Complaint: I have 9 fed student loan accounts that were dinged 90-119 days late. The time the accounts show late in in XX/XX/2015. I had a retroactive forbearance approved for those specific dates yet they still report negative on my credit report. I have filed a dispute with the credit bereaus and XXXX has sent a reply saying the accounts have always been in forbearance. Its impossible for there to be a late payment if the account has always had a Forebearance. It is not right for them to charge massive interest during the forbearance period and say that I was late. I need this fixed ASAP.

Complaint: Loan default was entered on my account on XX/XX/XXXX Due to said default, I incurred significant and burdensome penalties of approximately {$15000.00}, not including interest, which I continue to pay off to this day. The default was entered in error as I timely requested an emergency medical forbearance prior to the date that the default occurred.
On or about XX/XX/XXXX, I was admitted to XXXX XXXX in XXXX XXXX, California. I was struggling with XXXX and XXXX XXXX and due to my troubles, I was unemployable and unable to pay my student loans. At the time that I was admitted to the hospital, I was aware that my student loan account was near default. Therefore, after admittance to the hospital, I contacted AES to notify them of the situation. I was instructed to fill out a medical hardship signed by my doctor and send the form to them via fax. I did as instructed and sent the form to them prior to XX/XX/XXXX
Approximately 30 days after being admitted to the hospital, I was discharged and returned home. However, when I returned home, I was notified of the default. I immediately contacted AES and was told that my request was received too late EVEN THOUGH I SENT THE REQUEST IN A TIMELY FASHION AS INSTRUCTED BY AES. The default and rehabilitation process was explained to me and although I disagreed with the result, I immediately undertook measures to start the rehabilitation process.
At the time, I did not have the strength to fight the default. It was more important to me to get healthy and resume my life. I did just that I have been XXXX and XXXX for nearly 13 years and have been employed throughout that time period. I have made every single payment to AES. However, due to the increased financial burden and payment schedule, my debt to AES has barely decreased and every month it is a struggle to meet all of my financial obligations.

Complaint: I have been on an income-based repayment plan for a number of years. My federal student loans are currently serviced primarily by XXXX XXXX. In XX/XX/XXXX I received a standard notification that I would need to recertify my income by the end of the year in order to continue to be on income-based repayment in XXXX. In XX/XX/XXXX, I submitted the relevant paperwork and income verification to recertify my income-based plan. Despite this, my XXXX loan payment was approximately ten times what it should have been had I been under the income-based repayment.
I noticed this, and gave XXXX a call explaining the facts and the situation. I was then told that my XXXX payment amount would be " reviewed '' and I would receive an email within 7-10 business days with the outcome of the " review. '' In fact, more than a month later after having called in again, I was only then told over the phone that the " review '' was unsuccessful and my XXXX payment would not be corrected. I never got the email I was promised, and to date have no idea what standard was used to " review '' my payment amount. When I called I was told that XXXX " billed 20 days in advance '' and my XXXX bill had already been processed, and that was why the XXXX amount was so much.
My XXXX payment continues to remain the same, despite my XXXX and XXXX payments being the proper amounts based on the income-based repayment calculation.

Don't agree with the fees charged
Complaint: I recently read AES has the second highest complaints of all loan companies, namley charging more in interest. This article prompted me in scrutinize my own arrangement to which I discovered that more often than not the majority of my monthly payment is put toward accrued interest. In total, I've paid XXXX toward my loan but only XXXX has gone toward principal. How have I paid this much money and have only paid off XXXX?
Very few times was there more applied to principal than interest, I was often charged $ 20-50 or more in interest. There was even one payment that only applied {$9.00} to principal out of a {$170.00} payment. These monthly payment minimums are misleading as it doesn't say how much gets put in each month, the amounts are always different, and you can't edit to pay different amount. Who's to stop an extra payment from going totally to interest when you're not given the opportunity to express this?
I believe my account needs to be fully audited and I demand some action be taken, this is criminal.

