Complaint: I have a mortgage loan with the PHH mortgage Corporation, their payment processing center is based in XXXX, PA. Their mailing address is PHH Mortgage Corporation , Mortgage Services Center , XXXX. XXXX XXXX, XXXX, PA XXXX. The problem is this I have been sending my payments each month in the form of money orders to this address and it always reached on time for the XXXX of each month and even before that. Recently as far back as XXXX, 2018, they started sending me late payment notices stating that my mortgage payment was late, and imposed a fee of {$31.00}, whenever they claimed it was late. However, I send in my mortgage payment by theXXXX of the previous month for the next month to ensure that it is on time. E.g. on XX/XX/2018, I mailed the payment from my neighborhood in XXXX, N.Y., for XX/XX/2018. I went to my post office to find out how long it takes for a letter to reach Pennsylvania from XXXX, N.Y., the clerk told me it takes 2-3 days for the most, and look how many days in advance I have mailed the payment. Also I include {$20000.00} extra each month to lower the principle, so I believe they are deliberately holding back my payments to give me a late charge! In previous times, they have taken

Complaint: My husband and I recently just got a loan modification through our mortgage company. Because we were struggling to make ends meet. And wanting to keep our home and not wanting to be foreclosed on so are mortgage company made us think that a loan modification is our only option and forced us into a ridiculously high numerous fees charges loan modification or we lose our home to foreclosure.. and this loan modification has put us in so much financial stress and it all started from our mortgage company and Ive already filed a complaint about this with our {$580.00} insurance premium that went missing back in 2015 that was supposed to be paid to XXXX XXXX.. We are getting nowhere with our loan through our mortgage company because our mortgage company doesnt want to work with their customers with American people that have families and that have lives and a mortgage company like I have my loan through does this to me and my family. And will not address any of my concerns regarding my loan or my loan modification agreement my escrow account my homeowners insurance anything that has to do with my loan from top to bottom my mortgage company will not address my concern at all. And so I now doing my own research know that this is not my only option to keep my home for myself and my husband and my kids and Im not going to stop until I get the justice we deserve weve been with this mortgage company for 10 years weve suffered for 10 years from day one with this mortgage company they are nothing but dirty crooks that dont care about American people.. this mortgage company uses fraud and kickbacks to get what they want from their customers loans. Complaint: PHH Mortgage has made false entries on my account and PHH Mortgage needs to complete a forensic audit of my escrow account. In XXXX PHH began servicing my loan. I have a Customer Account Activity statement that shows {$350000.00} in escrow disbursements. The DC Office of Tax and Revenue has provided me documentation to show receipt of {$190000.00}. PHH transferred my loan to XXXX in XX/XX/XXXX. Prior to transferring the loan, PHH documentation shows 15 disbursements of {$320000.00} between XX/XX/XXXX to XX/XX/XXXX. The D.C. Office of Tax and Revenue only received {$160000.00} in payments during this period. On a single day, XX/XX/XXXX, PHH made 11 entries on my account totaling {$150000.00}. All of these payments are listed as Payment of City Tax with the exception of one disbursement which is titled Special Disbursement. The DC Office of Tax and Revenue has not received any of these payments. I am suspecting false entries and falsification of information. Eight of the XX/XX/XXXX are duplicate entries with duplicated dollar amounts and the Office of Tax and Revenue did not receive any of these payments. Further evidence of escrow fraud is demonstrated by lack of escrow disbursement activity in XXXX, XXXX, XXXX. For these years, my payments were escrowed for taxes ; however, no tax payments were made. InXX/XX/XXXX, PHH completed an escrow analysis and increased my payment to ~ {$18000.00} per month from a previous payment of XXXX {$2200.00}. I suspect this action was to force my property into foreclosure with the false payment entries. Finally, during the years that I was making escrow payments and my loan was current ( XXXX ), my account incurred {$61000.00} in interest and penalty charges. In addition to resolution of the false escrow account entries, PHH owes me a refund of this amount since they failed to make the tax payments ; however, they refuse to address this issue. All of this questionable activity occurred before I stopped making payments inXX/XX/XXXX. The loan was transferred to XXXX in XX/XX/XXXX.

Complaint: My mortgage was sold to PHH bank from XXXX XXXX XXXX in XX/XX/2010. I have not been late in paying my mortgage which is due on the XXXX of the month with a 16 day grace period.
XXXX bank has bee contacting me every month on the XXXX of the month informing me that my mortgage payment is late, when it is not.
This has become a constant with these people, which is quite bothersome and a harassment to me. I feel they are trying to DAMAGE my credit by constantly calling me about my mortgage- which has been paid on time.

