Complaint: Our home loan was sold off to SPS Servicing , Inc., XX/XX/XXXX from XXXX XXXX. Our credit was so good XXXX gave us {$8000.00} towards the principal of our loan. We 've been trying since XX/XX/XXXX to set up ACH Payments every month. Was NEVER told we could do it online. After the 1st attempt ( sent voided check ) account number wrong. After 3 more times, they failed to read the documents & continued to put the wrong number account number for withdrawal. The 4th time I sent a fax. My bank puts a dummy account number on checks to defer fraud. 3 times I wrote the correct account #, but they failed to read it. They want to charge {$15.00} for a phone payment, {$15.00} for an online payment. I have called more than 10 times! Check the notes! I do n't think they want our money. So now, I 'll snail mail a check every month. They do n't get it? They can have the house. We have NEVER missed a payment since we bought this house XX/XX/XXXX.

Complaint: My father passed away XX/XX/XXXX. I am his only heir. The mortgage company at the time, XXXX, would not speak to me even though I repeatedly sent them the death certificate, will and administratrix paperwork. XX/XX/XXXX my property was affected by the flooding in XXXX, XXXX. The loan had then been transferred to Select Portfolio Service in XXXX XXXX XXXX, XXXX, and so I began with them to explain my father was deceased but that I have been making the payments. They transferred the loan to the Estate of my Father instead of to me even though I asked to assume the mortgage and I am the only heir and supplied them a copy of the Will and Administratrix paper work. They sent me a letter today telling me this loan was included in a bankruptcy my father filed in XX/XX/XXXX ( it was not - and if it was why would we make payments through XX/XX/XXXX?? ) I HAVE to have this transferred to my name in order to complete my FEMA paperwork for damages from the flooding. The law was passed in XX/XX/XXXX that children could assume a parent 's mortgage. What will it take to make these people understand this? I am at wits end!

Complaint: In or about XXXX 2016 I was notified by Select Portfolio Services that I was eligible for a loan modification. I completed the application about XXXX 2016 and began the process of submitting the required documentation. I spoke with the Relationship Manager assigned to my account and many other reps regarding required documentation, took notes and sent the documents exactly as requested. I have been asked to resend the same documents in different formats on XXXX - XXXX occasions since I started the process. Weeks would pass and I would n't hear from them only to find out another document needed to be reformatted and sent in again. The most recent request was to fill out another application which was which is redundant because an application was completed when I initiated the process. This complaint is about the administration of the modification process. I have been in compliance with all requests from SPS and it has been unproductive and not yielded any results to date. My life has been on hold waiting to hear from SPS with a decision and I have not made any financial transactions that might XXXX the process. I am deeply concerned about the deceptive delay tactics that have been used with me by SPS regarding this modification and the reasons why. I expressed my concerns on several occasions with SPS representatives and was told that we are near the end of the process and I just need to submit the requested information and this would be it. It never was " it '' there was always another request.

Complaint: We have been dealing with SPS now for 2 years. We financed a mortgage with XXXX XXXX back in XXXX. There was fraudulent documents used in the closing and was proven to be by banking commission then XXXX bought them and could care less about the fraud than XXXX purchased the loan which they have given to SPS. We have tried numerous times to work this out with every mortgage company switching hands. I did my own appraisal sent it to XXXX and SPS. We have people coming not stop and even at night to leave SPS pamphlets on our door knob and to take picture of our house on our property. SPS has hired a lawyer contacting us trying to foreclose on us even though we were never served papers. I have a minor in the house and the last person that came we called the police and filed a report. Who are these people? How can they try and pursue any thing when SPS does n't own our mortgage and XXXX and SPS does not respond to any letter asking them for a list of questions and concerns concerning our mortgage. Also SPS would not reveal who they were if they were servicing the loan, debt collectors or bought the mortgage from XXXX. All request to XXXX and SPS are sent certified and signature return so I can prove we are doing our part. We have undeniable proof the there was illegal and fraudulent practice involved in making this loan and Banking commission confirmed it in their investigation. I am tired of the threats and living in fear with one of these people coming to the house with my son in the home. There are so many complaints with SPS. They should be held accountable for their actions along with any bank using them. This has been going on with XXXX since XX/XX/XXXX. Thank you for any help and God Bless

