Complaint: I have been working with my current mortgage company, PHH Mortgage, in regards to a loan modification. Back in XXXX of 2016 I was informed that my loan modification had been approved and that my first payment was due in XXXX. I made the first payment as scheduled. In XXXX I received notice that my loan modification had not been approved. I contacted my attorney and that third party company that I was working with regarding this notification and as result, it turns out that the mortgage company had not sent any trial documents and that the loan approval documents had not been sent to the correct address. After receiving all of this information PHH mortgage advised that the loan modification had in fact been approved, the miscommunication of loan documents had been an oversight on their part and to go ahead and send in my payments directly to them. I have now received notice that my home is up for foreclosure with a date and time of sale. I am an XXXX service member, which the mortgage company is well aware of, and have stayed engaged with them in every step to save my home. I contacted my attorney and the third party company for assistance in this matter. Contact was made with PHH Mortgage to discuss this matter and now we are being told once again that the loan modification has not been approved and that my payment has been return ( nothing has been received from PHH Mortgage ). We have asked to speak with my case manager at PHH Mortgage, his supervisor, and that persons supervisors. No one is ever available to assist in this matter. Once again I am in danger of losing my home and also, the tenants that I have living in the home are in danger of being put out. This highly unprofessional and unethical.

My mortgage servicing company PHH Mortgage Services, XXXX XXXX, NJ XXXX. This company has been harassing me and my family for over XXXX months. They call many times daily and they consistently mail threatening letters of harassment & threats. They say I am behind on my payments. However, I have never missed a payment. I try my best to explain to the bill collectors that constantly harass me and my family and sometimes some of them even get it. I mean they can actually see that I never missed a payment. However, that recognition by some, never stops the harassment I receive from all the other PHH collectors. I even have supervisors who are not willing to see that there has been a serious mistake made on my account. This must stop now. PHH Mortgage Services, XXXX XXXX, NJ XXXX. Must take the time needed to fix this ongoing injustice and it most certainly will take someone for the Corporate office to correct and compensate.

Complaint: My husband and I have applied for loan modifications with our mortgage company ( and received them ) a few times in the last few years. The problem is they have n't lowered the payments or interest rate. We recently filed bankruptcy but did not include our home. Our bankruptcy lawyer informed us about the HAMP program and we have a XXXX XXXX loan. Our mortgage company never mentioned this program to us and now are saying we do n't qualify because of our modifications.
Our bankruptcy lawyer suggested contacting you to help take care of this. I 'm certain we would have qualified for the HAMP back when we first applied for a modification and would like to see that remedied. Also, the attorney mentioned that we should n't have had to pay thousands of dollars to receive the modification ( which was required each time ) but we were not aware that they are n't supposed to require that so we had to take out a loan using my husbands XXXX account and because of that, his take home pay is {$800.00} less each month because of the loan payment right out of his paycheck.
I am quite frustrated with our Mortgage company PHH Mortgage as they have not helped us with the financial difficulties but made them considerably worse. Now they are saying we are going into foreclosure again on the XXXX of XXXX Please help.

Complaint: During VA refinancing from PHH ( loan # XXXX ) to PHH ( loan # XXXX ) the closing date was moved by PHH. A XXXX payment was not required as closing was supposed to be XX/XX/2016. Closing did not actually occur until XX/XX/2016 because of repeated delays by PHH. Then, because of the 3 day right of recision and a weekend, the loan did not fund until XX/XX/2016 PHH reported the XXXX payment 30 days late on the same day they funded the new loan. I did not miss any required payments.

