Complaint: I have called to get help with getting my payment cought up i do not want to lose my home an all i keep getting is that thay can not see my email or the documents i send an i keep getting farther behind an its almost to the point where i thank thay are not going to help. Complaint: I have a mortgage with PHH Mortgage Service that includes an escrow account to pay my insurance and taxes. ForXX/XX/XXXXI prepaid my taxes on XX/XX/XXXX for the amount of {$3300.00}. I reported this to PHH and faxed them a copy of the receipt and statement on XX/XX/XXXXper their request, to complete a re-evaluation of my escrow account. PHH does not dispute that I have prepaid the taxes, and that there are no property taxes due now until XX/XX/XXXX.
By XX/XX/XXXXthere will be a water/sewer tax of {$230.00} due along with a water tax of {$140.00}. Both are paid from my escrow account. In XX/XX/XXXX there will be an insurance bill due of {$1400.00}. These total {$1800.00} for the 12 month escrow period of XX/XX/XXXX through XX/XX/XXXX as calculated by PHH. They do not dispute this.
To pay the required amounts to cover those per 12 CFR part 1024 ( Regulation X ) 1024.17 Escrow accounts I would need to pay an escrow payment of {$150.00} per month, and the cushion/minimum balance should be no more than {$300.00}.
PHH has sent me a statement saying that my minimum escrow payment is {$420.00} per month with a minimum cushion of {$850.00}.
I explained to the tax expert, a customer service representative, and then a manager named XXXX XXXXXX/XX/XXXX( sp? ) that if I paid that amount, I would have a surplus of {$3300.00} by the end of XX/XX/XXXX the end of the 12 month calculation period. They do not dispute this and it is clearly shown on the escrow analysis they sent.
They claim I must make those payments and have that surplus per XXXX ( sp? ) regulations. They did not explain the regulation but XXXX and the other two people both kept saying it was due to those regulations.
XXXX gave me the option of petitioning to be removed completely from my escrow requirement, or to continue to pay the excessive amounts and then request an off cycle escrow analysis after XX/XX/XXXXto get a refund of the excess amount built up by then.
I do not want to be removed from my escrow requirement, I want PHH to continue to manage that as they should. I do not want to pay almost {$300.00} excess to PHH every month and then request a refund in XXXX and then another every few months until XX/XX/XXXX. I want to pay the proper amount for my escrow as defined in the CFR regulations.
I fully understand that in XX/XX/XXXXthere will be a new analysis that will show that my escrow deposit has to increase back to over {$420.00} per month to cover the taxes due in XXXX and XX/XX/XXXX. There are no property taxes due until then though, and those are well over the 12 month calculation period.
Please help explain to PHH that they are collecting far too much. Their own paperwork shows the surpluses and even the FAQ they sent says How did we calculate my new escrow payment? We list all possible disbursements or expenses such as property taxes or insurance premiums to be paid on your behalf for 12 months. We take the total and divide the amount by 12 payments. Total anticipated disbursements divided by 12 payments equals the monthly escrow payment.
If that were true in this case it would match the CFR regulations, but {$1800.00} divided by 12 is {$150.00}, not the {$420.00} that PHH says is my required escrow deposit.

Complaint: The home at XXXX XXXX XXXX XXXX, XXXX XXXX, Arizona XXXX was purchased with a loan though XXXX XXXX, ( no Doc. / Adjustable ), with the payments made to XXXX XXXX XXXX. There was never a late payment for over 7 years. My family developed financial issues due to medical difficulties and I ended up defaulting. I advised XXXX representatives that I was interested in finding a solution. For many months I worked with their representatives providing many, many documents, bank records, Veterans info etc. Finally, following months of discussions I was told that the foreclosure was cancelled and that I would receive a new loan opportunity. That was on a Monday. the Tuesday, following that Monday 's discussion, I answered the doorbell to be met by a sheriff telling me that there had been a Trustee 's Sale that morning and that I had 48hrs. to vacate. I contacted XXXX and they stated that there had been a mistake and that they would get back to me. four days later I called the XXXX representative I had been speaking to and she advised me that there was nothing that could be done. I subsequently moved. The loss of the home caused a fracture of my marriage and a significant loss of potential equity.

