there were GAP Insurance and service contract on the vehicle into the original purchase, these amounts should have been deducted from the amount that the Ally states I own.
Additionally, there were GAP Insurance and service contract on the vehicle into the original purchase, these amounts should have been deducted from the amount that the Ally states I own.
When a finance company finances a vehicle then repossess it, they can not collect all of the money on the vehicle what it was initially sold for. Once the vehicle is sold, the finance company must provide proof the vehicle was in their repossessed and proof the vehicle was sold and how much the vehicle was sold for minus the initially sell of the vehicle.
It is unfair to collect all the money of a sold vehicle and then ruin a person 's credit for seven-years from a vehicle that is sold.
