Complaint: PHH Mortgage stopped our automatic payment without notifying us. They also transferred the servicing of our mortgage without notifying us. On the phone they claim XXXX XXXX XXXX sent a joint notification. We never received it. I explained that a company I have no dealings with sending a letter claiming rights to my mortgage payment does not positively prove transfer of service. I requested PHH send a new letter. They refused and told me I had to ask XXXX for the letter. I 'm left with no paper trail positively identifying who we should be paying. We have paid two months of mortgage out of fear. XXXX has sent repeated delinquency notices and information about Foreclosure. Even certified letters. We have been harassed and threatened by this new company. They are happy to send us a letter claiming they have a right to our mortgage payment. But that does not prove they have a right. I must have a letter solely from PHH clearly stating who the services are being transferred to and when. Our dealings with PHH began when XXXX used them for servicing our mortgage. I never chose to deal with PHH or XXXX.

Complaint: Credit report shows zero balance for PHH Mortgage Service Center in New Jersey. In reality, we owe well over {$400000.00}. The credit report also shows that we have not made any payments, in reality we have paid our mortgage in full every month. This erroneous information is preventing us from refinancing our current mortgage. Complaint: Our mortgage was with a company named XXXX. After filing bankruptcy discharged in XXXX XXXX we applied for mortgage modification in XXXX XXXX. After 9 months of supplying information we were approved for the modification. Our XXXX trial payment was due XXXX. We sent our first trial payment to XXXX. They received the payment before the due date as the record shows and cashed our check. Unknown to us, the mortgage was transferred the same day of the due date of the first trial payment XXXX XXXX XXXX XXXX. We were not notified of the trabnsfer until later in XXXX. We sent the next trial payment due XXXX XXXX. to PHH Mortgage they received the payment on time and cashed the check as the record shows. Our third trial payment was due XXXX XXXX. I called PHH on XXXX XXXX. and with the assistance of XXXX XXXX I made the third and trial payment with an ACH check which I will attach showing PHH received it on XXXX XXXX XXXX XXXX and the funds were transferred to their bank account on that date. After much confusing and misinformation by PHH we received the attached letter dated XXXX XXXX, XXXX saying they are honoring the terms of the modification in paragraph XXXX, upon receipt of the XXXX trial payment. They had already received it. We want them to comply with their commitment to honor the terms of the modification. The terms were met. Also the terms of the loan modification state the insurance and taxes are included in our payments as the record shows. This letter states in paragraph XXXX, XXXX failed to inform PHH of the loan modification. They also failed to notify us of the mortgage transfer in a timely manner. Also in the attached letter dated XXXX XXXX, XXXX, she states the record shows we appied for mortgage assistance with PHH on the loan. This is false as we had already been approved. I was asked if I wanted to apply on this loan and I said no as we were already approved. Their is nothing in the record showing we applied for mortgage assistance on loan # XXXX. The statement in paragraph XXXX is false in saying we applied.The " package was incomplete '' because their was n't XXXX. We just want to get on with our lives as this has been going on now for over a year. They need to do what they say they are going to do. Please see attached trial agreement with XXXX showing the XXXX trial payments are due on the first of the month starting XXXX XXXX. XXXX. The letter from XXXX XXXX, XXXX from XXXX XXXX stating they are honoring the terms of the modification. The ach check to PHH drawn from our bank and into theirs XXXX XXXX st. the due date complying with the terms of the agreement. XXXX XXXX told me to send the same amount of the trial payment for our regular payment XXXX XXXX. which we did and it was returned to us. They have said they will accept no more payments. I will also attach the original trial payment agreement with XXXX showing the payments were due on the XXXX XXXX of each month not the XXXX. as stated by XXXX XXXX with PHH.

