Trouble with how payments are being handled
Complaint: Student loan servicer, NAVIENT, is misapplying student loan payments and failed to conduct an investigation. 1 ) Auto-payments are not being properly distributed among the loans. I have 3 Direct loans and 2 Direct Grad Plus loans serviced by Navient. I am on the regular repayment program using auto-pay to automatically deduct my fixed monthly payment from my bank account. My auto-payment is {$1400.00} per month. Of this amount, {$400.00} is a fixed amount that should be applied to the highest interest rate loan. On at least two occasions ( the XXXX and XX/XX/2019 autopayments ) Navient applied less than the fixed amount to the highest interest rate loan and shifted payment to the lower interest rate loans. In XX/XX/2019, no principle whatsoever was paid on the highest interest rate loan by the auto-payment. 2 ) Navient failed to conduct an investigation or respond to my concerns. On XX/XX/2019, I called Navient and spoke to a representative regarding payments. I was told that an investigation would be opened and I would be emailed written report detailing how auto-payments and overpayments to the highest interest rate loan were applied. I was told that the report would be emailed within two to three business days. I did not receive any emailed or written report. On XX/XX/2019, I called Navient and spoke to a different representative. I was told that the first investigation was concluded, no report was emailed or mailed to me, and that no changes had been made to my account. Again, I requested Navient investigate why the auto-pay was not applying the correct amounts to the highest interest rate loan and instead paying principle on lower interest rate loans. I again requested Navient investigate that all payments were properly applied over the life of the loan. I was told there would be an investigation and that I can expect a written report delivered by XX/XX/2019. Because Navient 1 ) failed to properly apply payments, and 2 ) failed to investigate and report on misapplied payments, I am filing this complaint. As a consequence of this failure by Navient I may be forced to overpay by thousands of dollars over the life of the loan.

Complaint: I tried to put my card down for my payments and it went through then I went to XXXX to see my grandma for a month and the card was not saved and the payments were made. I call navient and I get a machine and I tell the robot send me to customer service and it doesnt. Navient calls me and I get a representive they say they will send me things about lowering my payment or that I qualify to make zero payments but they never do. This is very frustrating because they are ruining my credit and i dont have any money I am looking for a job and i only have money for food.

Complaint: This is the third such complaint I have submitted regarding the same type of issue over the past 12-18 months. On XX/XX/XXXX, my co-signed account was flagged by Navient as past due. The XXXX payment was mailed priority on XX/XX/XXXX and received by Navient on XX/XX/XXXX and delivered to " an individual '' per the post office. I called Navient on XX/XX/XXXX to talk to them about why my account was flagged since they received the payment long before the due date. The payment is sent via XXXX money orders under the same cover. The XXXX money order ( {$160.00} ) was cashed on XX/XX/XXXX per XXXX XXXX, the second money order ( {$250.00} ) which was sent in the same priority envelope and received the same time has not been cashed. When I called the customer service agent at Navient she told me that my account was past due and wanted me to send another payment. When I explained that they had received the payment she argued with me that if they received it, the payment would have been cashed. I asked to speak with a supervisor. I was connected with supervisor, XXXX XXXX, who asked that I send copies of the payments to him so he could submit for a missing payment request. I faxed the proof on XXXX @ XXXX with a receipt acknowledgment. On XX/XX/XXXX, the payment was still not applied to the account. When I called XXXX XXXX, the money order was still not cashed. I called Navient again. Because of an argumentative customer service rep again, I requested to speak with a supervisor. I spoke with XXXX XXXX. She states that payment was not received. I explained the situation again. She said the missing payment request had not been submitted. She had me upload the documents so she could request a missing payment search. I have done everything I have been asked. This issues continues to occur. For approximately 6 months at a time, Navient gets this right then there are issues again and again. I have submitted CFPB complaints about this in the past. I was told it would take 5-7 business days to be resolved.

On XX/XX/2019 Navient XXXX received a Fault in Dishonor Notice in regards to the Disclosure Statement not being answered question for question. On XX/XX/2019 Navient XXXX received a Default in Dishonor Notice with the disclosure statement still unanswered. On XX/XX/2019 Navient Corporation Received an Estoppel Notice for which the only mail they sent afterwards was the alleged promissory note for the student loan which did not answer any of the question from the Disclosure Statement. Complaint: My loans began in XX/XX/XXXXwhen my first of 3 children went to college. These were government loans through Sallie Mae. These loans went through various payments, deferments, etc. while various payments and interest was applied. In XX/XX/XXXX, there were 2 loans left and they were consolidated and a set amount was paid monthly on time since then. Progress has been slow because the interest rate is 8 % and in many discussions with Sallie Mae, they advised the way to get ahead was to apply lump sums to the principle and that will help move closer to paying these off. Navient is the servicing company now and I have started making lump sum payments but they refuse to apply them as I ask ... They take the interest and say they must split my payments and take all their interest first. This is illegal and they are stealing money from millions of people trying to pay back loans. I see that there is a pending law suit for just this practice and I want to join in because they have done this and I am forced to continue to work at age 70 to pay these off. I support paying for my loans but they are trying to make themselves rich at others expense.