Complaint: On XX/XX/XXXX I sent a check # XXXX in the amount of {$22000.00} to PHH Mortgage to pay off my mortgage in full ; I used their own online payoff calculation tool to get to that number, I even included an extra five days to cover any mailing delays. On Monday the XX/XX/XXXX I received a form letter from them and my returned check stating that " Certified funds are required for payoff. '' It seems ironic that over eight years I sent them over 90 personal checks that were always perfectly acceptable to them, not a single check was ever late or overdrawn, I have a perfect record with PHH. This is some sort of a scam or a hustle to prolong the loan by a few more weeks in order to continue to bill a consumer for phony interest charges. This game of theirs cost me an additional {$37.00} in interest and an additional {$25.00} charge by PHH to process the wire transfer. {$62.00} may not seem like a lot of money to you, but if this is their business practice and they are doing this to thousands of consumers then the numbers do continue to add up ; much like XXXX XXXX and XXXX this is a dishonest and deceptive business practice. PHH should be inspected and fined for its business practices.
BTW ; I made three separate, lengthy and highly frustrating phone calls with PHH before filing this complaint.

Complaint: This is the second complaint Ive filed with this agency. My original complaint # XXXX was closed after one response from PHH Mortgage. The company explained that they had made an error by not posting my mortgage within the 24 hour period in which they received it. Since the date of PHH Mortgage response, a second mortgage payment was sent by me via the XXXX priority 2 day mail. I have the receipt showing PHH Mortgage received the payment on XX/XX/XXXX. Once again PHH failed to post this payment until XX/XX/XXXX.. I reiterate my original complaint that this is not an isolated incident with PHH Mortgage. I would like another explanation from PHH Mortgage. I am also asking that this agency leave this complaint open. Im having difficulty believing mine is an isolated occurrence with PHH Mortgage. It is also XX/XX/XXXX and I have yet to receive my interest statement from PHH Mortgage for tax purposes. It is my understanding that mortgage companies are required to send consumers the interest statement by XX/XX/XXXX of each year. I had the same problem with PHH in XX/XX/. I finally had to contact the company to request a copy of my interest statement. That of course caused an additional seven day delay to my being able to file yearly taxes. The same is occurring this year.PHH Mortgage fails greatly when it comes to legal requirements set forth by the state of Illinois and the government in general. Please contact me if copies of all my receipts are needed for verification of my complaints. If this agency is not able to help legally with these allegations I would like some direction as to my next step. PHH has yet to correct the dates of my mortgage payments on my credit report. PHH Mortgage does not allow a consumer to make a late mortgage payment via their website. PHH Mortgage does not allow a consumer to make a late mortgage payment via the phone. The consumer is at the disposal of PHH posting the payments as PHH Mortgage sees fit to do so.

I have one 30 day late and from I understand this should not be reported on my credit report because I am no longer financially responsible. This has caused my credit to drop by 30 points. It is illegal to report this information as I am protected by the bankruptcy.

Complaint: My Mortgage company PHH, located in New Jersey sent me a letter stating that due to my equity in my home ( {$300000.00} ) and my excellent credit I qualified for a refi at a terrific rate, please call. I called because this would also pay off my bills. I talked with an agent XXXX XXXX. My main question was " whats the interest rate '', I believe currently I 'm at 3.84 %. He had to have my SS number which I hated because it will show on my credit report. He looked and came back with a little over 4 %. I agreed to proceed. He asked for a credit card number which rattled me. Why? He said in case I DECIDED TO DROP out of this offer it covered their costs. I asked him again to be sure we were clear. He then forwarded my info to a XXXX XXXX who asked for all kinds of forms - the normal forms. I receive Royalties for lease and gas/oil in the state of Oklahoma. I get XXXX 's but getting a contract showing what I would receive for the next three years was near impossible. No one understood what I was talking about. SO I informed XXXX if they had to have this and I would be rejected to be sure to remember I was told that I would not be charged the {$730.00} fees on my card. She never answered me on that question/statement. I have all the email 's as proof. I was charged yesterday on my credit card. I wrote XXXX stating why? I also have not received anything in writing that my refi was rejected. She wrote that my refi was denied because of the inability to get continuance on my royalties. Even a job can not give continuance. What I did receive from PHH was another letter stating that due to my excellent credit and equity in my home I qualify for a loan on my equity. What kind of scam is this place running??

