Complaint: I repeat that I have been monitoring my credit reports to make sure that all accounts are properly validated. Two of the accounts I have been disputing have been American Education Services loan reportings -- AES/XXXX ( original : {$14000.00}, balance : {$22000.00} ) and AES/XXXX XXXX ( original : {$14000.00} ; which apparently transferred to AES/XXXX ). That complaint regarding issue with the credit reporting of these two accounts still stands, but in addition, that complaint is regarding the documents that were sent to me from AES/XXXX claiming that the accounts are validated and verified. Their exact words are, " American Education Services ( AES ) has determined that the loan ( s ) listed on the back of this letter is valid. Accordingly, we have enclosed copies of the documents that confirm your obligation to repay the loans. The original Creditor name and address can be found in this enclosed document. '' 1 ) I have never seen a lot of these documents ever in my life, so seeing my signature there is quite amazing. The " Consolidation Loan Verification Certificate '' -- never before seen. The extraordinary magic letter from XXXX XXXX , XXXX -- never before seen. The original creditor IN the Performant letter named XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX -- who in the world is this? LOL -- never before seen. There's even a botched rendition of my signature on this letter. Okay, really? Try harder. The document titled, " Financial Disclosure for Reasonable and Affordable Rehabilitation Payments '' -- never before seen. Yet, it claims it was emailed XX/XX/XXXX. Please tell me how someone is responsible for something they've never seen or signed. Yet, this is all still being pushed as proof. The only one I have seen was the document dated in my hand on XX/XX/XXXX -- that I know for a fact was not sent to AES, XXXX XXXX, or XXXX. 2 ) Therefore, I continue to stand by the fact that I never signed an agreement with AES, XXXX XXXX, or XXXX. You MUST provide original provide an original contractual agreement in its original form, bearing my actual, wet signature and of which THOSE DOCUMENTS MUST EXPLICITLY STATE AN AGREEMENT WITH THE COMPANIES THAT ARE REPORTING ON MY CREDIT REPORTS. You have still not done this, so no, this process is not over. Moreover, you are still under violation of the FCRA & FDCPA because you are reporting an invalidated, unverified account and have not supplied an original instrument of indebtedness bearing my signature that CLEARLY states obligation to pay the companies that are reporting in my credit files -- AES, XXXX XXXX, and XXXX. You must provide this, but if you do not, you must DELETE the unverified, invalidated accounts ; the one shown as closed AND the one showing open. I am not to receive bills, lists of disbursement dates, or copies of random documents that I, the consumer, hasn't even received. 3 ) Under the FCRA & FDCPA, validate & verify with proof that all of the addresses and email addresses are indeed mine. Obtaining notice of the said loans and being responsible for the receipt of them is crucial. It is negligent to say that debts this large are mine simply because information is on a page ; you must prove that it actually is mine AND THAT I RECEIVED THIS INFO, WHICH I KNOW I DID NOT.

Complaint: I am a medical resident that has been trying to pay back my loans with FedLoan. I submitted to be on pay as you earn four times during my second year in residency, and I was denied because they said I made too much money. When I spoke to them, I finally got through to a supervisor who said this was their fault and I can be back on PAYE. However, before this happened, they capitalized XXXX dollars on XX/XX/18. I called immediately about this, and they said that this should not have been capitalized and that it is their fault and they will submit a request to have it changed. It has now been almost three months, and I have been placed on income contingent, then forebearance, then income contingent, and now finally back to pay as you earn. They also sent a letter saying I now have XXXX more dollars that will be capitalized due to all of the switching. I called and they submitted another request to have this changed. SO now I have XXXX dollars of capitalized interest that should never have happened, and they refuse to let me speak to the people in charge that deal with these complaints. I can barely afford to live on my resident salary, and I am never going to be able to pay back these loans if they keep messing it up. PLease help!.

Complaint: I have contacted all the credit bureaus and XXXX XXXX to update the months of XXXX, XXXX, XXXX and XX/XX/2015 to ok/current on my 23 closed student loan accounts. I have documentation showing there were 0 days delinquent on all 23 closed accounts but they are all reporting 4 months late making there be 92 delinquent marks on my credit reports. This is causing my credit scores to be significantly lower than they should be causing a barrier for me financially while I am trying to purchase a home for my XXXX XXXX son and I. I have consolidated all the accounts at the XX/XX/2015 and have maintained them as current and kept communication with the company. Please grant my request and adjust the late payment status to ok/current for the months XXXX, XXXX, XXXX and XX/XX/2015 on all the credit bureaus. Thank you