Complaint: I would like to have case # XXXX reopened and addressed. The authorization was once again faxed ( I have a copy of both the authorization as well as the fax confirmation ) to PHH mortgage on XXXX/XXXX/16 at XXXX. I called again today and once again they have no receipt of the authorization. The number that I called was the number I was instructed to call from a voicemail that I received this afternoon. When I called, I was told that they once again could not help me because of no authorization and that they could not provide me with any information as the loan is in foreclosure and it is with the attorney. The attorney that they are referring to is XXXX XXXX XXXX XXXX XXXX, XXXX. I had previously received a letter from them dated XXXX XXXX, 2016 ( addressed to XXXX XXXX, the " unauthorized 3rd party '' ) mentioning foreclosure in a sentence. The letter also states that a dispute should be submitted in writing within 30 days ( I sent a letter via certified mail XXXX/XXXX/16 to dispute ) and a response will be sent back to me via mail. It is now XXXX/XXXX/16 and the only correspondence I have received is a voicemail from XXXX/XXXX/16 from XXXX at ext. XXXX stating that they had received my letter and I was to call them back. I returned the call that afternoon and left a message for XXXX. I have yet to receive a return call or paper correspondence via mail.
Also on the XX/XX/XXXX mortgage statement it says that " The first notice or filing required by applicable law for the foreclosure process has not been made. '' My original complaint ... Case # XXXX. None of the issues in that complaint have been addressed nor has the dispute I submitted in response to PHH 's response to my original claim been addressed.
I have since my original complaint filed for a refinance of the mortgage solely in my name. I have been denied on the basis of Garnishment, Attachment, Foreclosure, Reposession, Collection, Action or Judgement and Unacceptable Payment record on Previous Mortgage, however the mortgage with PHH is not on my credit report. The bank that I had applied for the the refinance through said that they had contacted PHH mortgage. They were given information regarding the loan. So how could that bank receive information but I can not? Since I am still according to PHH " an authorized 3rd party, '' how could they have been authorized to disclose anything based on my application which was solely in my name?
I am not being helped by PHH mortgage and now they have stood in the way of me obtaining a loan in my name with another bank ( which was approved and I paid for the appraisal ) so that I can keep my house.

Complaint: I submitted a complete Borrowers Response Package on behalf of my clients on XXXX/XXXX/2016. The Borrowers were finishing a Forbearance period upon submission of the package for review of modification and other options. As of XXXX/XXXX/2016, the SPOC, XXXX XXXX at PHH Mortgage Servicing Center reviewed the file with me. She stated that she sees the documents were scanned to the Borrowers file. However, no action has been taken to open a review. I inquired about an Acknowledgement letter being sent to the Borrowers. She verified that one was on the file, but was never sent to the Borrowers. I requested escalation of the file. She stated she will email the Document Review Department. This file was submitted on XXXX/XXXX/2016. It is now 40 days from the submission of the Borrower Response package without being looked at.

For over four years I have been attempting to obtain a mortgage modification under the Making Home Affordable Act of XXXX. I have filed several complaints with this agency against my mortgage company siting many various violations with factual evidence in the Mortgage Modification Process. I have received replies from the mortgage servicing company with various insufficient answers, some of which I officially refuted with this agency. Beyond this, I have not received a reply from anyone to my last complaint filed against my mortgage servicing company..
The CFPB 's mission as stated in its own website is as follows : " We aim to make consumer financial markets work for consumers, responsible providers, and the economy as a whole. We protect consumers from unfair, deceptive, or abusive practices and take action against companies that break the law. We arm people with the information and stepstools that they need to make smart financial decisions. '' CFPB website - XXXX XXXX, XXXX While the CFPB is abundantly aware that for the duration of 4 years of attempts I have made to obtain a mortgage modification, I have not received a modification offer consistent with law and guidelines. But, throughout this process I have been subjected to all manner of violations including fraudulent statements, improper handling, and violations of servicing requirements without one word from the CFPB. Not one action, or word of defense by the CFPB on my behalf.
To further outline this agencies failures to take appropriate action in the face of blatant violations of mortgage servicing guidelines by my mortgage company, please find in the attached file a letter submitted by my attorney to the Chief Council for mortgage company, and to the Attorney General of New Jersey.
Sadly, I am informed by my attorney, that should I end up in foreclosure, that the vast majority of the judiciary in the State of New Jersey, in cases involving foreclosure, has proven itself time and again, to be prejudiced in favor of the banks and not the home owner. The judiciary in New Jersey in foreclosure hearings, has adopted an overwhelming 'need for speed ' to reduce its case load, and thereby consistently withholds indeed ignores any and al serious consideration of well documented complaints with solid evidence of serious violations of the Making Home Affordable Act, and established mortgage servicing guidelines, by the banks and mortgage servicing companies during foreclosure hearings.
The NJ judiciary typically views homeowners such as myself as 'freeloaders ', giving no weight whatsoever to my growing personal liabilities as evidence of cost to me, the homeowner. My personal liabilities grow every day as a direct result of the violations and fraudulent acts committed by the mortgage servicing company.
Six plus years after default, and after 4 of those 6 years of watching my liabilities relative to my mortgage mount, I continue to await any word from the CFPB, and long overdue satisfactory responses from my mortgage servicing company for the many complaints I have filed. During all these years, I continue to sit, wonder, and watch as this agency completely abnegates its responsibilities to me, and paying no attention to factual evidence brought to the CFPB 's attention! No action by the CFPB despite overwhelming evidence of violations presented.to it.
If I lose my home in a foreclosure proceeding, wherein no consideration is given to years of factual evidence against my mortgage servicer, I will be left with the sad unsatisfied feeling of having been ignored by the one agency here to help me - The Consumer Financial Protection Bureau ( " CFPB '' ).

