Complaint: Before passing away, my Mother quitclaimed her property to me in XX/XX/XXXX. In early XX/XX/XXXX ; I began experiencing financial difficulties and the mortgage went into default. Over a period of one ( 1 ) year ; from XX/XX/XXXX to XX/XX/XXXX, I have repeatedly submitted loan modification applications to the loan servicer and I have always submitted the follow-up documentation timely ; with fax confirmations as proof.
I have received a denial of all of these applications due to conflicting reasons as given by the servicer : 'insufficient documentation ' or 'no loss mitigation options available '. The last denial I received was on XX/XX/XXXX ; which I am currently appealing. As I await the results of my appeal ; the servicer has informed me that the foreclosure sale is still moving forward.

Complaint: I got divorced in XX/XX/XXXX, so I had a reduction on income and had a Loan Modification around XX/XX/XXXX, through Select Portfolio Servicing. My interest Rate was at a non-fixed rate, so they fixed it at 8.75 %. They also reduced my payment by {$400.00} while they were doing the Loan Mod. A couple months later when they fixed my interest rate, they said that's all they could do to help my payment went back up to the Regular amount it was before I called about a Loan Mod. They reported me to the Credit Bureau as late during those 3 trial months of the Loan Mod. I have noticed that only around {$35.00} a month was going toward my principal each month, so a couple months ago I called them to get a amortization Schedule to see when more would go on the principal. I purchased the house in XX/XX/XXXX for {$150000.00} now in XX/XX/XXXX .... 12 years later I still owe {$140000.00}. I knew something wasn't right. The person I spoke with at Select Portfolio told me they couldn't give me an amortization schedule because I was on a Balloon Payment and they I better hurry and start making extra payment because I will still owe around {$100000.00} at the end of my 30 year note! I told them I never would have agreed to something like that and the home mod was suppose to be helping me, how was that helping me?! I asked for them to send me paperwork stating all of this and they still haven't sent me anything, that's been a few months ago now .... I am confused and feel I need to sell my house to get out from under this terrible scam they are doing. I need help.

Complaint: I obtained my mortgage in XXXX and remained current until XXXX, when I experienced some financial difficulty and subsequently applied for and received a loan modification late that same year. I experienced temporary financial difficulty again in late XXXX by way of my father 's illness and subsequent passing in XX/XX/XXXX. I attempted to begin payments again that same month ( XXXX ) but the payments were refused ; I was approximately {$7000.00} in default ( with lender+ trustee fees ) at that time.
Since XXXX, I have attempted 4 times to submit a 2nd request for mortgage assistance ; I was repeatedly asked for more documentation each time, then informed on XX/XX/XXXX, that I did not qualify, although my earnings have remained the same and I have the means to cure the arrears through a modification.
I initially applied in XXXX and throughout the back-and-forth ; the arrears have continued to increase.

Complaint: Our current servicer ( 1of 6 servicers dating back to XX/XX/XXXX ) is SPS. Our mortgage originator was XXXX XXXX XXXX XXXX ( who has been out of the mortgage industry since XX/XX/XXXX ), on XX/XX/XXXX, of whom 3 months after our closing bundled, pooled and sold our mortgage to unnamed investors, with XXXX XXXX XXXX as Trustee. XXXX was the XXXX XXXX of XXXX XXXX. Their attempt to securitize these mortgages in the pool " failed '' they were not securitized properly. After over 50 attempts of submitting completed loan modification applications dating back to XX/XX/XXXX to all 6 of the servicers who took over our loan, it begs the question, will this complaint to CFPB make a difference? Do each and every servicer have a compiled view into the history of hardship that we have endured and that we have brought to the surface. Our struggles, pains, vulnerabilities, fears and the reality in which live every single day dating back to XX/XX/XXXX I can only have hope that this letter of hardship will make the difference as despite everything we have been through I still believe in human decency and the housing system. Simply put ; We have raised our daughter from a small girl into an aspiring XXXX XXXX in our beloved home. We have raised our son from a young boy into a United States XXXX in our beloved home. On XX/XX/XXXX, Our Son, XXXX XXXX XXXX XXXX and XXXX XXXX XXXX, lost his life serving our country. We have cared for an aging parent with a XXXX XXXX of XXXX in our beloved home which impacted our ability for one of us to continue XXXX due to the growing medical needs of an ailing parent, yet we endured. We have had countless family gatherings and holidays full of joy, in addition to gatherings of sadness not knowing if it would be the last time we would be together in our home, our beloved home. The stress on our marriage due financial troubles and repeated mortgage modification denials, yet we continue to stay strong together hand in hand and gainfully employed. We endure. All the while of submitting over 50 applications for Mortgage Assistance across many mortgage servicers and the associated stress and angst of repeated mortgage denials by the loan owner/investor, yet we endure. Our mortgage has been passed along to a new servicers nearly every ( 2 ) years. Where we continuously on board new servicers to the actual history of our mortgage, tell our story, at the encouragement of each servicer, hanging on their every word, we continue to apply for Mortgage Assistance and we wait. Will this attempt make the difference, or will it result in another denial indicating that investor or loan owner does not authorize loan modifications. Please accept this appeal for a loan modification and request for outreach to the investors or loan owners for permission to modify our mortgage.

