Complaint: I have student loans with ACS and have been with ACS for over 10 years. I had been on an IBR plan and it came time to update information at the beginning of the year and I sent in all required information. I was waiting to hear what my payments were going to be and when they would start up as previously the payments were XXXX . I then got a bill stating I was late. I called and began making payments on the account trying to catch up. I recently have been talking to a mortgage broker as I am trying to obtain a mortgage. He pulled my credit report and informed me ACS had reported me late in XXXX 2017 . I called them several times to ask them to remove and update the late payment report as it is not accurate. They refused to remove it. I also asked them if I could write a goodwill letter to explain what happened and they said no. I am disappointed at their unwillingness to work with me and my account under the circumstances. It is essential I get the late report for XXXX 2017 removed to move forward with the mortgage.

Complaint: I lost my long-term job on XX/XX/XXXX . I graduated from XXXX XXXX in XX/XX/XXXX . I had never missed a payment since I started with ACS on XX/XX/XXXX . I cont inued to try to stay off of forbearance and managed to pay my student loan until XX/XX/XXXX . My normal monthly payment is {$380.00}. I contract while I am interviewing for a full time job which I have not found yet. When I realized I could not meet the payment requirement in XX/XX/XXXX , I tried to request forbearance for 1 month only - but the paperwork took too long to arrive and they tried to withhold but were unable to. I still made my XX/XX/XXXX payment as soon as I could on XX/XX/XXXX and made my XX/XX/XXXX payment timely on XX/XX/XXXX . As of now I am current. I received an e-mail on XX/XX/XXXX informing me that on XX/XX/XXXX , they were now going to start withholding {$440.00}. I called requesting an explanation and they told me that there was only a 15-day grace period and they were raising my interest rate and payment amount for each month by {$54.00}. I had to apply for a reduction in loan amount for two years as I 'm worried about making the payments now with the increase. I 'm upset because I only made one late payment and am penalized permanently going forward.

Complaint: ACS Education services Consolidated student loans from college from XX/XX/XXXX - XX/XX/XXXX ( University XXXX XXXX ) an d law school from XX/XX/XXXX - XX/XX/XXXX ( XXXX XXXX XXXX ). After I filed Chapter XXXX bankruptcy in XXXX and received a discharge in XXXX XXXX , I set up payment arraignments with ACS-Education, the servicer for these student loans. The XXXX l oans totaled roughly {$35000.00} and I have made each payment on time since XXXX XXXX . The issue lies in my legally required periodic billing statements which I should receive each month ( Regulation Z - Truth in Lending A ct & Student Loan Act ( CFR 682 ) ). I have elected for Automatic Clearing House ( ACH ) paym ents from my checking account to receive a .25 % interest rate reduction. I can only receive this reduction by also electing to receive all information via email, which is great. However, ACS-Education only submits ACH Remittance notices via email and not Billing statements. In addition, Billing statements are not available online at their website either. The representatives also confirm that I am unable to do ACH payments to get the interest rate reduction AND recieve my legally required statements which should have my balance, interest acrued, interest rate, interest paid, principle paid, remaining balance, payment options, etc. Increasingly troubling is that I am unable to get my statements printed for the past 3 years and the representatives from ACS Education claim all of the same information is on the website but they are incorrect because various disclosures are missing, various information is incomplete on their website. The inten t of Congress an d the legislature to requir e Creditors ( including student loan servic ors ) to provide periodic billing statements is to ensure fairness, transparency and Notice ( knowledge ) i s given to the consumer whom owes the debt. Furthermore, t he US Gover nment allows consumers to file private right of actions against Creditors who violate these fundamental Lending practices and issue statutory penalties of {$1000.00} per occurance under Fair Debt Collections Practices Act ( Ro senthal Act-California state law similar in nature to FDCPA ). However, since these loans are backed by the Federal Government, these servicors are given immunity and protected by a law that shields consumers from filing lawsuits via private right of action. For example, these violations by ACS should warrant {$1000.00} fine for each month they failed to provide me my state ment ( times 2 for both loans ), which would equal {$72000.00} over the past 36 months they failed to meet their requirement. Even more puzzling is tha t ACS essention ally coerces debtors into ACH payments so they can receive a APR reduction. This practice then prevents statements from being created and sent to debtors, thereby saving Billions of dollars in printing and mailing costs which more than makes up for the messly .25 % APR rate reduction consumers receive. This appears to be much more of a organized crime such as racketeering then simple loan servicing. I am appalled at this and I do not simply want to get my statements hereon out, but I want to be compensated for damages incurred just as if the Loan servicer was a creditor not shielded by the fact that these are Federal student loans ( Student Loan Act ). Lastly, ACS h as further harmed me by failing to provide me with all of my legally available payment options. Since I owe over {$30000.00} wit h ACS and co mbined with all my student loans over {$60000.00}, President Obama wrote into law the student releif act that provides extended loan payment terms from 10 to 20-25 years, but ACS continuously for 3 years indicated that was n't an option. Recentl y I forced their hand by issuing the law and asking to pull the promissory note which gave 25 years regardless while all the w hile ACS clai med I only had 10 years to pay the loan. These acts are abusive to say the least and displa y ACS 's willful disregard to laws, consumers, fairness, transparency and equitable relief. I am disgusted and ashamed to say this only ha ppens in America.