Complaint: PHH is the servicing company for XXXX, which holds the mortgage.I tackled with PHH in XXXX 2017 about paying my property taxes early, due to the new tax laws. They advised me to do so and then send them separate receipts for each quarter paid (I paid two quarters) via fax and then to follow up by phone two days later. They also advised that 10-days after my call they would be able to review my escrow account and return any overpayments to me.I followed the above procedures and asked for an escrow review. PHH advised me that two-days after my call they mistakingly sent payment to the XXXX XXXX XXXX for quarterly taxes and that I would have to wait for the money to be returned before they would review my escrow and return funds.The net is, they have asked me to fund their mistake and have been completely unresponsive, either not calling back for days or simply putting me off. I have gotten nowhere with them and would appreciate your intervention so that they immediately return the funds with interest credited from the day they removed them and, accordingly, review my escrow and return the overage.Thank you for your assistance.

Complaint: I suffered an insurance loss and promptly reported the loss to both my insurance company and my mortgage company. The first payment for replacement of cabinets, painting and drywall was issued to me with no problem. The second part of my claim pertained to my wood floors. My insurance company allotted me funds for a full replacement of all flooring in my downstairs however my floor contractor was able to replace/repair only what was damaged which resulted in a much small amount. My mortgage company is refusing to release my funds to me even though all repairs have been completed and the inspector from the mortgage company has approved all repairs. Per the terms of my deed of trust, once all repairs are completed and approved funds are to be released to me. I may or may not decide at a later date to have more flooring replaced however all repairs have been completed to the satisfaction of the mortgage company inspector.

Complaint: InXX/XX/XXXX I contacted PHH Mortgage to see to see if I would be able to do a short sale for a significantly underwater co-op apartment that I owned. At that time, I vacated the apartment, kept it in good condition and wanted to continue to make payments to PHH until such time that the short sale process was concluded.
The PHH representatives directed me to fill out an application packet, which I quickly did. Although the application, which I provided, was complete, they incorrectly asked for additional irrelevant information, which delayed the process for several weeks.
After PHH acknowledged the information I provided was accurate, I received a letter in late XXXX XXXX, stating that my application was denied because I was not eligible to be considered for a short sale.
In early XXXX XXXX I wrote/called PHH to understand why I was not eligible for the application and was told because I was up to date on all of my payments ( to be clear I NEVER missed one payment in 14 years ).
I was told that my application would not be considered as long as my payments were current. I explained that if I ceased payments, it would kill my XXXX credit score and furthermore was not what I wanted to do because of how the damaged credit score would hurt me with other personal/business matters.
After hearing from PHH that there was no other way to proceed, I stated to PHH ( on their calls which they record ) and via formal follow up written and electric communication ( which they received ), that although I completely disagree with their forcing me to do this, I would temporarily cease payments as they instructed ONLY if they accurately reported that I was not making payments solely because of their forcing me to do so as opposed to PHH stating that I was temporally suspending payments as my sole discretion.
Furthermore, I stated verbally and in writing to PHH that I would consider such reckless disregard to comply with this as bad faith and that I would be irreparably harmed. I received NO RESPONSE TO THESE LETTERS DISPUTING MY POSITION.
Thereafter in late XXXX, I received payment notices and calls requesting payments. I responded to all PHH calls and letters with my position, asking for a supervisor to confirm. I received NO RESPONSE TO THESE LETTERS DISPUTING MY POSITION.
In late XXXX, I was monitoring my ( and my wife 's credit score ) and noticed that there was a negative inaccurate notices from PHH. Once again, I called and sent letters asking for a PHH supervisor to contact me and I received NO RESPONSE TO THESE LETTERS DISPUTING MY POSITION.
In early XXXX XXXX, I separately was in the process of obtaining a loan from a separate bank and was denied because my original XXXX ( which had me pre-approved ) dropped to XXXX SOLEY BECAUSE OF THE INACCURATE DELINQUENCY NOTICES PROVIDED TO THE CREIDT AGENCIES BY PHH.
When I explained to them what happened, I was told this was a predatory lending practice by PHH and if their bank were to do so they would be sued and fined.
I have now been irreparably harmed by their predatory lending practices and can not get PHH to engage on cleaning up their mess.

