The date they say I was served I was in bed recovering a XXXX. in 2013 I was XXXX, XXXX, XXXX XXXX. I could not have been delivered papers regarding this and there was no one else at my home who could have accepted it at the time they are stating. I was in bed, on XXXX and could not have walked down the stairs to answer the door. I did not even know about the court date or I would have shown up in court. They had to have lied in court and stated I had received notification.

Complaint: XXXX XXXX thru Love, Beal and Nixon has been garnishing my wages for a debt that is well over 7 years old. They have violated my rights under the FDCPA Fair debt collection act. In XXXX XXXX, XXXX XXXX XXXX had a Civil Action against me. Love, Beal and Nixon filed it on XXXX XXXX 's behalf of a credit card debt of around {$1000.00} ( I dont know the true balance ) in XXXX XXXX Oklahoma. I was never informed of this court hearing. I found out when on XXXX/XXXX/XXXX when XXXX XXXX started garnishing my wages at 25 % per paycheck. The paperwork was supplied by my employers, not XXXX XXXX or Love, Beal and Nixon. That was when I contacted XXXX Co Courthouse for documents of the Civil Action. The balace of the bill was {$4800.00}. That was about five times the accual amount of the bill. Then I moved from Oklahoma to Florida in XXXX XXXX due to the tornadoes destorying my home. In a new job in Florida I was yet again getting my wages garnished on XXXX/XXXX/XXXX. XXXX XXXX again thru Love, Beal and Nixon was garnishing wages at 25 %. I called XXXX XXXX and they told me I would have to contact the lawer firm handleing the case. I called Love, Beal and Nixon and tried to settle the case due to financially difficulties I was having. I was informed that they would not settle and if I didnt pay the full amount they could go to court and get me to pay more money than I owed. Love, Beal and Nixon didnt record my phone call and the woman I was speaking with refuse to tell me her name. She was cussing at me and telling me the firm and XXXX XXXX owned me and they could do what ever they wanted to get payment, the court was on thier side. About 4 months later I was contacted by Love, Beal and Nixon about settleing the debt. The man stated he was authrized to allow the amount garnished to be enough to settle the debt. He would be sending me a letter in the mail stating the debt was settled and considered paid in full. The letter never came. I tried to contact Love, Beal and Nixon at the phone number he provided and it was disconnected. Then called the phone number on all the papwork and was hung up on. Then on XXXX/XXXX/XXXX XXXX XXXX allowed Love, Beal and Nixon to garnish my bank account. They took {$1000.00}. XXXX XXXX and Love, Beal and Nixon has never once contacted me on any of the court cases against me. Niether has XXXX XXXX XXXX house where the judgements are coming from. The debt is well over 7 years old and doesnt even show up on my credit report anymore. Plus the fact that they settled with me and yet still coming for money and the XXXX Co Court is letting them. I know now that XXXX Once and Love, Beal and Nixon lied to me about the settlement as I have never gotten the promised settlement letter.

Complaint: Love beal and Nixon illegally sued me and got a default judgement against me I never received a date of the hearing I called the court house several times they never gave me a date I even responded to the motion still never received a date.. I called and spoke to XXXX and was set up on a payment plan for XXXX accts I sent in payments for XXXX accts they accepted the payments. They then put a garnishment on my checking acct even though I am set up on a payment plan.. It is my understanding that they can only take up to 25 % of monies in my acct they have taken everything I was once again never notified by XXXX not the bake I still have not received anything from them. This is a known issue with them I do n't understand how they are legally still in business..

Complaint: The creditor in question, Love, Beal & Nixon, PC ( hired by XXXX XXXX XXXX of XXXX, OK. ) continued to attempt collection from me on a credit card account I had no knowledge of AFTER I advised them I had secured an attorney. I have several of their FDCPA violations documented, including in a document I filed through the XXXX XXXX XXXX. Each time they violated the FDCPA and/or FCRA, I made them aware of violation ( s ) and advised them to contact my attorney. However, they continued to contact me ( by mail ) directly rather than contact my attorney. I provided Love, Beal & Nixon, PC with my attorney 's name and telephone number but they still continued to violate FDCPA rules with total disregard for my rights as a consumer.
