We got in to a predatory lending .We got the home in XXXX for XXXX paying XXXX XXXX XXXX XXXX a month we been ask for a mod but in XXXX the rear was XXXX the home they started to foreclosure on it I filed a bankruptcy to stop and keep ask for a mod they told me to pay XXXX I pay it for 3 months then the cont. to persuade the foreclosure and refuse take the next month in XXXX they file again I filed a bankruptcy again the start cont to file and then in XXXX while Im still ask for the mod we keep filling bankruptcy and keep asking for the mod summit document after documents no answer we never had a day in court because we in bankruptcy the bankruptcy was discharged in XX/XX/XXXX and the court give them a sale date for XX/XX/XXXX now the home is to be for sale on that date the home has change lender able loan serving, littion loan services, ocwen loan serving now PHH loan servicing and they just send me help paperwork out XX/XX/XXXX and I just get home for the hospital try contact the wit HUD counselor On today and they refuse to help the still say we own XXXX in rears and we never pay or their no loan of a payment of XXXX it was XXXX and the give us a loan mod for XXXX at 2 percent and they send out a letter tell us we at the lost amount we never received anything form the but foreclosure paperwork and we was not in predatory lending they still say we own XXXX and they did receive some payment and keep say XXXX payment I want the CFPB to publish this description on consumerfinance.gov so that others can learn from my experience. The CFPB will take steps to remove my personal information from this description but someone may still be able to identify me. Learn how it works. I consent to publishing this description after the CFPB has taken these steps. What would be a fair resolution to this issue? Stop the foreclosure and the sale date and review they account and place us on that XXXX loan mod they say we was given, and tell us how they going file foreclosure with a four year old file with the same people or give us our date in court because in XXXX the case was to be close do to no active on the case and the people that foreclosure on received some payments in XXXX form us after a couple months later they refuse to take our payment a payment in XXXX and the keep refuse payment after some months Step 4 What company is this complaint about? On XX/XX/2019 I received a message from my bank that XXXX was submitted and returned ( not the XXXX ) And again on XX/XX/2019 they submitted XXXX. This caused my bank to over draft twice. That was an unauthorized / fraud charge. I called them to see what happened and they told me my payments increased and changed due to my escrow. I told them i didn't receive anything in the mail concerning an escrow increase. I called them back when it happened again and they said that the XXXX was my petition payment, again i received nothing in the mail of my payments changing. If you read my 1st complaint, they wouldn't run my check through a 2nd time when i was on a mod trail and now they decided to run it twice. Can someone tell me what i can do protect and keep my home with PHH Mortgage Company?

Complaint: My home loan was formerly with Ocwen, however on XX/XX/19 PHH Mortgage services took over the loan. on XX/XX/19 i submitted a payment in the amout of {$1800.00} that was a direct withdraw from my checking account and PHH rejected the payment, they sent a check to me in the mail that was made out to them with my property address on the check with no explanation as to what the fake looking check was, I contacted PHH and was told that the payment went to " the wrong mailing address '' and could not get an answer as to why my payment was rejected. On, XX/XX/19 I then scheduled another withdraw from my account that was rejected again. i again called PHH and was told to send the payment by paper check to XXXX, PA so on XX/XX/19 i sent a paper check for {$1400.00} and it too was sent back to me with the reason being that it was not enough to cover the whole payment which by this point is now several months behind. I made another call to PHH on XX/XX/19 and was told that a packed would be sent to me in the mail for a possibility of a loan modification, due to the fact that i was on medical leave and was off of work without pay for 5 weeks. i am now back to work full time, explained that to the gentleman on the phone who asked several financial questions and stated that we did qualify for the modification and we still have not received anything in the mail. I am very upset with the thoughts that I could be facing foreclosure when I have made efforts to pay my mortgage.

Complaint: I have requested that the PMI Insurance requirement be stopped many times, beginning back on XX/XX/XXXX to as recently as XX/XX/XXXX and again on XX/XX/XXXX. My original request was with Ocwen Loan Servicing and is now with PHH Mortgage which acquired Ocwen as of XX/XX/XXXX. I have called numerous times and gotten various responses and various conflicting correspondence via email and mail with both servicers. Initially I was told 1. the loan had to be current every month since inception of the loan to be eligible to stop PMI at the mid point which was XX/XX/XXXX. 2. Then I got a letter saying it would automatically stop only to receive another letter that said it would not. 3. Ocwen told me I had to pay for a agent of their choice at a price of {$500.00} (? ) to determine loan to value. The tax valuation was not good enough nor was the assessment of a registered Architects valuation. 4. I was also told that my house was rented so I had to keep PMI. For the record my home has NEVER been rented and continues to be owner occupied. They basically have refused to remove the PMI no matter what I do or who I ask and I do not feel I should have to pay a very expensive realtor of their choice on a mortgage that will mature in XXXX! I have tried arbitration to no avail either.