Complaint: PHH Mortgage Corporation, Plaintiff VS. XXXX XXXX, Defendant XXXX County Previous case # XXXX, dismissed New Case # XXXX on XXXX/XXXX/XXXX, now changed to XX/XX/XXXX because the attorneys say they did not get a copy of the Motion to Dismiss that I sent them.
PHH started a case against me for foreclosure in XX/XX/XXXX, which was dismissed and now they started a new one about a year later in XX/XX/XXXX. As my document shows, PHH Mortgage shows they sold my loan to a company called XXXX in Florida In XX/XX/XXXX. XXXX shows that they are still, however, the servicer, meaning they collect the payments but no longer own the loan.
I have always made my mortgage payments, never missed a single one until I was advised by the company to skip payments and go through a trial payment process. I followed everything PHH told me to and now I am having to fight for my familys home. As the trial payment letter states I was to make 4 payments for XX/XX/XXXX- XX/XX/XXXX, which were all made on time and collected by PHH . I even made 1 additional payment in XX/XX/XXXX because I had no response from the company on what else to do and I could not reach anyone by phone after multiple tries. The next letter I received showed that they were returning some of the money I paid. I received a check for {$2000.00}, and was told that no more payments would be received and I now needed to pay the full loan balance or my home would be foreclosed on. The checks were cashed months before and were sufficient to make a regular and/or trial payment, but the payments were never applied.
During my trial payments I was continuously receiving foreclosure notices saying they were not receiving payments, although my checks were being cashed and when I called and was able to reach PHH, they told me everything was fine and they payments were received and the notices were sent by mistake.
In the first case, XXXX, the case was dismissed because PHH had sold my loan indicated by the letter they sent me. Now, they come back in XX/XX/XXXX7 with a similar case, but documents are changed. There were 3 pages to my original note which are indicated by the numbering at the bottom of the document. 2 pages with the title Allonge are now added. Both Allonge pages are both signed by XXXX XXXX, Assistant Vice President of PHH Mortgage. The 2 additional Allonge pages have falsely been created and added by the Plaintiff to show some type of transaction, but they show no date to when this transaction happened. An allonge is only added to an original note when there is not sufficient room on the note, this is not the case with these 2 added pages. These Allonge pages were falsely added by the Plaintiff to mislead the court.
There also appears to be an alteration by another Assistant Vice President of PHH Mortgage Corporation, XXXX XXXX, to the note on page 3. This was not on the document in the first case, as a matter of fact, in PHHs Response to motion to dismiss Plaintiffs Complaint, the attorneys state that The Note executed by the Defendant in favor of the Lender has not been endorsed in any way.
Further, PHH has submitted to the court of XXXX County, Oklahoma, a Corporate Assignment of Mortgage PHH Created the document and has submitted the document to the court in XXXX County, OK.
The document is created by XXXX XXXX, an employee of PHH Mortgage The assignment happened on XX/XX/XXXX after the sale of the note from Plaintiff to XXXX on XX/XX/XXXX. The alleged assignment in XX/XX/XXXX shows it to be between XXXX, the defendant, and the Plaintiff from the original mortgage document dated XX/XX/XXXX. This date of XX/XX/XXXX happens to be just before the execution of the previous case by Plaintiff on XX/XX/XXXX. This course of events does not make any sense, if the loan was sold to XXXX in XX/XX/XXXX, how is there an assignment 2 months later in XX/XX/XXXX allegedly giving some right to the Plaintiff from the original date of XX/XX/XXXX?
XXXX is not a party to my case and XXXX has no financial interest in my mortgage.
