Complaint: I have made past requests to bring clarity and validation on 9 creditor disputes that I believe was related to identity theft. I have since then XX/XX/XXXX submitted a police report about my identity theft, dating back to XXXX of XXXX of an incident of my identity theft, which brought every account into scrutiny as to whether the entire account was invalid by being created with using my personal information or portions of the account 's balance being a cause of identity theft with unwarranted charges to the account. Since then XXXX, XXXX, and XXXX, have addressed some of the issues with some these disputed creditors according results like CFPB report # XXXX, which suggests that identity theft was possibly at work behind those accounts that were deleted as result. Yet I am still getting targeted and bullied by creditors and collection agencies that have not been able to produce an original wet signature from my own hand to validate these accounts ( this would be my right and protection according to Federal Law, section 609 ). I have reason to believe that because there is no valid response since XX/XX/XXXX these accounts I am disputing may also have some involvement of identity theft as well. Can you cause them to stop with their bullying since they have failed to comply with my request of validation of these accounts? The issue is still unaddressed concerning this and it has been since XX/XX/XXXX that there has been no wet signature of my writing to validate the source of these documents. According to our federal governing laws of section 609, I ask that you verify that these accounts have already been deleted from my XXXX, XXXX, and XXXX XXXX XXXX.. Accounts that have not been properly addressed are : Original creditor : XXXX XXXX. with account number : XXXX Current creditor : XXXX XXXX XXXX : XXXX Original creditor : XXXX XXXX XXXX with account number : XXXX MCM account Number : XXXX Current Owner : XXXX XXXX XXXX If any of these are reported on XXXX, XXXX, and/or XXXX can you please verify them with a matching original wet signature by my own hand ( this request is backed by Federal Law, of Section 609 )? And since it has been since XX/XX/XXXX, with already no matching wet signature by my own hand, can you according to Federal Law, section 609 have these creditors deleted from all three of these credit bureaus and have XXXX XXXX XXXX, XXXX XXXX, and Weber & Olcese, P.L.C. to desist from their bullying efforts according to Fair Debt Collection Practices Act ( FDCPA ). Even If any of these are not reported or are reported on the these three Bureaus, can you have them stop with the bullying and forward this complaint to the Attorney General of the United States Government according to my rights stipulated the Fair Debt Collection Practices Act ( FDCPA ).

The companies are trying to collect money from me for a account with XXXX XXXX XXXX XXXX which I do not have. The collection companies can not and have not provided me with documentation of this account. I contacted XXXX XXXX XXXX XXXX about this matter, which I am a current customer and have been for awhile and was told I have no past due or a old account with them. The collection company has sent me court papers trying to collect money from bank accounts and other means. They also sent me a thing full of papers asking for copies of private information that I am not going to send them. I have contacted this company a few times about this matter and still yet havent been resolved.

Complaint: In XX/XX/XXXX I was offered a position with XXXX XXXX in Michigan, which I accepted and began working with this company in XX/XX/XXXX. XXXXXXXX XXXX required me to be in Michigan in XX/XX/XXXX and one two weeks out of every month for the remainder of the year. I maintained my residence in Nebraska and never moved to Michigan. I stayed at a hotel for the entire month of XXXX and then, in order to be more cost effective, I rented a house in XXXX XXXX, which XXXX reimbursed me for. This property was for myself and one other employee who was based out of Texas. During this same time period, I brought my personal vehicle to XXXX so that I did not have the added expense of renting a vehicle. While XXXX did reimburse me for rental costs, it was more cost effective for me to drive my own vehicle. Not to mention, the insurance was immensely cheaper, and as a XXXX, I was more comfortable in my own truck. While it appears that this lawsuit began some time ago, I was just recently notified of same, when my PREVIOUS employer, XXXX XXXX XXXX, sent me a copy of a garnishment notice. I am still unsure as to who the company representing the original creditor is, as in my research I have located confusing and conflicting information showing both Weber and Olcese and XXXX XXXX and at this point am unsure as to who is representing who. I have attempted to verify the debt is valid with Weber and Olcese ; however, they have been unable to provide me with an original signed contract or billing statements representing the entire time they have indicated this card was in use. Weber and Olcese did provide me a copy of the judgment they filed, as well as their proof of service. The process servers notes on the Motion and Verification for Alternate Service confirm that it was a male staying at the property when they spoke to the neighbor, " Neighbor XXXX female at XXXX confirmed address - said HE drives a truck ''. While the process server may in fact have heard a TV on in the property, it was not me staying there at that time. The process server goes on to note that " defendant has had plenty of time is evading service. '' If evading service means that I was in Nebraska, at MY HOME, then I guess that could be construed as an accurate statement. The process server then posted the debt lawsuit documents on the door. These documents were NOT in an envelope or concealed in any manner from third party viewing. They were affixed to the front outside door with tape, and were discovered and taken by the landlord, who proceeded to send pictures of each page of the document to the party that was at the property that week, in addition to my work. My lease at the property was terminated shortly after this incident occurred. It seemed coincidental at the time, it doesnt any longer. It appears as if my lease was terminated due to the information posted at the property. At that point, I was in Nebraska working remotely, and was only in Michigan for one week out of every one or two months. For this reason, I did not establish another rental in Michigan. The lawsuit, judgment, and any other entries of default that have been filed into a court system in Michigan, should never have occurred as I was never a resident of Michigan in XXXX, XXXX, XXXX. Hence the Nebraska 21 county license plates and a mailing address in XXXX, Nebraska. My state income taxes were also filed as a resident of Nebraska, not Michigan. On another note, as youll notice, the last 4 pages of the documents they provided to me for verification, are for an entirely different person. I would wager to guess that this person, and every other person they are filing suit against, would be less than pleased to note the obvious carelessness and lack of oversight in their business practices. Are they able to state with any certainty that MY information hasn't been inadvertently sent to another??

