Complaint: We filed for assistance during hurricane Irma XX/XX/XXXX through our mortgage company Home Point Financial. We were granted a forbearance period and a loan modification with a lower payments. Our payments start XX/XX/XXXX to be paid {$990.00}. During this time the company then had a servicer change delaying the process and basically making it impossible to communicate with the correct person. We continue to call and leave voice mail messages for XXXX XXXX which was supposed to be assigned to our case. We never received any call back and he eventually no longer was employed for the company. During this time and currently my credit was and is being reported negatively as not being paid as agreed. We were and are continuing to make the agreed upon payments by phone and attempting to communicate with the mortgage company, but seem to be getting different information and no written information in the mail regarding our loan and current/correct payments. Our contract that we signed only states the {$990.00}.
Today, XX/XX/XXXX we are being told that we have not been paying the correct amount which has never been disclosed to us as we call and pay it monthly. We call at least once a month to find the status of our modification only to be told that we will receive a call back never to receive a call back. We are being told we have to pay a balance of over {$1700.00} to make our account current. It has been disclosed to us that there are thousands of consumer affected. We are being told our new payment is higher than our previous mortgage payment we requested assistance in paying.

Complaint: In the month of XXXX I saw early on that XXXX XXXX had withdrawn two payments for my account instead of one, which caused my mortgage payment to go NSF. I called my mortgage service provider around the XX/XX/XXXX-XX/XX/XXXX to notify them of the issue. they said it wasn't a big deal and to just submit the payment online again and it would be fine. I submitted again and the funds had not been cleared yet by my bank which resulted in ANOTHER NSF payment to the mortgage company. Post that payment I made two others that cleared my account but were returned a few days later. When I called they said my account had been placed as certified funds meaning the will only accept XXXX XXXX, cashiers check or Money orders. My bank if mostly an online bank and I am unable to go them and get a cashiers check. XXXX XXXX has upper limits on transactions and I would be forced to send them two transactions with fees of {$50.00} each. And given that the amount of each would not satisfy the amount owed they would more than likely return those as well.

Complaint: On XX/XX/XXXX after hurricane Irma ( my county was declared a disaster area ) I got behind my mortgage payment in order to fix my home and appliances damages I did applied for fema but i was denied because i have home insurance witch I couldn't afford my {$3500.00} deductible. On XX/XX/XXXX I applied for a loan modification witch it was approved on XX/XX/XXXX the same time my loan was being transferred to a different mortgage service. ( from XXXX to Home point ) the modification process continue and I started the 3 months trial on XX/XX/XXXX until now XX/XX/XXXX still making my agreement payments. Here is the issue my loan modification has not finalized yet according to Home point they have not received the original documentation from XXXX, but I spoke with XXXX and they assured me they have send Home point all the documents including the originals. ( spoke with associate # XXXX on XXXX ) who assured me all information was send and gave the information to get in touch with CFPB for help since I ask her what can I do. Complaint: We are experiencing wrongful foreclosure proceedings by Home Point Financial - haven't missed a payment with the exception of an approved forbearance period of 3 months. Funds from a FHA Disaster Partial Claim Modification ( to pay for forebereance months ) have yet to been applied a year after signing documents.
After Hurricane Irma ( XX/XX/XXXX ), Home Point Financial ( our mortgage bank ) offered a 3-month forbearance ( for XXXX, XXXX, XXXX ). In XX/XX/XXXX, we continued with our monthly payments until XX/XX/XXXX. On XX/XX/XXXX, we submitted paperwork for an approved FHA Disaster Partial Claim modification that would cover payment for forbearance months + XX/XX/XXXX ( while the modification was setup and took place ) in the amount of {$10000.00}. We were instructed to resume payments in XX/XX/XXXX, and we have sent our monthly payment without failure to this date.
However, as of today XX/XX/XXXX ( a year after we submitted documentation for the FHA Disaster Partial Claim modification ), the funds have not been applied to the account. In the bank system, we appear delinquent to the amount that equals this modification and regardless of our multiple attempts to call attention to the bank to review this anomaly, we have been told that their system is correct and that we must pay in full that amount.
We sent a letter* dated XX/XX/XXXX to several offices of Home Point in multiple states with copies of all checks proof of our regular payments. Should the FHA modification funds were applied, we would not be delinquent. We doubt they read our letter. On phone call in XX/XX/XXXX we were told that because of our delinquency our account was sent to legal department to initiate foreclosure proceedings. *letter attached to this claim.
Checks with mortgage payments for XXXX and XX/XX/XXXX were returned ; we sent XXXX 's payment but won't be surprised that is also returned. At the moment our delinquency totals 7 months : 4 months covered by the FHA modification + XXXX, XXXX, and XX/XX/XXXX. We have placed the funds for the returned checks aside so that when the bank starts accepting payments again, we will be able to submit.
For months we have received calls from debt collectors, and experienced dismissives from multiple bank associates and managers - because in their records their files are accurate. They don't seem to realize the FHA modification funds are missing!
We need help locating the FHA modification funds and having them properly accounted towards our account so that we can bring our loan account current, and stop the wrongful foreclosure proceedings.