Complaint: Dear Sir or Madam, Please let this correspondence serve as a formal complaint letter re garding ACS practices and the predicament I find myself in due to same.
ACS has engaged in documentable unfair and unethical practices in regards to the handling of student loans and accrued interest and fees. I have fallen victim to these practices, and I hereby wish to formally file this grievance with CFPB. I have been enrolled in the Income-Based Repayment Program ( IBR ) on my original XXXX student loans sinc e XX/XX/XXXX , wh en I applied for XXXX school an d its subsequent new set of loans. Since enrolling in IBR, Ive met all requirements for continuous participation in this program. This year, ACS changed their verification date to XX/XX/XXXX , but failed to inform me of having done so. My regular recertification cycle had previously been XX/XX/XXXX - XX/XX/XXXX and I had no reasonable way of knowing about this change. ACS claimed I had defaulted on my recertification and put me in standard repayment status. I spoke with a XXXX XXXX ( agent # XXXX ) on XX/XX/XXXX . After repeated inquiry with two agents, they finally stated that the due date was XX/XX/XXXX . I was informed that ACS can offer no administrative forbearances and that this is just a tool they use as a resource if Im out of forbearances. I was also informed that regardless of forbearance status, interest will be capitalized. The total additional interest for being 45 days late in recertification will be {$630.00}. XXXX did offer to knock me do wn to the IB plan and said this would bring me current immediately. I would then have to apply for a new IBR plan. However, after being on hold for a while, he came back on and said it would take 5 to 7 business days. Wh en I confronted him with his earlier statement about being brought current immediately, he denied what he had said, and was rude to me. A temporary forbearance, which Id applied for in XX/XX/XXXX , came through on XX/XX/XXXX . The agent I spoke with previously, on or about XX/XX/XXXX ( XXXX - # XXXX ), h ad none of this information and said that I was not eligible for an administrative forbearance. I get different answers, misinformation, and advice that leads me to act against my own best interest every time I speak with ACS. On XX/XX/XXXX , I requested my payment history from the origination of the loan consolidation to present date, including an explanation of every interest capitalization event. As of today Ive not received any such itemization. These complaints come in addition to the much more serious issues Ive had with ACS in the past, when they had failed to inform me about the very existence of the IBR program, an omission which has caused me to accrue outlandish sums in capitalized interest due to utilizing forbearances and deferments rather than a reasonable payment schedule which would have been readily available to me had I been informed of it. At no point did ACS inform me of the total interest and fees which would accr ue by utilizing deferments and forbearances, including unemployment forbearances. This grievance has been detailed in correspondence with my lawyer dating from XX/XX/XXXX ( attached. ) Ive been dealing with these issues with ACS throughout their name changes ; from XXXX XXXX XXXX to ACS, and now XXXX ( which, along with their new address, they didnt disclose to me ), since my XXXX loan consolidation i n XX/XX/XXXX . In XX/XX/XXXX , I c onsolidated again to combine my outstandi ng FFEL l oans to create a new consolidation loan. I adde d XXXX new loans totaling over {$12000.00}. When you factor in a ccrued interest, totals {$55000.00}. My loans had such high interest rates, the {$55000.00} loan is probably somewhere in between 7-8 %. XXXX XXXX XXXX solicited me to do this consolidation, and probably received a kick back from the lende r ( XXXX XXXX XXXX ) f or doing so. The compounded interest now seems to have pushed that balance to {$91000.00}, and climbing. I have been in contact with your representative from the Office for Students, XXXX XXXX , who has insights into what may have happened in the consolidations of my loans, some of which would be highly unethical. The matter of my XXXX student loans as handled by ACS needs a thorough investigation. There are discrepancies and overcharges that are unexplained. I have recently contacted MA Attorney General XXXX XXXX office to request assistance in sorting out these matters, and received a positive response ; they are willing to advocate on my behalf. Complaint: We were going to pay off our student loan, but discovered the allocation of interest vs. principle was way off, very inconsistent. It seems we have already paid more interest in 7 years than we should have in the life of the 12.1 year loan. Some months they put XXXX to principle and our entire payment to interest. Even the statement shows we paid over 7K in principle, yet our balance has only gone down by 2K?