Complaint: I called PHH Mortgage Services, my mortgage servicer, on XX/XX/XXXX requesting to cancel my PMI since I am at 79 % on my loan to original loan value. They stated that they would send me the packet for cancelling PMI and it would be received at my house within 7 to 10 business days. As of XX/XX/XXXX ( 14 business days after my call ), I have still not received my packet. This is the second time I have tried to cancel PMI and both times they have slow played the process and used sketchy business practices to keep their PMI proceeds coming in. The first time was in the summer of XX/XX/XXXX. We purchased our house with 10 % down and then completed approximately {$40000.00} worth of renovations to the kitchen and flooring of our home that we purchased for {$180000.00}. In addition, the approved appraisal of our property used to close our mortgage loan in XX/XX/XXXX was for {$230000.00}. After 2 years of on-time payments, I followed the process to remove PMI based on the argument that the money we had put into the house plus the equity we started with according to the appraisal they approved at closing brought us below 80 % of the home 's value. As part of the process, we were required to allow an appraiser that they selected value our house to ensure that our loan balance was less than 80 % of the home 's value. Shockingly, the appraiser they selected determined that our house had gone down in value from {$230000.00} at closing in XX/XX/XXXX to {$200000.00} in the summer of XX/XX/XXXX even after we put {$40000.00} into renovations. The number that their appraiser came up with was mysteriously about {$4000.00} less than the value we needed for the home to be able to cancel PMI. I sent in a detailed report stating why I believed that his value of our home was incorrect and I was denied any kind of serious follow up from the mortgage servicer. PHH mortgage is clearly trying to use every trick in the books in order to keep their precious high margin PMI in place.

Complaint: On XX/XX/2016, I accidentally paid my mortgage twice in the amount of {$1900.00}. I reversed one of the payments because I can not afford to pay my mortgage payment twice in a single month. They assessed a non-sufficient fund fee of approximately {$50.00} even though the payment was not late and I've been fighting with them ever since to have this fee reversed. I've called and emailed them multiple times and none of them seem to understand the issue or how to resolve it. They've told me multiple times that someone would call me back but they never do.

Complaint: We closed on our home XX/XX/XXXX with a perfect payment history even with my husband losing his ability to work due to his health. Then in XXXX of XXXX came Hurricane Irma which caused a financial hardship and a trickle down effect. We live in a very strict HOA and had to take care of trees and shrubs immediately. This along with the care of my husband took a huge toll on us, he did not have medical Insurance until XXXX of this year so everything was coming out of our pocket. When things calmed down from the hurricane we called our mortgage company PHH MORTGAGE and ask for help, they offered us three options one being A FORBEARANCE, A REFINANCE, OR A LOAN MODIFICATION. We ask PHH MORTGAGE to put everything behind on the back of the loan which the said they would do. We received a new coupon book with a lower payment that was to include PITI our payment was to start XX/XX/XXXX in the amount {$980.00} for XXXX, XXXX & XXXX then we had a 30 day grace for XXXX with a new modification and new payment of {$920.00} everything included. No mention of any shortage during the whole process of modification. PHH MORTGAGE contacted us after the closing documents were signed and said they now needed more money for escrow and taxes. A REAL ESTATE ADVISOR highly recommended that we investigate our mortgage due to the thousands of illegal loans and modifications done by PHH MORTGAGE where they did not follow Service Rules and they are still under indictment.

Complaint: On XX/XX/XXXX I received a call from PHH Mortgage Servicing that I had not made my XXXX payment, and demanding payment plus a late fee immediately over the phone. I knew my payment had been sent via ACH on XX/XX/XXXX. the agent verified they received the funds on XX/XX/XXXX, but stated they had applied them to my principle, and again demanded payment. I explained again, she claimed I failed to make the full payment, so they applied it to my principle. She refused to provide a Supervisor when I asked for one repeatedly. The claimed my payment had gone up due to my escrow, even though my escrow was refunded for an overage. So, once again, they have messed up my escrow and raised my monthly payment without notice, or reason, since my taxes and insurance premiums have NOT increased! I am beginning to believe they are putting these extra payments in THEIR pockets, since they can not or will not explain WHY my payment increased by {$60.00} per month. Their Tax Dept confirmed they have the wrong tax amount XXXX it's too high ) but only by about {$100.00} annually. Their tax dept is researching, but can not explain the higher payment either.
