Complaint: Select Portfolio Servicing and XXXX XXXX XXXX have attempted twice to foreclose on the principle amount of {$970000.00}. I had modified with XXXX XXXX/XXXX/09. The principle amount then was {$910000.00}. Select Portfolio monthly mortgage statements show the principle amount is {$840000.00}. Why the disparity in amounts? I have complained multitude of times. I have had two trustee sale dates. I have proven to SPS that they are in violation of Dual Tracking. And they claim they did not. I have documentation from XXXX XXXX XXXX recording a trustee sale date while I am in the Modification Loop. What can I do when they deny and deny the accuracy of the sale date county recordings and the ongoing documentation request for the pretend modification? Do I send you all the proof of the first sale date? Does SPS have the XXXX information. Where is my true Deed of Trust and Note? And now where do I go with the Dual Tracking proof?

Complaint: We were XXXX in XXXX, XXXX until XXXX. We then XXXX transfer to XXXX XXXX, XXXX and decided to leave our family in XXXX so our daughter could complete her final year in high school. We then rented our house out as we were unable to sell it after being vacant for 6 months. We lost the renters in XXXX XXXX. We began working with XXXX XXXX XXXX in XXXX to obtain a work out because we were upside down with the mortgage, behind in payments due to my wife 's medical issues, and unable to rent the house for enough to cover the mortgage. XXXX then sold the mortgage to Select Portfolio Servicing ( SPS ) but did not transfer the work out request to them in XXXX XXXX. We have now been dealing with SPS since XXXX XXXX with no resolution. They continue to ask us for the same paperwork that we have already sent them and this is confirmed with their agents that they do in fact have the requested documents. Despite these confirmations they continue to ask for documents that their agents have assured us they have thus dealing the decision and forcing us to accrue late charges and interest.

Complaint: Hello : I have recently received a letter stating my loan was transferred to SPS ( and during a previous attempt to satisfy my XX/XX/XXXX payment via XXXX XXXX ). A fixed 20 year term XXXX Mortgage Loan. With a new loan Number within SPS of XXXX. My due date is the XXXX of each month and a grace period of fifteen days. At XXXX I contacted SPS and spoke with a representative, whom stated a payment by phone, online, and or mail will not be applied to the account until the eleventh of the month ( at the earliest ). Claiming our account information has not fully uploaded from XXXX XXXX to SPS, therefore any attempts to set up online, or a payment by phone is not an option. And if a payment is received, it will not be applied to the account until XX/XX/XXXX. Here are my concerns : We will continue to accrue daily interest, due to SPS not having the capability to upload any mortgage information, until the eleventh ( transfer date occurred on XXXX XXXX, 2016 ). When the representative was confronted of my concern, she responded by stating, SPS was in compliance of RESPA. QUESTIONS : Does the correspondence, advise the borrower of the delay to apply credit to the loan, ( I have read the correspondence and saw no verbiage )? Why would your system take eleven days to upload from XXXX to SPS? If there are system limitations, do you feel you have the opportunity to upload mortgage loan in increments? Is SPS in compliance of REG Z ( Are you back dating payments? ). What does RESPA have to do with the transfer of my loan? Overall, I feel this appears to be unfair and deceptive practices. As stated earlier, I am concerned due to SPS not having my loan information immediately after transferring the loan, I am negatively impacted with accrued interest. Sincerely, XXXX XXXX XXXX

Complaint: I had a Loan modification XX/XX/2010. I filed Chapter XXXX XX/XX/2010. At the time of filing Chapter XXXX I was only XXXX months behind. My lawyer fail to do there job and listen to me when I kept telling them I had a loan modification a few months pirio. Once we got to the the last fews months in my chapter XXXX I told then again that I had a loan modification. So they finally looked into it. MY lawyer and SPS lawyer looked into this and see that I did have a loan modification the same year. The money that was paid into the chapter XXXX to was not the amount I was behind at the time. I paid them a total of XXXX. My mortgage company have not credit the amount to my loan so I can pay the reminder and get my loan current. I This have been a problem that has been going on for a few months. This my XXXX time submitting a complaint.

Complaint: XXXX XXXX transferred me to SPS ... SELECT PORTFOLIO SERVICING IN 2015 XXXX. I HAVE MADE ALL MY PAYMENTS ON TIME TO XXXX AND SPS. somehow and i still do n't know why, XXXX took my payments and divided them saying that i owed XXXX $ then i wrote for a research and investigation.when sps contacted XXXX/after a year of harrassment calls and letters they then said i owed another XXXX remember i made all payments never late or missed.i contacted CONSUMER COMPLAINTS SEVERAL TIMES TO NO AVAIL.now after 14 m0nths i am getting new harrassment letters of forclosure.to stop the harrassment i have been sending extra payments to sps on XX/XX/XXXX, with my reg XXXX payment.this XXXX holiday SPS SENDS ME MORE FORECLOSING LETTERS THE SAME SAME LETTERS I RECEIVED 14 MONTHS AGO ... Complaint: I have been working with my mortgage company for months trying to complete a short sale. The last buyer I had terminated the contract because she states my bank was taking too long to approve the short sale. I have a new buyer now and I submitted all the necessary documents and my bank kept delaying the process & giving me misinformation. They would tell me my short sale is still in review but have decisions made. They would also give me and my Realtor different information. They said they denied my short sale because they want the full payment they are owed. My house is worth less than what I owe and I thought the purpose of the short sale was for the bank to acknowledge that and write off some cost. They claim they are short {$450.00}. They are jeopardizing me to get a FORECLOSURE over {$450.00} I 'm totally baffled, disgusted and distressed ; this does not seem to be a legitimate reason to deny a short sale. I 'm sure there are many more cases like mine at this company. I do n't understand the reason behind the short sale if the bank was expecting full payment. The XXXX Program is nothing but false hope, a faade. This was a waste of my time, my realtor 's time, the buyer 's time & buyer 's realtor time. This bank has no due diligence, and I desperately need to know my options and request that someone look into this bank to make sure they are not conducting unethical or illegal business practices. Any information you can provide me will be greatly appreciated.
