Complaint: I obtained a mortgage from U.S. Bank N.A in XXXX XXXX. I signed a Loan modification agreement with XXXX XXXX XXXX XXXX with the first date of lien on XXXX XXXX, XXXX and the modification of the mortgage effective XXXX XXXX, XXXX ; this document was signed by XXXX. I had to file for Chapter XXXX on XXXX/XXXX/XXXX with a release date on XXXX/XXXX/XXXX. My mortgage payments have been going to the servicer XXXX for U.S. Bank and I have asked to refinance or recast the balance. XXXX said they are not a bank and are not able to refinance the loan. I have written to U.S. Bank Corporate office to discuss the the aforementioned HAMP recast and other perks and have not heard back.

Complaint: My mortage was sold from XXXX to SPS Servicing in XXXX XXXX. The original mortage was done in XXXX and at that time the escrow only included the taxes and I the homeowner always paid the insurance out of my own pocket. Well 12 years after the original mortage this new company SPS decided to pay my insurance company even though the declarations pages clearly state Insured pays this is not a demand for payment, they raised my payment. When I contacted them they and told them the issue, they stated the had the right of escrow. In the meantime my insurance company refunded me the mortage company payment and I called the mortage company and made a lump sum payment of {$2300.00} to my escrow account for their mistake and to cover the " shortage '', but my payment was never adjusted and the are still wanting me to pay the insurance amounts and also my insurance company is still debiting my account for the money too. I have tried numerous times to get this issue resolved and I never get any response other than they have the right to escrow.. I am now facing foreclosure because I am not making the full payment because in reality I do not owe what they stated and my escrow account actually has a credit amount in it, but they are still saying I owe back escrow payments but in reality I do not because my payment was never adjusted to reflect the lump sum payment I had already made. I have been dealing with this for almost 16 months now and they still continue to not evaluate my escrow, and now I recently switched insurance companies and they did it again where they paid the insurance when they received a declaration page clearly stating Insured pays. Also, the new insurance dropped approximately {$100.00} a month in cost, but the payment does not reflect this drop in rates and still say I owe {$300.00} in escrow a month when the math does n't add up and if I did pay them what they say I owe eventually they would owe me money. I am not a legal expert but this in my opinion is mortage fraud and is causing me much heartache over something that is the company 's fault and lack of understanding or ability to do simple math.

Complaint: I would like file a complaint against SPS and XXXX. We have been going back and forth with both banks since XXXX 2016 to gain approval for the short sale of our home. We have a qualified buyer willing to pay full asking price for our home and we have yet to hear back from them. They are requesting multiple forms of the same paperwork, dragging their feet and delaying the process. We have done everything on our end to ensure the home does not go into foreclosure by getting any and all requested paperwork in in a timely manner and will be filing a request for mediation to avoid going to foreclosure.

2. They are foreclosing on me with an assignment that was fraudulenty created and robo signed.

Complaint: I NEED HELP WITH MY SHORT SALE. I sent a Short Sale package with a contract in XX/XX/XXXX and no one responded. I lost the buyer. I have a new qualified buyer and submitted a package in XX/XX/XXXX. I have n't had a response yet. My husband is a XXXX veteran and I am his caretaker. We have to relocate and bills are piling up because the maintenance and upkeep is causing more hardship -- We really need help to get this expedited ... ... ..PLEASE! We keep losing prospective buyers because of the timing.
However, I am pleading with SPS to stop the foreclosure sale scheduled for XXXX XXXX, 2016 and honor my short sale loss mitigation package.
My husband is a XXXX Veteran and I am his sole caretaker. He suffers from XXXX.
I came out of Bankruptcy previously in order to do a short sale when I was offered a modification that was n't feasible.
I listed my property, received offers and submitted my package twice. I have yet to receive a response. Instead, the first time I submitted a package a hearing was schedule to reset foreclosure sale date.
I resubmitted package and still no answer. I had a foreclosure sale date twice and the judge stopped the sale. I do not want to file bankruptcy again because I can not run the risk of having a Deficiency judgment and I need financial assistance to relocat I have submitted my package to the Consumer Ombudsman office as well as the Short sale department. Please send me a single point of contact whom I can work with and call twice a week until this matter is totally resolved.

Complaint: I am working on a short sale through HAFA short sale program. The loan servicer has a very inflated value for the subject home. The buyer paid for a full appraisal to dispute the short sale lenders value. The short sale lender is NOT taking the buyers appraisal into consideration due to the status of the comparable - some comps are bank owned or in some form of financial distress / since the subject is a short sale - I feel that these comparable homes are suitable.

