Complaint: I submitted my annual re-certification information for my income-based repayment plan several weeks ago. Two days after the plan was due, I received a letter in the mail letting me know it was rejected because I did n't submit my tax return ( which I did ) and I did n't submit the " eCertification '' form. The instructions never included a requirement for an eCertification form. I logged into my tax preparer website and could only locate a screenshot verifying that my tax return was submitted successfully. I called customer service and they are n't familiar with this form either. Since they will only correspond by mail, I am worried that I will submit this screenshot only to be rejected. Second, enclosed in the letter I received, are instructions for my spouse to login to the studentloan.gov page to authorize my IBR submission. No where in the original instructions was this requirement disclosed to me. I have done this for other servicers, but it is included in the instruction. I would have done this weeks ago had I known. However, I am not sure this is even a requirement because the instructions are vague and there is no mention of this in the letter. I asked customer service and they said for my husband to do this asap. He did, but the code they sent did n't work! So I am in limbo.

This account with ACS Education Services was transferred, closed with a {$0.00} balance. This is how it 's reporting on my credit report. I 'm currently paying off this original student loan with XXXX and have never been late with payments. I contacted ACS Education Services in XXXX and XXXX and requested the negative remarks ( late payment ) to be removed from my credit report. I was told via secured email that the account will report accuratly and the negative remarks will be removed from credit report. However, this never happened. I filed a dispute with a credit agency, XXXX in XXXX of XXXX and provided a letter stating that I completed rehabilitation program for the student loan, currently making automatic payments to XXXX and never missed one payment in 2 years. I also provided email communication between ACS and myself stating that they will remove negative remarks from credit report. ACS replied to credit bureau, XXXX stating that the account is reporting correctly since I was late when I had the active account with them, even if my account with them is currently closed, transfered with a {$0.00} balance.

Complaint: I was in school full time from XXXX XXXX until I graduated from XXXX XXXX in XXXX of XXXX. During this time my loans were in deferment. Upon graduation I was informed that I have 6 months to not have to make payments. I filed for IBR payments in XXXX XXXX and have made all required payments on time, without fail, since then. Upon looking at my credit report this year, somehow my account with ACS is delinquent from XXXX XXXX XXXX, but then goes current again starting in XXXX XXXX and has been since. Somehow, in less than a month after graduation, I am 60 days late on a student loan within my 6 month grace period.
I 've contacted ACS several times about this. I 've let them know that I have several other student loans and NONE of them have reported any late payments, ever. They have been completely unhelpful with this situation and are completely unwilling to help me out with this error on their behalf.

Complaint: ACS/XXXX XXXX XXXX XXXX This is a education loan which was consolidated. It states on my credit reports it was paid but past due 90 days. I was never past due on this loan. I have four loans with ACS all of which were consolidated at the same time and this is the only one reporting inaccurate information. I started an investigation with ACS and they have not remedied the problem. This late reporting is inaccurate and I would like this corrected on my credit reporting and reported accurately with no late payments made.