Complaint: Received a demand letter from the town stating a landfill tax of XXXX plus interest and fees for the mortgage co not paying it - resulted in a XXXX bill. My husband had called the town of XXXX XXXX, ma to ask what it was since hes never seen a bill labeled that in other towns we lived in, and 2. He never saw the initial bill to begin with. The town said we didnt see the bill because it was sent to the mortgage company- they didnt pay it and thus why we saw the demand letter. When my husband called last Thursday, homepoint financial ( the mortgage co ) stated to send the bill over to XXXXXXXXXXXX.XXXX and they would look into it. Never told my husband that it takes up to three days not including weekends to even get the email or the images uploaded. So on Monday at XXXX XXXX est I spoke with a cs rep there who told me they still didnt see any images and that they never saw a bill for the original XXXX for landfill tax. So I told her I found that odd since the town said they sent it out to them. And when they didnt pay thats when we got the demand letter. Town was rude saying there would be a lien if XXXX wasnt paid on XX/XX/XXXX. So the cs rep at homepoint told me to send over the bill again and her supervisor XXXX XXXX @ XXXX would look into it. However she also said it would take 3 days for her supervisor to research it so it was best we paid the bill. She was going to get the bottom of why they supposedly didnt pay that tax bill and 2. The cs rep said they would ask the town why it was labeled something that the town was saying was mislabeled to begin with. They ( the town ) are saying its not a landfill / utility tax that its a tax increase bc all homes in town got recently assessed. I have been waiting on the town collector to clarify why the bill reads wrong.
As waste management in the town told my husband on Friday that it was not a landfill /utility tax for waste management.
I specifically after finding out how long homepoint was going to take to research this bill of XXXX stated in an email to XXXX XXXX that we were paying it via certified mail as it was due XX/XX/XXXX. She goes ahead and tells me shell research it in email and then pays the town again. I was told by a cs rep that this will increase our mortgage.
I never in that email to XXXX stated that they should pay it. I specifically said we were on Monday XX/XX/XXXX. I asked why they ignored it though when the town stated it was sent to them directly previously. No answers to that. Just goes ahead and double pays the town.
Now the town is double paid and we are paying twice - once with a check we paid out to them and now because XXXX at homepoint didnt read an email correctly- an increase in the mortgage.
Ive asked them to credit the XXXX before legal action is taken and to get their money from the town that they knew we were paying. Still no credit to loan number XXXX.

Complaint: I gave recently refinanced my home using a VA loan. I closed escrow on XX/XX/2019. My old mortgage company " Home Point Financial '' has not refunded my escrow account and we are past the 30 day window. I have called multiple times and I have been told that a check has not been issued yet and that I need to be patient. My exact refund is unknown but I have been told by my loan officer that it is about {$4900.00}. I do not know how to move forward with this situation. I feel like I have been patient since we are on day 33 and I still have not received my money. Please help

Complaint: This company is horrible to deal with if you have any issues logging in, making a payment, claiming fault for any website malfunctions, checking banking information for accuracy to avoid rejection of payments after the due date which results in late fees that they will not excuse because of a fault of their own. THEN ... on XXXX we called Home Point Financial to explore the possibly of skipping a payment and adding it to the end of the long due to a nature disaster where our home is inhabitable and in the middle of an insurance claim. We have had SEVERAL unexpected expenses due to this situation and Home Point mentioned they don't offer the service to skip a payment and if we would become more than a month late they report it to a debt collection agency. I understand that this might not be a service that they would want to offer, but I am very frustrated that it is not an opportunity for some circumstances. Horrible customer service and I am looking forward to the day of getting to refinance with a more understanding and WELL ROUNDED company.

Before the closing was not told about black mold, wood rotting of floors, the house ready to collapse, rain damage, moisture causing black mold in crawl space or carbon monoxide in the back bedroom I have to keep the door shut and cardboard under the door. The roof leaks the walls cracking apart the house is falling in on it's self. There was 10 percent inspection done in the crawlspace. The realtor was dating the inspector the condition of the house caused a slew of health issue s respiratory infection s, tremors and memory problems, migraines, the water is on a well smell of rotten egg, sulfide gas, iron and sulfur bacteria this happen after the water heater had to be replaced XX/XX/XXXX payment {$62000.00} a month the central air went out now I have to have a hang on unit air conditioner the house is in a bad shape can't sell to the public, the price is to high to sell to a investors. XXXX insurance company said after paying them three years that the coverage for {$130000.00} XXXX s said it's my XXXX lost.

Complaint: Recently received Trial Payment plan for a mortgage modification from my servicer Home Point Financial. The modification payment is incorrect because my escrows were not figured correctly. I have changed my homeowner insurance to lower the premium. The new insurance was sent to my servicer so they would update my escrow account to reduce my monthly mortgage payment.
Please adjust my mortgage payment for the correct payment including the correct amount for my escrow. I don not want to sign the Modification agreement dated XX/XX/XXXX because the payment is incorrect.