Complaint: Upon inception of the refinance mortgage on XX/XX/XXXX for which PHH dba Coldwell Banker Mortgage was designated as the lender, and XXXX ( hereby " XXXX '' ) as the mortgagee and nominee, my taxes and insurance were not part of an escrow for I paid those items on my own, and paid to PHH principal and interest in the amount of {$1300.00}.
On XX/XX/XXXX, upon entering into a modification prepared by PHH that consisted of a XXXX loan number, my taxes and insurance were not part of an escrow as with the original transaction.
Then, without any legal authority or justifiable reason, PHH forwarded to me a correspondence dated XX/XX/XXXX acknowledging receipt of my modification payment of {$600.00}, and demanded an additional payment of {$990.00} for taxes and insurance knowing that taxes or insurance were ever part of an escrow with the original transaction or the modification, and that my taxes and insurance payments were both up to date.
On XX/XX/XXXX, PHH commenced the last of XXXX illegal foreclosure debt collection actions in the Superior Court of XXXX by falsely declaring itself the owner and or party in possession of the original mortgage loan by using a falsely uttered instrument titled " assignment of mortgage '' in which XXXX is declared the nominee for PHH and the assignor, PHH is declared the assignee, and the instrument displays the name and alleged signature of attorney XXXX XXXX XXXX of XXXX XXXX XXXX XXXX, XXXX. of XXXX impersonating an officer of XXXX, and a false notarization by the law firm 's employee XXXX XXXX who is a XXXX notary public.
Furthermore, within the foreclosure complaint filed in XX/XX/XXXX, PHH falsely declared : " The Mortgage contains a provision that, together with, and in addition to, the monthly payments of principal and interest payable under the terms of the secured Note, the Mortgagors will pay the Mortgagee, on the first day of each month until the note is fully paid, a sum equal to XXXX of the annual taxes and insurance premiums that will next become due, which shall be applied by the Mortgagee to pay the taxes and insurance on the premises. " ... On XX/XX/XXXX, the mortgage went in default. An installment of principal and interest, insurance and taxes was due and has not been received by the plaintiff. ".
Hence, PHH knew or should have known that the asserted default as of XX/XX/XXXX for which they alleged included an " installment of principal and interest, insurance and taxes ... '' is false because from the inception of the disputed undertaking dated XX/XX/XXXX and the disputed " balloon modification '' that I signed on XX/XX/XXXX, the " installment '' demanded by PHH was for " Principal & Interest '' only, not insurance and taxes, for I paid the latter items without an escrow and remained timely on both payments to the municipality and insurance carrier.
As of present date, PHH is continuing to pursue the unlawful foreclosure of my home asserting the aforementioned misrepresentations, using the aforementioned false evidence, and concealing that PHH is not the owner of the mortgage loan in dispute which has since been sold to a XXXX guaranteed trust entity.
Furthermore, the unlawful tactics of PHH set forth above resulted in the latter wrongfully reporting me delinquent to the credit bureaus for a false default declared by PHH as of XX/XX/XXXX, that is based upon their misrepresentation that I failed to pay the full amount due for which they included taxes and insurance, items which were not part of the original transaction in dispute or the modification, and items that I always made timely payments to the municipality and insurance carrier.

Complaint: My wife and I bought our home in XX/XX/XXXX with an adjustable rate mortgage loan for {$220000.00} through XXXX. This loan was eventually sold to PHH Mortgage, and we are having a problem with this company. Due to unexpected hardship and an increase in the payment due to the interest rate adjusting I missed some mortgage payments. We began trying to work with PHH Mortgage to fix this issue and be considered for modification or other programs they had available. We received letters from PHH Mortgage telling us that they wanted to help and work with us. However, when we tried to follow up with them via phone we found the opposite to be true. We were transferred from one department to another. We were never assigned a single point of contact. We were given conflicting information, and led to believe that there was no help available, even though other representatives and letters from PHH led us to believe that there was help and that we qualified. Besides being confusing it was painful because we fell further and further behind on the loan because of the obstructionist tactics of PHH Mortgage. We are now in foreclosure and PHH is preparing to set an auction date of our home. I served my country proudly as a XXXX and paid on this loan for over 10 years. They have collected thousands of dollars in interest and principal payments from me, and now they are refusing to give me the chance to fix this problem and save my home.
We had no issues paying on this loan for the first 10 years, and even after I retired from my position as an Industrial Designer we were able to afford the payment. We ran into trouble in XX/XX/XXXX when I began having some medical issues that required large co-pays. The issue was exacerbated when PHH Mortgage began servicing this loan and the interest rate adjusted and our payment went up almost {$300.00} a month. We hung on as long as we could, but eventually started missing mortgage payments. Not long after that we attempted to initiate communication with PHH Mortgage to be reviewed for a modification. My wife was and still is working full time, and I was receiving SSI, so we had income, but due to our hardship and adjusting rate our payment was no longer manageable.
We believed PHH when they sent us letters stating that they intended to help, that there were programs available for people in our situation and eagerly anticipated working together to restructure and modify our loan. However, we were sadly mistaken. I feel the least they could do is give us the opportunity at resolving this matter. Instead we talk to a different person every time we call and we have never made any progress in getting a review for options conducted and face the real possibility of losing our home to foreclosure.