Complaint: I have been on an IBR with for my XXXX loans with ACS ( loan number XXXX ) for the last year, and the year prior. My payments were made on time and for most part fo r two to three ti mes the minimum amount. I believed my re-certification was coming up soon and I was on the lookout for emails and/or mail notifying me of the date to certify. I received nothing from ACS regarding this matter either my email or by mail. In fact I have received NO mail from ACS since sometime in XXXX XXXX ; the exact month I do not recall. I received a letter from XXXX , the guarantor of my ACS loans, dated XXXX / XXXX / XXXX stating my loans were 60 days past due. I believed my loans were current and this was just another scam trying to con me into signing up for student loan relief. I get these all the time. The only reason I hung onto to it was to file a complaint with the CFPB. All this time I have been making monthly payments. Each time I make a payment I receive an email from ACS acknowledging my payment. There was NO mention of the payment being insufficient or that my account was overdue. I was on the site in late XXXX to get my XXXX and saw nothing unusual with my account. By chance last Sunday, XXXX XXXX , I logged on to find my account was seriously delinquent. This was news to me. At the top it said " address is bad ''. Really? So how did I receive a letter from the guarantor? This morning XXXX XXXX I called ACS and requested a supervisor. She said ACS had mail returned by the post office saying my address was bad. News to me. I have had no complaints from anyone else. When I read her back the address she admitted it was the same address they had been using for the last eleven years, actually it is more like 20 years. I confronted her with the fact that XXXX mailed a letter. I said I did not give out my address to XXXX . She admitted they provided XXXX with my address. I demanded to know why they did n't email me like XXXX does. They email an acknowledgement every month I make a payment. She said " they do n't email ''. What century are these people in? She read me a forebearance which I agreed to put my XXXX accounts in forebearance till I can fill out an IBR form. The amount due is well over {$600.00}. A large unexpected sum. She said they attempted to call my three times on my land line. That number was given to ACS 20 years ago. I refuse to give ANY lender my cell phone as it has been proven over time these companies are unscrupulous and reckless with personal information. It has never been a problem with my paid off PEP loan, my paid off XXXX loan, my paid off credit card taken out at school, or my current credit card with near zero balance ; a card I have not been late on a payment in ov er 17yrs.
By tonight only the smaller loan was listed in forebearance. The larger loan is still listed as delinquent leading me to believe all of this is just a scam to generate late fees.
She said ACS does not report late payments to credit agenc ies till a loan is over 60 days due. The smaller loan is 54 days. The larger loan is 84 days due. That means they have reported to the credit agency. She refused to contact the agency to retract the late payment information saying they attempted to call me. I NEVER use my land line. I keep it solely as a c atch all for scams and marketing phone calls which are relentless. When I checked tonight there were 63 messages ; two of which were messages from my sister. The balance were marketing or scam calls and three ACS calls. I ch eck my messages once every couple of months only to delete them.