Complaint: XXXX XXXX has a Private student loan that is serviced by XXXX XXXX XXXX, formerly ACS Education Services DBA XXXX XXXX XXXX. XXXX XXXX is the master servicer and the lender does n't have a mailing address or phone number or any employees according to XXXX XXXX.
XXXX XXXX took out 6 loans for the following amounts.
1. {$5000.00} 2. {$5000.00} 3. {$5000.00} 4. {$5000.00} 5. {$5000.00} 6. {$6000.00} ACS consolidated the loan into the following loans without XXXX XXXX 's permission A-1 {$5000.00} A-2 {$15000.00} A-3 {$11000.00} In this time period XXXX XXXX did NOT know the following ( proof attached ) 1. How his payments were allocated 2. The balance of the individual loans 3. The method used for the allocation 4. The rates of the individual loans 5. The rate changes for the individual loans In this time period XXXX XXXX was unable ( by ACS and XXXX XXXX admission ) to 1. Make individual loan payments 2. Make partial payments to avoid deferment to one loan instead of all in the group ( for example he was billed {$120.00} for A-2 but really he should have had the opportunity to pay {$50.00} for loan 2 to keep it current ) 3. Specify how to apply loan payments via the mail lockbox As a result of the above 1. XXXX XXXX 's credit report was incorrect 2. XXXX XXXX 's credit balance were incorrect 3. XXXX XXXX 's credit history did not show correct length or balance of payments To hide this information ACS and XXXX XXXX 1. Withheld loan balances and rates upon request 2. Withheld payoff amounts upon request 3. Sent redacted promissory note with page numbers blacken out and told this was the complete document.
4. Sent 3/6 promissory notes and told that was all of them in order to trick XXXX XXXX into thinking he only had 6 loans.
5. Failed to properly inform XXXX XXXX partial payments would suffice to keep one or more loan in good standing 6. Failed to tell XXXX XXXX the nature of his loans upon multiple calls.
7. Failed to tell XXXX XXXX his interest rates 8. Failed to provide a correct and usable payment history for each loan 9. Failed to respond to any request in a timely manner 10. Failed to explain how his loan payments were applied or calculated.
The results led to 1. Minimum payments decreased from {$50.00} ( contract ) to as low as {$30.00} in some cases thus costing XXXX XXXX thousands in interest and denying his opportunity to payoff the loan in advance 2. Rates were averaged or mixed and payments were allocated in a manner that was disclosed to XXXX XXXX. There was no way to know what was happening to his loan.
3. XXXX XXXX attempted to payoff individual loans with a tax return but was unable to complete the task due to the lack of disclosing of the individual balances or compliance with requests to know which loan had the highest rate 4. XXXX XXXX 's credit report showed higher balances thus hurting his credit Then ACS attempted to switch the rates and balances for multiple loans in an effort to confuse XXXX XXXX. ( attached ) With multiple calls to ACS and XXXX XXXX neither company offered to correct the issue.
With XXXX XXXX as a witness XXXX XXXX called numerous times to speak to a representative at ACS and was denied the opportunity to speak to a person about his loan for over 90 days. They would refuse to answer questions and continually hang up or transfer to an unmanned voicemail system even after requests to stay on the line until a person answered.
XXXX XXXX issued an administrative deferment after this episode.
1. XXXX XXXX owed {$0.00} before the forebearance 2. The issues were not correct or even addressed 3. ACS refused to answer calls for 90 days with XXXX XXXX as witness 4. ACS is now reporting XXXX XXXX 60 days late and caused his credit to drop over XXXX points I believe ACS and XXXX XXXX are in violated of the following the Unfair and deceptive practices related to payment allocation, in violation of Sections 1031 and 1036 of the Consumer Financial Protection Act of 2010 ( CFPA ), 12 U.S.C. 5531, 5536 ; ACS mislead and refused to provide information necessary for each transaction. Complaint: On XX/XX/XXXX I received an email from " XXXX XXXX XXXX XXXX XXXX via XXXX '' informing me that XXXX was changing loan servicer from ACS to XXXX. This email was sent to " XXXX '' which seems to be a listserv they created for everyone who has a Perkins loan within the XXXX system. Someone else was able to respond to that email with questions, which blasted out to everyone. This violates privacy and data sharing practices. Additionally, much of the communications around this Perkins loan has been sketchy and has made me think that there is fraud involved. I was n't aware I had a Perkins loan until I received an overdue notice from ACS ( to my parents address, not to me ) which was written in a way that was intentionally misleading. I owed {$200.00} at the time but it gave me the full amount based on what would happen if I did n't pay, and told me I was seriously delinquent, even though they had not communicated anything to me earlier. This hit my credit score until I paid.

Complaint: My husband and I have a Parent plus loan dating back about 10 yrs, originated with XXXX and now with ACS. Payments have always been made by mail. the past several years as our XXXX children graduated and money became more available to us, I made larger payments. I began to notice my statements were not coming monthly. I set up a on-line account and realized there were quite a few statements with 3 month lapses and sums of extra payments that were applied to interest and not the principal. I notified ACS by phone which requires a few auto dials and time. I instructed them that I would like to receive monthly statements even when I overpay in order that we could receive the benefit of paying ahead. I was informed that it could not be changed at this time but I would have to wait until another payment was made and I would have to call back when the next payment was being processed. Regarding the extra balance paid ahead, some of the money was applied toward the interest that accrued over the months that ACS did not send me any statements, making it look like they had been taking what I thought would be coming off my principal and instead using it to pay unpaid 2-3 months of interest. My husband and I have paid off many loans over the years, and never have I seen anything that resembled this. If I pay ahead on the principal, I always continue to get a monthly statement that updates me and allows me to budget. This, being a student loan at 7.25 % interest, which we have never been negligent on, should be much easier and user friendly. Our option is to attempt to contact ACS at the right time to change to monthly billing or take money from a retirement 401k and pay the XXXX XXXX balance off. Also, does not make up for the money lost when we thought our extra payment was being applied to our principal, and we did not realize that a statement had not come that month ; we had actually gone a month or at times 2 months without making a payment. At times it looks like our entire extra payment went to the principal ; I always write on the return slip to '' apply to principal. '' At other times it was going to interest which I have now found out was because no payment had been made for 2-3 mo., again related to no monthly statements.