Complaint: This is a follow up of complaint XXXX.
I have been attempting to work with SPS servicing for over 3 months. It is without a doubt in my mind that the only objective this company has is to fraudulently delay and stall all processes in order to keep this file from closing and keep collecting fees for servicing. They are committing fraud to their investors and if their investors knew what they are doing they would investigate this company. I am a XXXX and I am very familiar with process. I have literarily called this company over 50 times over the past 70 days. Every single time I call them they fabricate a new required document that was not needed the previous day. I will literally call, get a supervisor, they will review the file, they will say you need a document. I will ask if they need anything else and they will say no. The very next day I will call, and they will say " oh '' and we need this document. I send them each document with in the same day. I ask the supervisor if they need anything else again and they say no. Then again, I call the very next day and all of a sudden again they need another document. It is like the movie " Ground Hogs Day '' every day is literally the same. This has happen literally 40 times on the same file.
Example : I supplied the supervisor with a closing discloser. I called them, and they said we need to change it to show how much the difference is in the pay off and the amount of the loan. We submitted. Few days later they said, we need you to change the HUD to so that it says something different in the same line items. We submitted it. I called back two days later. They said, we don't understand what this means, so I asked them to give me the exact language to put on the line item. They provided the exact language. The supervisor walked over the short sale department and had them tell us the exact words they wanted on the line item. I sent it to the supervisor while on the phone and XXXX XXXX ( supervisor ) said it was exactly what they wanted. I called back two days later and talked with XXXX XXXX ( supervisor ) and he says the HUD is wrong and that we need to remove the short amount numbers and show the amount of the total payoff not the short sale difference. This is after I had changed the HUD three times.
Further example : Every time they submit a document or need a document they say, " the investor has reviewed the file and they require another document. '' They somehow get a new requirement for a document directly from the investor in a day or two and then we keep submitting. Now finally after submitting all the documents multiple times they now say it is going to take a while ( no real date here ) for the investor to review the file.
I have talked to the following people numerous times : XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX, XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX. These are all supervisors. This is how many times I have called this company that I have a list of most of their supervisors.
How is it that the investor can review the file so quickly when they find a missing document but now they are going to take a longer time frame once they have all the documents. How is it that the investor has seen this file for 45 days and now suddenly the need time to review the file they have been looking at for 45 days.
We missed the first closing because SPS servicing is fraudulently delaying the process. Now we have extended the closing toXX/XX/2018 closing. All parties are ready to close. All money is ready. The sale price is {$10000.00} above the BOV.
This company is committing fraud to its investors. It is completely evident beyond a shadow of a doubt that SPS Servicing Inc is with all intent purposely delaying the process a part of their modus operandi to stall or cause deals to fall apart so the company can maintain accounts and collect fees from it investors for servicing. They with intent created processes that prevent anyone from successfully completing a short sale process so that they will keep the file on their books and not lose the servicing fees.
I have worked with this company for almost 3 months and they have repeated shown this trend in behavior. Not once have I called and received the same answer twice. Not once have a called when they did not create a new requirement that was not there the next day.
They are committing fraud to their investors and they need to be investigated immediately.

Complaint: XXXXXXXX XXXX and Select portfolio is continues to conduct unfair lending practices and mortgage fraud.
XXXX claims I agreed to a Sub Prime Loan Modification. I never agreed to a Subprime mortgage. My principle balance was {$84000.00} prior to XXXX transferring my loan to their Loan Servicer ( Select Portfolio Servicing ).
I have been waiting for the past 7 months to get a resolution with Select Portfolio for a Loan Modification, Now SPS is stating they need approval from the Lender who is actually XXXX XXXX. This is a mortgage fraud, XXXX told me to behind on payments to qualify for the HARP program. Now SPS is saying the same thing, my mortgage payment is {$980.00} a month and out of that amount only {$120.00} dollars goes towards the principle balance.
Please add me to the Class Action Lawsuit against Select Portfolio and XXXX for Mortgage Fraud