Complaint: Weber & Olcese is a debt collector who obtained an account I did not open, addressed to an address in another city I have never lived in or used, received a default Judgment against me and then a garnishment, which was sent to my bank requesting funds and all my private information so they can locate other accounts of mine. They did this in violation of the FCRA, without serving me or making a diligent effort to locate me. I did not find out about any of this until I received a notice of garnishment from my bank XXXX XXXX in late XXXX. FACT : As of XXXX, Michigan had the 4th highest ID Theft complaints : 4. Michigan > Complaints per 100,000 population : 676.7 > Total complaints : 66,964 ( 6th most ) > Identity theft complaints per 100,000 : 97.1 ( tied for 4th most ) > XXXX home value change : -24.4 % ( 5th worst ) Unlike many other states with high incidents of fraud, Michigan residents had less debt than most Americans. For example, the average auto loan debt in Michigan was just {$13000.00} as of XXXX of this year, the lowest in the nation. While residents may not have as much to lose as those in other states, they were among the hardest hit by the financial crisis and are likely still vulnerable to fraud. Home values fell by 24.4 % between XXXX and XXXX, more than double the nationwide decline. The states 8.3 % unemployment rate last year was also one of the worst in the nation Source : XXXX XXXX XXXX & XXXX XXXX I contacted a local news station who had one of their investigative reporters contact me. After providing documents and speaking with the investigative reporter I found out the following disturbing information : The Investigative reporter told me shady debt collection practices have become their 2nd highest complaints next to Robo-Calls Complaints concerning unlawful or deceitful Debt collectors had increased 60 % in XXXX with most of those being consumers not finding out about a debt until after having their accounts garnished. The investigative reporters theory ; Debt Collectors have a scheme to give the appearance they have made a diligent effort to serve individuals, the Courts always take the DEBT COLLECTORS at their word and even lower the standards of proof for these Debt Collectors. Many of these collection agencies have either a personal relationship with Judges or donate heavily to the Judges that hear their cases. The system is set-up to encourage bad behavior by Debt Collectors ; By obtaining a default Judgment whether its based on untruthful affidavits, deficient service, or lack of jurisdiction, The Burden of Proof flips from the Debt Collector to the Defendant. Prior to a default Judgment a Defendant just needs to question the accounting of the debt. However, after the improper Default Judgment is obtained the Defendant now must prove both : a. ) Good Cause to set aside the Default and b ) a meritorious defense. Moreso, the standards of Defendants meritorious defense substantially increase. Meaning, even after the defendant provides what should be a valid meritorious defense the Courts continue to rule in favor of the Debt Collector largely due to the relationships built between the Courts and the Debt Collectors. Again, the Debt Collectors rarely ever make a diligent effort to give the consumer proper notice of a complaint for a debt. Its so much easier to obtain a judgment when the other side does not have the ability to defend him/herself. Weber & Olceses effort is primarily crossing the Ts and Dotting their is to give the appearance of a diligent effort and mislead to Courts into granting default Judgments, My case with Weber & Olcese is a perfect example how reckless they are and how simple it is to steal money from anyone at anytime in a public forum. **Once I forwarded the default judgment to the reporter it was implied that someone at Weber & Olcese and the Judge who was assigned to the case, have a close relationship. The reporter told me I should request the Judge to recuse himself. Based on these standards I can file a Civil lawsuit against any individual e.g. XXXX for {$15000.00}. Use an address XXXX never lived at in another City or County, hire a process server who will provide an affidavit XXXX is evading service and obtain a default Judgment against XXXX, and then garnish his bank account ( s ). By the time XXXX knows what happened I am walking off with his {$15000.00}. This is unconscionable!