Complaint: Navient continues to allege that I have three loans l with them. They continue to harass me and cause me see XXXX. I lost my job and have no healthcare and told Navient that there was no way that could ever make Ann payments on any alleged debt even when I was employed making less than XXXX a year with XXXX in debt ... the harassment from Navient will not make money magically appear and the harassment is causing a great deal of XXXX and misery ... Navient continues to add on fees, interest, has no realistic payment options for any alleged debt and all they do is stalk and harass me with robo calls regardless of the time of day and even when I told them to cease and desist they continue to harass me.. this is a predatory company that does nothing but harm people.

Complaint: I have attempted to acquire my payment history for private school loans I received between XXXX and XXXX from an entity listed on my credit report as SLM XXXX XXXX XXXX XXXX TR. I made payments on the loans between XXXX and XXXX. At some point, the account was transferred from Sallie Mae to Navient. I have requested my account information from both entities for this time period and they each keep directing me to the other organization. Sallie Mae states that they no longer have record of any account information after it was sold to Navient. Navient states that they have no account information before they purchased the account. Navient has since sent information to the IRS information stating that they have forgiven part of my debt without regard for the substantial amount of repayments I have made because they claim to have no records.

Complaint: For the past few years I have been almost entirely unemployed, and besides the time I was actually in college, my loans should have been under the income based repayment. I had no idea about the difference between IBR and forbearment and deferment. Instead of having my principle reduced and interest halted entirely, my student loans have increased due to deceptive behavior by Navient. Today I learned that interest should not accrue from IBR plan, and I remembered seeing an email recently about accrued interest. So I looked at my Navient account ans see DEFERMENT instead of IBR. On the IBR screen it is very tricky, it suggests I am on it because it says to contact them to exit it. All this time I thought I was on the IBR plan. It turns out, I was scammed. Also, it's not possible to proceed with IBR because it requires certifying on the site, which pulls IRS, and since I was unemployed, there are no IRS records. Therefore it can not proceed, and Navient refuses to help. This is only the tip of the iceberg. Years ago I had returned to school thinking that, since I was unemployed, I was under a deferment or something. Turns out all were in default. So I reconsoliated with totally wrecked credit. Unfortunately, the student loan company neglected one of the loans into the reconsolidation, so years later after that I learned that that loan was still in default and my credit was destroyed. So, I solved that. Then the student loan company continued to report false information resulting in years of destroyed credit. Today one loan is left which will fall off my report in two years despite them reporting a false default which was years after I solved the reconsolidation issue that had also been their fault. This is not even mentioning that their illegal practices and illegal laws forbidding bankruptcy or any protections under the law for illegal moneylending practices and exorbitant interest.

I highly recommend you generate verification that SALLIE MAE has been reported completely in accordance with the Fair Credit Reporting Act regulations, it's really a serious problem to mis-report. Moreconfirmation of the aforesaid item too. My proper request mustover, I was never 30 days/60 days/120 days late in any of my payments and I'm not greatly tuned in to the date opened so I prefer to ask your be investigated as soon as possible and confirmed to be correct. Complaint: I have been operating under the assumption that I have been satisfying the requirements for the federal public service student loan forgiveness program. Several years ago I reached out to Navient to understand the eligibility of my loans to the program. They said I was eligble but had to wait until I made 10 full years of payments. Upon completion of my 10 years of service I submitted the paperwork only to find out that the way my loan was structured it rendered my loan ineligible for loan forgiveness. I understand now that Navient may have been intentionally misinforming or under informing customers about actions they needed to be taking in order to qualify for this. So rather than having the full balance of my loan forgiven I still have over $ XXXX in loans that need to be repaid. I feel Navient has been operating in their own best interest and not those of their customers.

Complaint: Navient may be avoiding submitting my XXXX Loan Forgiveness application to the guarantor, or the guarantor could be delaying a response. According to my records, I originally submitted the application in XXXX of XXXX. On XX/XX/XXXX, months after I submitted the application, in response to my email query, they informed me that the application had been resubmitted to the guarantor, but that I may have a wait of up to 120 days before a response should be expected. Since XX/XX/XXXX was well into that 120 day period, I submitted further requests for information. On XX/XX/XXXX, they responded with the exact same information, and continued to do so on XX/XX/XXXX and XX/XX/XXXX - all in response to my further requests via email for information. It is now XX/XX/XXXX, and I still have no word from them about the status of my application, and I don't believe they intend to inform me further. In the meantime, they put my loan in forbearance. They said this was a courtesy, but I have never been late, and have made it a priority to pay on time, and I asked them, via a phone call, to take the loan out of forbearance because I want to keep my high credit rating ( of course! ). It also looks like they have not taken my loan out of forbearance, and I suspect that every time they put it in, it increases some fee which is added back into the loan. This loan forgiveness is dearly needed. I attended my college on a special half-price scholarship for older students, but my student loan documents stated that the cost of my education was still twice what it should have been for the salary I was making. Can you help me with this issue?