Complaint: XXXX of this year, I did not realize that I no longer had the six-month forbearance after my graduation had been conferred in XXXX of XXXX . In XXXX XXXX , I started receiving calls from a collection agency asking for either the full payment of {$780.00} to bring me up to date or {$390.00}. When I inquired as to why I was receiving these calls at this time, it was then that I was informed that I no longer had the six-month grace period but the notice that was sent to me in XXXX was the actual bill for XXXX payment of {$390.00}, not a warning statement for XXXX XXXX . I was a lso told that since ACS is private student loan lender it is up to their discretion as to when they would schedule their loan repayments.
To try to get back in front of this loan, I requested a reduced loan payment plan. This took approximately one month, during which debt collectors were still calling me. I had three, 3-way calls to verify that I had applied to lower my payment with the ACS debt collectors, the ACS representative and I. It was not long after the last of these 3-way calls that I was demoted to XXXX XXXX XXXX . My employees organizational move, due to budget cuts, has put me in the unexpected place of no longer having a steady income. When I called ACS tw ice, after my demotion for further assistance I was told the first time that I would need to reverse my current forbearance and payment plan so that my account could be like it originally was and then apply for a hardship forbearance. The following week when I called back to check and see if that was the correct procedure ( because that did not soun d right to me ), this representative told me that ACS is a private student loan lender and they are not required to nor will they assist me any further because I have used all of my deferments and forbearances. Hear this news, I felt hopeless and happened to stumble across the Better Business Bureau ( BBB ) website. I participated in the live online chat and the BBB representative told me that I could file a complain t with their agency either by paper or internet, I was also told that I could also contact the Consumer Financial Protection Bureau ( which I will do also ). The following day, Tuesday, XXXX XXXX , XXXX , I filed an online complaint with the XXXX , PA BBB, which at the time h ad 48 complaints against ACS. In my complaint, I stated that I did want to hear from the ACS directly to hopefully address and resolve this issue. On Monday, XXXX XXXX , XXXX , I received a call from th e ACS office. The ACS representative once again informed me that there is nothing that they can do to help me because they are a private lending company and they do not have to do anything additionally to assist me. I have already taken advantage of all of the deferment and forbearance offered by the lender. She also stated that I was granted forbearance and a lower payment scheduled ( hence the {$190.00} for six months, {$290.00} for six mo nths, {$310.00} for one-year, {$430.00} for 163 months, and {$430.00} for the final payment for a total of {$77000.00} for an original loan amou nt of {$39000.00} ). But they have no additional options to assist me during my current period of unempl oyment.

Complaint: I have an account with ACS Education Service. I called and asked for the paperwork to do an income based repayment plan. I stated that I want to start paying the loan but I could n't afford the XXXX dollars monthly payment. I also asked about the deferment since by the definition on their website, I fall under this category. The individual was rude and told me that I 'm not on XXXX XXXX . I asked her to explain since this was and has. been my status for the past 10 years. She stated that I did n't qualify but of course she could put the loan in forbearance ( of course, because it accrues more interest and they always give this option instead of trying to work with me to actually get the payments to an affordable amount ). She stated she could send me the paperwork, fill it out and send it back to them. I did this, then I was told o, your application was n't accepted because that 's the wrong application. But this is the application that you sent me. I was very specific in I wanted to apply for an income based repayment plan. Then I was told to redo the paperwork. I did this. This time I was told that my tax return was illegible. How is the application legible ( which was handwritten ) but the tax return, printed directly from the tax servicing company illegible. Then AGAIN, it was reported to my credit report that I 'm past due. I keep going in circles with this company and I will reconsolidate with another company. It is ridiculous that this is the second complaint I 've had to make about this company. When I call into customer service, the agents are so rude and they either want you to pay or put it in a forbearance. They are absolutely no help. My last complaint, the agents kept telling me to call the Dept of Education, k nowing fully that they have nothing to do with a pre-existing loan. I 've faxed my application to this company several times and as much as I follow the directions given on the paperwork and by the agent, I still get a letter saying my paperwork is denied. The only time I 've gotten anyone that actually wanted to help and took the time was individuals who called after I made the complaint. EVERY call to customer service has been rushed, rude, given misinformation/false information and made no progress in resolution to pay my student loan.