Complaint: To : consumer Financial Protection Bureau re : PHH re-finance mortage application fee XXXX/XXXX/XXXX To Whom it May Concern : Near the end of XXXX I telephoned my mortgage company, PHH Mortgage to investigate re-financing my home mortgage in order to reduce the interest rate and attempt to get my payments lowered. My employment scenario changed in XXXX and I have been struggling to meet the high mortgage. I have demonstrated reliability but was seeking help.
After several lengthy telephone calls giving all the required information they then forwarded a lengthy application with very strict return date guidelines.
The bottom line is that in the initial conversations, I was led to believe that my current salary would be part of the evaluation process. I was encouraged to include documents in the application that demonstrated my new contracts with more hours for this coming year/season. At no time was I told the only my last 2 years of tax returns would be used to evaluate the application final approval.
In the end, after meeting all of their deadlines, and slow-downs, and requests for further documents, even adding my mother as a co-signer and gathering her documents, signatures, etcetera, my application was turned down. PHH wants to keep the application fee.
I believe that I was purposely misled. Everything from long, wearing-you-down-style phone conversations ( in car salesman fashion ), to mis-representing what would be required, to extreme enthusiasm and nearly promising that the loan would be approved, to the extensive providing of documents, even repeats in comparison to the application items, the delaying of their response to those documents, and ultimately delaying a firm answer until their fee had gone through on my credit card. I had been willing to compromise at XXXX point, If they would agree to provide me with a complete copy of the house appraisal and return half of the application fee, I would have accepted. Currently, PHH sees no fault in their action and refuses to return the application fee, which frankly, I can not afford.
I deem this to be under-handed business practice, unethical, unacceptable. My naivety about what would be required for a refinance, is admitted, but certainly, it is not a good enough reason to suffer such business practices.
The fact is that they never told me in the initial calls that only my previous 2 years tax return income would be used. That would have saved many many hours, time, stress.
I seek help in getting my application fee refunded. If there is any education and guidance you can give me in the matter, I would be grateful.

Complaint: Backaround XX/XX/2016 I contacted my mortgage co, PHH Mortgage about re-financing.The original loan was in my husband 's name ( now deceased ) only. I told them I was going to apply {$50000.00} as a down payment. This was a gift from my sister-in-law. I was told they could do the closing XXXX XXXX, & I needed to send them the $ XXXX PLUS my regular payment of {$780.00} before XXXX XXXX. I did. No closing on XXXX XXXX. Then, after I started calling regularly, they mailed me a letter saying they had my closing set for XXXX XXXX. That day came & went. Nothing. So on Monday XXXX XXXX, I called to find out why they did n't close. Said they needed to do employment verification. They had done it twice already. I told them I was getting an attorney to investigate. Next day, I got a call saying they were coming to my house @ XXXX on XXXX XXXX. Never came. Wo n't ans wer my calls. I am a widow. No pension, no social security. Only a job paying {$10.00} an hour. I can barely pay my bills, & only then with help from relatives & food stamps. PLEASE help me if you can. Thank you!

Complaint: I am a PHH customer, Loan # XXXX. I initiated a refinance application in the first week of XXXX XXXX. That refinance application was given the # XXXX. I received a complete packet of documents from PHH, which they needed me to complete/sign and return. I sent them everything they requested except for the XXXX Income Taxes, because we had requested an extension while waiting for the state of Maryland XXXX XXXX to correct a form they 'd sent us for the IRS.
In XXXX, XXXX, PHH closed my loan application and wrote to me saying I 'd closed the loan application ; they also charged me for accumulated fees they had incurred in the the loan process on my behalf.
I had not closed the loan application. In fact I was in communication with the PHH Loan Processor regarding remaining documentation he ( XXXX XXXX ) had requested from me ; I was anticipating the XXXX Income Tax form and it arrived and I emailed it and additional documentation to him on XXXX/XXXX/XXXX.
I contacted PHH to get an explanation and was told by XXXX XXXX and his supervisor, XXXX XXXX, that PHH had closed my refinance application in error, and that XXXX XXXX would reactivate the loan application within an unspecified period of time.
PHH had demonstrated an unresponsiveness to me from XXXX thru XXXX during the initial application period ( XXXX60 days ), but I continued to contact them with emails and phone calls. When they canceled the loan in XXXX XXXX and assured me they 'd be calling me back to update me, I did not wait too long for them before calling/emailing them to find out the status. Days passed with no written update or phone calls from PHH.
I eventually learned that PHH had canceled the loan, reopened the loan, then canceled the loan again in XXXX.
I submitted a complaint to the Office of the President along with forwarded copies of all emails between me and XXXX XXXX over a 2+ month period. After 11 days, I called a XXXX XXXX XXXX in the Office of the President seeking a summary of what she 'd learned during her 10 day investigation. XXXX XXXX XXXX told me the cancellation was the result of my not responding to PHH request for additional documentation ; I refuted that by referring to the emails I 'd forwarded to her almost 2 weeks prior. It seemed to me she might not have reviewed the timeline.
Therefore, I found out who was XXXX XXXX XXXX 's supervisor and on XXXX XXXX, XXXX, I wrote to XXXX XXXX XXXX. He assured me he 'd have the investigation done properly and get back to me with response to my questions, which were as follows : 1. Please tell me what PHH learned thru its investigation about the processing of my loan application?