Complaint: I have repeatedly requested in written Qualified Written Requests to SPS, in telephone conversations with SPS, in telephone conversations with the abustmans office of SPS, in letters to XXXX XXXX, and in copies of the Qualified written requests to SPS legal representatives, and even in the CFPB complaint system numerous times the following information that has repeatedly been promised but never provided : 1. Accounting information from XX/XX/XXXX loan origination thru XX/XX/XXXX which includes all payment information, fees, interest, escrow information and payments for the loan and the complete loan accounting history and loan balance history and transfer and assignment information.
2. TOTAL escrow accounting information from XX/XX/XXXX loan origination thru XX/XX/XXXX.
3. Accounting information and all history concerning trial modifications and any payments and credits for them and also the verification of any loan modification alledged balances and accounting.
The above information has NEVER been provided. Althought SPS and the previous servicer, XXXX XXXX XXXX, provided history of payment records during their servicing of the loan they have both responded that they have no previous loan records from the XX/XX/XXXX loan origination timeframe thru XX/XX/XXXX and can not therefore provide it. BUT they then claim that they have satisfied the request for the information and close out the request over and over without providing the information and creating confusion and an illusion that they have complied with the requirement for the information.
I submitted a request again for this information in this forum again ( along with a written QWR ) and provided several copies of the prior QWR reflecting just the most recent requests for the information and cited that they again responded that they had provided the information previously. In that complaint I also provided the attachments of the actual documents that had been provided to clarify and show clearly that they had not actually provided all the document. SPS promised to " work '' on getting the information but they did not provide attachments showing that they had provided even the data that they claimed they were sending besides the above required information.
SPS has provided a certified document in court from a representative of XXXX XXXX that certifies they have reviewed all accounting on the loan and deem the amount they claim is owed as accurate. HOW CAN THEY legally certify that information if they do not have all the accounting and escrow information along with the other trial and modifications accounting? XXXX XXXX claims to have none of the account information in the past 2 weeks and has referred me to SPS.

Complaint: This all started with my job loss in XX/XX/XXXX when I reached out to XXXX XXXX to reduce my mortgage payments. I literally chased XXXX for almost a year before finally signing papers in XX/XX/XXXX and secured a much needed mortgage modification. After making my first payment, a few weeks later the sheriff was at my door with foreclosure papers. I told him everything was already taken care of and I just made my first mortgage payment. He told me to call the attorney 's office listed on the paperwork. I called immediately ; the girl told me that it looks like they forgot to remove my name from their " list '' and that it was an oversight, she assured me it would be taken care of and not to worry. That was the LAST I heard about any foreclosure until XX/XX/XXXX when the Sheriff taped the notice of Sheriff Sale to my door!
At that time in XX/XX/XXXX I, of course contacted XXXX but couldn't get a live person. ( This was the time XXXX was taking over XXXX and it was pure chaos ) I kept calling for weeks and only receiving voice mail, until one day I was provided a XXXX phone number. I called XXXX and was told they knew NOTHING about this modification and that I needed to move forward and apply again. This was a very difficult time in my life as my father had suffered with XXXX for years and unexpectedly passed away in XX/XX/XXXX. I'm a fighter and usually would have fought for the signed modification/ I already completed with XXXX but I took the mortgage rep 's advice to move on. This is a decision which I regret to this day but I was vulnerable, grieving and traumatized by my dads passing.
I had to reapply for a modification once again, this time with XXXX XXXX XXXX. Their careless and negligent practices were enough to drive someone over the edge. I had to send in the SAME paperwork over and over again, reapply over and over again, my representative changed continuously. It was horrible. In XXXX XXXX XXXX XXXX offered me a new modification thru the XXXX XXXX XXXX, this modification was to reduce my principal and monthly payments significantly, I signed the documents to proceed ( 2 or 3 times! ), faxed what they needed and the next thing I knew, they transferred my mortgage to a servicing company who knew ABSOLUTELY nothing about this modification program!
After constantly calling and sending letters to this servicer, I was AGAIN transferred to another servicing company, then another ... ..now they have a Sheriff 's Sale on XX/XX/XXXX from a foreclosure that was filed 10 years ago that I didn't even know existed and I am going to lose my home! I had a HUD Counselor involved and called SPS on Friday, XX/XX/XXXX to ask them to postpone the sheriff sale so I can continue to work with my HUD counselor but then they said, sorry there is NO MODIFICATION OPTION FOR YOU, only the sale ... ..What??? Is this even legal??? I'm devastated ... I bought my house in XX/XX/XXXX and have my son and my XXXX grandchildren here that are XXXX and XXXX. I contacted SPS as I have the other servicers quite a few times and even mailed a copy of the XXXX XXXX XXXX Modification offer under the XXXX XXXX XXXX but they do not seem to care ... they just want to move my house into Sheriff Sale ... they are cold and calculating ... .they are a collection company or that is what they act like ... I have folder upon folder of letters I have written, modification offers just everything ... .I need someones help on this ... ..it doesn't make sense ; they are NOT complying with the XXXX XXXX XXXX and NO ONE SEEMS TO CARE!! I beg someone to help me ... .I 'm in tears every minute of every day and can not concentrate on ANYTHING ... ... .This is unfair and I can not believe it is even legal!!

Complaint: In XX/XX/2005 I went looking for a remodification of my loan I was told I could not do this because I was current and was advised the only way to remod was stop paying my mortgage I was on an interest only loan afrer I stopped paying my interest only payments and was granted a remodification my principal was increased from {$600.00} XXXX to {$680.00} XXXX without me having any knowledge of this happening I feel this is a very unfair practice and considered predatory lending practices for the last 13 years I have been paying interest on top of interest in essence paying double interest. this doesn't seem fair .as I was not informed