Complaint: On Saturday, XX/XX/XXXX, I received a delinquency notice by mail from ACS, the lender 's servicing agent, dated XX/XX/XXXX. I was very surprised as I thought I had made a payment in XX/XX/XXXX and, moreover, the account should have been pre-paid for a period of at least a year, if not two. I had the same issue 10 or more years ago, the servicing agent acknowledged back then the account was pre-paid ( by approximately 4 months ) and I have been paying it further in advance ever since. I checked my bank records and saw no check or ACH payment in XX/XX/XXXX and immediately scheduled a {$600.00} payment. Because it was a Saturday, the earliest the payment could be scheduled by ACH was Monday, XX/XX/XXXX. After scheduling the payment, I used the " contact us '' feature on the ACS website asking for confirmation of the pre-paid status, confirmation that no late fee had been applied, and for the date through which the loan was pre-paid. On XX/XX/XXXX, I received an unsecure email from ACS advising that my account was " no longer eligible for the special benefits of the incentive program '' due to the alleged delinquency. I was unclear as to what " special incentives '' applied to my account, but upon checking the ACS website I noticed they had increased my interest rate from 3.125 % fixed to 4.125 %. On XX/XX/XXXX, I received a secure email, which I was finally able to access with great difficulty. The email very curtly stated my account was not pre-paid and that I HAD been assessed a late fee ( the email stated due to a missed payment due XX/XX/XXXX which apparently meant to say XX/XX/XXXX ). I contacted customer service and while the representative hedged considerably about how far in advance the account had been pre-paid, she did understand that I had been paying in excess of the installment amount for years and said their processing department would review and have someone contact me. The representative also indicated that while a late payment had been applied it had been reversed. I received a statement dated XX/XX/XXXX, which indicated, with the {$600.00} payment mentioned above, the account WAS pre-paid with the next regular payment due XX/XX/XXXX. The {$600.00} payment mentioned above would have advanced the next payment due by no more than 3 months, meaning that as of the time of the alleged " missed '' XX/XX/XXXX payment, no payment was actually due until XX/XX/XXXX ( i.e., the alleged " missed '' payment was made more than 2 years in advance ). The same statement indicated {$6.00} of my XX/XX/XXXX payment had been applied to a late fee. I can not locate a copy of the promissory note, but I is my understanding that pursuant to Federal law and the terms of the Note that excess payment amounts are to be applied to future installments unless the lender is notified otherwise. I have not ever indicated to the lender or its servicing agent to apply excess payments in any other fashion. I attempted to contact customer service at ACS over 3 weeks ago. It was quite late and I was surprised to reach anyone, but I did speak with a representative and described the issue and asked to speak with a supervisor. The representative indicated that no supervisor was available due to the late hour but took my cell number and said someone would contact me. To date, I have heard nothing, by phone or mail or email, the website still reflects the higher rate of interest and I do not see any indication that the late fee was actually ever credited. Copies are attached of the XX/XX/XXXX statement/notice, XX/XX/XXXX statement, unsecured emails regarding the XX/XX/XXXX ACH payment and loss of incentive benefits, payment history from the ACS website and the secure email.

Complaint: I have been a XXXX in a large XXXX XXXX district since XX/XX/XXXX and am unable to receive a clear history of my student loans in regards to the XXXX Loan Forgiveness Program. My loans were consolidated in XX/XX/XXXX ; however, my servicer ( ACS ) is unable to provide me with the type of loans that were consolidated and the date of consolidation, which can impact my eligibility for the XXXX Loan Forgiveness Program. In addition, my servicer ( ACS ) said my loan is being transferred to another lender/servicer ; however, they were unable to provide a date or time frame that this would occur. My servicer ( ACS ) referred me to the U.S. Department of Education, who also provided limited/false information. I was provided with a servicer who, when I contacted, had no records of my loans.
By not being able to access my loan history, I have not been able to receive confirmation of my eligibility for the XXXX Loan Forgiveness Program. My servicer 's practices ( ACS ' ) are unfair and deceptive as I am not able to receive consistent information regarding my loans. My loan is also being frequently transferred to different lenders and servicers making this process more complicated.
I have contacted my servicer ( ACS ) on multiple occasions, with the latest contact being XX/XX/XXXX. The servicer ( ACS ) stated they could request a copy of my Promissory Note from the loan guarantor ; however, this will take 30 days to provide and I am not sure how this will help me to understand my eligibility for the XXXX Loan Forgiveness Program. Complaint: I mailed a payment in XX/XX/XXXX for {$110.00} that was cashed by ACS on XX/XX/XXXX but apparently was never applied to my account. So in XX/XX/XXXX when I received the statement showing past due I contacted them. That was XX/XX/XXXX, the gentleman that I spoke to said to send a copy of the cashed check to them, which I did on XX/XX/XXXX ( I sent copies of both the XX/XX/XXXX payment and the XX/XX/XXXX payment both for the amounts of {$110.00} ). I received the XX/XX/XXXX bill today and it is still showing past due so I called them and they still have not processed the payment from XX/XX/XXXX to credit it to my account. There are late fees on my statement both for the month of XX/XX/XXXX and XX/XX/XXXX. They will not let me speak to a supervisor or correct their error for me. The best they can tell me is to check back at the end of the week to see if the situation has been fixed. Meanwhile this negatively affects my credit and I am paying more interest than I should be since the amount applied to the late fees should have been applied to my principal thereby reducing what I owe and what the interest would be each month.