Complaint: I purchased my home in XX/XX/2015 with a conventional loan and 10 % down payment. The home values in my area have risen so I contacted Home Point Financial to determine the process for removal of PMI through an appraisal. I have been given three different answers. Upon speaking with the first customer service rep I was told I would need XXXX XXXX ratio for borrower requested PMI removal. The next customer service rep told me that I would need XXXX XXXX because I was requesting PMI removal within 5 years. I submitted a formal request for clarification and was given a written response that said that I needed XXXX XXXX to have my PMI removed. This is the first that I have heard of this and does not appear to be conventional/ conforming loan terms. I am writing in hopes of getting written clarification on proper LTV. Additionally, I would like a list of approved appraisers in my area to write a check to them directly rather than writing a check to Home Point Financial to have them select an appraiser.

Complaint: we applied for a loan through first home mortgage. it was a 203k loan. the initial amount was for XXXX after we closed our loan first home sold the loan to home point financial. we informed home point that we would not require the entire {$190000.00} as we were not giving zoning for the extension/ improvement. we borrowed a total of {$61000.00} dollars from them. we informed them of this and they told us that we have to use the entire {$190000.00}. we repeatedly told them that we were done and all that was needed was the {$61000.00}. they said that they didn't care and we have to use the full amount, and continued to charge us for the {$190000.00} sum. they also told us that we have to use the same contractor for all work even after we informed them that this contractor was no longer in business for personal reasons. we have paid large amounts of money in interest payments and nobody at the bank will speak to us. they just keep hanging up

Complaint: I closed on my home in XXXX of XXXX and the loan was quickly sold to Home Point Financial. I received my first escrow analysis statement in XXXX of XXXX showing a very large escrow shortage, causing my monthly payment to increase by over {$250.00} starting in XXXX of XXXX. Examining the statement further along with the closing documents from when I purchased the home, I saw that the problem was that Home Point made a duplicate tax payment to my county. This payment was unnecessary due to the title company already making the payment when I closed on the home. I contacted Home Point immediately and the process took nearly 5 months to complete. Initially Home Point told me I needed to contact my county, then my county told me I needed to work it out through Home Point. I called Home Point many times throughout this process for updates. Each time I was told there was a note in the system that everything should be completed by a certain date. I would call back on that date and of course it wouldn't be complete. I asked every representative I spoke with, including managers, to proactively contact me when there were any updates on the situation and not a single representative or manager called me at any point during this process. At long last, the county sent a refund check and Home Point processed a new escrow analysis to bring my payment back down, but I had to make 2 mortgage payments at the higher and incorrect amount while this was being " worked on. '' I asked multiple representatives including a manager named XXXX if I would be able to be refunded for the extra amount I was being forced to pay due to their mistake, and multiple times I was told " yes. '' I called today to ask about the refund process for the {$500.00} or so that I over-paid and was told that no refunds would be given. It was Home Point 's mistake that forced me to pay an extra {$500.00}, and their poor customer service and dishonesty has led to me just being out that money with seemingly no recourse.

Complaint: Home point financial purchased my mortgage in the middle of XX/XX/XXXX, they then charged me for insurance at a rate triple of what my current insurance was I was not contacted and did not find out until I was looking at my online statement in early XX/XX/XXXX.
They had opened up an escrow account without my knowledge or permission, I asked them to provide documentation of when I gave permission for them to open escrow and they can not provide it.
After charging me for insurance when I had already had insurance, I called and emailed proof of insurance on XX/XX/XXXX.
Several weeks later they still had not corrected and refunded my account. I sent additional information and after over a month they credited my account for the insurance.
However, They have increased my mortgage payment by {$100.00} a month and have not closed the escrow account. I have emailed over 10 times. In addition, they charged late fees when I refused to pay the increased mortgage payment.
I BELIVE THEY ARE BUYING Mortgages WITH THE INTENTION OF MAKING MONEY BY CHARGING FOR LENDER PLACED INSURACE. With little research I was able to see the lending company is affiliated with the insurance company writing the lender played policies. I can not think of any other reason they would have purchased my loan as it has a very low APR and is only a few years from being payed? They would have made more money underwriting a new loan at current rates? Also when they purchased my loan they must have inquired if the property was currently insured? PLEASE LOOK INTO THIS!

Complaint: Please reference prior complaint regarding the unprofessional service from Home Point Financial. Although the recent complaint has been closed out ( XXXX ), I am still unable to get a response to either my written and/or voicemail requests for status on a progress payment due to my contractor for which Home Point Financial has had the funds to pay for many weeks. Although there was an inspection by both the county and their subcontractor on XX/XX/XXXX ( both inspectors passed the pre-drywall closure work stage ), Home Point continues to be unresponsive to both myself and my contractor, whom I have granted authority to communicate with them directly.
At this stage, all work to be performed by the contractor was completed as of XX/XX/XXXX with the exception of the glass enclosure, which is to be completed by a glass company acting as a subcontractor of my contractor.
I am stuck and have had to negotiate with the contractor to continue work as they wanted to stop as a result of not receiving the progress payment.