Complaint: I am four years out of XXXX school, with about {$190000.00} in student loan debt. XXXX XXXX cheated me out of my entire direct loan rebate in the following manner : Using XXXX XXXX XXXX online payment app on XX/XX/2018, I was for the first time presented with the option to " Target Specific Loans '' -- without any warning, fine-print or otherwise, of any potential pitfall of doing so. Grateful for the chance to target my highest-interest loan ( XXXX by default targets the lowest-interest loan ), I allocated my entire minimum payment ( {$240.00} ) towards that loan. In XXXX, I received the first of several letters and e-mails from XXXX XXXX, stating that I was delinquent, had missed payments, and therefore that my direct loan rebate was irrevocably lost. On XX/XX/XXXX, I made an extra payment of {$320.00} in an effort to make up any alleged delinquency, so that XXXX might restore my direct loan rebate. I called XXXX on XX/XX/XXXX, requesting that my XX/XX/XXXX payment be reallocated to remedy any delinquency, and that my direct loan rebate be restored. The XXXX representative advised me that he had succeeded in reallocating my XX/XX/XXXX payment, and that he would speak to his superiors about getting my direct loan rebate restored. On XX/XX/XXXX, I called XXXX again to complain that my direct loan rebate had not been restored. The representative told me that it could never be restored. I can not be the only student borrower who has fallen into this trap of attempting to target a minimum repayment to the highest-interest loan without any advisory from XXXX XXXX of the perils of doing so, and then irrevocably losing his direct loan rebate, even though he did not, in fact, miss a payment, pay late, or pay less than the minimum.

Complaint: AES is not abiding by the laws that are in place when it comes to Wiretapping laws in Pennsylvania. On XX/XX/2018, AES was contacted by me. They advised that they were recording the phone call, to which I said I was also recording the phone conversation. They said they did not authorize the recording, to which I said that I only authorize recording if AES authorizes me to record the same phone call. The representative said she had to transfer me to a non-recorded line, and then proceeded to ask for my personal information, to which I asked if they were still recording the call. The representative then proceeded to transfer me without getting my information. I got a new representative on the phone moments later. I informed that representative that I was recording the phone conversation, to which she also said she didn't authorize recording from my end. I asked her why they don't allow authorization if they are ok with authorizing the conversation from their end. I then proceeded to tell her that the previous representative stated that I would be transferred to a non-recorded line, to which the current representative said was false. I then asked for a supervisor to which I was not given as the representative stated no such authority figure was available at the present moment. I then just let her know that I would call back and see if a different representative would corroborate everything she said, to which she was dismissive. Eventually I dialed back and got a different representative who couldn't answer any questions or concerns I had about the lack of integrity for this type of situation. AES needs to understand that if they continue to record any conversations without my direct permission, I have the legal right to request those phone calls or have an investigation initiated to properly dispose of any conversations that were " illegally '' recorded. I have reason to believe that AES still keeps phone conversations that were illegally recorded ( recorded without my direct authorization ).

Complaint: This complaint is about the servicer XXXX, or actually the Department of Education for granting this outfit a contract. XXXX, in their otherwise very user friendly website, has no option to make any payments towards the principal. There are all kinds of repayment options except being able to pay additionally towards the principal. Now, why would this be? Perhaps the other repayment options available offer a clue. Indeed, they all maximize loan interest revenue. So, clearly this is a ploy to make it difficult for the consumer to get from under these loans. Is that the intention or in the spirit of the Education Department 's mission to get young people to obtain an education and build a life for themselves? Do the contract managers of the Dept of Education that review prospective loan servicers, take that into account, in addition to 20 plus pages of other federal requirements? Complaint: I've got a student loan for my son in XXXX and I've being paying for it sins then. The loan was sold a couple times. My current Servicer is AES sins XXXX. I've asked them in the past to send me amortization letter to better understand what exactly I'm paying for. I thought Truth in Lending Act requires lenders to provide you with loan cost information, by they told me they don't do this. So they kept me in the dark. So convenient! My son has passed, but I still make accurate payments. Over sudden I've got email from them stating I have to pay almost double amount monthly. So I called. The Lady told me THEY JUST FOUND OUT I was paying interest only for all this time and now it's time to start repaying the principal. She said it was not only me, there are thousands like me in the same situation. What a surprise! For all this years I didn't know I'm making just an interest payment. To know that thousands of us are in the same situation doesn't help. They also lowered my interest rate down to 4 % a few years ago, but on statements it's still shows 4.25 %. The same Lady told me don't worry, we charge 4 %. How do I know? I don't trust them. I fill now like they rip me off.

Complaint: I have submitted certification of my employment history to XXXX XXXX XXXX/Pennsylvania Higher Education Assistance Agency/PHEAA for the purpose of tracking payments to count for XXXX XXXX XXXX XXXX ( PSLF ). The updated certification that I was given was not an accurate count to my total service completed thus far ( count was too low compared the to qualifying payments that have been made ). Also, the count of the last three loans of the account was completely omitted ( not given credit for qualifying payments ). I have called several times and submitted emails requesting an explanation for these incorrect numbers. XXXX XXXX XXXX/PHEAA is unable to provide an explanation at how these numbers were created. They have also not fixed their mistake. Of note, this is the second time in 2018 I am experiencing this problem and need third party assistance for correction.