I could never get a straight answer. Took a 1 year forbearance in 15 years and it was blamed on that. Also told that in order to make headway I would need to pay before the due date each month, moving my payments up earlier and earlier each month. Something does n't seem right about that. One should be able to pay off their loan paying on the due date each month. However, I have done that and still only paid off a fraction of my loan. I have never made a payment that did not arrive on the due date or before. Monies applied to interest each month do n't seem to make sense. I would like answers. I want to know why money applied to principal is not reflected in my current payoff amount. I want to know in writing how they are calculating interest.

Complaint: ACS is the company. I found out this year that ACS Education Services closed in XX/XX/XXXX. I never received a letter from them that they will be closing. I keep on making my payments on my student loans. Over the years, I did take options that were available to me because of my financial situations. ACS charged me a lot of interest during this time. I never saw my account go down, just up. I transfer my students loans form ACS to XXXX in XX/XX/XXXX. I see my loan decreasing a lot now for example {$330.00}. ACS ripe me off numerous of time. They charge me more interest on my loan. I have talk to tell about my payment history. They sent that information to me in the mail. I do not understand it.

Complaint: ACS sent me a XXXX which I do not recall when I received it. Around the XX/XX/XXXX I received a letter from the IRS saying that I owed {$890.00} in taxes from my XXXX taxes due to the XXXX. I had spoke to our tax lady and she said that I needed to find out why I received the XXXX. That ACS must have filed the wrong paperwork. Within a two days I located the XXXX and called ACS. On the phone the lady said, " We knew that the IRS would think that we sent you a check for {$3000.00} and we were waiting for you to get paperwork so you could send it to us. '' I said something like I do n't understand, this does n't seem right. She explained that in XXXX of XXXX there was an audit on my account and they lowered my principle balance by {$3000.00} and that is what the XXXX is for. She said, " When you send us the paperwork we will send you a check. '' I restated that this does n't seem right. How can I pay taxes on money I did n't get. She said that is just how they do things. I said that It 's not right and then asked if they were going to just pay the taxes or send a check for the full amount. She said, " No, the check will be for the whole amount. '' I said, " So you are sending me a check for over {$3000.00}. '' She said, " Yes, for {$3000.00}. '' I again said this does n't make any sense. Within a couple days I emailed a copy of the IRS papers showing what we owed for taxes. On XX/XX/XXXX I called to find out what was going on. It was a different lady on the phone. She looked up the records and said, " A check was cut for {$890.00} and yesterday. '' I explained to her the conversation that I had with the first lady. This lady said no, I am sorry that you were told that. We just pay the taxes. I questioned how it was right to pay taxes on money that I did not receive. She said that is how we do things. I again stated that this is not right. I received a check on the XXXX XXXX for {$890.00}. This did not cover all that it cost me to fix this issue. There were fees from the IRS for paying with a credit card. I felt I had to pay it with a credit card so that there would not be any additional late charges. I am wondering what kind of tax relief or break they received from IRS to be able to do this.

Complaint: In 2006 I signed my student loan promissary note with a company by the name of XXXX XXXX XXXX. Keep in mind i was XXXX at the time and unaware of laws or regulations. After I signed the promissary note I was sent my truth and lending disclosure. Nothing in my promissary note stated I would have to pay XXXX XXXX late fees if I was 5 days or more late. It just recently happened that I hit hard times within the last few years and I was coming up late on some payments. I discovered they were charging late payments of XXXX XXXX a month which according to reg Z can not happen unless that was disclosed before I signed my contract. I called the company ACS education services but they refused to comply with removing the fees. They sent me a promissary note copy but it was redacted so it did not show the entire contract. I have been paying this loan for over 8 years, and cannnot understand how they can get away with this. Can't get other flexible options for repaying your loan
Complaint: I applied for the Public Service Loan Forgiveness program and was denied. I took ou t William D. Ford L oans and I have been paying on them since XX/XX/XXXX . I have paid for 17 years without missing a payment. I have never been late with a payment s ince I have automatic debit. I work fulltime as an XXXX in a XXXX XXXX XXXX and meet all the other qualifications. I have also applied for the XXXX forgiveness program and been denied because I took out my student loan in XX/XX/XXXX o ne semester before the program benefits. XXXX University DENIED the Perkin Loans to the XXXX students who were in greater need than the XXXX students because our classes were much more expensive. If they had allowed the XXXX students Perkin Loans I would have had 100 % forgiveness. What are my options at this point in time after paying faithfully for 17 years. Please help.