Complaint: I was contacted by XXXX XXXX, manager of underwriting for PHH mortgage company and he left a few messages on my phone. I finally called him back on XXXX XXXX, 2016. He had asked why I had not filled out the mortgage modification form from the Making Home Affordable program which would give me 3 trial payments and then an official modification. I replied that I had received nothing and that I was not actively seeking help with my mortgage, though I needed it badly. Though I make payments to my mortgage every month, I have been consistently late paying my mortgage and my account being flagged for a modification did not seem that far of a stretch. I had many late fees but never let a month go without making a full payment. I asked him a couple of test questions that only my servicer should know and he was able to answer them. We talked and I asked him some more questions to see if he really had any information on me and that he was who he said he was. When I received the paperwork from him through company email I was convinced that he may be from PHH and actually is offering a modification. The paperwork was spot on and looked like something I would receive detailing the payments and when they are due and what to expect through the modification process. Because I was already late making the 1st mod payment the only way to backdate the 1st payment to reflect on time payments was to wire the money ( XXXX ) to his HAMP manager XXXX XXXX in Indiana. He, XXXX XXXX, informed me that I do not need to make payments to PHH and that any defaults will be cured when all the payments are made and submitted as paid on time through the modification program. ( I was tricked, however not dumb enough to stop making my payments and therefore did not default on my loan ) On XXXX XXXX, I submitted the final 2 payments early through XXXX ( recipient XXXX XXXX in South Carolina ) as well, for a total of {$2400.00}. I was supposed to make 3 payments of {$1200.00}. After all payments were made I was then informed there was a {$990.00} fee that needed to be paid for admin fees. At this point I terminated the call knowing it was a scam. No HAMP manager would ask me for money to do a modification, especially AFTER the trial payments were made. They also stole mine and my wife 's social security numbers. They sounded like they were from XXXX or some XXXX country and they masked their phone numbers to appear like they were calling from my mortgage servicer. The direct line I used to contact them was XXXX, which I believe is now disconnected as of yesterday XXXX XXXX, 2016. I have all documentation and recorded all phone conversations with them.

Complaint: My credit was destroyed by my mortgage company. I have tried to dispute the incorrect I formation online. It started XX/XX/XXXX. I started to fall behind due to divorce, and no help from ex spouse. I was 2 months behind XX/XX/XXXX, went to make the full payment and they sent it to the lawyers. I called their lawyers and they refused payment. They said I had now to do a modification. I told them I did n't need one. They said it was too late and there was nothing I could do. Then I fought with this company for over 6 months doing this modification. My point of contact by email would never respond. I would scan and send all the requested documents. Then weeks would go by with no replys. They would then say my information was outdated and make me do it again. I was served foreclosure papers in the meantime of this mess. Went to court twice, with all of my documents. I started forwardingredients their lawyer everything I sent them as proof I was doing it. This just dragged on. They finally completed their what I feel was a huge scam. I owed close to what the original loan amount was after 9 years of payments. My loan amount was {$82000.00} in XX/XX/XXXX, i owe {$77000.00} now XX/XX/XXXX..HOW?? They just " applied '' over {$1000.00} credit to the account from a review of this mess. Never with any calculations as to how this came about. PHH had a lawsuit against them filed in NJ that I called to join, but was n't returned. It was for the SAME issue. They were told to settle with clients they have done that to. Please help fix my credit. Thank you kindly! This company has not handled themselves in a law obeying manner. Looking back I should have done more to fight. But I was so consumed with the kids after the divorce, and myself an XXXX Veteran who has not faired well since I returned home in XX/XX/XXXX.