Complaint: I had contacted American Education Services and made a payment of XXXX on XX/XX/XXXX. This payment was supposed to bring all 4 loans down to 39 days past due. When the payment was processed, it was not done as specified when talking to the person that took the payment by phone. When looking at the account, it showed one account being 13 days past due, two others showing 44 days past due, and the other was showing 75 days past due as of Wednesday XX/XX/XXXX. I contacted the customer service on this day and there was a request to re apply payment to correctly show the past due time/amount. If the amount paid was correctly distributed as instructed there would be no issue. As of today XX/XX/XXXX, This was still not corrected.
Upon looking at the account on Monday XX/XX/XXXX at XXXX hours MST i noticed a change in the current interest rate at 6.06 % for two loans ( XX/XX/XXXX and XX/XX/XXXX ) without any notification at all. I received the new repayment terms from AES via the paperless inbox which was dated for XX/XX/XXXX and showed a 5.870 % interest rate. Again, I never received any notification of this change.

Complaint: I've been trying to make my payments to AES on time and ahead of schedule, however, my payments are not being processed as I have requested.
I've had problems with my Loan being processed as I have requested.
Non of my Loan Payments were processed as requested in XX/XX/XXXX, until I called several times to have AES process my Loan Payments as requested.
Now again, for the month of XX/XX/XXXX, I submitted payments for all my Loan Sequences at the same time. After calling several times, all Loan Sequences were finally paid after being not being processeed as I requested, except one.
I requested AES apply {$140.00} Loan Payment to Loan Sequence XXXX - XX/XX/XXXX.
But Instead AES split my {$140.00} Loan Payment among FIVE ( 5 ) Loan Sequences : Loan Sequence XXXX - XX/XX/XXXX, AES applied {$9.00} to Principle - {$0.00} to Interest Loan Sequence XXXX - XX/XX/XXXX, AES applied {$2.00} to Principle - {$0.00} to Interest Loan Sequence XXXX - XX/XX/XXXX, AES applied {$1.00} to Principle - {$0.00} to Interest Loan Sequence XXXX - XX/XX/XXXX, AES applied {$60.00} to Principle - {$21.00} to Interest Loan Sequence XXXX - XX/XX/XXXX, AES applied {$44.00} to Principle - {$0.00} to Interest This is very frustrating for me. I have to call several times for AES to finally process my Loan Payments as requested.

Complaint: Please know after successfully completing a 60 month, 5 year pay plan for my XXXX XXXX XXXX. My case was officially recorded and XXXX on XX/XX/2017.
Dept of Ed / XXXX XXXX was a creditor in my case as was paid a claim of {$11000.00} as part of the bankruptcy settlement. This information was confirmed by the courts stamped and recorded proof of claim ( POC ), and the courts Interim Final Report ( IFR ).
I can not get XXXX XXXX to do a proper and accurate accounting of the {$11000.00} paid to them per the XXXX court documents.
They say the have not been paid. However, the court documents say they have been paid as proof in the Trustees Final Report.

Complaint: I had consolidated my two student loans under the Direct Student Loan program in XX/XX/XXXX.
In XX/XX/XXXXXX/XX/XXXX, I was employed under the XXXX XXXX XXXX as XXXX at XXXX XXXX XXXX XXXX, which was a certified job under the Public Student Loan Forgiveness Program. I have been employed there for over 10 years and paid all my payments on time but the Department of Education said that I was not in a qualified loan even though I had been in the Direct Student Loan program. They said I should have been in an Income Based loan program. I was never told that until now by my loan servicers ( there were more than one and XXXX was one of them ). Now the government is saying that I have to start over with my loan program under an income-based repayment loan for 10 MORE years. I am still owing approximately {$63000.00} on students loans that I was told would be forgiven. I am not sure what to do, but was told that CFPB may be able to file a complaint with someone about it. I personally blame the US Department of Education because the type of loan that they are saying that I needed to be on didn't even come into existence until like XX/XX/XXXX