Complaint: I am filing a complaint on behalf of my sister XXXX XXXX for which I have power of attorney to do so. This complaint is against her lender SPS and their lawyer XXXX XXXX for violating the New Jersey Fair Foreclosure Act and the Consumer Fraud Act. The law states the following and this was n't done : Notice of Intention to Foreclose Prior to filing a complaint in foreclosure, the mortgage lender must send the homeowner, via registered or certified mail, return receipt requested, a Notice of Intention to Foreclose. This is one of the most important protections that the Fair Foreclosure Act gives to homeowners. The lender must send the notice 30 days before filing a complaint. The notice notifies you that you are behind in your mortgage payments and gives you 30 days to cure the default.
They violated the Fair Foreclosure Act because they filed a complaint to foreclose ( XXXX ) in court on XXXX/XXXX/2016 without sending a registered certified letter to her stating the intent to foreclosure or the actual summons to foreclose. The only way we found out that they had filed the foreclosure complaint is from a foreclosure defense lawyer that contacted her stating that they could help with the foreclosure. I told him how could that be because we never received any certified letters or summons from the lawyer to let us know. When I contacted the foreclosure unit they stated that it was only showing the complaint had been filed but did n't show that it was sent out certified or delivered. I contacted the law firm several times for them to explain why this happened, but they never confirmed that the compliant was sent out certified, only asked how did I know it was filed. I have been telling SPS for the last 3 years if they have the legal documents to foreclose why has it gone for 9 years without it been foreclosed. If they could file the complaint to foreclose legally why not do so, so her defense attorney can file answer to the complaint requesting legal documents.
They are still violating the Consumer Fraud Act because it states : The act, use, or employment by any person of any unconscionable commercial practice, deception, fraud, false pretense, false promise, misrepresentation, or the knowing, concealment, suppression or omission of any material fact with intent that others rely upon such concealment, suppression or omission, in connection with the sale or advertisement of any merchandise or real estate, or with the subsequent performance of such person as aforesaid, whether or not any person has in fact been misled, deceived, or damaged thereby...
A court may find that the lender violated the New Jersey Consumer Fraud Act and that your mortgage is not valid if you were the victim of predatory lending.
Her mortgage was originated by a predatory lender, that preyed on them in they time of a crisis with her husband on his death bed. This Lender ( XXXX XXXX XXXX ) came to them under false pretenses and made false promises that they were going to reduce her mortgage down by {$500.00}, but instead increased it by {$500.00} ; she did't find out about the increase until she got her first statement. This lender added her husband name and income to the loan even though they knew he was on his death bed. He died the day after the application was signed. This lender set my sister up to default on her house, because no way could she pay a {$2400.00} mortgage note with a now income of {$2800.00}. It states that is a you are a victim of predatory lending that the mortgage is n't valid. This lender was indicted in {$11.00} XXXX in mortgage fraud. Now there are several lenders ( XXXX ) trustees ( XXXX, XXXX ) trying to claiming ownership to this same mortgage that is a fraud without even having legal documents as proof of ownership.

Complaint: In XXXX 2016 we lost out on a short sale buyer for our home due to Select Portfolio Servicing Companies customer service department not providing updates to the real estate agents for the buyer and seller in a timely manner. The poor communication caused the seller, myself, who has Select Portfolio as my loan servicer to lose the sale ; the buyers pulled out of the deal. A complaint was filed with CFPB by myself based on SPS loan servicing issues. I was contacted by theOmbudsman office who did not relive the complaint but stated that all we would need to do was obtain another buyers contract and we could submit all paperwork to their office to prevent the same issue happening again. Another contract was obtained and all of the paperwork was submitted on XXXX XXXX, 2016. I soon received communication from SPS that they did not have a HUD1 on file. After communication with Ombudsman it appeared that they had the correct paperwork the entire time, once again delaying the review process due to their negligence in reading the paperwork. Two weeks into a review SPS decided to do a second BPO which they did not inform us in the beginning they would need. Now that they have a fully signed contract with everything they need they have come back and said that they are counter offering for a higher amount, once again possibly causing our seller to back out of the deal. The offer was made by the seller due to SPS stating to the sellers real estate agent that they only wanted XXXX from the sale. With the newly submitted a contract they would be getting the amount they said they wanted. Now SPS is stating that the XXXX came back at XXXX and they are now requesting more money. It appears that each time Select Portfolio gets all the information they need, they either wait too long to update files causing the sellers to pull out or they find another loophole to prevent the short sale from happening. Each time the sellers provide everything SPS request SPS finds a way to compromise the short sale. The sellers are now at risk of being sued by the buyer due to breach of contract because the buyer make their offer and the XXXX that SPS initially approved. The buyers have completed all inspections and appraisals and select portfolio is now compromising the new contract. The home is not worth the XXXX BPO that was completed by XXXX XXXX. We would also request select portfolio provide to us as the counters all information that supports the XXXX XXXX along with approving and excepting the current contract for short sale. The current XXXX of XXXX SPS is choosing to use now does not accurately represent the worth of the home. When the home was initially listed 9 months ago it was listed in the XXXX range there were no offers the home has been on the market three months short of a year and did not get any offers until the price was lowered to the short sale price. There have been numerous showings on the home that resulted in no offers this information can be validated and obtained from the sellers real estate agent.

When they contacted the lender to request Mortgage Assistance on XX/XX/2016, they were informed by the lender that they needed 37 days prior to the Sale date to consider any mortgage assistance options. Consequently, the borrower asked the representative why were n't they provided the notice at least 37 days before the Sale date so they have had enough time to request mortgage assistance. The representative said that that was something that they were not required to do and that the Sale date will go through as scheduled unless there was a purchase offer submitted for the property, and even if there was, they may not be able to postpone the Sale date.

Complaint: I have a mortgage with Select Portfolio Servicing which Is paid on time and current. I had a fire in my home on XXXX XXXX, 2016. The insurance company issued a check in the amount of {$24000.00} which was made out to myself and the above Bank. I signed the check and sent it to the Bank on XXXX XXXX, 2016. I had all the paperwork they required signed by the contractor expressed mailed back to them on XXXX XXXX, 2016 they told me they received it and I would receive a check for the full amount of $ XXXXand would be mailed out in 5 business days and the mail would then take 10 business days to get to me. I called after the 10 business days and they said they never cut the check and again I would have to wait this 15 business day period bringing me now into XXXX. They have been holding my insurance check since XXXX now to XXXX. This is a rental apartment so I am losing 3 months rent which does n't seem to matter to them. I am a XXXX yr old widow and If I was 3 months late on my mortgage I would be in pre-foreclosure. Is there something you can do to them to make them overnight my money which I stressed to them I wanted done and they said I still have to wait an additional 5 business days before they could even cut the check.