Complaint: This collection agency is going above and beyond what is necessary to attempt to collect a debt I've already notified them that the card was opened fraudulently without any knowledge from myself XXXX XXXX XXXX was the original creditor they are aware of this this collection agency is well aware of this as well at one point XXXX XXXX XXXX had four different mailing addresses for me within a year 's time I mean if that doesn't throw up some red flags I don't know what does but this collection agency is still harassing me when it's more than obvious that the account does not belong to me never did the identity theft happened 6 + years ago at this point at a certain point enough is enough and now they've gone as far as asking the courts to subpoena more of my personal information at a certain point they need to accept that this was a case of identity theft like every other bank that was involved years ago did this is the only bank that I still had an issue with and this is the only question company that still is harassing me there's nothing more to give at this point you're asking for information I don't even have your asking for recent loan applications I don't have any recent loan applications you're asking for copies of my paycheck I'm not working and haven't been for a while now you also want bank statements what do you hope to accomplish I'm not working do you really think there's any money in my account? My domestic partner works but we are not officially married so no you can't go after him for this fraudulent account I've requested that you show me proof all you did was send me bank statements nobody 's disputing the fact that the account was opened and it was used it just wasn't used by me and nobody can explain why there's so many different phone numbers and email addresses and physical address is associated with this account when I've lived at the same place for years now but whenever I bring that up you just ignore that fact

Complaint: XXXX XXXX ( XXXX ) is attempting to collect a DEBT NOT OWED ( {$1200.00} ) for the second time - Weber & Oclese ( Debt Collection Attorney 's ). I contacted this agency multiple times, by phone and email. ( attached correspondences below ). I informed W & O about the first attempt to collect debt not owed and attached paperwork. However, I continue to receive letters from Weber & Oclese stating I owe this {$1200.00}. XXXX XXXX ( XXXX XXXX ) is notorious for doing " unlawful '' things - Trying to renovate the building on the backs of tenants. Claiming repairs ( due to normal wear and tear ) as the fault of current tenant, when XXXX needs to fix themselves. -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- I filed the first complaint with the CFPB on XX/XX/2018 ( Complaint # XXXX-XXXX ). I thoroughly proved I was NOT responsible for the alleged debt. XXXX claims I am responsible for replacing carpet in the unit. I AM NOT. I moved into a dirty apartment and the carpet was USED, fraying, and pulling from the walls ( so much I could see cracks in the foundation where the insects and rodents came from ). I documented this in an email to XXXX manager. I provided a copy of the email in the first complaint. I was evicted illegally after complaining to the City of XXXX of a bad infestation of bees in my apartment. Upon leaving, I asked XXXX to provide me with the outgoing checklist of the tenant who lived in the apartment before me. They never did. XXXX can not prove the damages were made by me and not the tenant before. However, I proved on an inventory checklist ( attached in first complaint ), I was put in a very dirty apartment, who's carpet was NOT NEW. Within one month of my tenancy I had an infestation of mice who defecated all over this " used carpet. '' Mice carry diseases. Luckily, my cat killed all of them. ( I have this on video and will post it if necessary ). The carpet should be replaced regardless after having a repeated infestation of rodents in my living space. Again, a XXXX responsibility. I did NOT bring mice in to live with me!! There were holes all over the apartment foundation where the mice got in. XXXX XXXX PAYS, NOT ME. My point, XXXX is RESPONSIBLE for replacing this carpet. It is not my responsibility. I am NOT paying for carpet that I DID NOT RUIN. I want Weber & Oclese and XXXX to STOP HARASSING ME. XXXX XXXX never sued me or taken me to smalls claims court for a judgement to be made on this " alleged debt. '' I DID TRY to SUE XXXX two times for the moving costs. Both summons were refused. XXXX has two chances to meet me in court to get a judgement on this alleged debt. They refused. Instead, choosing to repeatedly send collection agencies after me. To date, XXXX XXXX has sent a second debt collection agency after me - Weber & Olcese. I will not pay Weber and Oclese for this alleged debt either and fully anticipate being turned over to collections - screwing up my good credit score. I am TIRED of dealing with XXXX. XXXX, XXXX XXXX ( XXXX XXXX ), and all the agencies he keeps harassing me with.

I received a summons from the law firm they hired weber/olcese. we came to a settlement agreement which I will attach. I fulfilled the terms of the agreement however the XXXX account is still showing negative instead of paid on my report. I made all communication with XXXX and weber/olcese through email, but now when I email XXXX about this they only give me a number to call. I have made several attempts with XXXX to have this corrected and to get it reported correctly with XXXX to the bureaus, but they have not been helpful.

Complaint: I received a letter or garnishment served on my employer for an old account. They have been garnishing my check ever since. XX/XX/XXXX the last payment was taken from my check showing the garnishment was paid in full. Monday XX/XX/XXXX the same company emptied my checking & savings account of {$720.00}. I called and couldn't get anyone to talk to me. So I went thru the provider line and got someone that way. I explained what happened she said that her records indicate I still owe them {$200.00}. She said she would have an attorney look at it and let me know. But they are not responsible because they haven't received the last payment yet.