Complaint: I was transferred to XXXX from XXXX last year after applying for Public Service Loan Forgiveness. I have always made my payments on time and intend to continue to do so. On XX/XX/2017, I received notice that I needed to recertify my income to stay on the Income Driven Repayment Plan. I uploaded and mailed the recert papers to them before 30 days had passed. Just a couple of days after uploading, I received a notice that since I had not submitted the papers, my XX/XX/XXXX payment would be $ XX/XX/XXXX- more than 1/4 of my income!
After many calls and reassurances that they had the papers and would be processing them soon, they did take out that entire amount from bank account. I had to borrow money just to keep living. I would appreciate it if they would refund the amount paid less the amount of my regular payment.
I recently submitted a change to direct debit form after changing my bank, and they still have not processed that. I'm sure that they'll XXXX that up too and put me down as late.
Each time I contact them I am assured that everything is fine.

Complaint: I have reason to believe that AES/PHEAA is not allocating payments fairly with respect to current legislation for Student Loan lender laws either Federally or by State. AES/PHEAA is growing to be an increasing problem for many borrowers. While they maintain they are just following protocol, they are engaging in illegal practices by only applying small figures of a total Payment to loans in their favor. Should they disagree with this analysis, I am challenging AES/PHEAA to send a copy of all financial transactions in the last 6 months for where any partial part of a total payment was applied. For historical accuracy, AES/PHEAA should provide a detailed breakdown of what exact amounts were applied to what Loan account.

Complaint: Upon much research and due diligence regarding my student loans, it was brought to my attention that the bank or agent is not the holder in due course of the promissory note. Several attempts were made to obtain information regarding bookkeeping entries, questions concerning this transaction and other relevant information, and requests for the actual and original promissory note of the transaction to be produced. These requests in writing were sent via certified mail with delivery confirmation to agents of the Pennsylvania Higher Education Assistance Agency ( PHEAA ). On the following dates, letters were sent to XXXX XXXX XXXX, DBA XXXX XXXX agent, to request such information : XX/XX/XXXX Notice of Adequate Assurance of Due Performance ; XX/XX/XXXX Notice of Default and Demand to Cease and Desist Collection Activities Prior to Validation of Purported Debt ; XX/XX/XXXX a final notice regarding failure to comply with UCC Code 2-609 " Notice of Adequate Assurance and Performance '' ; XX/XX/XXXX Request for Original/Unaltered Front and Back Side of Promissory Note and Notice of Failure of XXXX XXXX to Respond to 2nd Questionnaire Regarding Creation of the Alleged Loans.
Despite sending these letters, I have not received answers to my questions, nor the original and unaltered promissory note as requested.
Lastly, on XX/XX/XXXX a Notice of Termination was sent to XXXX XXXX XXXX XXXX, XXXX, attorney for the agent XXXX Bank. Notice was given that the contract and any obligation it created was hereby terminated for failure to provide adequate assurance of due performance as outlined in international contract law UNIDROIT principles of international commercial contracts XX/XX/XXXX.
Despite requests for full-disclosure, I have not received information from the Pennsylvania Higher Education Assistance Agency ( PHEAA ) to assure of its performance and that I received proper consideration to support the contract. It's somewhat confusing that I can submit certain questions regarding this matter and the parties remain silent to my requests. My contention is that they have not satisfied themselves to the validity of the original agreement when becoming either agent or holder in due course and shows a profound failure in their due diligence and duty of care. It is also my understanding that they have an obligation to speak. Pursuant to the XXXX XXXX XXXX v. United States ( XXXX XXXX XXXX ) " An entity can not compel performance upon it's corporate statutes or corporate rules unless it, like any other corporation, is the ( holder in due course ) in some contract or commercial agreement between it and the one on whom it demands for performance are made, and is willing to produce said document and to place the same into evidence before trying to enforce it's demands. '' Since they have failed to respond and substantiate their capacity of holder in due course, I have no further duty or obligation to perform.