I reached out to them and asked that they issue a retraction to all 30 major credit reporting agencies. On XX/XX/XXXX I received an email from XXXX stating that they have completed their investigation and sided with PHH based on their recommendation not to change the status.. I tried to explain that the month of XX/XX/XXXX isn't completed and that they can not stated that I am 30 days delinquent. I was then told that there's nothing more I can do. PHH is a subsidiary of Ocwen Financial. They have been previously sued for this same XXXX XXXX demand letters.

Complaint: We applied for a loan modification in XX/XX/2018 after nine months we received paperwork to set up autopay, during this process we were told we did NOT have to make the old payment, we could wait until the modification amount was set. Two days ago we were mortified to see the payment had gone up, and the interest rate had increased one full point. My husband refuses to sign to the terms and now we have been made aware the payments not made will be reported to the credit bureau, but the old payment and interest rate will be restored if we refuse to sign the modification How can they realistically think anyone would apply for a modification to have the payments and interest rate go UP. Is there anybody that can help with this, or anywhere we can be directed to go for help. This should be a class action suit.

I made a payment last XXXX and used the incorrect bank acct ( my fault ), i called the company the very next day they told me they would run the check again so i changed the funds to the correct account and waited for they to run the check again. Well, i guess they decised not to run the check again and it cause my trial mod to be voided which i told the rep that i was on a trial mod. A foreclosure date was set and i filed Bankruptcy to avoid losing my home. The mortgage company told me to resubmit the modification and I have on 3 different occations. Since the bankruptcy I have resubmitted it twice and nothing is being done. It was only when i call i ffound out that they cancelled my first request without notice and when i called they told me they wanted me to start the process over. So I started over and its been over 1 year and 45 days and i havent heard anything until yesterday i called XX/XX/2019 and now they are requesting more documents. My mortgage company does not reach out to me via of phone, email or mail at all!!!!!!!!! I need help!!!!!!! On serveral conversation i have ask them to email me and i gave my son 's mailing address and nothing ... .. I dont want to lose my home and the bankrutpcy payments are killing me. Can someone help me push this through? Or can i file a law suite for answers. DO ANYONE CARE! I have a better paying job and things are starting to look up for me since the death of my spouse. Complaint: My mortgage loan was transferred to PHH from Ocwen home loans on XX/XX/XXXX. Before the loan was transferred I applied for a modification due to financial difficulties stemming from the wind storm we had back in XX/XX/XXXX. My roof collapsed, and ceilings caved in raining into my home. My XXXX had over XXXX worth of damage and the insurance declared it a catastrophic incident. we lived in a residence in for 4 months and had to pay for food, new clothing etc because we couldn't enter the home. We applied for a modification while continuing to do what could be done to keep the mortgage up and Ocwen turned it down stating that we had had too many modifications in the past. The question was posed to Ocwen and PHH how many have we had and to please provide us with paperwork as to when it was. we are currently 11 months behind and PHH has stated that a Notice of Intent has been sent but can not provide us with paperwork nor give us a explanation as to when it was sent nor can provide us with any paperwork as to the number of modifications were done. They just say no and that we have to provide 10 months of payments in order to even get on a payment plan. This company is unorganized and unprofessional and we just want to do what right.

Complaint: I refinance my home with PHH mortgage and it impossible to reach them either by phone or online. They never answer their phone I stay waiting up to one hour and a half. The menu in the phone is not true, they never transfer you to a live person. I been trying to register to see my statements and the system don't let you. I wrote to them about not receiving my statement an they never answer. They force you to pass the due date and the only way to pay is to this application they have called doxo or used a pay system I been paying XXXX dollars since. And now in my new bill I own them XXXX dollars for late payment, its a mess. PHH Mortgage Corp. has agreed to pay {$45.00} XXXX to resolve claims that it improperly serviced thousands of single-family residential mortgages. You can see in the internet all kind of complaints like this one : The PHH Mortgage lawsuit was brought by the attorneys general of 49 states and the District of Columbia over allegations that the New Jersey-based mortgage servicer violated the federal Consumer Financial Protection Act and the consumer protection laws of several states.