Complaint: We received a permanent modification yesterday XXXX/XXXX/XXXX from Select Portfolio servicing with terms that was different from the previous servicer XXXX. We initially was approved for a trial modification with three timely payments from XXXX. During the process were assured by XXXX that once we met all the requirements by making all three payments on time, then we would be given a permanent modification with no balloon payments. Our 1st payment was completed on XXXX/XXXX/XXXX with XXXX. Immediately after making the 1st payment, XXXX transferred the rest of the loan modification process to select portfolio servicing. The XXXX told us that transfer is the right of the Investor. Our Investor is XXXX with XXXX as trustee. XXXX promised us that nothing will change with the new servicer and that they will forward all details of the approved to select portfolio and select portfolio is to follow everything done in agreement between us and XXXX. We were stunned to learn of a balloon payment of {$550000.00} due with accrued interest at the end of the maturity date. added to the final documents. This is not what we were promised by XXXX That is who we made our first payment with thereby agreeing to the rest of the trial period which we completely successfully. CFPB needs to carefully look into this and direct this lenders/Investors to stop breaking these laws that are still in effect to protect us consumers. The terms of the permanent loan modification is only 19years that they gave us. WHY? Is this a loan modification or some type of gimmick. why a balloon payment and moreover accruing interest. This is just to prevent us from enjoying all the benefits of home ownership and to leave something to our children a legacy. See attached documents when areas I have highlighted with side notes. Thank you for your immediate intervention. The new modification expires in 15 days.

The loan was transferred to Select Portfolio Servicing and even-tough my property taxes and homeowner 's insurance have not increased, Select Portfolio Servicing has increased the escrow amount to an additional {$53.00} a month making my total monthly payment to XXXX. I find this very unfair and abusive.

Complaint: SPS XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX CA XXXX We are writing this complaint .... One that we have written on almost every file that we have had over the last 1.5 years with Select Portfolio Servicing ( SPS ). SPS is again dragging their feet on working on this file and has stretched out the file review for an additional 90 days. They continue to claim that each time their request a new document that they automatically give themselves another 30 days to review the file. So it should be no surprise at all that they end of each thirty day period, a new document is requested. This game has go on now for 3 successive months. Escalations of the file within SPS ' system yield no results and it appears that they only two reasons this is occurring is that it allows them to milk more servicing fees out of their dimwitted investors ( who have yet to catch on that anything is even going on on their asset ) and an utter lack of employees. It is very sad, but we have had managers at SPS tell us that they are doing the 'best ' they can, but are grossly understaffed. One can only assume that the chronic understaffing is being done in order to increase their profits at the expense of their investor, the borrower, and the communities in which these properties reside. I humbly request that instead of us having to continually fight to even get our clients documents review and files worked on that the CFPB take administrative action against SPS. Not only is the CFPB 's database filled with complaints against SPS, but a quick XXXX search will provide days .... In not weeks of reading material on the subject of SPS and servicing fraud. We would appreciate if the CFPB could put pressure on SPS to actually review and complete the file that we have submitted.

Complaint: On XX/XX/XXXX I obtained a copy of my credit report from XXXX and noticed that XXXX has allowed a collection agency named XXXX XXXX XXXX to insert in and duplicate a debt that is already listed on my credit report with the XXXX. SO now the debt is listed twice! Different amounts different dates! What is happening is that the original company ( SPS Servicing ) account is near its time of deletion from my report, and they have sold my account to a collection agency in which I have " NO CONTRACT WITH '' and now the debt is listed twice! A clear violation of law! XXXX XXXX XXXX has illegally added this debt to my credit report. Every few months another company buys the debt which now its ( XXXX XXXX XXXX ) reinserts it changes the dates and amounts and list it negatively on my report again. Most recently they have not payment history for the last 2 years but have the debt listed as being open in XX/XX/XXXX and a balance of XXXX as of XX/XX/XXXX. This is NOT true and a total lie in an attempt to ruin my credit. I have NEVER received any correspondence from XXXX XXXX XXXX and want this removed from my XXXX Credit Report asap! This is against the law. They have violated the FCRA Section 623 ( a ) ( 3 ) and FDCPA Section 807 ( 8 ).