Can't get other flexible options for repaying your loan
Complaint: I currently have both federal and private student loans that are serviced by ACS. I became XXXX in XXXX XXXX and have been on Social Security XXXX since then. As a result, my income has been drastically reduced. For my federal loans, I was eligible for an Income-Based Repayment plan and currently pay approximately $ 15/month. F or my private loans, I was told that I could have up to two 6-month deferments, but no other options are available from my lender. I am currently in the second 6-month deferment, which will end XXXX XXXX , XXXX . Starting in XXXX , I will owe approximately $ XXXX /month on these private loans. I can not afford to pay that much per month. I just spoke with a representative from ACS as well as a supervisor. They confirmed that I can either pay the full amount or go into default. If I go into default, I ruin my excellent credit rating and the lender does n't receive any payments. I also requested a way to contact the lender directly and was told that I could not. I have no idea what to do next and just want to work out a repayment plan with the lender that I can afford. I would think that they would rather get a reduced amount than nothing at all.

Complaint: I called the XXXX XXXX 2017 to ask a question about how much I actually still owe because the website is unclear. It to ok 25 min utes before anyone answered. I was told I owe XXXX plus an additional XXXX , so I paid all of that online with my bank account. I called again today XXXX XXXX 2017 because I notice all that money was gone from my bank but the their website says I still owe XXXX . It took me 27 minutes before anyone answered. The customer service is short and rude and actually hung up on me when I started the wait time was too long. Called again 29 minutes got someone. I found out I overpaid my loan by about 120 dollars because the first representative was incorrect about how much I actually owed. Now, I have to wait 60 days to get a refund. It is also worth noting that my credit score dropped dramatically because they claimed they were emailing me warnings about starting my payments but when I c hecked my email on the dates given that I got these warnings I have no emails and also got nothing in the mail.

Problem with customer service
Complaint: This is very simple. My payments were set to draw every XXXX of the month -- been paying it on time every month for about 7 years. My wife and I decided that we were finally in a position to get aggressive paying off our loans. The one problem we had was that payments were drawn on the XXXX , XXXX , and XXXX of each month. I realized we had a chance to pay off in full everything on the XXXX and then if we could move the XXXX payment to the XXXX or XXXX -- all ACS loans -- we would know how much surplus we had each month and would make additional payments simpler for us to make. So I first called all XXXX of our credit card providers to synchronize those payments to the XXXX week of the month. No problem, this was easily completed in less than XXXX hour. Then I called ACS in early XXXX XXXX They said on the phone the XXXX or XXXX were simply NOT options. The best they could do was the XXXX . But I had to send them a email, they simply could NOT start the change based on my phone call to them. Ok, I complied. Their bounce back email said a response said : " We will respond to your message in XXXX - XXXX business days ''. This statement is false. Probably a delay tactic by ACS. I waited for over a week before they replied on the XXXX of XXXX that they had to wait until the XXXX payment processed and then they would " ask '' the lender if it was possible. I do n't understand how I can make every payment on time, even at times when my wife and I were actually losing money month over month and then make a very simple request and yet get treated so terribly. If they ca n't do it, fine -- tell me that when I call in!! ACS is a deplorable institution engaged in fraud and deceit and they should be held accountable, as I would be if I failed to make those monthly payments.

There ar e 3 accounts that are currently being reported past the seven year period of the original date o f delinquency. Complaint: On XXXX XXXX , XXXX received a check from my mother for a total of {$22000.00} which we were to understand was the payoff for my student loan. They cashed the check and issued a refund for that amount which I was told was forwarde d to ACS Education, which is the bank that is servicing my loan. After speaking with them several times, they reported that they sent the payme nt to ACS on XXXX XXXX , 2017 . S ince, ACS has no t posted the payment. They said it could take up to 60 business days for the amount to post. It still has not posted. I have been in contact with them multiple times both before the 60 business days were up and after. After the 60 business days, I asked a customer service representative if they could contact XXXX to locate the money, however, they told me the best thing to do would be to email a copy of the canceled check to them at XXXX XXXX XXXX . I did thi s and despite a form email back stating it would take 2-3 business days for a response, it took 5 business days to get the acknowledgement that they received the copy of the check and state it will still be another 7-10 business days to research. In the meantime, my loan continues to accrue interest.

Complaint: I just completed a 5 year bankruptcy plan. I successfully repaid my plan as of XXXX XXXX . I am divorced and a single mom with full legal and physical custody of XXXX children. I want to pay my loans back however the monthly allocation of XXXX is high. I would like to negotiate taking off the interest that accrued during my bankruptcy to make the payments easier. I am currently throug h ACS and their communication is only to manage through deferment or forebearance which I am not interested in.