Complaint: In early XX/XX/XXXX I received a letter from XXXX XXXX XXXX XXXX who currently had my student loan that they were closing and that someone in the near future would be contacting me about my XXXX 's student loans. I had been trying to make a payment online like I usually did for months previously but the XXXX XXXX website would not go to payment page. I called and kept getting an automated response. So it made sense to me that the company closed or went under, it was not completed stated in the letter. About 3-4 months ago, now in mid XX/XX/XXXX, I began getting calls from a debt collector service, stating my student loan was in severe default and I was in collections. I checked my credit report and it stated I didn't make any payments and was severely late. I explained the events to the creditor and asked for official documents of the new lender. I even made a {$500.00} payment over the phone but no official documents were sent to me as requested. So I called and asked again after 2 weeks of no documents mailed, they said again they would mail it to me, another 2 weeks went by and they began calling me for more payments. I explained again I did not receive any documentation from a new lender. I reported the payment on my credit card as fraudulent as l had no documentation of a new lender or what was going on with loan. My credit card investigated, refunded me the {$500.00} and they didnt even send my credit card company the appropriate paperwork to dispute it. I was starting to think this was some type of scam. I was finally given an contact number for the supposed lender, financial group XXXX in NY. I called them a month ago 3x requesting official documentation or promissary note of my loan proving they owned it. Not a single paper of evidence or official document has been sent to my home. I have asked for it to be emailed and they refuse. This debt is showing very poorly on my credit and I can't even make a payment to anyone who has proof they own my loan now. I have no clue what to do at this point. Please help

Complaint: Repayment status since XX/XX/XXXX, IBR payment {$0.00} + PSLF enrollment. I was put into an un-requested administrative forbearance in XX/XX/XXXX due to Chapter XXXX notification : qualifying PSLF payments are not being counted for this time frame and another time frame in from XX/XX/XXXX to XX/XX/XXXX due to employment change. XXXX got the certification from BOTH employers, there was no break in employment. The Mass. Attorney General Sued XXXX XX/XX/XXXX for : For borrowers on track for PSLF, the lawsuit alleges that XXXX XXXX engaged in a variety of activities ( such as paperwork delays and erroneous determinations ) that forced people into forbearance instead of qualifying PSLF payments, or it failed to properly count qualifying PSLF payments. These actions caused thousands of PSLF-eligible borrowers to be in repayment far longer than they otherwise would need to be under the program.

Complaint: I am under the Income Based Repayment program and being serviced by XXXX XXXX. In XXXX, they began reporting interest to the Credit Bureaus even though the interest has not capitalized on my account, because I am in the IBR program. They informed me that on their end, the interest is not showing that it was added to my balance because of the IBR but they are aware that they are reporting it to the Credit Bureaus. Reporting to the Credit Bureaus like this is destroying the consumer 's credit. Being under the IBR is supped to help the consumer financially, not to destroy the consumer 's credit. It seems as though the servicing companies found a loop whole in the Fair Credit Reporting Act, to bury those who are under any type of payment or forgiveness program. Because of the way they are reporting to the Bureaus, the amount of my student loan is increasing over {$500.00} every month on my credit report. They need to be stopped before they begin to destroy every student 's credit and financial status that is in any type of repayment or forgiveness program. By them reporting the interest to the credit bureaus, forces the credit bureaus to lower the consumer 's credit score each month because of the increase that they are seeing. Because of this lowering the consumer 's credit score, it disables the former student from obtaining a good paying job, since employers are now running credit checks for certain positions. If the government allows them to continue to do this, it will put the country in a crisis. Less home purchasing, more jobless claims, more unpaid debt and student loans will become a bubble like the housing market in 2008.

Complaint: I have been trying to have XXXX XXXX provide a correct calculation of my eligible payments towards the Student Loan Repayment Program for the XX/XX/XXXX-XX/XX/XXXX period for about a year. They have incorrectly recalculated my eligible payments three times to date, to my knowledge. In the beginning of the year, after various incorrect recalculations, I requested a detailed statement showing which payments are qualifying payments and why. On XX/XX/XXXX I received a voicemail apologizing for the time it has already taken to process the request and to verify it is being processed. I called shortly after to confirm the request is still being process. I was told I would receive the document in my inbox within 30 days. It is now 4 months since that call and I have still not received the requested information. I have called numerous times and have been told they are still working on the request over at least 7 months from the initial submission and over a year and a half from submitting my initial verification.