Complaint: I am filing a Complaint against PHH Mortgage Corporation for the way they handled my request to refinance my mortgage. The lack of expedient handling of the whole process can be best demonstrated through the use of a time line which will reflect numerous delays.
*TimeLine will be attached as a supporting document.
On analyzing the TimeLine you will see that just looking in multi-day gaps of no action there were 105 days of delays on the part of PHH. This as part of a process that most mortgage companies will require 45 - 60 days tops to close or deny a loan, PHH took 204 days ( still could not complete the process ) and still were requesting more documentation. On day 204 they informed me of a second rate increase from XXXX to XXXX to XXXX and they requested additional documentation. At that point I requested that PHH honor the previous rate quote and I was told they could not / would not honor the previous rate because the delays were my fault as I did not provide the requested documentation in a timely matter. I told them I had no desire to move forward with the process as they did not seem to be any closer to closing and approving the refinance than we were back in early XX/XX/2016.
I should remind you PHH has been my mortgage holder for 15 years ; therefore, it is not as if I was an unknown applicant with no credit history. If this is how they treat long term customers I can only imagine how they will treat a new mortgage applicant.
This was compounded by : not returning phone calls, ineptitude of the processing group to know what they " really '' needed to process the loan, originating group basically washing their hands of the process but acknowledging the incompetence of the underwriting group, the customer service department taking a complaint but telling me they were not going to do anything about it, that if I really wanted to file a complaint I needed to do it in writing because the 'real ' complaint department would not take phone calls?
After spending seven ( 7 ) months trying to refinance with the mortgage lender, to whom I have paid my mortgage for the past fifteen ( 15 ) years I have come to the conclusion that their system has totally broken down. Or maybe it was a conspiracy against me and PHH going out of their way to delay the process and not have to honor the original rate quote of XXXX. Whatever the reason I truly feel that they have impacted my life and my ability to secure the best rate for a new mortgage. I was tied up in their process for 7 months just to walk away from an incompetent lender with nothing to show and my mortgage not refinanced.
I hope I have established a pattern of delays and incompetence on the part of PHH with my timeline, summary and attached documentation. Possibly the delays were contrived by PHH to deny the XXXX rate and if that is the case they accomplished their goal.
Now to add insult to injury I have received a letter informing me that PHH will be assessing a fee ( no dollar amount given ) to my credit card since I cancelled the application. The audacity of this group is unbelievable! They demonstrated that they did not possess the intellectual capacity to close the deal in a reasonable amount of time ( 204 days ) and now I am going to be further penalized because of their " total '' incompetence. What recourse do I have?
I am not sure what can be done for me and my refinance process but the shoddy performance on the part of PHH should be addressed by some authority who has more leverage to address this performance and hopefully prevent a similar situation happening again. This has been a totally unacceptable conduct on the part of PHH.

Complaint: I assumed a loan from PHH mortgage. The original loan amount was XXXX. I assumed the loan in XXXX, at that time the insurance changed from XXXX to XXXX It was part of closing, the amount of the payment changed also, It was appx. XXXX. I began to pay an even XXXX In XXXX the mortgage company sent out an escrow statement indicating that I had a shortage because the insurance had changed. The insurance did not change in XXXX. The amount of the payment had already changed. They then asserted that the payment would be XXXX. I disagreed and requested they audit the account. The change in the insurance was appx XXXX and had been included in the closing and the payment of the loan so any shortage was a mistake on their end. Also, a XXXX change would not initiate a XXXX, which is indicated if the amount of the monthly payment is changed by XXXX as they assert. Their response was that their analysis was the audit, it was right, and there was no need for an additional audit. They then began calling the previous borrower that the loan was assumed from regarding this issue instead of working with me to resolve it. They sent me a letter of default indicating that the mortgage is behind two payments which it is not. I contacted them again, and they said they will initiate an audit for XXXX but can not halt the change in payment until the audit is done because they are sure that it is right.

Complaint: PHH Mortgage is giving me the runaround on dropping my PMI. They keep telling me I need to be at XXXX % of my purchase price instead of XXXX % of my appraisal value. I am literally {$870.00} dollars away from being at XXXX % of my original appraisal value. Every time I speak with someone and ask them if I make a {$900.00} payment today to drop my PMI all I get is the run around. I have spoken to many people in refinance business and on this site and everything they are telling me is untrue. I offered to make a {$900.00} payment immediately to drop but then I get put on hold for XXXX minutes each time and they literally repeat the same conversation we just had. I am currently waiting for a higher up supervisor to call me back because the lady I last spoke with was of no help from the XXXX.
